ACCOUNTING FOR CHILDREN IN CONFLICT WITH THE LAW, CHILDREN’S CASES AND STREET CHILDREN IN THE JUSTICE SYSTEM. THE FINDINGS Street children in Kenya face innumerable hardships and danger in their daily lives. In addition to the hazards of living on the street, these children face harassment and abuse from the police and within the juvenile justice system for no reason other than the fact that they are street children. Living outside the protection of responsible adults, street children are easy and silent targets for abuse by police and society at large. On the streets, they are subject to frequent beatings by police as well as monetary extortion and sexual abuse. They are subject to frequent arrest simply because they are homeless; "vagrancy" (being without a fixed abode) is a criminal offense under Kenyan law. Once arrested, often by plainclothes police in roundup operations, street children are processed through the revolving doors of the Kenyan juvenile justice system, where children pass back and forth between remand detention centers and court before a final disposition is reached in their cases. After spending indefinite periods of time on remand, where they are further neglected and abused, they may be finally sentenced to institutions called approved schools, borstal institutions or adult prisons, which do little to improve their lives. CURRENT SITUATION Data gathered from human rights watch and the smile foundation There are several differing statistics about the number of street children in Nairobi Kenya. A study commissioned by the consortium of street children (CSC) brings some shocking statistics: In 1999 it was reported that there were over 50,000 street children in Nairobi and the government estimated that their numbers grew at 10% per year. It was estimated in 2007 that there were 250,000 – 300,000 children living and working in the streets across Kenya, with more than 60,000 of them in Nairobi. Without representation by legal counsel, and without the presence of a parent or legal guardian, these children are subjected to brief hearings on their cases whereby they may be deprived of their liberty and committed for years to juvenile correctional institutions know as approved schools or borstal institutions. They write the charge sheet and they take you to court. If they think you're older or if the offense is a more serious one, they'll take you to regular court. It's all based on looks. Kids can't explain themselves to the police. There's no time, and they're scared. There are other problems too-like in rural areas pastoralist children are born at home and have no official registration and may not know their exact age. The police don't care. It especially effects street children who don't have concerned parties to complain on their behalf and point out that they're only children. Increase surveillance, security and rehabilitate street kids and those in conflict with the law. Judiciary can know the exact number of street children, children in homes, condition of the homes, those in police custody, in borstals,to better account for them and provide services. The kids can easily be tracked within the programs they have been enrolled in.
