NOTICE INVITING SHORT TENDERS
Tender Notice No. 14/2013-14 of SE/OP/NZB/Tech, Spec. Nos. 01/2013-14 to 13/2013-14
On behalf of Northern Power Distribution Company of A.P.LTD. the Superintending
Engineer Operation Circle Nizamabad, invites sealed tenders from the intending bidders registered
with APNPDCL, in prescribed bid format for the following works ,to be received on or before
16.11.2013 up to13.00Hrs .The tender schedule of works along with other information will be
available in the above office up to 17.00 Hrs on 15.11.2013,and can be obtained on payment
schedule cost of Rs.1,145/- (including VAT) during the office hours on all working days
beginning from 01.11.2013 . The cost of the tender schedule should be in the form of crossed

The tenderer has to complete the work within the scheduled time frame. The tenderer
should furnish Bid Security 2% on Estimated Contract Value, along with his bid document in the
shape of Demand Draft drawn in favour of “Superintending Engineer/ Operation Circle,
APNPDCL, Nizamabad payable at Nizamabad.The tenderer should also furnish valid copy of
PAN along with his bid document.
The sealed tenders will be opened on the same day i.e. on 16.11.2013 at 15.00Hrs in the
above office in presence of tenderers or their authorized representatives who may likely be
present. The bid security of unsuccessful bidders will be returned after finalization of the bidding
process or bid validity period of 120days whichever is earlier. Any other information regarding
the work if required can be obtained in the said office during office hours. The authority reserves
the right to accept or rejected any or all the bids without assigning any reasons thereof.

have read the various conditions to tender, attached herewith and hereby agree to
abide by said conditions. I/We also agree to keep this tender open for acceptance
for a period of 120 (One hundred and twenty ) days, from the date fixed for
opening the same and in default there of I/We will be liable for forfeiture of my
Bid Security Amount. I/We offer to do the work at the rates quoted in the attached
schedule with plus or minus tender percentage and herby bind myself /ourselves to
complete the work in all respects within the period prescribed as mentioned in the
work order / purchase order to be issued by concerned DE/Op with respect to work
assigned.

APDSS, corrected up to date and carry out the work according to special conditions
of contract and specifications laid down by NPDCL, in the annexed special
conditions/specifications.

Any notice required to be served on me/us is hereunder shall be sufficiently
served on me/us if delivered to me /us by post(Registered/Ordinary) or left at
my/our address given therein ,such notice shall, if sent by post be demand to have
been served on my/us at the time wherein due course of post it would be delivered at
the address to which it is sent. I/we fully understand that the written agreement to be
entered in to between me/us and the NPDCL shall be foundation of the right of the
both parties and contract shall not be deemed to be completed until the agreement
has first been signed by me /us and by proper officer or authorized to enter.

Until a formal agreement is prepared and executed acceptance of this tender
shall constitute a binding contract between us subject to modifications ,as may be
mutually agreed to between us and indicated in the letter of acceptance of my/our

2.1 System of Tendering
Tender will consist of one packet and to be submitted in sealed cover at the time of
submitting tender. Envelope should be superscribed as mentioned in clause 1.1(a)
2.2 This packet shall be sealed and will consist of
(i)Bid Security in the form of D.D.
(ii) Tender Documents duly signed and completed
(iii)Partnership deed duly attested by Gazetted Officer or NPDCL dept.
Officer not less than the cadre of ADE/AEE.;if the firm is a Partnership
firm.
(iv) Registration Copy of the tenderer as the approved contractor in
NPDCL for carrying out Electrical Works in Nizamabad Circle.
(v) Copy of the PAN card duly attested by Gazetted Officer or NPDCL
dept. Officer not less than the cadre of ADE/AEE
(vi) Copy of service tax registration No. duly attested by Gazetted Officer or
NPDCL dept. Officer not less than the cadre of ADE/AEE
(vii) Copy of A grade License duly attested by Gazetted Officer or NPDCL
dept. Officer not less than the cadre of ADE/AEE
(viii) Any other document , the tenderer may like to submit in support of his
Credentials.
2.3 Eligibility Criteria
Only such tenderers/firms needs to apply who satisfy following eligibility Criteria
The tenderer must be a registered contractor in NPDCL for carrying out Electrical
Works in Nizamabad Circle.
The tenderer must have a PAN card on his name.
The tenderer must have a Service Tax Registration on his name.
The tenderer must have a A grade License on his name.
The tenderer must have a Turnover of Rs 5,00,000 = 00 in any one financial
year during last 3 financial years on his name.
2.4.Tender forms are not transferable.
2.5.Conditional tenders are liable to be rejected straight away and NPDCL reserves
the right to reject such tenders summarily without assigning any reasons what so
ever.
3.Bid Security
3.1 The tenderer/s is are required to deposit a sum of

Security in the shape of Demand Draft taken in favour of Superintending Engineer
Operation APNPDCL Nizamabad and must be enclosed to tender form while
submitting the tender.
The tenderer shall keep the offer open for a minimum of 120days from date of
opening of tenders.
In case the tenderer withdraw his/ their offer within the validity date of his/their
offer or fails to undertake contract after acceptance of his/their tender ,the full Bid
Security amount shall be forfeited.
Tenders containing erasurers and/or alterations of the tender documents are liable to
be rejected. Any correction made by tenderer in his/their entries must be attested by
him/them.
If the tenderer deliberately gives wrong information in his tender the NPDCL
reserves the right to reject such tender at any stage.
3.2 Security Deposit
The tender must be accompanied by a sum of Rs. ……………

as Bid Security in the form of DD, failing which the tender will not be considered.
If the tender is accepted the amount of Bid Security will be retained as part of
Security Deposit for due and faithful fulfillment of the contract by the contractor.
The balance to make up the Security Deposit of 5% of the contract value may be
deposited by the contractor in the form of DD or the same may be recovered from
contractor’s first and part bill.
The Bid security of unsuccessful tenderers will be returned within a reasonable time
,once the tender is finalized or 120days validity period whichever is earlier. This Bid
security amount will not carry any interest and NPDCL will not be liable to pay
interest on Bid Security amount.
3.3 In addition to the above ,5% of the value of work done will be recovered from
the contractor’s running bills for the due fulfillment of the Contract. Thus there will
be 10% of the value of the contract as Security Deposit. The amount so recovered
i.e.10% of contract value will be refunded to the contractor after completion of 12
months of defect liability period. These amounts will not carry any interest.
4.Partenership Deeds ,Power of Attorney etc.
4.1 The tenderer shall clearly specify whether the tender is submitted on his own or
on behalf of the partnership concerned. .If the tender is submitted on behalf of a
partnership firm, he should submit the certified copy of the partnership deed along
with tender and authorization to sign the tender documents
on behalf of a
partnership concerned.
4.2 The NPDCL will not be bound by any Power of Attorney granted by the
tenderer or by the changes in the composition of the firm made subsequent to the
execution of the contract.
5. RIGHTS OF NPDCL TO DEAL WITH THE TENDERER
The authority for the acceptance of the tender will rest with the NPDCL which does
not bind itself to accept the lowest or/any other tender and no tenderer shall
demand any explanation for the cause of rejection of his /their tender nor the
NPDCL undertake to assign reasons for declining to consider or reject any particular
tender or tenders.
6.EXECUTION OF CONTRACT DOCUMENTS
The successful tenderer shall be required to execute an agreement with NPDCL for
carrying out the works according to the “General conditions of the Contract”,
special conditions/specifications annexed to this tender.
The tenderer whose tender is accepted shall be required to appear in person (or
through their authorized representative in case of firms& corporations ) at the office
of the “Superintending Engineer, Operation Circle,Nizamabad-503001” and execute
contract documents within 10 days after receipt of notice issued by NPDCL that the
contract has been awarded to him .Failure to do so shall constitute a breach of the
agreement affected by the acceptance of the tender in which case the full value of
Bid Security accompanying the tender shall stand forfeited without prejudice to any
other rights or remedies.
7.OMISSIONS/DISCREPANCIES
Should a tenderer find discrepancies in ,or omissions from the drawing or any of
tender forms or should he be doubt to theirs meaning he should at once notify the
authority inviting tenders, who may send a written instruction to all tenderers .It
shall be understood that every endeavour has been made to avoid any error which
can materially affect the basis of the tender and the successful tenderer shall take
upon himself and provide for the risk of any error which may subsequently be
discovered and shall make no subsequent claim on account thereof .
8.The tenderers are required to quote his/ their rates %(percentage above/ below /at
par) in figures and words (both ) on item wise rates as per the rate sheet annexure
of the tender document and in case of discrepancy between rate quoted in figures
and words, the rate quoted in words shall be taken into account .
8.1.Preference among the tenderers will be given, if other things being equal to
those who are themselves professionally qualified or who undertake to employ
qualified men at their cost to look after the work.
8.2.No part of the contact shall be sublet without written permission of the
competent authority .
8.3Tenders with an excess of 5 % (Five Percent) and above on the item wise
rates mentioned in the rate annexure shall be summarily rejected .
8.4 For tenders up to 15 % less than, the item wise rates mentioned in the rate
annexure no additional security deposit is required .But for tenders, less, by more
than 15% of the item wise rates mentioned in the rate annexure,a bank guarantee
or demand draft for the difference between the tendered amount and 85 % of the
estimated contract value i.e Rs 10,00,000/-) should be paid by the successful
tenderer at the time of concluding the agreement as an additional security deposit to
fulfill the contract .This additional security deposit amount will be released soon
after completion of the work .
9.Taxes
All statutory taxes and duties payable (to central /state /local bodies etc., )such as
sales tax /VAT, seignorages, Labour cess, will be recovered from contractor’s
running bills as per the rules in vogue as on that date.
The rates quoted are inclusive of service tax portion of service provider.
10.Employment /partnership etc’, of retired employees
The contract will be liable for cancellation if either the contractor or any of his
employee is found to be a gazetted officer of the Govt or an officer of NPDCL who
retired from service and had not obtained the permission from the Govt. or NPDCL
for accepting the contract or employment within a period of two years from the
date of his
retirement. Should a tenderer
or contractor on list of approved
contractors have a relative or relatives or in case of firm or company of contractors
one or more of its share holders have a relative or relatives, employed as an officer
in NPDCL the authority inviting tenders shall be informed of the fact at the time of
submission of tender, failing which the tender may be disqualified / rejected or if
such fact subsequently come to light ,the contract may be rescinded .
11.
The tenderer shall examine closely the APDSS and also the standard
preliminary specifications contained therein, and sign the office copy of the APDSS
and its addenda volume in token of such study before submitting his tender unit
rates which shall be for finished works in-situ. He shall also carefully study the
drawings and additional specifications and all the documents which form part of the
agreement to be entered into by the accepted tenderer.
The APSS and other
documents connected with the contract such as specification, plans descriptive
specification sheet regarding materials etc., can be seen at any time between 11:00
am and 5:00 pm on working days in the office of the Superintending Engineer,
Operation, APNPDCL, Nizamabad
12.
The tenderer’s attention is directed to the requirements for materials under the
clause ‘Materials and Workmanship’ in the ‘Preliminary Specifications’. Materials
confirming to the ISS shall be used on the work, and the tenderer shall quote his
rates accordingly.
13.
Every tender is expected before quoting his rates, to inspect the site of the
proposed work. The materials must comply with relevant standard specification.
Samples of materials as called for in the standard specifications or in these tender
conditions, or as required by the Asst. Divisional Engineer/Operation, in any case
shall be submitted for the Asst. Divisional Engineer/ Operation approval before
the supply to site of work is begun.
14.
The tenderer’s particular attention is drawn to the sections and clauses in the
standard preliminary specifications dealing with:
1. Test, inspection and rejection of defective materials and work:
2. Carriage:
3. Construction plant:
4. Clearing up during progress and for delivery.
5. Accidents:
6. Delays:
7. Particulars of payment:
The contractor should closely pursue all the specifications, clauses which
govern the rates which he is tendering.
15. A bill of quantities accompanies this tender notice.
It shall be definitely
understood that the APNPDCL does not accept any responsibility for the correctness
or completeness of this schedule and that this schedule is liable to alterations
omissions, deductions, or as set forth in the conditions of contract. The tenderer
will, however, base his lumpsum tender on this schedule of quantities.
16.Rates or lump sum amounts for items not called for shall not be included in the
tender.
The tenderer shall not make any alterations in the contract form, the
conditions of contract, the drawings, specifications or quantities accompanying the
tender. The same if made will not be recognized and tender will be rejected.
17.
The tenderer should work out his own rates, without reference being made to
the Department current schedule of rates or the estimate rates which are not open for
inspection by tenderers and quote tender percentage accordingly.
18.Programme of work:The concerned DE/Operation
will entrust different line works / other
electrical works from time to time thorough different / separate work order /
purchase order against this rate contract agreement.
While giving separate work order/ purchase order the DE/Operation will
mention the time limit for completion that particular work. The works are broadly
classified into following three categories.
1. Major work
DTR involvement above 5 poles
6 months
2. Medium work
11 KV line DTR 2 and above
3 months
Upto 5 poles
3. Minor work
One pole and other work
1 month
Therefore the contractor is supported to do works in the above time limit.
The agricultrure works will not be entrusted against this rate contract agreement.
And DE/Operation can entrust such agriculture work to any other agency as per
powers entrusted to him by collecting different quotations. Against this rate
contract only 100% paid works , and other Govt. works will be take up.
If more than 4 works are pending with this agency, the DE/Operation at his sole
discretion can entrust the other works to some other agencies depending up on
exigencies reasonable to him.
Generally the agreement is entered fro execution of works for a period of 1 year
from the date of entering into the agreement . During the period of contract if the
department fails to show the work equal to Rs.10.00 Lakhs due to any unforeseen
reasons then the agreement period will be extended to a maximum of 2 years
period subject to consent of the contractor.
If any item of work is not covered under this rate contract agreement, the
department at its discretion entrust the total work to some other agency by
calling tender OR entrust to this agency by giving supplement schedule at SSR
rates for that particular item of work. This amendment to agreement will
normally be given by SE/OP/NZB.
19. A tenderer submitting a quotation which the tender accepting authority
considers excessive and/or indicative of the insufficient knowledge of
current prices or definite attempt of profiteering will render himself liable to
be debarred permanently from tendering or for such period as the tender
accepting authority may decide.
The tender rates should be based on the controlled price for material if any
fixed by the Government or the reasonable price permissible for the tenderer
to charge a private purchaser under the provisions of clause 8 of Hoarding &
Prevention Ordinance, 1943 as amended from time to time and on similar
principles in regard to labour and supervision in the construction.
20.The firm of contract will be lump sum.
21.The contractor is bound to execute all supplemental items that are found
essential, incidental and inevitable during execution of main works, at the rates to be
worked out as detailed below:
a)
Supplemental items directly deducible from similar items in the
original agreement:-
The rates shall be derived by adding to or subtracting from the agreement
rates of such similar items, the cost of the difference in quantity of material or
labour between the new item and the similar item in the agreement worked
out with reference to the schedule of rates adopted in the sanctioned estimate
with which the tenders were compared.
b)
New item:i)
Similar items the rates of which cannot be directly deduced from
the original agreement.
ii)
Purely new item which do not correspond to any item in the
agreement.
The rate shall be estimate rate .
NOTE:- The term estimate rate used in (i) and (ii) above means the rate
in the sanctioned estimate/ SSR rates with which the tenders were
compared or if no such rate is available in the estimate, the rate derived
with reference to the schedule of rates adopted in the sanctioned
estimate with which tenders are compared.
c).
Addition of provision towards importation of labour, labour amenities,
dewatering etc. in working out supplemental items. If the new item is
in substitution of an old item which allowed for importation of labour,
labour amenities, dewatering etc, those factors may be taken into
account in computing the substituted items also at the same rates at
which they were originally provided.
In respect of new items the case has to be considered on its merits and
provision for importation of labour, amenities, dewatering etc., has to be fully
justified.
d)
Fixation of rates for items of work in excess of quantities in Schedule
‘A’ Bill of quantities of tender. The rates payable for such items shall
be estimate rates for the items (+) or (-) overall tender percentage
accepted.
22.The contractor will at all times duly observe the provisions of employment
of Children Act XXVI of 1938 and any re-enactment or modification of the
same and will not employ or permit any persons to do any work for the
purpose or under the provisions of the said Act. The contractor shall agree to
indemnify the APNPDCL from and against all claims, Penalties which may
be suffered by the APNPDCL or any person employed-by the Department by
reason of any default on the part of the contractor in the observance and
performance of the provisions of the Employment of Children act, XXVI of
1983, or any re-enactment or modification of the same.
23.The contractor shall indemnify APNPDCL against all claims which
may be made under the workmen’s Compensation Act or any statutory
modification thereof or rules there under or otherwise for in respect of
any damage or compensation payable in consequence of any accident or
injury sustained by own workmen engaged in the performance of the
business relating to this contract. In all cases of personal injury to
workmen employed by a contractor on this work for which the
contractor is liable to pay compensation under the workmen’s
compensation Act, he shall pay the prescribed medical fee to the Medical
Officer
for issue of ‘C’ & ‘D” forms as prescribed, failing which the said fee will
be paid to the Medical Officer by the Department and recovery effected
from the contractor’s bills.
24.Preliminary specifications of APDSS shall apply to all agreements entered
by the contractor with APNPDCL and shall form an inseparable condition of
the contract.
The tenderer is expected to examine closely the relevant
specifications of the APSS and the special specifications and ISS before
submitting his unit tender rates.
25.
Scaffolding and gangways will have to be arranged by the contractor at his
own cost, whenever they are considered desirable or necessary by the Asst.
Divisional Engineer/Operation in-charge of the work to facilitate the work.
26. Dewatering if necessary has to be done by the contractor to suit the requirement
of the work.
27.Necessary arrangements have to be made by the contractor at his own expenses
towards hutting, accommodation, drinking water supply, health and sanitary
arrangements and other amenities for the workers required as per the relevant rules
and to the satisfaction of the public Health authorities and theAsst. Divisional
Engineer/Opration in-charge and land required for the purpose will have to be
provided by the contractor at his cost.
28.In case of any discrepancy between unit prices and amounts as noted in the
Tender schedule unit prices will govern. In case of any discrepancy between the
rate quoted in figures and words, the rate quoted in words will govern.
29.All pages of the tender schedules, conditions, specifications, drawings etc., shall
be signed by the tenderer at the left hand bottom corner and enclosed along with
tender.
30.All correspondence after opening of the tender shall be made with the
Superintending Engineer /Operation Circle /Nizamabad.
31.The disputes arising out of this contract if any have to be settled in the courts at
Nizamabad only.
Special Conditions
1. These Special Conditions and schedule of work shall govern the work to be
executed under this contract in addition to and/in part supersession of the General
Conditions of contract.
2.Where there is any conflict between these Special Conditions of contract on one
hand and standard specifications and General Conditions of contract the former
shall prevail.
1. Payments and Certificates
Payments will be made to the contractor under the certificate to be issued at
reasonably frequent intervals by the ADE/Operation i.e. through entry sheet
for each and every purchase order /work order entrusted by DE/Operation .
The agency has to ensure proper devolution of balance materials pertaining to
each purchase order before claiming bill.
The value of work executed shall comprise the value of the quantities of the items in
the bill of quantities completed.
The engineer may exclude any item certified in a previous certificate or reduce the
proportion of any item previously certified in any certificate in the light of later
information.
Payments shall be adjusted for deduction for advance payments, retention and other
recoveries in terms of the contract and deduction at source of taxes as applicable
under the law.
The employer shall pay the contractor the amounts certified by the engineer on or
after 30 days of date of each certificate.
No payment towards interest will be payable in case the payment is delayed for
whatever reason.
Item of works for which no rate or price has been entered in, will not be paid for ,by
the employer and shall be deemed covered by the rates and prices in the contract.
2.Penality
Time shall be considered as the essence of the contract. And failure on the part of
the contractor to complete the work within the stipulated time set out ,in the
contract, will attract penalty of 0.5% per week of delay or part there of on the value
of uncompleted work portion ,subject to a maximum of 5% of contract value.
3.Termination of Contract
The employer, without prejudice to any other remedy for breach of contract, by
written notice of default sent to the contractor, may terminate the contract in whole
or in part.
a) if the contractor fails to complete the work within the period specified in the
contract, or within any extension thereof granted by the employer.
b) If the contractor fails to perform any other obligations under the contract.
c) If the contractor , in the judgment of the employer has engaged in corrupt or
fraudulent practices in competing for or in executing the work.
In the event of employer terminates the contract in whole or in part ,the
employer may take up the work, upon such terms and in such manner ,as it
deems appropriate and the contractor will be liable to the employee for any
excess costs for such similar item of works. However the contractor will continue
performance of the contract to the extent not terminated.
4. Settlement of Disputes
If any dispute or difference of any kind whatsoever will arise between the employer
and the contractor in connection with or arising out of the contract,
the parties will make every effort to resolve amicably such dispute or difference by
mutual consultation. If within reasonable time, the employer and the contractor
could not resolve dispute/difference by mutual consultation ,the parties may resolve
the same through arbitration.
5. ARBITRATION:
Clause 73 of PS to APSS is deleted

6. JURISDICTION:
For the purpose of this agreement, all the transactions shall be deemed to have taken
place within the State of ANDHRA PRADESH and the courts in Nizamabad shall
have jurisdiction over the matters arising under or out of this agreement. No suit or
other legal proceedings shall be instituted elsewhere other than courts in
Nizamabad.
7. CONTRACTOR’S RISK AND INSURANCE:
Clause 50 of the PS to APSS will be effective subject to the following
modifications.

The words “work – executed”, occurring in line 1 of the above clause will also
include “work under execution”.
8. Seignorage charges
Seignorages and local cess charges payable on the materials used by the tenderer in
the work will be recovered at the rates fixed by competent authority from the
contractor’s bills and the same will be remitted to mines and minerals dept.
9 .Taxes
The rates quoted by the contractor shall be deemed to be inclusive of sales tax/VAT
and other taxes that the contractor will have to pay for the performance of this
contract. The employer will perform such duties in regard to the deduction of such
taxes at source as applicable.
10. Indeminities
The contractor is liable
for and indeminifies
the APNPDCL against losses,
expenses and claims for loss or damage to physical property, personal injure and
death caused by his own acts and omissions.
The contractor indemnifies the APNPDCL against claims to damages caused by
the movement of his equipment or temporary works.
11. SAFETY PRECAUTIONS
All the safety measures to avoid accidents shall be followed strictly in accordance
with the safety rules and regulations laid down by the Government authorities. The
Contractor shall take all safety precautions and shall provide proper scaffolding,
lifebelts, ladder shock proof helmets, etc. to avoid accidents and to ensure safety of
not only his personnel but also the safety of the staff and workers of other
contractors working at the same site.
12. FUNCTIONING OF THE CONTRACT:
The contractor shall carryout all directions and orders issued by the Asst.
Divisional Engineer /Operation connected with the work and shall communicate
with him regarding all matters pertaining to the contract.
13.CONTRACT INCLUDES ALL NECESSARY OPERATIONS:
The contractor is to include the whole of works whether permanent or
temporary which are described in or implied by the contract documents which may
be inferred to be obviously necessary for the efficiency, stability and completion of
the permanent works, also the performance of all other operations and the supplying
of all materials and things described in or implied by the contract documents which
may be deemed desirable or required for the completion in all respects of the above
works to the entire satisfaction of the Asst. Divisional Engineer/Operation and all
such matters shall be deemed as included in the contract.
Work shown upon the drawings and not mentioned in the specification or
described in the specifications without being shown in the drawings shall
nevertheless be held to be included in this contract, in the same manner as if they
had been expressly shown upon the drawings and described in the specifications
also.
14. OTHER CONTRACTS FOR THE WORK:
Should the APNPDCL enter into other contracts for specified items of the
corporate work each contractor shall cooperate with others to the fullest extent and
allow each other every facility and coordination for execution of their works
simultaneously and satisfactorily as intended in the designs, specifications and
drawings. Should there be dispute or disagreement between the contractors for any
cause whatsoever the same shall be referred to the Divisional Engineer/Operation
whose decision regarding the coordination, cooperation and facilities to be provided
by any of the contractors to the others shall be final and binding on all parties and
such a decision or decisions shall not vitiate any contract nor absolve the contractor
of his responsibilities under the contract.
15. MATERIALS, TOOLS AND PLANT BROUGHT ON TO THE SITE OF WORK:
All the materials, tools and plant of the contractor brought to and delivered
upon the site for purpose of the work shall from the time to their being so brought,
be deemed to be in the possession of APNPDCL, to be used for that purpose only
and shall not, on any account, be removed or taken away by the contractor or any
other person without the express permission in writing of the Asst. Divisional
Engineer/Operation but the contractor shall nevertheless be solely liable and
responsible for any loss or destruction thereof or damage thereto.
