WAIVER ACKNOWLEDGEMENT AND INDEMNITY
As a participant in the promotional activities of Florida Panthers Hockey Club, Ltd., I recognize and acknowledge that the activities I will be
engaging in, and the possible participation of fans, involves a risk of personal injury to myself and others. Nevertheless, I am voluntarily participating
in the promotional activities of Florida Panthers Hockey Club, Ltd. with knowledge of the possible danger involved. I hereby voluntarily assume and
accept any and all risks of injury to me or any other person that may result from my participation, regardless of how such injury may arise and
regardless of who is at fault or negligent.
I understand and agree that by signing this Waiver and Acknowledgement I am releasing, discharging and covenanting not to sue on behalf of
myself, my personal representatives, heirs, and next of kin, Arena Operating Company, Ltd. SSE Development, LLC; PHGP, LLC; Florida Panthers
Hockey Club, Ltd.; Arena Development Company, Ltd.; Sunrise Sports and Entertainment, LLC;; Broward County, Florida and Broward County
Board of Commissioners, SSE Promotions, LLC; SSE Publications, LLC and each of their respective affiliates, officials, officers, directors, partners,
members, managers, shareholders, agents, contractors, sponsors and employees (collectively, the “Releasees”), from any and all claims, demands,
or causes of action based on fault or negligence or not, including, but not limited to, any claim whatsoever on account of first aid treatment or service
rendered during the promotional activities of Florida Panthers Hockey Club, Ltd.
I hereby grant to the Florida Panthers Hockey Club, Ltd. permission to the use participants image, likeness and/or voice in any photograph and/or
video recording. Such usage may include, but is not limited to, television, internet and print advertising and promotion and is at the sole discretion of
the Releasees. This is a knowing and voluntary relinquishment of any rights and claims the undersigned, his or her spouse (if applicable) or anyone
else may have on behalf of the participant in the program. The undersigned does hereby acknowledge that the participant would not be allowed to
participate in the program in the absence of receipt of this release. I acknowledge that all rights to the program are owned by the club.
I acknowledge that although I have signed this waiver and will be participating in the promotional activities of Florida Panthers Hockey Club, Ltd., I
am not an employee of any Releasees, and therefore, I am not covered by any workers' compensation insurance or by any insurance of any type that
may have been obtained by any of the Releasees.
I agree that this Waiver and Acknowledgement is intended to be as broad and inclusive as permitted by the laws of the state of Florida and if any
portion of this Waiver and Acknowledgement is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and effect.
I have read this Waiver and Acknowledgement carefully and fully understand its contents. I am aware that this is an agreement not to sue the
Releasees and constitutes a complete release of liability by me, my personal representatives, heirs, and next of kin in favor of the Releasees. I
acknowledge that I am signing this document of my own free will, with full knowledge of the risks I am assuming, which include, without limitation,
the risk of injury or death regardless of how it occurs and even if it results from the neglect or fault of the Releasees. I further acknowledge that I am
signing this Waiver and Acknowledgement in consideration of, and as an additional inducement for, Florida Panthers Hockey Club, Ltd. allowing
me to participate in its promotional activities.
READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR
CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT EVEN
IF FLORIDA PANTHERS HOCKEY CLUB, LTD. USES REASONABLE CARE IN PROVIDING THIS
ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY
PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN
THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU
ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM RELEASEES IN A
LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH TO YOUR CHILD OR ANY
PRPOERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE
ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND FLORIDA PANTHERS
HOCKEY CLUB, LTD., HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO
NOT SIGN THIS FORM.
I agree for myself, my child and any other guardian to indemnify Releasees from any and all claims, lawsuits, actions, or proceedings for any injuries
or damages of any kind caused in part or whole by the undersigned, my child or any other guardian, including any and all damages, judgments, costs,
attorney fees, loss of services, and any other related expenses.
This Waiver and Acknowledgement contains the entire agreement between the parties with respect to the matters contained herein.
I have carefully read and understand the foregoing Waiver and Acknowledgement and sign it voluntarily.
