GAS AND ELECTRICITY ACT.
Act No. 42, 1935.
An Act to make better provision for and with
respect to the supply and use of gas and
electricity, the regulation of dividends,
funds, accounts and shares of gas companies
and the charges made for electricity by the
Electric Light and Power Supply Corporation Limited; to alter the law relating to
the licensing of electrical contractors and
electricians; to make certain provisions in
relation to electricity generating stations,
additional main generating units, and main
transmission lines; to constitute a Sydney
County
County Council and to transfer the Elec­
tricity Department of the Municipal Council
of Sydney to such County Council; to repeal
the Gas and Electricity Act, 1932, the
Electrical Contractors Licensing Act, 1924,
and certain other Acts; to amend the
Local Government Act, 1919, the Sydney
Corporation Act, 1932-1934, and certain
other Acts in certain respects; and for
purposes connected therewith. [Assented

1. (1) T h i s Act m a y be cited as the " G a s a n d Elec­
t r i c i t y Act, 1 9 3 5 . "
(2) T h i s Act, w i t h the exception of t h i s Division
a n d P a r t V I a n d P a r t X, shall commence on a d a y t o
be a p p o i n t e d by the G o v e r n o r a n d notified by p r o c l a m a ­
tion published in the Gazette, which d a y is in this A c t
r e f e r r e d to a s the commencement of this Act.
T h i s Division a n d P a r t V I a n d P a r t X of this A c t
shall commence on the d a y u p o n which the a s s e n t of His.
M a j e s t y to t h i s Act is signified.

SCHEDULES.
2. ( 1 ) W h e r e the provisions of this Act a r e incon­
sistent w i t h t h e provisions of a n y o t h e r Act with r e g a r d
to a n y m a t t e r to which t h i s Act applies the p r o v i s i o n s
of this Act shall p r e v a i l .
( 2 ) A g a s company, w h e t h e r o p e r a t i n g u n d e r t h e
provisions of a special A c t o r otherwise, shall be deemed
to be a u t h o r i s e d to do a n y act o r t h i n g n e c e s s a r y for
m a n u f a c t u r i n g or s u p p l y i n g g a s in accordance with the
r e q u i r e m e n t s of this Act.
(3) T h e G o v e r n o r m a y , by p r o c l a m a t i o n published
in the Gazette, exempt from the o p e r a t i o n of such p r o ­
visions of t h i s Act a s a r e mentioned in t h e p r o c l a m a t i o n ,
a n d for the p e r i o d mentioned therein, any g a s c o m p a n y
which is a local a u t h o r i t y or a n y p e r s o n o p e r a t i n g u n d e r
a franchise g r a n t e d u n d e r the Local G o v e r n m e n t A c t ,
1 9 1 9 , as amended by subsequent A c t s .
(4) Division One of P a r t I I I of t h i s Act shall a p p l y
only to a g a s c o m p a n y for the time being included in
Schedule One.
3. I n t h i s Act, unless the context or
otherwise r e q u i r e s —

" B o a r d " m e a n s a b o a r d constituted u n d e r this A c t ;
' ' B r i t i s h t h e r m a l u n i t " m e a n s the q u a n t i t y of h e a t
r e q u i r e d to raise one pound of w a t e r one d e g r e e
Fahrenheit;
" G a s c o m p a n y " m e a n s a n y company, c o r p o r a t i o n ,
firm or p e r s o n s u p p l y i n g or d i s t r i b u t i n g g a s f o r
lighting, heating, motive power, or
other
p u r p o s e , and disposing o f the same with a view
to profit, a n d includes a local a u t h o r i t y , b u t does
not include a n y person or c o r p o r a t i o n a c t i n g on
behalf of the C r o w n ;
"Gas
" G a s u n i t " moans t h r e e t h o u s a n d four h u n d r e d a n d
twelve B r i t i s h t h e r m a l units g r o s s ;
" L o c a l a u t h o r i t y " m e a n s council of a city, munici­
p a l i t y or shire, or an u r b a n committee, or a
county council;
" P a r t " m e a n s P a r t of this A c t ;
" P r e s c r i b e d " m e a n s prescribed by this Act or by
regulations m a d e t h e r e u n d e r ;
" S c h e d u l e " m e a n s Schedule to this A c t ;
" S t a n d a r d p r i c e " m e a n s , in relation to g a s supplied
by a c o m p a n y mentioned in Schedule One, the
a p p r o p r i a t e price for the time being set oppo­
site the n a m e of t h a t company in t h a t Schedule.
DIVISION 2.—Repeal
and
savings.
4. (1) T h e Gas a n d E l e c t r i c i t y Act, 1932, is hereby
repealed.
(2) All regulations m a d e u n d e r the Gas Act, 1912,
which a r e in force a t the commencement of this Act shall,
so f a r as t h e y a r e not inconsistent with this Act, con­
t i n u e in force until repealed or replaced by regulations
m a d e u n d e r this Act.
I n the construction of such regulations, a reference to
a b o a r d shall be construed as a reference to a board
constituted u n d e r this Act.
(3) A p e r s o n a p p o i n t e d to the office of gas examiner
u n d e r the provisions of the G a s Act, 1912, or the Gas
a n d E l e c t r i c i t y Act, 1932, a n d holding such office a t the
commencement of this Act, shall continue in office in the
game m a n n e r as if he h a d been a p p o i n t e d u n d e r this
Act.
(4) The r i g h t s , p o w e r s a n d obligations of a g a s
c o m p a n y as existing at the d a t e of the commencement of
t h i s Act in respect of a n y m a t t e r or t h i n g which u n d e r
t h i s Act m a y be dealt with by a board, shall continue in
full force a n d effect until v a r i e d u n d e r the provisions
of this Act.
(5)
(5) The p e r s o n who, immediately before the com­
mencement of this Act, holds office as C o m m i s s i o n e r
for Gas a n d E l e c t r i c i t y u n d e r the G a s a n d E l e c t r i c i t y
Act, 1932, shall, on such commencement, cease to hold
such office, but shall be eligible, on the r e c o m m e n d a t i o n of
the Public Service B o a r d , to be a p p o i n t e d to some office
in the Public Service c o r r e s p o n d i n g in classification a n d
s a l a r y to t h a t which he held at the date of his a p p o i n t ­
m e n t as Commissioner, a n d if he is not so recommended
a n d appointed within t h r e e m o n t h s after the commence­
m e n t of this Act, a n d if within such p e r i o d of t h r e e
m o n t h s he shall not have been appointed by the Govern­
m e n t to an office with a s a l a r y not less t h a n t h e said
s a l a r y , he shall receive such compensation as h e
would have been entitled to h a d his services been dis­
pensed with at the commencement of this Act o t h e r w i s e
t h a n according to law.
T h e provisions of the Public Service Act, 1902, a s
amended by subsequent Acts, a n d of any r e g u l a t i o n m a d e
t h e r e u n d e r , c o n f e r r i n g r i g h t s and privileges in r e s p e c t
of leave of absence on an officer of the Public Service
shall be deemed to have applied to a n d in respect of t h e
Commissioner to the same extent as if he h a d continued
to hold the office in the Public Service held by h i m imme­
d i a t e l y before his a p p o i n t m e n t as Commissioner, a n d
a n y leave by w a y of o r d i n a r y leave accrued to h i m a n d
not t a k e n at the commencement of this Act shall be a d d e d
to the leave to which he is entitled u n d e r section t h i r t e e n
of the Public Service ( A m e n d m e n t ) Act, 1919, as a m e n d e d
by subsequent Acts.
I n the event of his not being a p p o i n t e d to the P u b l i c
Service, then, for the p u r p o s e s of sections 13A a n d four­
teen of the Public Service ( A m e n d m e n t ) Act, 1919, a s
a m e n d e d by subsequent A c t s —
(a) the t e r m i n a t i o n of his office as C o m m i s s i o n e r
by the o p e r a t i o n of t h i s Act shall be deemed t o
be a r e t i r e m e n t from the Public Service u n d e r
the provisions of section sixty-seven of t h e
P u b l i c Service Act, 1902;
(B)
( b ) the money value of leave not t a k e n by him shall
be computed at the r a t e of s a l a r y received by
h i m a s Commissioner immediately before the
commencement of this Act.
PART I I .
BOARDS OF INQUIRY.
5. (1) T h e Governor m a y from time to time a p p o i n t
a b o a r d for the p u r p o s e s of this Act.
(2) A b o a r d shall consist of t h r e e m e m b e r s , one to
be n o m i n a t e d by the Minister, one to be n o m i n a t e d b y the
g a s c o m p a n y or gas companies concerned in the subjectm a t t e r of the inquiry to be held by t h a t board, a n d a
t h i r d m e m b e r who shall be c h a i r m a n , a n d shall be a
p e r s o n a g r e e d upon between the Minister a n d such
c o m p a n y or companies.
I n the event of the Minister a n d the c o m p a n y or
companies failing to a g r e e as to the t h i r d member, such
t h i r d m e m b e r shall be a p e r s o n n o m i n a t e d by the Chief
J u s t i c e of New S o u t h Wales.
(3) If no person, or no p e r s o n able or willing to
act as a m e m b e r of the board, is within the time prescribed
n o m i n a t e d by the c o m p a n y or companies concerned, the
M i n i s t e r m a y a p p o i n t a n y p e r s o n to r e p r e s e n t the
c o m p a n y or companies as a m e m b e r of such b o a r d .
(4) F o r the p u r p o s e s of any i n q u i r y by a board,
t h e c h a i r m a n shall have the powers, r i g h t s , privileges,
p r o t e c t i o n a n d immunities of a c h a i r m a n of a R o y a l
Commission within the m e a n i n g of Division One of P a r t
I I of the R o y a l Commissions Act, 1923-1934, and a
m e m b e r or a b o a r d shall have the p o w e r s , r i g h t s ,
privileges, p r o t e c t i o n a n d immunities of a commissioner
within the m e a n i n g of t h a t Division.
(5) T h e provisions of the R o y a l Commissions Act,
1923-1934, with the exception of section t h i r t e e n a n d
Division Two of P a r t I I , shall a p p l y to a n d with respect
t o any i n q u i r y by the board.

(6) A n y two m e m b e r s of a b o a r d shall be a q u o r u m
a n d shall h a v e the p o w e r s a n d a u t h o r i t i e s by this Act
conferred u p o n a b o a r d , p r o v i d e d t h a t if a t any m e e t i n g
of a b o a r d the c h a i r m a n is n o t p r e s e n t a n d the m e m b e r s
p r e s e n t differ in opinion upon a n y m a t t e r the d e t e r m i n a ­
tion of such m a t t e r shall be p o s t p o n e d until such t i m e
a s the c h a i r m a n shall be p r e s e n t .
(7) No act, d e t e r m i n a t i o n or proceeding of a b o a r d
shall be invalid merely because a t the time of the act,
d e t e r m i n a t i o n or proceeding t h e r e is a vacancy in t h e
office of a m e m b e r of the b o a r d .
(8) T h e c h a i r m a n shall h a v e a deliberative v o t e ,
a n d in the case of a n equal division of votes a c a s t i n g
vote.
( 9 ) I n the case of illness or absence of a m e m b e r ,
the a u t h o r i t y which n o m i n a t e d such m e m b e r m a y
n o m i n a t e a d e p u t y to act for such m e m b e r d u r i n g h i s
illness or absence, and such d e p u t y whilst so a c t i n g shall
be deemed to be a m e m b e r of the b o a r d .
(10) T h e costs of a n d incidental to a n i n q u i r y ,
including the fees of the m e m b e r s , shall be p a i d b y t h e
p a r t i e s to the i n q u i r y in such p r o p o r t i o n s a s the b o a r d
m a y direct.
(11) No action or suit shall be b r o u g h t or main­
t a i n e d a g a i n s t a n y p e r s o n who is, or a t a n y time h a s
been, a m e m b e r of a b o a r d , for a n y t h i n g done or omitted
b y him p u r s u a n t to the duties imposed upon him by t h i s
Act.

REGULATION OF GAS COMPANIES.

6. (1) The profits of a g a s c o m p a n y available for dis­
t r i b u t i o n a m o n g the holders of its s h a r e capital in a n y
y e a r shall not exceed the following r a t e s (in t h i s Act
r e f e r r e d to as the s t a n d a r d r a t e s of d i v i d e n d ) , t h a t is to
sayon the o r d i n a r y s h a r e capital of the c o m p a n y — t h e
r a t e of six p o u n d s in respect of every one hun­
d r e d p o u n d s actually p a i d u p or issued as p a i d
u p of such c a p i t a l ; a n d
on the preference capital of the company—the r a t e
of five p o u n d s t e n shillings in respect of every
one h u n d r e d p o u n d s actually p a i d u p or issued
a s p a i d u p of such capital.
(2) Should a g a s c o m p a n y other t h a n the four
companies firstly mentioned in Schedule One be unable
to obtain s h a r e capital a t p a r , the s t a n d a r d r a t e s of divi­
dend on such capital m a y , with the a p p r o v a l of the
M i n i s t e r a n d u p o n r e c o m m e n d a t i o n by a b o a r d be
i n c r e a s e d a n d such increased r a t e s shall be t h e s t a n d a r d
r a t e s of dividend on such capital.
7. (1) T h e directors of a g a s c o m p a n y m a y , if they
t h i n k fit, in a n y y e a r , t r a n s f e r out of the revenue of the
c o m p a n y a s p a r t of the e x p e n d i t u r e on revenue account,
a n y s u m n o t exceeding a n a m o u n t equal to one-half of
one p e r centum of the a g g r e g a t e of the s h a r e capital
(inclusive of p r e m i u m s ) a n d the loan capital a s defined
by r e g u l a t i o n to a n account to be called " t h e special
purposes account."
(2) T h e special p u r p o s e s account shall be appli­
cable only to meet—
(a) expenses i n c u r r e d by r e a s o n of accidents, indus­
t r i a l d i s p u t e s and other circumstances which d u e
c a r e a n d m a n a g e m e n t could n o t have p r e v e n t e d ;
(b) expenses incurred in the removal of p l a n t o r
works.

(3) T h e m a x i m u m a m o u n t s t a n d i n g to the credit
of the special p u r p o s e s account shall not, at a n y time,
exceed a n a m o u n t equal to one-twentieth p a r t of the
a g g r e g a t e of the s h a r e a n d loan capital of the company
a s p r e s c r i b e d in subsection one of this section.
(4) So long as t h e r e is a n y balance r e m a i n i n g in
the special p u r p o s e s account, a n y expenses of the n a t u r e
r e f e r r e d to in subsection two of this section shall be
c h a r g e d a g a i n s t such account.
8. T h e d i r e c t o r s of a g a s c o m p a n y m a y , if t h e y think
fit, in a n y y e a r , c h a r g e a g a i n s t the revenue of the company
a s p a r t of the e x p e n d i t u r e on revenue account, a n y sum
n o t exceeding a n a m o u n t equal to t h r e e p e r centum of the
book values (after deducting depreciation or allowing for
a n y a m o u n t in the depreciation r e s e r v e as the case m a y
r e q u i r e ) of the m a n u f a c t u r i n g a n d d i s t r i b u t i n g plant,
buildings, a n d equipment of the c o m p a n y calculated on
the a v e r a g e m o n t h l y balances of such book values
t h r o u g h o u t the y e a r , a n d a n y sum so c h a r g e d shall be
applied in w r i t i n g down such book values or be c a r r i e d
to a depreciation r e s e r v e .
9. T h e a m o u n t s t a n d i n g to the credit of the special
p u r p o s e s a n d depreciation fund of a g a s c o m p a n y a t the
commencement of this Act m a y be allocated between the
special p u r p o s e s account a n d the w r i t i n g down of the
book values of the c o m p a n y ' s assets or the t r a n s f e r to a
depreciation r e s e r v e in such p r o p o r t i o n s as the d i r e c t o r s
m a y decide, but not less t h a n one-seventh p a r t of such
a m o u n t shall be allocated to the special p u r p o s e s account.
10. (1) W h e r e the a v e r a g e price p e r g a s u n i t c h a r g e d
by a g a s c o m p a n y for all g a s sold by it d u r i n g a n y y e a r
shall have been six one-thousandths of a p e n n y or m o r e
below the a v e r a g e s t a n d a r d price p e r g a s u n i t applicable
to t h a t c o m p a n y the d i r e c t o r s of the c o m p a n y m a y , out
of the profits, set a p a r t such a m o u n t as they think fit b y
w a y of a g e n e r a l r e s e r v e .
T h e a m o u n t so set a p a r t shall not exceed the s u m ascer­
tained by m u l t i p l y i n g the total n u m b e r of g a s u n i t s sold
by
by the c o m p a n y d u r i n g the y e a r by the difference between
the a v e r a g e s t a n d a r d price per gas u n i t a n d the a v e r a g e
price p e r g a s unit.
I n this subsection—
" T h e a v e r a g e price p e r g a s u n i t " m e a n s the sum
a s c e r t a i n e d by dividing the total sum c h a r g e d
by the company for all g a s sold by it d u r i n g the
y e a r , by the total n u m b e r of g a s u n i t s so sold;
'The a v e r a g e s t a n d a r d price p e r g a s u n i t " m e a n s
the sum ascertained by dividing the total sum
which the company would h a v e c h a r g e d for all
g a s sold by it d u r i n g the y e a r if it h a d c h a r g e d
the s t a n d a r d price therefor, by the total n u m b e r
of g a s units so sold.
( 2 ) All a m o u n t s so set a p a r t m a y be invested in
G o v e r n m e n t or other securities not connected with the
business of the company a n d the dividends and i n t e r e s t
a r i s i n g from such securities m a y be invested in the same
or like securities in o r d e r t h a t the a m o u n t s m a y accumu­
late at compound interest.
(3) The g e n e r a l reserve so formed m a y be applied
to the p a y m e n t of dividends in a n y y e a r in which the
profits of the company a r e insufficient to enable it to p a y
the s t a n d a r d r a t e s of dividend.
11. ( 1 ) Save as a u t h o r i s e d in this P a r t no sum shall
in a n y y e a r be t r a n s f e r r e d from revenue by a g a s
c o m p a n y to a n y reserve, fund, or account.
( 2 ) Subject to this section the profits of a g a s
company shall not be utilised otherwise t h a n to p a y
dividends, and to provide a g e n e r a l r e s e r v e a n d a sus­
pense or r e s e r v e account to i n a u g u r a t e a s u p e r a n n u a t i o n
fund in accordance with this Act.
(3) If the clear profits of a company in a n y y e a r ,
after p r o v i d i n g for all expenses p r o p e r l y chargeable to
revenue, i n t e r e s t p a y a b l e on loans, a n d a n y t r a n s f e r s t o
a n y reserve, fund, or account a u t h o r i s e d by this P a r t ,
a m o u n t to a l a r g e r sum t h a n is sufficient to p a y t h e
s t a n d a r d r a t e s of dividend, t h e excess m a y be carried
f o r w a r d in the profit a n d loss account; but the balance
remaining
r e m a i n i n g in the profit a n d loss account a f t e r allowing
for p a y m e n t of accrued dividends shall not a t a n y t i m e
exceed the a m o u n t r e q u i r e d to p a y one y e a r ' s dividend
a t the s t a n d a r d r a t e s .
(4) A g a s c o m p a n y which c o n t r a v e n e s a n y p r o ­
vision of t h i s section shall be liable on s u m m a r y convic­
tion to a p e n a l t y n o t exceeding one h u n d r e d p o u n d s , a n d
a f u r t h e r p e n a l t y not exceeding fifty p o u n d s for e v e r y
d a y on which, a f t e r such conviction, the c o n t r a v e n t i o n
continues.
12. ( 1 ) A g a s c o m p a n y shall not c h a r g e for gas sup­
plied by m e t e r a price exceeding the a p p r o p r i a t e
s t a n d a r d price applicable to t h a t company.
(2) ( a ) T h e M i n i s t e r shall, at the request in
w r i t i n g of a g a s company, a n d m a y a t a n y time of his
own motion, constitute a b o a r d to inquire w h a t price or
p r i c e s of g a s would, if c h a r g e d by a company, and,
h a v i n g r e g a r d to all its o t h e r r e v e n u e , enable t h a t com­
p a n y to p a y the s t a n d a r d r a t e s of dividend after m a k i n g
p r o v i s i o n for—
(i) i n t e r e s t p a y a b l e on l o a n s ;
(ii) expenses u n d e r the p r e s c r i b e d h e a d i n g s p r o p e r l y
chargeable to revenue, including—
( a ) the m a x i m u m a m o u n t which m a y be
transferred
to the special
purposes
account in accordance with section seven
of this A c t ;
(b) the m a x i m u m a m o u n t which m a y be
c h a r g e d for d e p r e c i a t i o n in accordance
with section eight of this A c t ; a n d
(iii) a reasonable sum for contingencies which shall
not exceed the a m o u n t n e c e s s a r y to p a y one halfy e a r ' s dividend at the s t a n d a r d r a t e s .
(b) T h e b o a r d shall d e t e r m i n e a n d certify
such p r i c e or p r i c e s to the Minister, a n d w h e r e such price
or p r i c e s differ from the p r i c e or p r i c e s set opposite t h e
n a m e of the c o m p a n y in Schedule One, the G o v e r n o r m a y
by p r o c l a m a t i o n published in the Gazette a m e n d Schedule
One b y s u b s t i t u t i n g for the price or p r i c e s t h e n set
opposite the n a m e of t h e c o m p a n y the p r i c e or prices
so certified by the b o a r d .
(3).
(3) U p o n a n y r e p r i n t of this Act Schedule One
shall be r e p r i n t e d as a m e n d e d p u r s u a n t to this or a n y

DIVISION
2.—General provisions

13. (1) N o t w i t h s t a n d i n g the provisions of a n y Act or
of a n y m e m o r a n d u m or articles of association the issue
a f t e r the commencement of this Act of a n y s h a r e s in T h e
A u s t r a l i a n Gas L i g h t Company, the N o r t h S h o r e Gas
C o m p a n y Limited, T h e City of Newcastle Gas a n d Coke
C o m p a n y ( L i m i t e d ) or the Manly Gas C o m p a n y Limited,
shall be subject to the following p r o v i s i o n s : —
( a ) all s h a r e s so to be issued shall be offered for
sale by public auction or tender, a n d m a y be
sold at, above or below p a r ;
(b) notice of the i n t e n d e d sale shall be given to the
M i n i s t e r at least twenty-eight d a y s before the
d a y of auction or the last d a y for the reception
of t e n d e r s , as the case m a y be, a n d shall be
a d v e r t i s e d once in each of two consecutive weeks
in one or m o r e daily n e w s p a p e r s published in
Sydney, and in one or m o r e n e w s p a p e r s pub­
lished and circulating in the locality in which the
c o m p a n y supplies g a s ;
(c) a r e s e r v e price shall be fixed a n d notice thereof
shall be sent by the c o m p a n y in a sealed l e t t e r
to be received by the Minister not less t h a n
twenly-four h o u r s before, but not to be opened
u n t i l after the d a y of the auction or after the
last d a y for the reception of t e n d e r s as the case
may be;
( d ) no lot offered for sale shall comprise s h a r e s of
g r e a t e r nominal value t h a n one h u n d r e d p o u n d s ;
(e) in the case of a sale by t e n d e r no preference
shall be. given to one of two or m o r e p e r s o n s
t e n d e r i n g the same s u m ;
(f) it shall be one of the conditions of sale t h a t the
t o t a l sum payable by the p u r c h a s e r shall be p a i d

to
to the company on a d a y to be fixed by the com­
p a n y being within t h r e e m o n t h s after the date
of the auction or of the acceptance of the t e n d e r
as the case m a y b e ;
(g) a n y s h a r e s or stock which have been so offered
for sale a n d a r e not sold m a y be offered a t the
r e s e r v e price to the holders of o r d i n a r y and
preference s h a r e s or stock of the c o m p a n y and
to the employees of the company and to the con­
s u m e r s of g a s supplied by the company in such
p r o p o r t i o n s as the directors of the company m a y
think fit, or to one or more of these classes of
persons only:
P r o v i d e d t h a t in the case of an offer to holders
of s h a r e s or stock, if the a g g r e g a t e a m o u n t of
s h a r e s or stock applied for exceeds the a g g r e ­
g a t e a m o u n t so offered as aforesaid, the same
shall he allotted to and d i s t r i b u t e d a m o n g s t the
a p p l i c a n t s as n e a r l y as m a y be in p r o p o r t i o n to
the a m o u n t s applied for by them respectively;
(h) a n y s h a r e s or stock which m a y have been offered
for sale in accordance with the foregoing p r o ­
visions of this section, a n d a r e not sold, shall
be again offered for sale by public auction or
by t e n d e r in accordance with the provisions of
this section a n d any such s h a r e s or stock then
r e m a i n i n g unsold m a y be otherwise disposed of
at such price a n d in such m a n n e r as the d i r e c t o r s
of the c o m p a n y m a y d e t e r m i n e for the p u r p o s e
of realising the best price o b t a i n a b l e ;
(i) as soon as possible after the conclusion of the
sale or sales the company shall send a r e p o r t
thereof to the Minister, s t a t i n g the total a m o u n t
of the respective s h a r e s or stock sold, the total
a m o u n t obtained as p r e m i u m (if a n y ) , a n d the
highest a n d lowest prices obtained for the
respective s h a r e s or stock;
(,i) the a m o u n t of p r e m i u m shall in all cases be
t r e a t e d as non-dividend bearing.
(2) I n this section " s h a r e s " includes
a n d preference s h a r e s .

14.
14. (1) Subject to the provisions of this Act, the
M i n i s t e r shall, at the request in w r i t i n g of a gas c o m p a n y
(other t h a n a local a u t h o r i t y ) not included in Schedule
One, a n d m a y at any time of his own motion, constitute
a board—
(a) to inquire what price or prices of g a s would, if
charged by the company, a n d h a v i n g r e g a r d to
all its other revenue, and after allowing for the
charges mentioned in s u b p a r a g r a p h s ( i ) , (ii)
a n d (iii) of p a r a g r a p h (a) of subsection two of
section twelve of this Act, enable the company
to p a y dividends at r a t e s equivalent to the
s t a n d a r d r a t e s of dividend r e f e r r e d to in section
six of this A c t ; or
(b) to inquire into and r e p o r t as to whether the price
or prices of g a s supplied by a specified company
should be fixed; or
(c) to inquire into a n d r e p o r t as to the circumstances
of a n y such c o m p a n y a n d w h e t h e r or not it
should be included in Schedule One or w h e t h e r
or not it should be r e s t r i c t e d in respect of the
price or prices of g a s to be c h a r g e d by it, or
w h e t h e r or not it should be a u t h o r i s e d to p a y
dividends in excess of the s t a n d a r d r a t e s of
d i v i d e n d s ; or
(d) to inquire into a n d r e p o r t upon a n y m a t t e r
r e f e r r e d to in this section or a n y question
a r i s i n g therefrom.
( 2 ) The board shall make such inquiry a n d
shall furnish to the Minister a r e p o r t sotting out its
findings.
I n the case of an inquiry u n d e r p a r a g r a p h (a) of sub­
section one of this section, the b o a r d shall certify the
price or prices as d e t e r m i n e d by it to the Minister. I n
the case of an inquiry u n d e r p a r a g r a p h (c) of t h a t sub­
section, the b o a r d m a y recommend t h a t the c o m p a n y be
included in Schedule One, and the G o v e r n o r m a y upon
such recommendation by proclamation published in the
Gazette amend t h a t Schedule by the addition of the n a m e
of the company concerned with the price or prices recom­
mended by the board set opposite the name of the
company.
(3)
(3) A b o a r d shall not be constituted by the Min­
i s t e r of his own motion u n d e r this section unless a n
inspection h a s been m a d e a n d a r e p o r t furnished to him
on the accounts of the company concerned p u r s u a n t to
section eighteen of this Act.
( 4 ) W h e r e a b o a r d recommended t h a t the com­
p a n y be included in Schedule One, it shall also r e p o r t a s
to w h a t consequential action should be t a k e n by the com­
p a n y , a n d without limiting the g e n e r a l i t y of this obliga­
tion, shall recommend what t r a n s f e r s should be m a d e
from a n y existing r e s e r v e fund or account of the com­
p a n y so as to b r i n g it into conformity with this Act or
the r e g u l a t i o n s m a d e t h e r e u n d e r .
U p o n a p p r o v a l by the G o v e r n o r of the r e p o r t the
company, on being r e q u i r e d so to do, shall take such
action as m a y be n e c e s s a r y for the p u r p o s e of giving
effect t h e r e t o .
( 5 ) N o t w i t h s t a n d i n g a n y t h i n g contained in t h i s
Act, a b o a r d constituted u n d e r this section m a y d e t e r m i n e
a n d certify w h a t price or prices should be fixed as t h e
price or prices for g a s supplied by the c o m p a n y a n d
m a y recommend that the name of the c o m p a n y be not
included in Schedule One. U p o n p r o c l a m a t i o n by t h e
G o v e r n o r published in the Gazette the price or p r i c e s
so certified shall be the m a x i m u m price or prices which
m a y be c h a r g e d by the c o m p a n y for gas supplied.
( 6 ) W h e r e a b o a r d r e p o r t s that, h a v i n g r e g a r d to
the special circumstances of the company, including in
such circumstances, its obligations i n c u r r e d in respect of
s h a r e s a l r e a d y issued, the company should be included in
Schedule One but should n e v e r t h e l e s s be a u t h o r i s e d to
p a y for a. specified period or periods or g e n e r a l l y divi­
dends a t a r a t e or r a t e s in excess of the s t a n d a r d r a t e s
r e f e r r e d to in section six of this Act, the G o v e r n o r m a y ,
by the p r o c l a m a t i o n a m e n d i n g Schedule One by including
the c o m p a n y t h e r e i n , a u t h o r i s e it for the p e r i o d or
p e r i o d s specified, or generally, to p a y dividends a t the
r a t e or r a t e s specified in the p r o c l a m a t i o n , and, in the
a p p l i c a t i o n of Division One of this P a r t to the company,
the r a t e or r a t e s so a u t h o r i s e d for the time being shall be
deemed to be the s t a n d a r d r a t e s of dividend which m a y
be p a i d by t h a t company.
Any
A n y such a u t h o r i t y m a y be cancelled, v a r i e d or revoked
in like m a n n e r upon a like report.
15. ( 1 ) Subject to the provisions of this Act the
M i n i s t e r shall, a t the request in w r i t i n g of a local
a u t h o r i t y conducting a t r a d i n g u n d e r t a k i n g for the supply
of g a s , constitute a b o a r d to inquire w h a t price or prices
of g a s would, if c h a r g e d by the local a u t h o r i t y , h a v i n g
r e g a r d to any other revenue of the u n d e r t a k i n g , enable
the local a u t h o r i t y t o —
(a) p a y all i n t e r e s t on loans lawfully r a i s e d for the
p u r p o s e s of the u n d e r t a k i n g ;
(b) p a y all expenses p r o p e r l y chargeable to revenue
from the u n d e r t a k i n g including a sum for
depreciation at such a r a t e upon the d e p r e c i a t i n g
assets in use by the local a u t h o r i t y for the pur­
pose of the u n d e r t a k i n g as the b o a r d m a y
determine;
(c) p r o v i d e a reasonable r e s e r v e for contingencies;
and
(d) m a k e such provision for a n y sinking fund or
reserve a u t h o r i s e d by law a s the b o a r d m a y
determine.
( 2 ) T h e b o a r d shall d e t e r m i n e a n d certify such
price or prices to the Minister.
U p o n publication of a proclamation of such price or
prices by the Governor in the Gazette, such price or prices
shall be the m a x i m u m price or prices which m a y be
charged by the local a u t h o r i t y for gas supplied.
16. The Minister shall, a t the request of a g a s com­
p a n y , constitute a board to inquire w h e t h e r the company
should be p e r m i t t e d t o —
(a) r e q u i r e g u a r a n t e e s of a specified a n n u a l sum
or a specified a n n u a l revenue as a condition of
s u p p l y i n g g a s to a n y district, a r e a or p e r s o n ; or
(b) m a k e m i n i m u m or service c h a r g e s
supplied by the c o m p a n y ; or

gas
(c) m a k e differential r a t e s for g a s supplied by such
company.
The
T h e b o a r d shall r e p o r t to the Minister a n d if the case
so r e q u i r e s , certify the r a t e s a n d / o r charges which in its
opinion a r e p r o p e r .
T h e Minister m a y by w r i t i n g a u t h o r i s e the company to
r e q u i r e g u a r a n t e e s or to m a k e m i n i m u m or service
charges or differential r a t e s as recommended by the
board.
17. (1) A g a s company (other t h a n a local autho­
r i t y ) shall f o r w a r d to the Minister on or before the
thirty-first d a y of M a r c h in each year, an a n n u a l state­
m e n t of accounts duly audited, and if a n d when r e q u i r e d
by the Minister a list of s h a r e h o l d e r s of the company a t
the thirty-first d a y of December then next preceding.
The s t a t e m e n t a n d list shall be in the form a n d contain
the p a r t i c u l a r s prescribed or as n e a r t h e r e t o a s cir­
cumstances will p e r m i t .
I n every such a n n u a l s t a t e m e n t of accounts the audi­
t o r shall certify w h e t h e r in his opinion the c o m p a n y h a s
correctly a p p o r t i o n e d its e x p e n d i t u r e between capital
a n d revenue.
( 2 ) T h e c o m p a n y shall keep copies of such a n n u a l
s t a t e m e n t a t its office a n d sell the same to a n y a p p l i c a n t
at a price not exceeding one shilling for each copy.
( 3 ) A n y g a s c o m p a n y which m a k e s default in
complying with the provisions of this section shall be
liable to a p e n a l t y not exceeding two p o u n d s for each d a y
d u r i n g which such default continues.
18. (1) T h e A u d i t o r - G e n e r a l shall, at the r e q u e s t of
the Minister, either p e r s o n a l l y or by a p e r s o n a p p o i n t e d
by him, audit or inspect the accounts of a g a s company
and r e p o r t to the M i n i s t e r t h e r e u p o n .
T h e Minister m a y a p p o i n t a p e r s o n who is a public
accountant, an inspector of local g o v e r n m e n t accounts
or the holder of an a u d i t o r ' s certificate p r e s c r i b e d by or
u n d e r the Local Government Act, 1919, as a m e n d e d by
subsequent Acts, to audit or inspect the accounts of a g a s
company and r e p o r t to him thereupon.
(2)
(2) F o r the p u r p o s e of a n y such audit, inspection
or r e p o r t the A u d i t o r - G e n e r a l or the p e r s o n a p p o i n t e d
b y him or by the Minister, shall have access to all books,
accounts, documents, w r i t i n g , p a p e r s or i n s t r u m e n t s in
t h e possession or u n d e r the control of the company, which
r e l a t e to the accounts of the company.
(3) A n y p e r s o n who obstructs the Auditor-Gene­
r a l or the p e r s o n appointed by him or by the Minister
in the p e r f o r m a n c e of his duties u n d e r this section, or
who w i t h o u t lawful excuse refuses to produce any such
book, account, document, writing, p a p e r or i n s t r u m e n t ,
or to a n s w e r a n y question asked by the A u d i t o r - G e n e r a l
or such a p e r s o n in the p e r f o r m a n c e of such duties, shall
be liable upon s u m m a r y conviction to a penalty not
exceeding t w e n t y p o u n d s , a n d w h e r e such a p e r s o n , after
conviction for such a n offence, still refuses to p r o d u c e
a n y such book, account, document, writing, p a p e r o r
i n s t r u m e n t , or to a n s w e r such a question, he shall be
liable upon s u m m a r y conviction to a f u r t h e r penalty not
exceeding t w e n t y pounds for each d a y d u r i n g which such
refusal continues.
19. W h e r e a person is r e q u i r e d by a g a s company to
give security for a supply of gas or for the p a y m e n t of
the r e n t a l of a m e t e r or any a p p a r a t u s whatsoever, a n d
such security is in the form of a deposit of cash or the
equivalent of cash, such company shall, in accordance
with the regulations, p a y i n t e r e s t t h e r e o n to such person
a t the r a t e p a y a b l e for the time being by the Common­
wealth S a v i n g s B a n k of A u s t r a l i a upon a savings bank
deposit of a like amount.
20. (1) N o w i t h s t a n d i n g the provisions of any Act,
a g a s company m a y —
(a) raise such additional capital as m a y be necessary
by the creation a n d issue of o r d i n a r y s h a r e s or
stock, or preference s h a r e s or stock, or wholly
or p a r t i a l l y by one or m o r e of those modes
respectively;
(b)
(b) raise or b o r r o w money a n d secure the p a y m e n t
or r e p a y m e n t of such money in such m a n n e r a n d
upon such t e r m s a n d conditions in all respects
as the said c o m p a n y in g e n e r a l m e e t i n g or the
d i r e c t o r s m a y d e t e r m i n e ; a n y security given in
respect of a n y such money shall unless otherwise
p r o v i d e d by the articles of association (if a n y )
of such c o m p a n y be u n d e r the h a n d s of a n y two
of the d i r e c t o r s a n d the s e c r e t a r y for the time
being of the company, a n d shall be in such form,
a n d shall contain such provisions, a s the direc­
t o r s m a y decide; a n d
(c) consolidate a n d divide all or a n y of the s h a r e
c a p i t a l of the c o m p a n y into s h a r e s of l a r g e r
a m o u n t (but not exceeding one h u n d r e d p o u n d s
a s h a r e ) t h a n the existing s h a r e s of the com­
p a n y , or subdivide the existing s h a r e s of the
company, or a n y of them, into s h a r e s of smaller
amount, but so t h a t in the subdivision the p r o
p o r t i o n between the a m o u n t p a i d and
the
a m o u n t , if any, u n p a i d on each reduced s h a r e
shall be the same as it w a s in the case of the
s h a r e from which the reduced s h a r e is derived.
( 2 ) This

a
local
21. (1) W h e r e a g a s c o m p a n y included in Schedule
One desires to supply or d i s t r i b u t e g a s beyond the a r e a
within which it is for the time being a u t h o r i s e d so to do,
it shall first a p p l y in w r i t i n g for the consent of t h e
council of the shire or municipality within the b o u n d a r i e s
of which it is d e s i r e d so to supply or d i s t r i b u t e g a s .
( 2 ) U p o n r e q u e s t by the company, the Minister
shall constitute a b o a r d for the p u r p o s e of i n q u i r i n g into
the m a t t e r .
T h e b o a r d shall afford the council an o p p o r t u n i t y of
being h e a r d , a n d shall t h e r e a f t e r recommend to the
M i n i s t e r the a d d i t i o n a l a r e a , if any, within which the
company should be p e r m i t t e d to supply or d i s t r i b u t e g a s
as aforesaid.
The
T h e b o a r d m a y also recommend w h a t special price, if
any, m a y be c h a r g e d by the company, h a v i n g r e g a r d to
the cost of supplying a n d d i s t r i b u t i n g g a s within such
additional a r e a , a n d w h a t conditions, if any, should
a t t a c h to the r i g h t to supply a n d d i s t r i b u t e g a s within
that area.
(3) U p o n publication in the Gazette of a proc­
l a m a t i o n by the Governor in t h a t behalf the company
shall be deemed to be a u t h o r i s e d —
(a) to supply a n d d i s t r i b u t e g a s within the a r e a a n d
subject to the conditions, if any, mentioned in
the p r o c l a m a t i o n n o t w i t h s t a n d i n g the provisions
of a n y Act, deed of settlement or m e m o r a n d u m
or articles of association; a n d
(b) to charge the special price, if any, specified in
the p r o c l a m a t i o n for gas supplied within such
additional area.
2'2. (1) The Governor may, a f t e r a b o a r d constituted
for the p u r p o s e by the Minister h a s inquired a n d r e p o r t e d
t h a t such action would be desirable, by proclamation
published in the Gazette, a u t h o r i s e —
(a) a g r e e m e n t s for the p u r c h a s e of the assets and
u n d e r t a k i n g of a g a s company b y a n o t h e r such
c o m p a n y a n d / o r for the joint w o r k i n g a n d / o r
for t h e a m a l g a m a t i o n of a n y g a s companies
u p o n such conditions as the b o a r d m a y recom­
mend, including n e c e s s a r y provisions with
r e g a r d to the capital of the combined company,
the v e s t i n g of the p r o p e r t y a n d r i g h t s of t h e
p u r c h a s e d or a m a l g a m a t e d companies, a n d other
n e c e s s a r y incidents a n d consequences of pur­
chase, a m a l g a m a t i o n , or joint w o r k i n g ;
(b) a n y scheme for the s u p e r a n n u a t i o n of the
employees of a gas company, including the pro­
vision to set aside sufficient funds from suspense
accounts or r e s e r v e s to i n a u g u r a t e such a
scheme,
scheme, and the provision of funds for the
s u p p o r t of the same as an expense properly;
chargeable to r e v e n u e ;
(c) the a m e n d m e n t of a n y s u p e r a n n u a t i o n scheme
in operation at the commencement of this Act
or a u t h o r i s e d u n d e r this section after such
commencement a n d of a n y deed executed to give
effect to any such scheme;
(d) t h e t r a n s f e r by The A u s t r a l i a n Gas L i g h t Com­
p a n y of such a m o u n t of the fidelity fund held
by the company to a s u p e r a n n u a t i o n fund as
the d i r e c t o r s of the company deem unnecessary
for the p u r p o s e s of such fidelity fund.
( 2 ) A b o a r d shall be constituted b y the M i n i s t e r
for the p u r p o s e s of p a r a g r a p h (b) or p a r a g r a p h (c) of
subsection one of this section a t the r e q u e s t of the com­
p a n y concerned or of the F e d e r a t e d Gas E m p l o y e e s '
I n d u s t r i a l Union, New S o u t h W a l e s B r a n c h , a n d if the
Governor in accordance with this section a u t h o r i s e s a n y
of the m a t t e r s r e f e r r e d to in either of the said p a r a ­
g r a p h s the c o m p a n y concerned shall take such steps a s
m a y be n e c e s s a r y on its p a r t for the p u r p o s e of giving
effect t h e r e t o .

2 2 A . N o t w i t h s t a n d i n g the provisions of a n y Act, deed
of settlement, m e m o r a n d u m or articles of association, a
gas c o m p a n y m a y as an e x p e n d i t u r e p r o p e r l y chargeable
to revenue—•
(1) join or become a m e m b e r of a n d subscribe or
give donations to a n y association, c o r p o r a t i o n or
society, formed or to be formed, the objects or
p a r t objects of which a r e :
(a) to p r o m o t e a n d develop the gas i n d u s t r y
in its v a r i o u s b r a n c h e s ;
(b) to stimulate invention a n d r e s e a r c h in
respect to the g a s i n d u s t r y in its v a r i o u s
branches:
(2)
( 2 ) give donations or contributions to universities,
technical colleges, schools or similar institutions
for the p u r p o s e of c a r r y i n g out r e s e a r c h or other
activities for the advancement of knowledge
r e l a t i n g to the g a s i n d u s t r y in its v a r i o u s
branches, and s u p p o r t associations or other
bodies engaged in work which will be of benefit
to the g a s i n d u s t r y .
PART
IV.
GAS.
DIVISION
1—Standards of heating power,
pressure
of gas.
purity
and
23. (1) (a) The s t a n d a r d of h e a t i n g power of the
g a s supplied by a g a s company shall be not less t h a n five
h u n d r e d and fifty British t h e r m a l units g r o s s : P r o v i d e d
t h a t if the Minister is satisfied t h a t it would be to the
a d v a n t a g e of p e r s o n s supplied with gas by a g a s company
he m a y , by notification published in the Gazette, v a r y
t h e s t a n d a r d of h e a t i n g power of the gas to be supplied
by such company.
(b) A company supplying or d i s t r i b u t i n g g a s
of a s t a n d a r d of h e a t i n g power which at the commence­
m e n t of this Act h a s been d e t e r m i n e d u n d e r the law for
the time being in force m a y m a i n t a i n t h a t s t a n d a r d until
v a r i e d by the Minister, as p r o v i d e d in p a r a g r a p h (a)
of this subsection.
( 2 ) T h e g a s supplied by a g a s company
contain no s u l p h u r e t t e d hydrogen.

(3) A gas company shall supply g a s at such a
p r e s s u r e as will balance a column of w a t e r not less than
two inches in height between the h o u r s of five a.m. and
nine p.m., a n d a column of w a t e r not less t h a n one and
one-half inches in height between the h o u r s of nine p.m.
a n d five a.m. at the m a i n or as n e a r as m a y be to the junc­
tion therewith of the service pipe supplying the consumer.
(4)
(4) A n y test of the h e a t i n g power, p u r i t y and
p r e s s u r e of g a s shall be m a d e in accordance with the
provisions of Schedule Two.
(5) A g a s c o m p a n y shall p r o v i d e the prescribed
a p p a r a t u s for t e s t i n g g a s a t such places (not exceeding
t h r e e in n u m b e r ) on its p r e m i s e s or elsewhere as the
Minister m a y a p p r o v e , a n d shall at all times keep such
a p p a r a t u s in p r o p e r o r d e r and r e p a i r .
24. ( 1 ) W h e r e at any time the gas tested at a n y
t e s t i n g place is of less h e a t i n g p o w e r t h a n t h a t p r e ­
scribed, the c o m p a n y s u p p l y i n g such g a s shall be liable
upon s u m m a r y conviction to a p e n a l t y n o t exceeding
ten p o u n d s if the deficiency exceed two p e r centum but be
not m o r e t h a n five per centum, a n d not less t h a n twentyfive p o u n d s nor m o r e t h a n one h u n d r e d p o u n d s if t h e
deficiency exceed live p e r centum.
T h e a v e r a g e of the testings m a d e at a t e s t i n g place
on a n y two consecutive d a y s shall be deemed to
r e p r e s e n t the h e a t i n g power of the g a s tested on the first
of such d a y s at such t e s t i n g place. One p e n a l t y only
shall be i n c u r r e d by a g a s company in respect of defect
of h e a t i n g power on a n y one day.
( 2 ) Where at any time the g a s tested at any test­
ing place is of less p u r i t y t h a n t h a t prescribed, the com­
p a n y s u p p l y i n g such g a s shall be liable u p o n s u m m a r y
conviction to a p e n a l t y not exceeding ton p o u n d s . One
p e n a l t y only shall be i n c u r r e d by a g a s c o m p a n y in
respect of defect of p u r i t y on a n y one day.
(3) W h e r e at any time the p r e s s u r e of g a s tested
is less t h a n t h a t prescribed, the c o m p a n y s u p p l y i n g such
g a s shall be liable upon s u m m a r y conviction to a p e n a l t y
not exceeding ten p o u n d s .
One p e n a l t y only shall be
i n c u r r e d by a g a s c o m p a n y in respect of defect of
p r e s s u r e on any one d a y .
(4) A p e n a l t y shall not be i n c u r r e d by a g a s com­
p a n y under this section if it can be shown t h a t the defect
w a s due to circumstances beyond the control of the
company, or in the ease of defect of p r e s s u r e t h a t such
defect w a s due to the n e c e s s a r y a n d t e m p o r a r y o p e n i n g
or d i s t u r b i n g of the c o m p a n y ' s mains.
DIVISION
DIVISION
2.—Gas
examiners.
25. (1) The Governor may, u n d e r a n d subject to the
p r o v i s i o n s of the Public Service Act, 1902, as amended
b y subsequent Acts, a p p o i n t g a s examiners for the p u r ­
poses of this Act.
(2) A gas examiner m a y , at a n y reasonable hour,
t e s t in accordance with the provisions of this Act the
h e a t i n g power, p u r i t y a n d p r e s s u r e of the g a s supplied
b y a g a s company. Reasonable notice of a p r o p o s e d
t e s t i n g shall be given to the c o m p a n y concerned a n d a
p e r s o n a p p o i n t e d by it m a y be p r e s e n t a t the testing.
(3) A g a s examiner shall, on the d a y succeeding
t h a t on which the t e s t i n g shall have been conducted or
a s soon t h e r e a f t e r as practicable, make and deliver to
the Minister a r e p o r t as to the r e s u l t s of his testing. H e
shall also f o r w a r d a copy of the r e p o r t to the company.
(4) A g a s c o m p a n y a n d its officers a n d s e r v a n t s
shall give to a g a s examiner a n d his a s s i s t a n t s access to
t h e t e s t i n g places a p p r o v e d in accordance with this Act,
a n d shall afford all facilities for the p r o p e r execution of
his duties. A gas c o m p a n y or its officer or s e r v a n t failing
so to do shall be liable upon s u m m a r y conviction to a
p e n a l t y not exceeding ten p o u n d s .
DIVISION
3.—General and
supplemental.
26. N o t w i t h s t a n d i n g a n y t h i n g contained in a n y Act
o r m e m o r a n d u m or articles of association, a g a s company
shall charge for g a s supplied by it on the basis of the
n u m b e r of g a s u n i t s so supplied.
27. (1) A g a s c o m p a n y shall not give, n o r shall a
p e r s o n take, a supply of g a s otherwise t h a n t h r o u g h a
m e t e r supplied by the c o m p a n y giving the supply.
The Minister m a y g r a n t exemption from the provisions
of this subsection in special circumstances, for such p e r i o d
a n d subject to such t e r m s as to charges and to such con­
ditions as he m a y think fit.
(2) A m e t e r shall not be supplied by a gas com­
p a n y for the p u r p o s e of r e g i s t e r i n g a s u p p l y of g a s
unless it h a s been tested a n d s t a m p e d in the m a n n e r
prescribed.
(3)
(3) A g a s c o m p a n y or a person offending a g a i n s t
the provisions of this section shall, u p o n s u m m a r y
conviction, be liable to a p e n a l t y not exceeding five
pounds.
(4) The r e g i s t r a t i o n of a m e t e r supplied in
accordance with this A c t shall be p r i m a facie evidence
of the quantity of g a s which h a s p a s s e d t h r o u g h the
meter.
28. ( 1 ) A p e r s o n d e s i r i n g a supply of g a s to p r e ­
mises a b o u n d a r y of which is s i t u a t e d within twenty-five
y a r d s of a n y pipe of a g a s company a u t h o r i s e d to s u p p l y
gas within the locality shall serve on the c o m p a n y a
notice specifying the p r e m i s e s in respect of which the
supply is r e q u i r e d a n d the day, not being earlier t h a n
forty-five d a y s from the d a t e of service, u p o n which the
supply is desired to commence.
H e shall, if r e q u i r e d by the company so to do, give a
w r i t t e n u n d e r t a k i n g to the company to take a n d p a y for
a s u p p l y of g a s for a p e r i o d of at least twelve months,
a n d shall if so r e q u i r e d give to the c o m p a n y security for
the p a y m e n t of all moneys which m a y become due by
him in respect of the supply of g a s a n d in respect of such
p r o p o r t i o n of the cost of a n y pipe laid for the p u r p o s e
of giving the s u p p l y as he m a y be r e q u i r e d to b e a r by
subsection t h r e e of this section.
(2) The c o m p a n y shall give to such p e r s o n a
supply n o t l a t e r t h a n the d a t e mentioned in the said
notice as being the d a t e upon which the s u p p l y is r e q u i r e d
to commence, a n d shall, subject to this Act, continue such
supply:
P r o v i d e d t h a t the c o m p a n y shall not be bound to give
or to continue a supply to a p e r s o n who is indebted to it
for g a s supplied or u p o n p r e m i s e s where the pipes, fit­
t i n g s , appliances o r o t h e r a p p a r a t u s used in connection
with the supply or use of gas a r e , in the opinion of the
company, unsafe.
A g a s company which refuses or wilfully neglects to
give or continue a supply which it is r e q u i r e d to give or
continue u n d e r this Act, shall, u p o n s u m m a r y conviction,
be liable to a p e n a l t y not exceeding forty shillings in
respect of each d a y d u r i n g which such refusal or neglect
continues.
(3).
(3) T h e cost of so much of a n y pipes as m a y be
laid upon a n y premises for the p u r p o s e of giving a
s u p p l y t h e r e t o a n d of so much of a n y pipes as m a y be
laid for t h a t p u r p o s e for a g r e a t e r distance t h a n t h i r t y
feet from a n y pipe of the company, although not on such
premises, shall be borne by the p e r s o n m a k i n g the
request.
2 9 . (1) A n officer or s e r v a n t of a gas c o m p a n y duly
a u t h o r i s e d in t h a t behalf may, a t a n y reasonable hour,
e n t e r a n y p r e m i s e s to which gas is or h a s been supplied,
or on which a n y pipe, meter, fitting, appliance or other
a p p a r a t u s h a s been installed for the supply o r use of
g a s , a n d m a y inspect a n d test a n y such pipe, meter, fit­
ting, appliance or other a p p a r a t u s , affix a seal to a n y
such m e t e r or pipe a n d remove a n y such pipe, meter,
fitting, appliance or o t h e r a p p a r a t u s belonging to the
company.
(2) A p e r s o n who obstructs such officer or ser­
v a n t in the exercise of a n y a u t h o r i t y u n d e r this section
shall be liable u p o n s u m m a r y conviction to a p e n a l t y not
exceeding five p o u n d s .
3 0 . (1) A p e r s o n who wilfully, f r a u d u l e n t l y or by
culpable negligence injures, or suffers to be injured any
pipe, meter, fitting, appliance or other a p p a r a t u s belong­
ing to a g a s company, or a l t e r s the index of a n y m e t e r ,
or p r e v e n t s a n y m e t e r from duly r e g i s t e r i n g the q u a n t i t y
of gas supplied or i n t e r f e r e s with any m e t e r or with a n y
seal affixed to a n y m e t e r o r p i p e ; or fraudulently a b s t r a c t s ,
causes to be w a s t e d or diverted, consumes or uses gas
supplied by a gas c o m p a n y shall be guilty of an offence
a n d shall on s u m m a r y conviction be liable to a p e n a l t y
not exceeding fifty p o u n d s or to i m p r i s o n m e n t for a t e r m
not exceeding twelve m o n t h s , and shall (without p r e j u ­
dice to a n y other r i g h t or r e m e d y for the protection of
the g a s c o m p a n y or the p u n i s h m e n t of the offender), for
e v e r y such offence, forfeit a n d p a y to the g a s company
a sum not exceeding twenty-five p o u n d s , a n d the company
m a y , in addition t h e r e t o recover the a m o u n t of any
d a m a g e by it sustained.
(2) T h e existence of artificial m e a n s for causing
such a l t e r a t i o n or prevention, or for a b s t r a c t i n g , wast­
ing, diverting, consuming, or u s i n g g a s supplied by a g a s
company W h e n the meter, pipe, fitting, appliance or other
apparatus
a p p a r a t u s is u n d e r the custody or control of the con­
sumer, shall be p r i m a facie evidence t h a t such a l t e r a t i o n ,
p r e v e n t i o n , a b s t r a c t i o n , w a s t e , diversion, consumption o r
u s e ( a s the case m a y be) h a s been fraudulently, know­
ingly, a n d wilfully caused by the consumer.
3 1 . W h e r e a p e r s o n h a s committed a n offence a g a i n s t
section twenty-nine or section t h i r t y of this Act, the g a s
c o m p a n y m a y , until the m a t t e r complained of h a s been
remedied b u t no longer, discontinue the supply of g a s t o
the p e r s o n so offending.
3 2 . If a p e r s o n neglects to p a y a n y sum due by h i m
to a g a s c o m p a n y for g a s supplied, the c o m p a n y m a y ,
after giving reasonable notice of its intention so to do,
discontinue his supply of g a s until such sum, t o g e t h e r
with a n y expenses of the c o m p a n y in discontinuing a n d
reconnecting such supply, a r e fully paid, b u t no longer.
3 3 . A g a s c o m p a n y m a y h i r e to a n y p e r s o n a p r e p a y ­
m e n t m e t e r a n d fittings to be u s e d t h e r e w i t h at such r a t e
not exceeding seven one-hundreds of one p e n n y for each
g a s unit supplied as m a y , from time to time, be fixed by
the Minister.
T h e r a t e shall include the supply, fixing, r e p a i r , m a i n ­
tenance, inspection a n d collection of the said m e t e r a n d
fittings a n d all costs w h a t s o e v e r i n c u r r e d by the c o m p a n y
in connection t h e r e w i t h .
3 4 . (1) N o t w i t h s t a n d i n g the p r o v i s i o n s of the Act
p a s s e d in the eighth y e a r of the r e i g n of H i s l a t e M a j e s t y
K i n g W i l l i a m the F o u r t h , intituled " A n Act for L i g h t i n g
w i t h Gas the T o w n of S y d n e y in the Colony of N e w
S o u t h W a l e s , a n d to enable c e r t a i n p e r s o n s associated
u n d e r the n a m e , style a n d firm of ' T h e A u s t r a l i a n G a s
L i g h t C o m p a n y ' to sue a n d be sued in the n a m e of the
S e c r e t a r y for the time being of the said C o m p a n y , a n d
for o t h e r p u r p o s e s t h e r e i n m e n t i o n e d , " as a m e n d e d by
subsequent A c t s , it shall be lawful for the p r o p r i e t o r s of
T h e A u s t r a l i a n Gas L i g h t C o m p a n y by resolution p a s s e d
a t a n y g e n e r a l m e e t i n g of the c o m p a n y a n d confirmed a s
h e r e i n a f t e r in this subsection p r o v i d e d t o —
(a)
(i) a l t e r the n u m b e r of d i r e c t o r s of the com­
p a n y , but so t h a t the n u m b e r of d i r e c t o r s
shall not exceed s e v e n ;
(ii)
(ii) provide for the election, r e t i r e m e n t , quali­
fication a n d disqualification of d i r e c t o r s ;
(iii) p r o v i d e for the r e m u n e r a t i o n of d i r e c t o r s ;
(b) do or a u t h o r i s e to be done such t h i n g s as relate
to the i n t e r n a l w o r k i n g a n d r e g u l a t i o n of the
c o m p a n y a n d its business a n d a r e not p a r t of
the objects of t h e c o m p a n y a n d could be autho­
rised or covered by the articles of association of
a c o m p a n y r e g i s t e r e d u n d e r the Companies Acts
for the time being in force in the S t a t e of New
South W a l e s :
P r o v i d e d t h a t no such resolution shall become opera­
tive unless confirmed by such p r o p r i e t o r s entitled to vote
a s a r e p r e s e n t in p e r s o n or by p r o x y a t a subsequent
g e n e r a l m e e t i n g of which notice h a s been duly given a n d
held after an i n t e r v a l of not less t h a n fourteen d a y s n o r
m o r e t h a n one m o n t h from the date of the first meeting.
T h e two meetings m a y be convened by one a n d the same
notice, a n d it shall be no objection to such notice t h a t it
only convenes the second m e e t i n g contingently on the
resolution being p a s s e d at the first meeting.
(2) N o t w i t h s t a n d i n g the provisions of the said
Act, t h e said c o m p a n y m a y , after a resolution in t h a t
behalf h a s been p a s s e d a t a n y g e n e r a l m e e t i n g of the
c o m p a n y a n d confirmed a t a subsequent g e n e r a l m e e t i n g
as p r o v i d e d in subsection one of this section—
(a) c a r r y on a n y process for or in connection with
the use or disposal of r e s i d u a l p r o d u c t s or the
p r o d u c t s a r i s i n g from the w o r k i n g up or con­
version of residual p r o d u c t s a n d do all things
incidental t h e r e t o or connected t h e r e w i t h ;
(b) m a n u f a c t u r e a n d r e p a i r m e t e r s , a n d manufac­
t u r e , sell, r e p a i r or deal in furnaces a n d a n y
o t h e r appliances, p a r t s or m a t e r i a l s used in con­
nection w i t h the m a n u f a c t u r e or use of gas o r
residual products;
(c) build, p u r c h a s e , c h a r t e r , r e n t a n d otherwise
acquire ships and vessels for the c a r r i a g e of
coal or o t h e r m a t e r i a l of or r e q u i r e d by the com­
p a n y , or a n y s h a r e s or i n t e r e s t in a n y such ships
or vessels, or m a i n t a i n , r e p a i r , i m p r o v e , alter,
sell, exchange or let out o n hire or c h a r t e r or
otherwise deal with a n d dispose of a n y such
ships, vessels or s h a r e s ;
(d)
(d) p u r c h a s e or acquire a n d hold or dispose of a n y
s h a r e s , stock, d e b e n t u r e s or debenture-stock of
a n y c o m p a n y or body c a r r y i n g on or about to
c a r r y on a n y u n d e r t a k i n g or business which the
c o m p a n y is entitled to c a r r y o n ;
(e) p u r c h a s e or otherwise acquire a n y i n t e r e s t in
a n y p a t e n t s , b r e v e t s d'invention, licenses, con­
cessions a n d the like conferring an exclusive or
non-exclusive or limited r i g h t to use o r a n y
secret or o t h e r i n f o r m a t i o n as to any invention
in relation to the production, distribution a n d
use of g a s or of a n y by-products or residuals
thereof o r therefrom, a n d a n y other invention
which m a y seem to the c o m p a n y capable of being
profitably dealt with, a n d use, exercise, develop
a n d g r a n t licenses in respect of or otherwise
t u r n to account a n y such p a t e n t s , b r e v e t s d'in­
vention, licenses, concessions and the like, a n d
i n f o r m a t i o n aforesaid,
F o r the p u r p o s e s of this subsection the e x p r e s s i o n
" r e s i d u a l p r o d u c t s " m e a n s p r o d u c t s a r i s i n g directly or
indirectly from the m a n u f a c t u r e of g a s .
(3) W h e r e a b o a r d in fixing the s t a n d a r d price of
g a s , is satisfied t h a t a n o p e r a t i o n of the c o m p a n y autho­
rised by subsection two of this section, c a r r i e d out by the
c o m p a n y itself o r by a s u b s i d i a r y company, h a s been
d e t r i m e n t a l to the i n t e r e s t s of p e r s o n s supplied with g a s
by the company, it m a y disallow such p o r t i o n of the
expenses c h a r g e d a g a i n s t the revenue account in relation
to such o p e r a t i o n as it considers reasonable.
F o r the p u r p o s e of this subsection a s u b s i d i a r y com­
p a n y is one in which the company holds, either by itself
or t h r o u g h nominees or t r u s t s , a p r e p o n d e r a n c e of the
v o t i n g power.
(4) (a) A p r o p r i e t o r of T h e A u s t r a l i a n Gas
Light C o m p a n y at a g e n e r a l or special m e e t i n g of the
c o m p a n y shall h a v e the r i g h t of voting either p e r s o n a l l y
or by p r o x y in m a n n e r following, t h a t is to s a y : —
F o r e v e r y five s h a r e s or p o r t i o n thereof held by him
u p to one h u n d r e d s h a r e s , one vote.
F o r every ten s h a r e s or p o r t i o n thereof beyond the
first one h u n d r e d s h a r e s u p to two h u n d r e d
s h a r e s , one vote.

(c) A c o r p o r a t i o n being a p r o p r i e t o r m a y
a p p o i n t as its p r o x y one of its officers, t h o u g h not a p r o ­
p r i e t o r of the company.
(5) T h e Act r e f e r r e d to in subsection one of this
section as a m e n d e d by subsequent A c t s including this
Act m a y be cited as the A u s t r a l i a n Gas L i g h t C o m p a n y
Acts, 1837-1935.

3 5 . T h e Local G o v e r n m e n t Act, 1919, as amended by

description, or type of wire, cable, appliance,
fitting, m e t e r , i n s u l a t o r , a p p a r a t u s or m a t e r i a l ,
intended, suggested or designed for use in or for
p u r p o s e s of or for connection to a n y electrical
installation, which shall not after a d a t e speci­
fied in such p r o c l a m a t i o n be sold, h i r e d or ex­
p o s e d for sale or hire or a d v e r t i s e d for sale or
h i r e in any a r e a unless such t y p e , description,
or class of wire, cable, appliance, fitting, meter,
insulator, a p p a r a t u s or m a t e r i a l h a s been a p ­
proved of by the p r e s c r i b e d a u t h o r i t y .

(2) A n y p e r s o n who in a n y area, after
the d a t e so specified, sells, h i r e s or exposes for
sale or hire or a d v e r t i s e s for sale or hire or
causes to be sold or h i r e d or exposed or adver­
tised for sale or h i r e a n y wire, cable appliance,
fitting, m e t e r , insulator, a p p a r a t u s or m a t e r i a l
of the class, description or t y p e p r e s c r i b e d in
such p r o c l a m a t i o n shall, unless such t y p e , de­
scription or class of wire, cable, appliance, fit­
ting, m e t e r , i n s u l a t o r , a p p a r a t u s or m a t e r i a l
h a s been a p p r o v e d of by the p r e s c r i b e d autho­
r i t y , be guilty of a n offence a g a i n s t this Act.
(3) F o r the p u p o s e s of this section the
ordinances m a d e in t h a t behalf m a y p r o v i d e for
a p p r o v a l of a type, description or class of
electric w i r e or cable or electrical appliance,
fitting, m e t e r , insulator, a p p a r a t u s or m a t e r i a l
being signified by a p p r o v a l of a sample thereof
or by a n y other m e a n s whatsoever.
(4) I n this section the w o r d " a r e a "
includes the city of S y d n e y a n d the W e s t e r n
Division.
512B. A n y p e r s o n who unlawfully a n d mali­
ciously cuts or i n j u r e s a n y electric line or w o r k
erected in p u r s u a n c e of a n y a u t h o r i t y conferred
by or u n d e r this Act, with intent to cut off a n y
s u p p l y of electricity, shall be guilty of felony,
a n d be liable to be kept in p e n a l s e r v i t u d e for
a n y t e r m not exceeding t h r e e y e a r s , or to be im­
p r i s o n e d , with or w i t h o u t h a r d labour, for a n y
t e r m n o t exceeding one y e a r , b u t n o t h i n g in t h i s
section shall exempt a p e r s o n in respect of a n y
offence which is p u n i s h a b l e u n d e r a n y o t h e r
provision of this Act, or u n d e r a n y other Act,
or a t common law, so t h a t no p e r s o n be p u n i s h e d
twice for the same offence.
512c. A n y p e r s o n who wilfully and unlawfully
removes, d e s t r o y s , or d a m a g e s a n y electric line
or a n y pillar, post, l a m p , m e t e r , fitting, i n s u l a t o r ,
a p p a r a t u s or w o r k s connected w i t h or r e l a t i n g
to the s u p p l y of electricity by the council or
a n y o t h e r p e r s o n or who wilfully a n d unlawfully
extinguishes
extinguishes a n y of the public l a m p s or lights
m a i n t a i n e d by the council or a n y o t h e r p e r s o n
shall be guilty of a n offence, a n d shall on
s u m m a r y conviction be liable to a p e n a l t y not
exceeding fifty p o u n d s or to i m p r i s o n m e n t for
a t e r m n o t exceeding twelve m o n t h s , a n d shall
(without prejudice to a n y o t h e r r i g h t or r e m e d y
for the protection of the council or such o t h e r
p e r s o n or the p u n i s h m e n t of t h e offender) for
each such offence forfeit a n d p a y to the council
or such o t h e r person, as the case m a y be, a
s u m not exceeding twenty-five p o u n d s , a n d the
council or such p e r s o n m a y in addition t h e r e t o
recover the a m o u n t of a n y d a m a g e sustained.
512D. A n y p e r s o n who carelessly or accident­
ally breaks, t h r o w s down, or d a m a g e s a n y
electric line, or a n y pillar, post, l a m p , m e t e r ,
fittings, insulator, a p p a r a t u s or works belong­
i n g to the council or a n y p e r s o n s u p p l y i n g elec­
tricity shall forfeit a n d p a y such sum of money
to the council or such p e r s o n for the d a m a g e
done not exceeding fifty p o u n d s as a s t i p e n d i a r y
or police m a g i s t r a t e shall think r e a s o n a b l e :
P r o v i d e d t h a t this section shall not affect a n y
other r e m e d y the council or such p e r s o n
s u p p l y i n g electricity m i g h t otherwise have.
512E. (1) A n y p e r s o n who wilfully or fraudu­

exceeding twelve m o n t h s , a n d shall (without
prejudice to a n y o t h e r r i g h t or r e m e d y for t h e
protection of the council, or such other p e r s o n ,
or
or the p u n i s h m e n t of the offender) for every
such offence, forfeit a n d p a y to the council, or
such o t h e r person, as the case m a y be, a sum
not exceeding twenty-five p o u n d s , a n d the
council or such p e r s o n m a y in addition t h e r e t o
recover the a m o u n t of a n y d a m a g e sustained.
(2) T h e existence of artificial m e a n s

fraudulently, knowingly a n d wilfully caused by
the consumer.
512F. (1) W h e r e a p e r s o n h a s committed an
offence a g a i n s t section 512E of this Act the
council or p e r s o n s u p p l y i n g the electricity (as
the case m a y be) may, until the m a t t e r com­
p l a i n e d of h a s been remedied, b u t no longer,
discontinue the supply of electricity.
(2) If a p e r s o n neglects to p a y any s u m
due b y h i m to t h e council or p e r s o n s u p p l y i n g
electricity, for electricity supplied, the council
or p e r s o n (as the case m a y be) m a y , a f t e r giving
reasonable notice of its intention so to do, dis­
continue his supply of electricity u n t i l such sum,
t o g e t h e r with a n y expenses i n c u r r e d by the
c o m p a n y or such p e r s o n in discontinuing such
supply, a r e fully paid, b u t no longer.
512G. W h e r e a n y electric line, m e t e r , fitting,
i n s u l a t o r , a p p a r a t u s , or w o r k belonging to the
council or a n y o t h e r p e r s o n is placed in or u p o n
a n y place or building (not being in the posses­
sion of the council or such p e r s o n ) for the
p u r p o s e of s u p p l y i n g electricity, such electric
line, m e t e r , fitting, insulator, a p p a r a t u s or w o r k
shall not be taken i n execution u n d e r a n y process
of a court of law or equity.
N o t h i n g in this section shall affect a n y execu­
tion lawfully issued a g a i n s t the council or such
person.
DIVISION
Electricity
Committee.
DIVISION 2B.-—The
Advisory
512H. (1) There shall be a committee which
shall he called the Electricity Advisory Com­
mittee.
(2) The Committee shall consist of the
following members:—
(a) the person for the time being holding the
office of Under-Secretary for Local Gov­
ernment, who shall be Chairman of the
Committee;
(b) the person for the time being holding the
office of general manager of the Sydney
County Council;
(c) the person for the time being holding the
office of Chief Electrical Engineer of the
Public Works Department;
(d) the person for the time being holding
the office of Chief Electrical Engineer,
Department of Railways;
(e) an alderman or councillor, who shall be
appointed by the Governor, and shall he
selected from a panel of four persons
nominated jointly by the executive com­
mittee of the Shires Association of New
South Wales and the executive committee
of the Local Government Association of
New South Wales;
(f) two persons each of whom is the holder of
a certificate as an electrical engineer
under this Act, and is in charge of the
electricity undertaking of a county shire
or municipal council. Such persons shall
be appointed by the Governor and shall
be selected from a panel of four persons
nominated jointly by the executive com­
mittee of the Shires Association of New
South Wales and the executive committee
of the Local Government Association of
New South Wales;
(g)
(g) two p e r s o n s who shall be a p p o i n t e d by
t h e G o v e r n o r a n d shall be selected from
a p a n e l of four p e r s o n s n o m i n a t e d by
t h e S y d n e y C h a m b e r of C o m m e r c e ;
(h) two p e r s o n s who shall be a p p o i n t e d by
t h e G o v e r n o r a n d shall be selected from
a p a n e l of four p e r s o n s n o m i n a t e d b y the
C h a m b e r of M a n u f a c t u r e s of New South
Wales ;
(i) two p e r s o n s who shall be a p p o i n t e d by
the Governor, one selected from a p a n e l
of t h r e e n o m i n a t e d by the Electrical
T r a d e s U n i o n of A u s t r a l i a , New S o u t h
Wales Branch.
(3) T h e p r o v i s i o n s of t h e Public Ser­
vice Act, 1902, or a n y A c t a m e n d i n g t h a t A c t
shall n o t a p p l y to t h e a p p o i n t m e n t of a n y
m e m b e r of the c o m m i t t e e ; a n d a m e m b e r of t h e
committee shall not in his c a p a c i t y as a m e m b e r
be subject to t h e provisions of a n y such Act.
(4) T h e m e m b e r s of the committee
a p p o i n t e d b y the G o v e r n o r shall, subject to this
Act, hold office for a t e r m of t h r e e y e a r s f r o m
the d a t e of t h e i r a p p o i n t m e n t a n d be eligible
for r e - a p p o i n t m e n t from time to t i m e for a like
term.
E v e r y p a n e l constituted u n d e r subsection two
of this section shall be constituted in the m a n n e r
a n d within the time p r e s c r i b e d b y ordinance,
a n d shall be accompanied by the w r i t t e n consent
of each p e r s o n whose n a m e is included on t h e
p a n e l to serve on the committee if a p p o i n t e d .
If within the time p r e s c r i b e d a valid p a n e l h a s
not been constituted by the a u t h o r i t y entitled
to constitute such panel, the G o v e r n o r m a y
a p p o i n t a p e r s o n or p e r s o n s as the case m a y
r e q u i r e to be the r e p r e s e n t a t i v e or r e p r e s e n ­
t a t i v e s on the committee of such a u t h o r i t y .
On the occurrence of a v a c a n c y in the office
of a n y m e m b e r a p p o i n t e d b y the G o v e r n o r a
m e m b e r p o s s e s s i n g t h e n e c e s s a r y qualifications
shall
shall be a p p o i n t e d by the G o v e r n o r for t h e
r e m a i n d e r of the u n e x p i r e d t e r m of the v a c a n t
office.
(5) A m e m b e r of the committee a p ­
p o i n t e d by the G o v e r n o r shall be deemed to h a v e
vacated his oflice if he resigns from the com­
m i t t e e by w r i t i n g u n d e r his h a n d a d d r e s s e d to
the Governor, or is removed by the G o v e r n o r
from his office, or is absent from t h r e e consecu­
tive o r d i n a r y meetings of the committee except
with leave g r a n t e d by the committee.
(6) T h e c h a i r m a n shall p r e s i d e at all
meetings of the committee. I n the absence of
the c h a i r m a n from a n y m e e t i n g the m e m b e r s
p r e s e n t shall elect a n acting c h a i r m a n to
p r e s i d e at t h a t meeting.
If the v o t i n g on a n y question at a m e e t i n g is
equal the c h a i r m a n , or in his absence the acting
c h a i r m a n , shall have a casting vote in addition
to his deliberative vote a s a m e m b e r of the
committee.
(7) The p r o c e d u r e for the calling of
m e e t i n g s of the committee a n d for the conduct
of such meetings shall, subject to a n y ordinances
m a d e in t h a t behalf, be as d e t e r m i n e d by the
committee.
(8) Seven m e m b e r s of the committee
shall form a quorum, a n d a n y duly convened
m e e t i n g a t which a q u o r u m is p r e s e n t shall be
competent to t r a n s a c t a n y business of the
committee.
(9) T h e •committee shall keep p r o p e r
m i n u t e s of its proceedings, the custody of which
shall be in the h a n d s of the c h a i r m a n .
512i. (1) I t shall be the d u t y of the com­
mittee—
(a) to consider such m a t t e r s r e l a t i n g to
the generation, t r a n s m i s s i o n , supply, a n d
use of electricity as m a y be r e f e r r e d to it
by t h e Minister, a n d to furnish r e p o r t s
to and advise the Minister thereon ;
(b)
(b) to f u r n i s h such i n f o r m a t i o n concerning
finance, statistics, s t a n d a r d s a n d t e s t i n g
in r e l a t i o n t o electricity as the Minister
m a y r e q u i r e or a s m a y be p r e s c r i b e d ;
(c) to devise schemes for the co-ordination
h a v i n g r e g a r d to efficiency a n d economy
of the s u p p l y of electricity t h r o u g h o u t
t h e S t a t e a n d in p a r t i c u l a r p a r t s of the
S t a t e , a n d to furnish the Minister with
details of such s c h e m e s ;
(d) to consider the advisability of a m e n d i n g
the law r e l a t i n g to the generation, t r a n s ­
mission, supply a n d use of electricity, a n d
to r e p o r t t h e r e o n to the Minister. A n y
such r e p o r t shall be accompanied by a
d r a f t of the legislation (including regula­
tions, ordinances, by-laws, a n d the like)
n e c e s s a r y to give effect to the c o m m i t t e e ' s
report;
(e) to c a r r y out such functions of a n a d v i s o r y
c h a r a c t e r a s m a y be prescribed.
(2) W h e r e by this or a n y other Act or
by a n y ordinance, r e g u l a t i o n or by-law m a d e
u n d e r a n y Act, the a p p r o v a l of the G o v e r n o r is
r e q u i r e d to be given to a n y p r o p o s a l r e l a t i n g
to electricity or to the g e n e r a t i o n , t r a n s m i s s i o n ,
supply or d i s t r i b u t i o n thereof, such a p p r o v a l
shall not be given unless a n d until the p r o p o s a l
has been r e f e r r e d to the committee for con­
sideration.
(b)
(i) by omitting p a r a g r a p h (h) of section five
h u n d r e d a n d t h i r t e e n a n d by i n s e r t i n g in
lieu thereof the following new p a r a ­
g r a p h s :—
(h) t h e examination, testing, a p p r o v a l a n d
s t a m p i n g or labelling and the withholding
a n d w i t h d r a w a l of a p p r o v a l of a n y t y p e ,
description
description or class of wire, cable, appli­
ance, m e t e r , fitting, i n s u l a t o r , a p p a r a t u s
a n d / o r m a t e r i a l intended, s u g g e s t e d or
designed for use for p u r p o s e s of or for
connection to a n y electrical installation
(h1) p r e s c r i b i n g s t a n d a r d s for electric w i r e s
a n d cables a n d for the m a t e r i a l s u s e d in
the m a n u f a c t u r e of electrical appliances,
meters,
fittings,
insulators,
and/or
apparatus;
(h2) the fees to be c h a r g e d for t h e examina­
tion, testing, a n d / o r a p p r o v a l of a n y t y p e ,
description or class of wire, cable, a p p l i ­
ance, m e t e r , fitting, i n s u l a t o r , a p p a r a t u s
a n d / o r m a t e r i a l intended, suggested, or
designed for use for p u r p o s e s of or for
connection to a n y electrical i n s t a l l a t i o n ;
(h2a) p r e s c r i b i n g the f o r m a n d basis of
c h a r g i n g for electricity a n d the m e t h o d s
to be a d o p t e d in fixing such c h a r g e s a n d
p r e s c r i b i n g times for revising
such
charges;
(h3) p r o h i b i t i n g interference by u n a u t h o r i s e d
p e r s o n s with any electric wire, cable, a n d /
or m e t e r a n d / o r a n y prescribed electrical
appliance, fitting, i n s u l a t o r a n d / o r a p ­
paratus ;
(h4) c o n f e r r i n g upon any council or upon a n y
person s u p p l y i n g electricity in a n y a r e a
the power to refuse or discontinue the
supply of electricity w h e r e the conditions
of such supply m a y be d a n g e r o u s to life,
health, or p r o p e r t y , a n d r e g u l a t i n g the
exercise of such p o w e r ;
(h5) r e q u i r i n g the periodical inspection b y
the a u t h o r i t y s u p p l y i n g electricity of
electrical
wires,
cables,
appliances,
m e t e r s , fittings, i n s u l a t o r s a n d a p p a r a t u s
installed
installed in, on, over or u n d e r public
or p r i v a t e p r e m i s e s , a n d in, on, u n d e r or
over public places or public r e s e r v e s ;
(h6) the safety of p e r s o n s employed in or
a b o u t electric g e n e r a t i n g stations or in
the installation of electric w i r e s , cables,
appliances, m e t e r s , fittings, i n s u l a t o r s , or
a p p a r a t u s in, on, u n d e r or over public or
p r i v a t e p r e m i s e s , or in, on, u n d e r or over
public places or public r e s e r v e s ;
(h7) p r e s c r i b i n g s t a n d a r d s for the voltages to
be m a i n t a i n e d a t the t e r m i n a l s of
consumers
of
electric
current
and
p r e s c r i b i n g s t a n d a r d s a n d rules for the
installation of electric wires, cables, ap­
pliances, m e t e r s , fittings, i n s u l a t o r s , or
a p p a r a t u s in, on, u n d e r or over public
or p r i v a t e p r e m i s e s , or in, on, u n d e r or
over public places or public r e s e r v e s , a n d
the a l t e r a t i o n , r e p a i r or r e n e w a l t h e r e o f ;
(ii) by i n s e r t i n g a t the end of the same section
the following new s u b s e c t i o n s : —
(2) A n ordinance m a d e u n d e r the
a u t h o r i t y of p a r a g r a p h ( h 1 ) , p a r a g r a p h
( h 5 ) , p a r a g r a p h (h6), or p a r a g r a p h (h7)
of subsection one of this section shall bind
the Crown if expressed so to do.
(3) A n ordinance m a d e in relation to
a n y of the m a t t e r s r e f e r r e d to in p a r a ­
g r a p h s (h) to (h7) (both inclusive) of
subsection one of this section m a y a d o p t
wholly or p a r t i a l l y or by reference any
of t h e s t a n d a r d rules recommended or
a d o p t e d by the S t a n d a r d s Association of
A u s t r a l i a r e l a t i n g to t h e m a t t e r with
which the ordinance deals.
(c) by i n s e r t i n g at the end of section five h u n d r e d
a n d ninety-one the following p a r a g r a p h : —

councils
as to gas

electricity.
3 6 . T h e Local G o v e r n m e n t Act, 1919, as amended by
subsequent Acts, is f u r t h e r amended—
(a) by i n s e r t i n g a t the end of subsection four of
section four h u n d r e d a n d eighteen t h e following
w o r d s : " B e f o r e e n t e r i n g into an a g r e e m e n t with
the council of a n o t h e r a r e a for the extension
into such area, of a t r a d i n g u n d e r t a k i n g r e f e r r e d
to in p a r a g r a p h (a) or p a r a g r a p h (b) of sub­
section one of this section, the council p r o p o s i n g
so to extend the t r a d i n g u n d e r t a k i n g shall submit
the p r o p o s a l with such details a s m a y be
prescribed to the Governor, a n d shall not proceed
with the p r o p o s a l until the G o v e r n o r ' s a p p r o v a l
of the a g r e e m e n t is signified in w r i t i n g
thereon " ;
(b) by i n s e r t i n g a t the end of subsection two of
section five h u n d r e d a n d six the following w o r d s :
" I n the case of a supply of g a s or electricity
t h i s section shall not be acted upon unless with
the a p p r o v a l of the G o v e r n o r as provided in
subsection four of section four h u n d r e d and
eighteen of this A c t " ;
(c) by i n s e r t i n g a t the end of section four h u n d r e d
a n d eighteen the following new subsection:—
(7) The council shall not e n t e r into a n a g r e e ­
m e n t to supply g a s or electricity in bulk to
a n o t h e r council or to take a supply of g a s or
electricity in bulk from a n o t h e r council or from
a n y p e r s o n or a u t h o r i t y unless the p r o p o s a l
to give or take such supply is submitted to
the Governor, a n d t h e G o v e r n o r h a s a p p r o v e d
of the p r o p o s a l , a n d a n y a g r e e m e n t for such
supply entered into a f t e r the commencement
of the Gas a n d Electricity Act, 1935. shall
n o t be binding on either p a r t y n o r shall it have
a n y force or effect in law or equity unless a n d
until the a p p r o v a l of the Governor is signified in
w r i t i n g thereon.

3 7 . T h e Local G o v e r n m e n t Act, 1919, as a m e n d e d by
subsequent Acts, is f u r t h e r a m e n d e d by i n s e r t i n g after
section four h u n d r e d and twenty-two the following new
section:—
422A. (1) N o t w i t h s t a n d i n g a n y t h i n g contained in
this or a n y other Act, no p e r s o n or Council shall, in
a n y a r e a , construct or establish an electricity
g e n e r a t i n g s t a t i o n or i n s t a l an additional m a i n
g e n e r a t i n g u n i t or construct or e x t e n d a m a i n t r a n s ­
mission line, except with the consent of the G o v e r n o r
a n d in accordance with a n y conditions or stipulations
which m a y be specified in such consent.
(2) A n y p e r s o n who or Council which con­
t r a v e n e s a n y p r o v i s i o n of this section shall be liable
to a p e n a l t y not exceeding five h u n d r e d p o u n d s .
(3) A n y p e r s o n who or Council which uses
for or in connection with the g e n e r a t i n g or s u p p l y
of electricity a n y electricity g e n e r a t i n g s t a t i o n or
a d d i t i o n a l m a i n g e n e r a t i n g unit or m a i n t r a n s m i s ­
sion line constructed, established, installed or ex­
tended in c o n t r a v e n t i o n of this section shall be liable
to a p e n a l t y not exceeding fifty p o u n d s for each d a y
d u r i n g which the same is so used.
(4) T h i s section shall n o t a p p l y to or in
respect of a n y electricity g e n e r a t i n g s t a t i o n or t r a n s ­
mission line not o p e r a t e d for or in connection with a
s u p p l y of electricity to the p u b l i c ; n o r shall it a p p l y
to or in r e s p e c t of a n y t r a n s m i s s i o n line which is
c o n s t r u c t e d or extended within the b o u n d a r i e s of a n y
a r e a by a p e r s o n or council lawfully s u p p l y i n g
electricity to the public in such a r e a , a n d is so con­
s t r u c t e d or extended solely for or in connection w i t h
such supply.

SUPPLY
OF ELECTRICITY I N T H E C I T Y OF SYDNEY AND
CERTAIN OTHER AREAS.

1—Preliminary.
3 8 . ( 1 ) T h i s P a r t shall bo r e a d a n d c o n s t r u e d with
t h e Local G o v e r n m e n t A c t , 1 9 1 9 , a s a m e n d e d b y subse­
quent Acts.
(2) T h e Local G o v e r n m e n t Act, 1 9 1 9 , a s so

3 9 . ( 1 ) T h e S y d n e y C o u n t y District a n d t h e Syd­

county council constituted u n d e r P a r t X X I X of t h e

the m e a n i n g of t h a t A c t .

such supplier.
(3) (a) W h e r e a n a r e a or p a r t of a n a r e a is in­
cluded in the S y d n e y County District u n d e r the provisions
of subsection two of this section u p o n the t e r m i n a t i o n of
a n y electricity franchise existing in such a r e a or p a r t of
a n a r e a , the S y d n e y C o u n t y Council m a y p u r c h a s e from
the holder of such franchise t h e reticulation a n d equip­
m e n t used in connection w i t h the supply t h e r e t o f o r e
c a r r i e d on in such a r e a or p a r t of a n a r e a , u p o n such
t e r m s a n d conditions as m a y be a g r e e d upon.
(b) T h e provisions of p a r a g r a p h (a) of t h i s
subsection shall not be construed to limit in a n y w a y a n y
power or a u t h o r i t y in r e l a t i o n to the p u r c h a s e of reticu­
lation or equipment which the S y d n e y C o u n t y Council
could h a v e exercised if p a r a g r a p h (a) of this subsection
h a d not been enacted.
(4) W h e r e the council of a n y a r e a is c a r r y i n g on
a n electricity u n d e r t a k i n g or w h e r e in a n y a r e a a n elec­
t r i c i t y u n d e r t a k i n g is being c a r r i e d on u n d e r a franchise
a n d such a r e a is included in the S y d n e y C o u n t y Council
D i s t r i c t u n d e r the provisions of subsection two of this
section—
(a) the provisions of subsections two a n d t h r e e of
section forty-seven of this Act, and
(b) the provisions of section forty-eight of this Act,
and
(c) the provisions of section forty-nine of t h i s Act
with r e g a r d to a joint committee,
shall m u t a t i s m u t a n d i s apply.

3—Constitution of Sydney
County
Council.
4 1 . U p o n a d a y to be a p p o i n t e d by the G o v e r n o r a n d
notified by p r o c l a m a t i o n published in the Gazette t h e r e
shall be constituted a C o u n t y Council u n d e r t h e n a m e of
" The S y d n e y County Council " which shall h a v e a n d
exercise
exercise the p o w e r s , a u t h o r i t i e s , duties, a n d functions
conferred a n d imposed u p o n it by or u n d e r this P a r t of
t h i s Act.
4 2 . (1) The Sydney County Council shall consist of
five councillors, who shall be elected a s in this P a r t
provided.
(2) E a c h councillor shall be elected to r e p r e s e n t
a constituency.
(3) E a c h constituency shall comprise the a r e a s
g r o u p e d t h e r e i n respectively a s set out in Schedule
T h r e e to this Act, a n d each constituency shall r e t u r n the
n u m b e r of councillors indicated in t h a t Schedule.
(4) The G o v e r n o r where the S y d n e y County Dis­
t r i c t is a l t e r e d by the inclusion t h e r e i n of an additional
a r e a or p a r t thereof shall by p r o c l a m a t i o n published in
the Gazette include the a r e a or p a r t included in the
S y d n e y C o u n t y D i s t r i c t in one of the constituencies.
4 3 . (1) Councillors shall be elected by the a l d e r m e n
a n d / o r councillors of the a r e a s comprised in each
constituency.
(2) A n y p e r s o n shall be eligible for election a s a
councillor if at the time of the holding of the election he
is eligible to be elected as an a l d e r m a n or councillor of
a n y of the a r e a s for the time being comprised in a n y
•constituency u n d e r this P a r t a n d would n o t be disquali­
fied to hold office if elected as a councillor of the S y d n e y
C o u n t y Council.
4 4 . The office of a councillor shall—
(a) commence on the d a y of his election as council­
lor; and
•(b) become vacant on the d a y a p p o i n t e d for the next
o r d i n a r y election of councillors or upon the
occurrence of an e x t r a o r d i n a r y vacancy, which­
ever h a p p e n s first.
T h e election of councillors shall be c a r r i e d out a n d
c o n d u c t e d a n d the r e s u l t thereof notified to the Governor
in the m a n n e r p r e s c r i b e d by ordinances m a d e u n d e r the
P r i n c i p a l Act in t h a t behalf.
4 5 . (1) T h e first o r d i n a r y election of councillors

b y the S y d n e y C o r p o r a t i o n Act, 1932-1934, for the g e n e r a l
election of a l d e r m e n of the City of Sydney.
(3) A n election to fill an e x t r a o r d i n a r y vacancy
shall be held u p o n a d a y fixed a n d a d v e r t i s e d by the
r e t u r n i n g officer being within two m o n t h s after t h e
occurrence of the vacancy.
(4) If a vacancy in the office of a councillor
continues after the time p r e s c r i b e d for election t h e r e t o ,
the G o v e r n o r m a y a p p o i n t a n y qualified p e r s o n to t h e
v a c a n t office: P r o v i d e d t h a t where he deems it expedient
the M i n i s t e r m a y a u t h o r i s e the holding of an election t o
fill the v a c a n t office.
4 6 . (1) F o r the p u r p o s e s of the first o r d i n a r y election
of councillors, the G o v e r n o r m a y a p p o i n t a r e t u r n i n g
officer a n d such d e p u t y r e t u r n i n g officers, poll clerks, a n d
a s s i s t a n t s as he m a y deem necessary.
(2) T h e expenses i n c u r r e d in the conduct of such
election shall when certified u n d e r the h a n d of the r e t u r n ­
i n g officer be p a i d out of the Consolidated Revenue F u n d .
T h e a m o u n t of such expenses shall be r e p a i d by t h e
S y d n e y C o u n t y Council within six m o n t h s after t h e
account t h e r e f o r is r e n d e r e d to the council by the Colonial
Treasurer.

and of certain
other
relating to electricity supply,
etc.

4 7 . (1) U p o n a n d after a d a y to be a p p o i n t e d b y t h e
G o v e r n o r a n d notified by p r o c l a m a t i o n published in t h e
Gazette (in this Division r e f e r r e d to as " t h e a p p o i n t e d
d a y " ) t h e p o w e r s , a u t h o r i t i e s , duties, a n d functions of
t h e Municipal Council of Sydney in relation to or in
connection with the electricity u n d e r t a k i n g of t h a t Council
shall be exercised a n d p e r f o r m e d by the S y d n e y C o u n t y
Council which Council shall be on a n d after the said
a p p o i n t e d d a y t h e a u t h o r i t y to c a r r y out t h e Municipal
Council of S y d n e y E l e c t r i c L i g h t i n g Act, 1896-1928, a n d
shall h a v e the p o w e r conferred on the said Municipal
Council of S y d n e y b y section two h u n d r e d a n d n i n e t y t h r e e of the S y d n e y C o r p o r a t i o n Act, 1932-1934.
The
T h e a p p o i n t e d d a y shall be n o t l a t e r t h a n six m o n t h s
after the d a y a p p o i n t e d in p u r s u a n c e of section forty-one
o f this A c t for the constitution of the S y d n e y C o u n t y
Council.
(2) U p o n a n d from the a p p o i n t e d d a y such officers
a n d s e r v a n t s of the Municipal Council of S y d n e y as the
G o v e r n o r , u p o n the r e c o m m e n d a t i o n of the j o i n t com­
mittee p u r s u a n t to section forty-nine of this Act m a y
d i r e c t a n d such officers and s e r v a n t s of the Municipal
Council of Sydney as a r e t r a n s f e r r e d or a p p o i n t e d to
t h e service of the Sydney County Council between the
commencement of this P a r t a n d the a p p o i n t e d d a y shall
become a n d be the s e r v a n t s of the S y d n e y County
Council.
A n y officer or s e r v a n t so t r a n s f e r r e d or a p p o i n t e d shall
r e t a i n a n d shall have a n d enjoy the same r i g h t s a n d
privileges, if any, with r e g a r d to a n n u a l , sick, deferred,
a n d extended leave, as if he h a d continued an officer or
s e r v a n t of the Municipal Council of S y d n e y d u r i n g the
p e r i o d of his service with the S y d n e y County Council.
A n y officer or s e r v a n t so t r a n s f e r r e d or a p p o i n t e d who,
u p o n such t r a n s f e r does n o t become a p e r m a n e n t s e r v a n t
w i t h i n the m e a n i n g of the Local G o v e r n m e n t ( S u p e r ­
a n n u a t i o n ) Act, 1927, shall r e t a i n the same r i g h t s a n d
privileges in relation to p a y m e n t s on r e t i r e m e n t or death
a s if he h a d continued to be a n officer or s e r v a n t of t h e
Municipal Council of S y d n e y d u r i n g the p e r i o d of his
s e r v i c e with the S y d n e y C o u n t y Council.
A n y officer or s e r v a n t so t r a n s f e r r e d or a p p o i n t e d who
u p o n such t r a n s f e r or a t a n y time t h e r e a f t e r becomes a
p e r m a n e n t s e r v a n t within the m e a n i n g of the Local
G o v e r n m e n t ( S u p e r a n n u a t i o n ) Act, 1927, a n d who within
t h r e e m o n t h s a f t e r such t r a n s f e r or a f t e r the date u p o n
which he becomes a p e r m a n e n t s e r v a n t as aforesaid ( a s
t h e case m a y r e q u i r e ) , by notice in w r i t i n g a d d r e s s e d to
the S y d n e y C o u n t y Council, so elects, shall be entitled to
r e t a i n the r i g h t s a n d privileges in relation to p a y m e n t s
o n r e t i r e m e n t or death to which he would h a v e been
e n t i t l e d if he h a d continued to be an officer or s e r v a n t
of the Municipal Council of S y d n e y d u r i n g the period of
his
his service w i t h the S y d n e y County Council. T h e p r o ­
visions of the Local G o v e r n m e n t ( S u p e r a n n u a t i o n ) A c t
1927, shall n o t a p p l y to or in respect of a n y officer or
s e r v a n t who makes such election a s aforesaid.
No officer or s e r v a n t so t r a n s f e r r e d or a p p o i n t e d u n d e r
this section shall be entitled to claim benefits u n d e r t h i s
Act, as well a s u n d e r a n y o t h e r Act, by-law, or resolution
in respect of the same p e r i o d of service.
W h e r e a n y condition of employment of a n y officer or
s e r v a n t so t r a n s f e r r e d or a p p o i n t e d to the S y d n e y County
Council is at the d a t e of his t r a n s f e r or a p p o i n t m e n t
r e g u l a t e d b y a n a w a r d or i n d u s t r i a l a g r e e m e n t , such
condition shall continue to be so r e g u l a t e d until a n a w a r d
b y which the S y d n e y C o u n t y Council is bound is m a d e
b y a competent t r i b u n a l or such condition is r e g u l a t e d
b y an i n d u s t r i a l a g r e e m e n t to which the said Council is
a party.
(3) W h e r e an officer or s e r v a n t of the Municipal
Council of S y d n e y who is employed in or in connection w i t h
t h e E l e c t r i c i t y D e p a r t m e n t of t h a t Council is n o t included
a m o n g the officers a n d s e r v a n t s of the Municipal Council
of S y d n e y who a r e t r a n s f e r r e d to the service of t h e
S y d n e y C o u n t y Council, he shall, if he is not p r o v i d e d
with a position in the service of t h e Municipal Council of
Sydney, be deemed to have been r e t i r e d from his position
by the Municipal Council of Sydney, and shall be entitled
to compensation with r e g a r d to accumulated a n n u a l a n d
extended leave of absence as if he h a d been r e t i r e d from
his f o r m e r position for a n y cause other t h a n an offence
a n d to a. r e t i r e m e n t allowance the equivalent of one
m o n t h ' s p a y at his then nominal r a t e of p a y for each y e a r
of service.
T h i s subsection shall not a p p l y if within a p e r i o d of one
m o n t h the Municipal Council of Sydney or the C o u n t y
Council offers him a n d he accepts a position in its service.
T h e joint committee r e f e r r e d to in section forty-nine
of t h i s Act shall d e t e r m i n e how the expense involved in
p a y i n g compensation in such a case shall be met.
(4) A f t e r the a p p o i n t e d d a y all r e g u l a t i o n s of t h e
G o v e r n o r a n d by-laws of the Municipal Council of S y d n e y
m a d e u n d e r the Municipal Council of S y d n e y E l e c t r i c
L i g h t i n g Act, 1S96-1928, a n d in force on the a p p o i n t e d
day
d a y , so f a r a s they a r e not inconsistent with this
Division, shall continue a n d r e m a i n in force until
r e p e a l e d by ordinances m a d e u n d e r the P r i n c i p a l Act,
a n d a n y reference in such r e g u l a t i o n s or by-laws to the
Municipal Council of Sydney or the Council shall be
deemed to be a reference to the Sydney County Council.
4 8 . On a n d from the said a p p o i n t e d d a y the follow­
ing provisions shall, subject to this Act, have effect:—
(a) All real a n d p e r s o n a l p r o p e r t y a n d all right
a n d i n t e r e s t t h e r e i n a n d all m a n a g e m e n t a n d
control of a n y land or t h i n g which, immediately
before the a p p o i n t e d d a y , is vested in or belongs
to the Municipal Council of Sydney a n d held by
it in connection with the electricity under­
t a k i n g t r a n s f e r r e d by this Act to the Sydney
County Council shall vest in a n d belong to the
S y d n e y C o u n t y Council.
(b) All moneys, liquidated and unliquidated claims
which, immediately before the a p p o i n t e d day,
a r e payable to or recoverable by the Municipal
Council of Sydney in relation to its electricity
u n d e r t a k i n g shall be moneys, liquidated a n d
u n l i q u i d a t e d claims p a y a b l e to or recoverable
by the S y d n e y County Council.
(c) All suits, actions, a n d proceedings p e n d i n g
immediately before the a p p o i n t e d d a y at the
suit of the Municipal Council of S y d n e y in
relation to a n y m a t t e r or claim in r e l a t i o n to
the said electricity u n d e r t a k i n g so t r a n s f e r r e d
shall respectively be suits, actions, a n d p r o ­
ceedings p e n d i n g at the suit of the S y d n e y
County Council.
(d) All c o n t r a c t s , a g r e e m e n t s , a n d u n d e r t a k i n g s
entered into with a n d all securities lawfully
given to or by the Municipal Council of
S y d n e y in respect of the electricity u n d e r ­
t a k i n g so t r a n s f e r r e d a n d in force immediately
before the a p p o i n t e d d a y shall be deemed to
be contracts, a g r e e m e n t s , a n d u n d e r t a k i n g s
e n t e r e d into with a n d securities given to or b y
the Sydney County Council.
(c)
(c) T h e S y d n e y County Council m a y p u r s u e t h e
same remedies for the recovery of any such
moneys a n d claims, a n d for t h e prosecution of
such suits, actions, a n d proceedings as the Muni­
cipal Council of Sydney m i g h t h a v e done but for
this Act.
(f) The S y d n e y C o u n t y Council m a y enforce a n d
realise a n y security or c h a r g e existing imme­
diately before the a p p o i n t e d d a y in favour of
the Municipal Council of S y d n e y in respect of
a n y such moneys a n d claims as if such security
or charge w e r e existing in favour of the Sydney
C o u n t y Council.
(g) All debts due a n d moneys p a y a b l e b y the Muni­
cipal Council of S y d n e y solely r e l a t i n g to the
electricity u n d e r t a k i n g so t r a n s f e r r e d , including
a n y a m o u n t due b y the electric light account to
the City F u n d , a n d all claims liquidated or
u n l i q u i d a t e d recoverable a g a i n s t the Municipal
Council of S y d n e y solely r e l a t i n g to t h e elec­
t r i c i t y u n d e r t a k i n g so t r a n s f e r r e d shall be
debts due a n d moneys p a y a b l e b y a n d claims
recoverable a g a i n s t the S y d n e y C o u n t y Council.
(h) No a t t o r n m e n t by a lessee of a n y land vested in
the S y d n e y County Council by this section shall
be necessary.
4 9 . ( 1 ) D u r i n g the p e r i o d commencing on the d a t e of
t h e constitution of the S y d n e y C o u n t y Council a n d
e n d i n g on the a p p o i n t e d d a y , t h e p o w e r s a n d functions
of the Council shall be limited to the m a t t e r s a n d t h i n g s
following, t h a t is to s a y —
(a) election of a c h a i r m a n ;
(b) the p r o v i s i o n of a n office for the Council;
(c) t h e a p p o i n t m e n t of s e r v a n t s of the Council a n d
t h e o r g a n i s a t i o n of the staff of s e r v a n t s ;
(d) the p r e p a r a t i o n , p e r f o r m a n c e a n d c a r r y i n g into
effect of all such acts, m a t t e r s a n d t h i n g s as in
the opinion of the Council a r e n e c e s s a r y or
expedient in o r d e r to enable the Council to
exercise
exercise all or a n y of the p o w e r s , a u t h o r i t i e s ,
duties, a n d functions vested in the Council by or
u n d e r this A c t ;
(e) the m a k i n g of a r r a n g e m e n t s a n d a g r e e m e n t s in
accordance with this section.
B u t n o t h i n g contained in this subsection shall be con­
s t r u e d so as to limit the exercise by the Council of its
p o w e r s , a u t h o r i t i e s , duties, a n d functions in respect of
a n y of the aforesaid m a t t e r s a n d things after t h e
a p p o i n t e d day.
(2) F o r the p u r p o s e s of c a r r y i n g out the p o w e r s
a n d functions r e f e r r e d to in subsection one of this section,
the Sydney County Council may, with the a p p r o v a l of the
Governor, m a k e use of the services of a n y of the officers
or s e r v a n t s of the Municipal Council of S y d n e y ; a n d the
Municipal Council of S y d n e y shall take all necessary
s t e p s to give effect to such a p p r o v a l .
(3) (a) The Municipal Council of S y d n e y a n d
the S y d n e y County Council shall as soon as practicable
a f t e r the constitution of the S y d n e y County Council
a r r a n g e a n d a g r e e upon a division of the assets, debts,
a n d liabilities of the Municipal Council of S y d n e y so t h a t
the a s s e t s , debts, a n d liabilities to be t r a n s f e r r e d b y this
A c t shall be defined.
(b) E a c h of such Councils m a y for the p u r p o s e s
r e f e r r e d to in p a r a g r a p h (a) of this subsection a p p o i n t
two of i t s m e m b e r s to a joint committee to be convened
by the Governor, a n d to which the Governor m a y a p p o i n t
a r e p r e s e n t a t i v e , who shall be c h a i r m a n .
I n the case of a n y difference between the said councils
such difference shall be d e t e r m i n e d as the Governor shall
direct.
(c) The joint committee shall also d e t e r m i n e
w h a t books, documents, records, a n d p a p e r s shall be
h a n d e d over by the Municipal Council of S y d n e y t o the
S y d n e y C o u n t y Council a n d consider a n d make recom­
m e n d a t i o n s to the G o v e r n o r as to which officers a n d
s e r v a n t s of the Municipal Council of Sydney should be
t r a n s f e r r e d to the service of the Sydney County Council,
a n d how the expense of m e e t i n g the p a y m e n t s on account
of
of leave or upon r e t i r e m e n t or d e a t h of an officer o r
s e r v a n t so t r a n s f e r r e d should be a p p o r t i o n e d between
the Municipal Council of Sydney a n d the S y d n e y County
Council.
(d) W h e r e a n a g r e e m e n t h a s been a r r i v e d a t
or a d e t e r m i n a t i o n m a d e on the m a t t e r s w i t h which such
committee is c h a r g e d a sufficient record thereof shall be
filed in the offices of both of the said Councils a n d a copy
t r a n s m i t t e d to the Minister for r e c o r d p u r p o s e s .
(e) A n y expenses of the joint committee shall
be c h a r g e d to the S y d n e y County Council.
(4) (a) The S y d n e y County Council is hereby
a u t h o r i s e d to expend such moneys as m a y be n e c e s s a r y
for the p u r p o s e of exercising a n d p e r f o r m i n g the p o w e r s
and for t h a t p u r p o s e m a y , with the a p p r o v a l of t h e
Governor, m a k e a r r a n g e m e n t s with any bank or other
financial institution for a t e m p o r a r y loan of the r e q u i r e d
amount.
(b) T h e Colonial T r e a s u r e r is h e r e b y autho­
rised to g u a r a n t e e to such bank or institution the r e p a y ­
ment of the a m o u n t of such t e m p o r a r y loan, with i n t e r e s t
a t the r a t e a g r e e d upon between the Council a n d such
bank o r institution.
5 0 . (1) T h e S y d n e y County Council shall as from the
a p p o i n t e d d a y indemnify a n d keep h a r m l e s s the Muni­
cipal Council of S y d n e y a g a i n s t all claims a g a i n s t t h a t
Council in respect of moneys b o r r o w e d in connection w i t h
the said electricity u n d e r t a k i n g a n d a g a i n s t all claims
for a n y other liabilities i n c u r r e d in respect thereof.
(2) T h e S y d n e y C o u n t y Council shall p a y all
i n t e r e s t accruing due in respect of a n y moneys b o r r o w e d
on account of the said electricity u n d e r t a k i n g a n d m a k e
the contributions r e q u i r e d by law or by any a g r e e m e n t
to the sinking funds established in connection with a n y
loan on account of such u n d e r t a k i n g .
(3) (a) N o t h i n g contained in t h i s P a r t shall p r e ­
judice or affect the security r i g h t s , p o w e r s , a u t h o r i t i e s ,
a n d remedies of a n y holder of a bond, d e b e n t u r e ,
m o r t g a g e deed or o t h e r security given by the Municipal
Council of S y d n e y before the commencement of this P a r t
b u t such holder shall h a v e a n d continue to have d u r i n g
the
the c u r r e n c y of his bond, debenture, m o r t g a g e deed or
o t h e r security the same security r i g h t s , powers, a u t h o r i ­
ties, a n d remedies in respect of the electricity u n d e r ­
t a k i n g and other assets hereby vested in the S y d n e y
C o u n t y Council a n d the revenue t h e r e f r o m as if the said
bond, debenture, m o r t g a g e deed or other security h a d
been given by the Sydney County Council i n s t e a d of by
the Municipal Council of Sydney.
(b) N o t h i n g contained in this P a r t shall
prejudice or affect the r i g h t s a n d remedies, a g a i n s t the
Municipal Council of Sydney its revenues a n d assets, of
the holder of any bond, debenture, m o r t g a g e deed or
other security given by t h a t Council before the com­
mencement of this P a r t .
(4) T h e liability imposed upon the Sydney
County Council by this section shall for the p u r p o s e of
securing the discharge thereof rank in p r i o r i t y over a n y
loan raised by the Sydney County Council.
5 1 . (1) T h e S y d n e y County Council may within the
S y d n e y County District exercise all or any of the powers
conferred on the Municipal Council of Sydney by the
Municipal Council of Sydney Electric L i g h t i n g Act, 18961928, as a m e n d e d by this Act, a n d shall be subject to the
like obligations a n d duties t h r o u g h o u t the Sydney C o u n t y
D i s t r i c t as a r e imposed upon the Municipal Council of
Sydney with r e g a r d to the City of S y d n e y by t h a t Act.
(2) Where the Sydney County Council p r o p o s e s
to exercise such p o w e r s in the City of Sydney or in a n y
local g o v e r n m e n t a r e a , such notice (if any) as is pre­
scribed by the ordinances shall be given to the Municipal
Council of S y d n e y or the council of the a r e a , a n d a n y
r e p r e s e n t a t i o n s received in response to such notice shall
be given consideration by the Sydney County Council.
5 2 . (1) As from the a p p o i n t e d day,
C o r p o r a t i o n Act, 1932-1934, is a m e n d e d —
the
Sydney
(i) by omitting from section one h u n d r e d a n d fiftyone the word " s h a l l " w h e r e first occurring a n d
by i n s e r t i n g in lieu thereof the word " m a y " ;
(ii)
(ii) by omitting from section two h u n d r e d a n d fortysix the words " o r the Municipal Council of Syd­
ney E l e c t r i c L i g h t i n g Act, 1896-1928";
(iii) by omitting from the same section the w o r d s —
" T h e power to p u r c h a s e or r e s u m e lands
conferred u p o n the council by this section
for a n y of the p u r p o s e s of the Municipal
Council of S y d n e y E l e c t r i c L i g h t i n g Act,
1S96-1928, shall be deemed to extend a n d
a l w a y s to h a v e extended to the p u r c h a s e or
r e s u m p t i o n of l a n d s outside the b o u n d a r i e s
of the city as well a s of l a n d s within such
boundaries";
(iv) by omitting from subsection one of section two
h u n d r e d a n d fifty-five the w o r d s " t h e Municipal
Council of S y d n e y E l e c t r i c L i g h t i n g Act or of."
(2) A s from the first d a y of J a n u a r y next a f t e r
the said a p p o i n t e d d a y the S y d n e y C o r p o r a t i o n Act,
1932-1934, is a m e n d e d by i n s e r t i n g a t the end of section
one h u n d r e d a n d fifty-one the following new subsection:—
(2) T h i s section shall extend to the pipes, wires,
cables, a n d rails of the S y d n e y C o u n t y Council.
(3) A s from the first d a y of J a n u a r y next after
the said a p p o i n t e d d a y the Local G o v e r n m e n t Act, 1919,
a s amended by subsequent A c t s , is amended by insert­
i n g a t the end of section one h u n d r e d a n d seventy-one
the following new subsection:—
(2) T h i s section shall extend to the rails, p i p e s ,
w i r e s , poles, cables, tunnels, a n d s t r u c t u r e s of t h e
S y d n e y C o u n t y Council.
5 3 . O r d i n a n c e s m a y be m a d e to c a r r y this Division
into effect, a n d with respect to a n y m a t t e r which by the
Municipal Council of S y d n e y E l e c t r i c L i g h t i n g Act, 18961928, is p e r m i t t e d to be prescribed by r e g u l a t i o n s or by­
laws.
5 4 . (1) A s from the said a p p o i n t e d d a y the Muni­
cipal Council of S y d n e y E l e c t r i c L i g h t i n g Act. 1896-1928,
is amended in the m a n n e r sot out in Schedule F o u r to this
Act.
(2)
(2) After the said a p p o i n t e d d a y the Municipal
Council of S y d n e y E l e c t r i c L i g h t i n g Act, 1896-1928,
as a m e n d e d by this Act, m a y be cited as the Municipal
Council of S y d n e y E l e c t r i c L i g h t i n g Act, 1896-1935.
5 5 . (1) The t r a n s f e r to the Sydney County Council of
the powers, a u t h o r i t i e s , duties a n d functions of t h e
Municipal Council of Sydney u n d e r the Municipal Coun­
cil of S y d n e y E l e c t r i c L i g h t i n g Act, 1896-1928, shall be
deemed to be a delegation w i t h i n the m e a n i n g of section
five h u n d r e d a n d sixty-four of the P r i n c i p a l Act to the
S y d n e y C o u n t y Council of p o w e r to s u p p l y electricity
a n d to supply electrical fittings a n d appliances.
(2) I n addition to such p o w e r s the following
p o w e r s , a u t h o r i t i e s , duties a n d functions of a council
shall be deemed to h a v e been delegated to a n d imposed
on the S y d n e y County Council:—
(a) all the p o w e r s , a u t h o r i t i e s , duties a n d functions
u n d e r section t h r e e h u n d r e d a n d eighty-two of
the P r i n c i p a l Act to construct, extend, protect,
maintain, control a n d m a n a g e w o r k s for the
s u p p l y of electricity, a n d those u n d e r sections
four h u n d r e d a n d sixteen to four h u n d r e d a n d
nineteen both inclusive of the P r i n c i p a l A c t r e ­
l a t i n g to the supply of electricity a n d the supply
of electrical fittings a n d a p p l i a n c e s ;
(b) the power to r a i s e special loans a n d o v e r d r a f t s
for the p u r p o s e of exercising the p o w e r of
s u p p l y i n g electricity a n d of s u p p l y i n g electrical
filings a n d a p p l i a n c e s ;
(c) the p o w e r to m a k e a n d levy a loan r a t e in con­
nection with a n y loan so raised.
(3) F o r the p u r p o s e of m o r e effectually enabling
the S y d n e y C o u n t y Council to exercise the p o w e r s a n d
p e r f o r m the duties conferred and imposed upon it by this
P a r t , the provisions of the P r i n c i p a l Act indicated in
Schedule F i v e shall m u t a t i s m u t a n d i s a p p l y to and in
respect of the S y d n e y C o u n t y Council and the powers
a n d duties conferred a n d imposed upon the Council or
the P r e s i d e n t or M a y o r or S h i r e or Town Clerk or other
s e r v a n t of a S h i r e a n d / o r Municipality b y such p r o ­
visions or by any ordinance m a d e u n d e r or in p u r s u a n c e
of
of such provisions a r e hereby conferred a n d imposed
u p o n the Sydney County Council or t h e C h a i r m a n or
General M a n a g e r or o t h e r s e r v a n t of the County Council,
a s the case m a y r e q u i r e .
(4) (a) T h e Sydney C o u n t y Council m a y a r r a n g e
with the council of a n y a r e a in the S y d n e y County Dis­
trict, including the Municipal Council of Sydney, to
execute within such municipality a n y service r e l a t i n g to
a n y power, a u t h o r i t y , duty, or function t r a n s f e r r e d o r
delegated to the Sydney C o u n t y Council by t h i s or a n y
other Act, with such r e s t r i c t i o n s a n d r e s e r v a t i o n s as to
the S y d n e y County Council m a y seem meet.
Such a r r a n g e m e n t shall be embodied in an a g r e e m e n t
between the council concerned a n d the Sydney C o u n t y
Council, which shall contain such provisions a s m a y be
d e t e r m i n e d by such council and the S y d n e y C o u n t y
Council or as m a y be p r e s c r i b e d by ordinance.
(b) The delegation of a n y power, a u t h o r i t y ,
d u t y , or function m a d e by the S y d n e y County Council to
t h e council of a n y a r e a u n d e r this section shall n o t be
revoked by the S y d n e y County Council except with the
consent of the council of the a r e a concerned.
(c) A n y council m a y e n t e r into a n d execute
any a g r e e m e n t m a d e in p u r s u a n c e of this section.
(5) The P r i n c i p a l Act is a m e n d e d —
(a) by o m i t t i n g p a r a g r a p h (m) of subsection five
of section six h u n d r e d a n d fifty-four;
(b) by i n s e r t i n g a t the end of the same section the
following new subsection:—
(6) I n this section—
(a) a reference to an a r e a shall be deemed
to include a reference to the City of
S y d n e y ; and
(b) a reference to a council shall be deemed
to include a reference to the Municipal
Council of Sydney.

DIVISION
5—Exercise of powers,
etc., of
Council.
5 6 . ( 1 ) Subject to this P a r t the Sydney C o u n t y Coun­
cil shall directly exercise a n d p e r f o r m all a n d every of the
p o w e r s , a u t h o r i t i e s , duties a n d functions of t h a t Council
in relation to the following m a t t e r s , t h a t i s to s a y : —
(a) the m a k i n g of a n y r a t e , the fixing of c h a r g e s or
fees, or the b o r r o w i n g of any m o n e y s ;
(b) the v o t i n g of moneys for e x p e n d i t u r e on the
works, services and o p e r a t i o n s of the Council;
(c) the acquisition, leasing, sale and exchange of
any land or other p r o p e r t y a n d the g r a n t i n g of
any lease of l a n d ;
(d)
subject to the provisions of this Division, the
acceptance of t e n d e r s ;
(e) any p r o p o s a l for the m a k i n g of an o r d i n a n c e ;
(f) the election of the c h a i r m a n of the Council;
( g ) meetings of the Council;
(h) t r a v e l l i n g expenses of m e m b e r s of the Council;
(i) public inquiries o r d e r e d by the Governor or the
Minister;
(j)
a n y application or notice to the Governor or t h e
Minister;
( k ) a w a r d s or i n d u s t r i a l a g r e e m e n t s u n d e r the
I n d u s t r i a l A r b i t r a t i o n Act, 1912, or any amend­
ment thereof, a n d any question as to the p a y m e n t
to a n y s e r v a n t of a n y s a l a r y or w a g e s a t a r a t e
in excess of the r a t e fixed by a n y such a w a r d or
industrial agreement;
(l) subject to the provisions of this Division, the
a p p o i n t m e n t , suspension a n d t e r m i n a t i o n of
employment of the General M a n a g e r , the Chief
E n g i n e e r , a n d the S e c r e t a r y , a n d the g r a n t i n g
of any g r a t u i t y to a n y s e r v a n t upon the
t e r m i n a t i o n of his e m p l o y m e n t ;
( m ) a n y a g r e e m e n t respecting t h e supply of elec­
t r i c i t y in bulk by the Council to a n o t h e r
a u t h o r i t y s u p p l y i n g electricity;
(n)
(n) the extension of the Council's o p e r a t i o n s i n t o
other a r e a s ;
(o) the continuance of the sale or h i r e of electrical
fittings a n d a p p l i a n c e s ;
( p ) t h e a u t h o r i s i n g of the establishment of new g e n ­
e r a t i n g stations to be o p e r a t e d by the Council
or the construction of a d d i t i o n a l m a i n g e n e r a t ­
ing u n i t s or m a i n t r a n s m i s s i o n l i n e s ;
(q) the conditions r e s p e c t i n g a n y sinking fund or
investment;
( r ) the division of a s s e t s , debts a n d liabilities be­
tween the Municipal Council of S y d n e y a n d t h e
Council, a n d the t r a n s f e r of officers a n d s e r v a n t s
from the Municipal Council of S y d n e y to t h e
Council as r e f e r r e d to in section forty-nine of
this A c t ;
(s) m a t t e r s r e l a t i n g to the i n d e m n i t y which t h e
Council is r e q u i r e d to give u n d e r this P a r t ;
(t) the inclusion of a n y new a r e a or p a r t in t h e
Sydney County District;
(u) the delegation of r e s e r v e d functions to t h e
G e n e r a l M a n a g e r , a n d the revocation of such
delegation;
(v) the a p p o i n t m e n t of r e p r e s e n t a t i v e s of the
Council to a t t e n d a n y conference or m e e t i n g a n d
the p a y m e n t of the expenses of such r e p r e ­
sentatives.
(2) I n this P a r t the p o w e r s , a u t h o r i t i e s , d u t i e s
a n d functions e n u m e r a t e d in subsection one of this sec­
tion a r e r e f e r r e d to as the " r e s e r v e d f u n c t i o n s . "
5 7 . T h e S y d n e y County Council m a y b y resolution
w i t h the a p p r o v a l of the G o v e r n o r delegate to t h e
G e n e r a l M a n a g e r either wholly or in p a r t , a n d e i t h e r
p e r m a n e n t l y or for a limited period, a n d subject to such
limitations as m a y be contained in the resolution or a s
m a y be prescribed, a n y of its r e s e r v e d functions except
the p o w e r to b o r r o w or to m a k e a r a t e , a n d m a y by sub­
sequent resolution w i t h d r a w a n y such delegation, e i t h e r
wholly or in p a r t .
No
N o act of the General M a n a g e r done within the scope
of a n y such delegation d u r i n g the p e r i o d such delegation
w a s in force, shall be invalidated b y r e a s o n of a with­
d r a w a l of the delegation.
5 8 . (1) T h e S y d n e y C o u n t y Council shall a p p o i n t a
p e r s o n chosen solely on the basis of his executive a n d
a d m i n i s t r a t i v e experience a n d qualifications to be the
General Manager.
(2) T h e General M a n a g e r shall exercise a n d per­
f o r m for a n d on behalf of the Sydney County Council:—
(a) the p o w e r s , a u t h o r i t i e s , d u t i e s a n d functions
of the Council other t h a n the r e s e r v e d functions;
(b) such of the r e s e r v e d functions as m a y be dele­
g a t e d to him by the Council a n d in r e s p e c t of
which the delegation shall n o t have been with­
d r a w n by the Council;
(c) the a p p o i n t m e n t , suspension a n d t e r m i n a t i o n of
employment of s e r v a n t s of the Council (not
including the Chief E n g i n e e r or the S e c r e t a r y ) .
(3) F o r the p u r p o s e s of every enactment (includ­
i n g enactments p a s s e d or m a d e after the p a s s i n g of this
Act) r e l a t i n g to County Clerks, the General M a n a g e r
shall be the County Clerk of the S y d n e y County Council
a n d have, exercise a n d p e r f o r m all the p o w e r s , a u t h o r i ­
ties, duties, functions a n d r i g h t s for the time being held,
c o n f e r r e d or imposed by a n y such enactment or other­
wise by law on the County Clerk.
(4) A n y fees or emoluments which a r e p a y a b l e by
o r u n d e r a n y s t a t u t e (whether p a s s e d before or after this
Act) to County Clerks, a n d a r e received by the General
M a n a g e r by v i r t u e of his being the County Clerk of the
S y d n e y County Council, shall be p a i d by the General
M a n a g e r into the a p p r o p r i a t e fund of the Council a n d be
accounted for accordingly.
(5) The General M a n a g e r shall be a s e r v a n t of
the Council.
(6) The General M a n a g e r shall be p a i d
s a l a r y as the Council m a y determine.

(7) T h e General M a n a g e r m a y do all such m a t t e r s
a n d things, including the m a k i n g of c o n t r a c t s for and on
behalf of the S y d n e y County Council, a n d the affixing
of the official seal of the Sydney County Council to docu­
m e n t s , as m a y be n e c e s s a r y for or incidental to the exer­
cise or p e r f o r m a n c e of a n y of the p o w e r s , a u t h o r i t i e s ,
duties a n d functions conferred a n d imposed upon h i m
b y or u n d e r this Act.
(8) T h e General M a n a g e r shall not affix the offi­
cial seal of the S y d n e y County Council to a n y docu­
m e n t s save in the presence of the c h a i r m a n .
(9) T h e General M a n a g e r may, subject to the p r o ­
visions of a n y ordinance m a d e in r e l a t i o n t h e r e t o , call
for a n d accept t e n d e r s for c o n t r a c t s w h e r e the contract
involves the e s t i m a t e d e x p e n d i t u r e of an a m o u n t not
exceeding one t h o u s a n d p o u n d s , and such a m o u n t is
within the limit of e x p e n d i t u r e authorized by the S y d n e y
County Council.
5 9 . (1) H u g h Rose F o r b e s Mackay, E s q u i r e , the Gen­
eral M a n a g e r of the Electricity D e p a r t m e n t of the Muni­
cipal Council of Sydney, shall be a n d is h e r e b y a p p o i n t e d
to be the first G e n e r a l M a n a g e r for the S y d n e y C o u n t y
Council as from the a p p o i n t e d d a y r e f e r r e d to in section
forty-seven of this Act.
(2) The said H u g h Rose F o r b e s Mackay, Esquire,,
shall be deemed to have been a p p o i n t e d as General Man­
a g e r by the Council, a n d shall hold office until he r e a c h e s
the age of sixty-eight y e a r s , unless he sooner dies or
resigns his office, or his employment is t e r m i n a t e d by t h e
Council.
(3) The a p p o i n t m e n t of the said H u g h Rose
F o r b e s Mackay u n d e r this section shall be deemed to bo
a t r a n s f e r within the m e a n i n g of subsection two of
section forty-seven of this Act, a n d he shall r e t a i n , h a v e
a n d enjoy the same r i g h t s and privileges, if any, with
r e g a r d to a n n u a l , sick, deferred a n d extended leave a n d
p a y m e n t on r e t i r e m e n t or death as if he h a d continued
a n officer of the Municipal Council of Sydney, a n d for
t h i s p u r p o s e his service with the Municipal Council of
S y d n e y shall count as continuous service with the S y d n e y
C o u n t y Council, provided t h a t he shall not be entitled t o
claim
claim benefits u n d e r this Act as well as u n d e r a n y o t h e r
A c t or a n y by-law or resolution with respect to the same
p e r i o d of service.
6 0 . (1) The General M a n a g e r shall, whenever re­
quested by the C h a i r m a n of the Sydney County Council,
or by t h a t Council so to do, afford to the c h a i r m a n or
the Council (as the case m a y r e q u i r e ) all such informa­
tion as m a y be in the possession or p r o c u r e m e n t of the
General M a n a g e r in relation to a n y act, m a t t e r or t h i n g
a p p e r t a i n i n g to or concerning a n y business or t r a n s a c ­
tion of the Council which is mentioned in such request.
(2) I t shall be the d u t y of the General M a n a g e r
to advise a n d assist the S y d n e y County Council gener­
ally in relation to the exercise or p e r f o r m a n c e by it of
the r e s e r v e d functions and in p a r t i c u l a r in relation to
a n y m a t t e r or t h i n g concerning the exercise or p e r f o r m ­
ance by t h a t Council of the r e s e r v e d functions on or in
respect of which the Council r e q u e s t s the advice or assis­
tance of the General M a n a g e r .
(3) I t shall be the d u t y of the General M a n a g e r
to c a r r y into effect all lawful o r d e r s of the Council in
relation to the exercise and p e r f o r m a n c e of the r e s e r v e d
functions.
(4) The Sydney County Council m a y at a n y time
by resolution r e q u i r e the General M a n a g e r to p r e p a r e
a n d submit to the Council p l a n s a n d specifications for the
execution of a n y p a r t i c u l a r work specified in such resolu­
tion which can lawfully be executed by the Council,
t o g e t h e r with an estimate of the probable cost of the
execution of such work.

6 1 . (1) The General M a n a g e r shall have the r i g h t to
a t t e n d meetings of the S y d n e y C o u n t y Council a n d to
t a k e p a r t in discussion a t such m e e t i n g s as if he were
a councillor, b u t he shall n o t be entitled to vote on
a n y question which is to be decided by a vote of t h e
councillors.

The G e n e r a l M a n a g e r shall not be entitled to be
p r e s e n t a t a n y such m e e t i n g d u r i n g a n y discussion which
concerns his a p p o i n t m e n t or dismissal or his s a l a r y or the
conditions of his employment.
(2) T h e General M a n a g e r shall a t t e n d any meet­
ing of the S y d n e y County Council a t which he is required
by the Council to a t t e n d , a n d shall a t such m e e t i n g give
to the Council such advice a n d assistance as shall
r e a s o n a b l y be r e q u i r e d of him b y the Council, a n d for
t h a t p u r p o s e the General M a n a g e r shall a r r a n g e for the
a t t e n d a n c e a t such m e e t i n g of such of the s e r v a n t s of the
Council as m a y be necessary, h a v i n g r e g a r d to the busi­
ness to be t r a n s a c t e d a t such meeting.
6 2 . (1) T h e S y d n e y C o u n t y Council, a t a meeting
specially summoned for the p u r p o s e in accordance with
a n y ordinance m a d e in t h a t behalf, m a y by resolution
r e q u i r e a n y p a r t i c u l a r act, m a t t e r , or t h i n g specifically
mentioned in such resolution to be done in r e l a t i o n to
a n y of the p o w e r s , a u t h o r i t i e s , duties a n d functions of
the Council which a r e not r e s e r v e d functions.
(2) W h e r e a resolution h a s been p r o p o s e d a t the
m e e t i n g of the Council s u m m o n e d for the p u r p o s e u n d e r
this section, the Council a n d the General M a n a g e r shall
consider such resolution a n d if after such consideration
t h e Council p a s s such resolution a n d the n u m b e r of
m e m b e r s v o t i n g for such resolution is t h r e e or m o r e , the
G e n e r a l M a n a g e r shall, if a n d when a n d so far as money
for the p u r p o s e is or h a s been provided, do in accordance
w i t h such resolution the act, m a t t e r , or t h i n g which is
r e q u i r e d b y such resolution to be done.
(3) A resolution p a s s e d u n d e r this section shall
n o t be so expressed as to a p p l y or extend—
(a) to the exercise or p e r f o r m a n c e of a n y power,
a u t h o r i t y , duty, or function of t h e Council
generally or to every case or occasion of the
exercise or p e r f o r m a n c e of a n y such power,
a u t h o r i t y , d u t y or function or to a n u m b e r or
class of such cases or occasions so extended as
to be substantially or in effect e v e r y case or
occasion on which such power, a u t h o r i t y , duty
or function is exercised or p e r f o r m e d ; n o r
(b)
(b) to the exercise or p e r f o r m a n c e of a n y power or
d u t y conferred or imposed on the General
M a n a g e r by or u n d e r this P a r t in r e l a t i o n to
the s e r v a n t s of the Council or the control, super­
vision, service, r e m u n e r a t i o n , privileges, o r
s u p e r a n n u a t i o n of such s e r v a n t s or any of t h e m .
A n y resolution p u r p o r t i n g to bo p a s s e d by the Council
u n d e r this section which c o n t r a v e n e s this subsection shall
be void a n d of no effect.
(4) I n the event of a n y d i s p u t e a r i s i n g between
the Council a n d the General M a n a g e r a s to w h e t h e r o r
not a n y resolution p a s s e d by the Council u n d e r t h i s
section c o n t r a v e n e s the provisions of subsection t h r e e
hereof, the m a t t e r shall be r e f e r r e d for decision to t h e
Minister.
T h e decison of the Minister upon a n y such reference
shall bo final, and shall be binding upon the Council and
the General M a n a g e r .
6 3 . (1) T h e s e r v a n t s of the S y d n e y County Council
shall p e r f o r m t h e i r duties a s such s e r v a n t s in accordance
with such directions as the General M a n a g e r m a y from
time to time give, either generally or in relation to the
p e r f o r m a n c e of a n y p a r t i c u l a r d u t y or a n y p a r t i c u l a r
class or classes of duties or in relation to the p e r f o r m a n c e
of a n y such d u t y by a n y p a r t i c u l a r s e r v a n t of the Council,
a n d the General M a n a g e r shall have a n d exercise control
a n d full supervision of a n d over such s e r v a n t s a n d a n y
a n d every act or t h i n g done or to bo done by t h e m in t h e i r
capacity a s s e r v a n t s of the Council.
(2) Subject to this P a r t a n d to the provisions of
a n y Act a n d of any ordinance or regulation m a d e t h e r e ­
u n d e r a n d for the time being in force in relation to t h e
service, r e m u n e r a t i o n , privileges or s u p e r a n n u a t i o n ( a s
the case m a y be) of the s e r v a n t s of t h e Council, t h e
General M a n a g e r shall consider and decide all such
questions as m a y from time to time a r i s e in relation t o
the service, r e m u n e r a t i o n , privileges and s u p e r a n n u a t i o n
of the s e r v a n t s of the Council.
64.
6 4 . (1) E v e r y act or t h i n g done or decision taken by
the G e n e r a l M a n a g e r which, if done or t a k e n b y the coun­
cil of a county district, or municipality or shire, would
be r e q u i r e d by law to be done or taken by resolution of
such council, shall be done or taken by t h e G e n e r a l Man­
a g e r by an o r d e r in w r i t i n g signed by him a n d containing
a s t a t e m e n t of the time at which it was so signed.
(2) W h e r e by or u n d e r a n y Act, including this
Act, public notice of a n y m a t t e r is r e q u i r e d to be given
by the council, such notice shall be given by the General
Manager.
(3) E v e r y o r d e r m a d e by the General M a n a g e r
u n d e r this section shall for all p u r p o s e s be deemed to be
m a d e a t the time a t which it is signed by the General
M a n a g e r , a n d every such o r d e r shall, until the c o n t r a r y
is proved, be deemed to h a v e been so signed at the time
s t a t e d in t h a t behalf in such o r d e r .
(4) T h e General M a n a g e r shall keep a r e g i s t e r in
which shall be entered a copy of every o r d e r m a d e by him
u n d e r this section, a n d the General M a n a g e r shall, at
e v e r y m e e t i n g of the S y d n e y C o u n t y Council, produce for
t h e inspection of the m e m b e r s of the Council so much of
such r e g i s t e r a s contains a n y such o r d e r s m a d e sihce the
n e x t p r e v i o u s m e e t i n g of the Council.
(5) E v e r y document p u r p o r t i n g to be an o r d e r
m a d e a n d signed by the General M a n a g e r shall, without
proof of the s i g n a t u r e of the p e r s o n p u r p o r t i n g to sign
such document or t h a t such p e r s o n w a s the General
M a n a g e r , be received in evidence in all courts, a n d shall,
until the c o n t r a r y is p r o v e d , be deemed to be a n o r d e r
d u l y m a d e a n d signed by the General M a n a g e r u n d e r t h i s
section a n d to have been so signed at the time s t a t e d in
t h a t behalf therein.
(6) E v e r y document p u r p o r t i n g to be certified in
w r i t i n g by the General M a n a g e r to be a t r u e copy of an
o r d e r m a d e by the General M a n a g e r u n d e r this section
shall, w i t h o u t proof of the s i g n a t u r e of the p e r s o n p u r ­
p o r t i n g so to certify or t h a t such p e r s o n w a s the General
M a n a g e r , be received in evidence a n d shall, until t h e
c o n t r a r y is proved, be deemed to be evidence of the con­
t e n t s of the o r d e r of which it p u r p o r t s to be a copy a n d
of
of the fact t h a t such o r d e r w a s duly m a d e a n d signed b y
t h e General M a n a g e r u n d e r this section at the time stated
i n t h a t behalf therein.
6 5 . (1) T h e General M a n a g e r m a y b y o r d e r signed by
h i m a n d countersigned by the s e c r e t a r y of the S y d n e y
C o u n t y Council a u t h o r i s e the m a k i n g of a n y p a y m e n t
out of the funds of t h a t Council in respect of a n y expense
o r on account of a n y liability i n c u r r e d by the Council or
t h e General M a n a g e r on behalf of the Council in the
exercise or the p e r f o r m a n c e by the Council or the General
M a n a g e r (as the case m a y be) of a n y of the p o w e r s ,
a u t h o r i t i e s , duties or functions of the Council which a r e
exercisable or p e r f o r m a b l e by it or him respectively
u n d e r this P a r t .
(2) T h e Council m a y a t a n y time by resolution
d i r e c t t h a t e v e r y o r d e r m a d e u n d e r subsection one of this
section shall, d u r i n g such p e r i o d as is specified in such
resolution, be submitted to the c h a i r m a n or to some other
councillor n o m i n a t e d from time to time for the p u r p o s e
b y the Council for his s i g n a t u r e .
(3) T h e Council m a y a t a n y time by resolution
revoke a direction given u n d e r subsection two of this
section.
(4) "Where the Council gives a n y such direction
a s is hereinbefore mentioned, then, while such direction
r e m a i n s in force, the s i g n a t u r e of the c h a i r m a n or of the
councillor n o m i n a t e d for the p u r p o s e (as the case m a y
r e q u i r e ) shall be necessary on every such o r d e r a s is
m e n t i o n e d in subsection one of this section in addition t o
the s i g n a t u r e a n d c o u n t e r - s i g n a t u r e mentioned in t h a t
subsection, but the c h a i r m a n or such councillor (as the
case m a y be) shall not by r e a s o n of the fact of his signa­
t u r e being on a n y such o r d e r incur a n y liability to which
h e would not h a v e been liable if such direction as afore­
s a i d h a d not been given.
6 6 . (1) T h e General M a n a g e r shall cause to be p r e ­
p a r e d in each y e a r a t the p r e s c r i b e d time a n d in the
p r e s c r i b e d form a n estimate of income a n d e x p e n d i t u r e
(in this section r e f e r r e d to as the e s t i m a t e s ) showing the
a m o u n t s which in his opinion will be n e c e s s a r y to meet
the
the expenses a n d p r o v i d e for the r e q u i r e m e n t s of t h e
S y d n e y C o u n t y Council d u r i n g the y e a r t h e n n e x t
ensuing.
(2) T h e estimates p r e p a r e d in each y e a r u n d e r
this section shall be considered by the Council a t a meet­
ing thereof (in this section r e f e r r e d to a s t h e b u d g e t
m e e t i n g ) , a t which the General M a n a g e r shall be p r e s e n t
a n d which shall be held a t the time p r e s c r i b e d e i t h e r
generally or in r e g a r d to a n y p a r t i c u l a r y e a r a n d of
which not less t h a n twenty-one d a y s ' notice in t h e p r e ­
scribed form shall h a v e been given by the G e n e r a l
M a n a g e r to e v e r y councillor.
(3) Not less t h a n twenty-one d a y s before the d a y
on which a b u d g e t m e e t i n g is to be held, the G e n e r a l
M a n a g e r shall send to every councillor a n d shall d e p o s i t
in the offices of the Council a copy of the e s t i m a t e s re­
quired by this section to be considered b y the Council a t
such meeting, a n d the General M a n a g e r shall a t the s a m e
time give notice in the p r e s c r i b e d m a n n e r a n d f o r m of
the fact t h a t such estimates have been p r e p a r e d a n d t h a t
a copy thereof h a s been so deposited.
(4) The copy of the estimates deposited u n d e r
this section in the offices of the Council m a y be inspected
free of charge by a n y m e m b e r of the public a t a n y t i m e
a t which such offices a r e open for the t r a n s a c t i o n of official
business, a n d the General M a n a g e r shall supply to e v e r y
p e r s o n m a k i n g application to h i m t h e r e f o r a copy of s u c h
e s t i m a t e s a t the price of one shilling p e r copy.
(5) A t a b u d g e t m e e t i n g or a n y a d j o u r n m e n t
thereof u n d e r this section the Council m a y (subject to
the provisions of this section) a m e n d w h e t h e r by addi­
tion, omission, or v a r i a t i o n the e s t i m a t e s r e q u i r e d b y
this section to be considered by it at such meeting, a n d
t h e Council shall by resolution p a s s e d at such m e e t i n g
or a n y a d j o u r n m e n t thereof a d o p t such e s t i m a t e s e i t h e r
with or without a m e n d m e n t and shall by the same o r
a n y subsequent resolution p a s s e d by it at such meeting:
or such a d j o u r n m e n t thereof d e t e r m i n e in a c c o r d a n c e
with such estimates as so a d o p t e d the r a t e s (if a n y ) to be
m a d e a n d levied or the c h a r g e s a n d fees to he i m p o s e d
for the p u r p o s e s specified in such e s t i m a t e s .

(6) W h e r e at a b u d g e t m e e t i n g an a m e n d m e n t of
t h e e s t i m a t e s considered a t such m e e t i n g is p r o p o s e d a n d
t h e General M a n a g e r is of opinion t h a t such a m e n d m e n t ,
if m a d e , would seriously prejudice the efficient or
economic p e r f o r m a n c e of the duties of the Council, the
General M a n a g e r shall a t such m e e t i n g s t a t e his objec­
tion to such a m e n d m e n t a n d his r e a s o n s therefor, a n d
t h e r e u p o n the Council shall consider such objection a n d
shall either decide at such m e e t i n g n o t to make such
a m e n d m e n t or shall a d j o u r n the f u r t h e r consideration of
such a m e n d m e n t .
(7) W h e r e the f u r t h e r consideration of a n amend­
m e n t of the estimates is a d j o u r n e d u n d e r subsection six
of this section, the budget meeting shall, after all business
which can lawfully and conveniently be t r a n s a c t e d t h e r e a t
w i t h o u t a d j o u r n m e n t is disposed of, be a d j o u r n e d for not
less t h a n fourteen d a y s a n d a t such a d j o u r n e d m e e t i n g
the a m e n d m e n t or a m e n d m e n t s which occasioned the
a d j o u r n m e n t (with or without any modification thereof)
b u t no other a m e n d m e n t of the said estimates shall be
considered a n d decided upon a n d the business of the
b u d g e t m e e t i n g shall be completed.
67. I n every action or other legal proceeding, w h e t h e r
civil or criminal, i n s t i t u t e d in any court of law or equity
b y or a g a i n s t the Sydney County Council the General
M a n a g e r shall act for and on behalf of the Council and
m a y do all such acts, m a t t e r s or things as ho m a y consider
n e c e s s a r y for the p r e p a r a t i o n a n d prosecution or defence
of such action or other p r o c e e d i n g in the same m a n n e r
in all respects as if (as the case may r e q u i r e ) he were the
plaintiff or p r o s e c u t o r or t h e d e f e n d a n t therein, a n d
w h e r e a n y such action or other proceeding r e l a t e s to
t h e exercise or the p e r f o r m a n c e by the Council of any
of the r e s e r v e d functions the General M a n a g e r shall in the
doing of a n y such act, m a t t e r or t h i n g as aforesaid act
w i t h the e x p r e s s a u t h o r i t y of the Council, which
a u t h o r i t y shall be deemed to have been given unless a n d
u n t i l the c o n t r a r y is shown.
T h i s section shall not a p p l y where the a m o u n t involved
i n a n y such action or legal proceedings as aforesaid
exceeds five h u n d r e d pounds.
68.
6 8 . (1) W h e r e t h e General M a n a g e r is on leave or i s
t h r o u g h illness, absence from the S y d n e y County District,
or suspension from the p e r f o r m a n c e of his duties, tem­
p o r a r i l y incapable of exercising a n d p e r f o r m i n g t h e
p o w e r s , a u t h o r i t i e s , duties a n d functions conferred a n d
imposed on him by this P a r t , a d e p u t y G e n e r a l M a n a g e r
shall be a p p o i n t e d u n d e r this section for the d u r a t i o n of
such leave or incapacity but m a y be removed at a n y time
d u r i n g such leave or incapacity.
(2) Where the General M a n a g e r is on leave a n d
also where the G e n e r a l M a n a g e r is so incapable as afore­
said a n d such incapacity is due to absence from t h e
Sydney C o u n t y D i s t r i c t the p o w e r of a p p o i n t i n g t h e
d e p u t y General M a n a g e r u n d e r this section m a y be ex­
ercised by the General Manager, after consultation with
the c h a i r m a n , before a n d in contemplation of such leave or
such incapacity (as the case m a y ho), but in every o t h e r
case, that is to say, where the General M a n a g e r is so in­
capable as aforesaid owing to illness or suspension a n d
also where the General M a n a g e r is on leave or is so in­
capable as aforesaid owing to absence from the S y d n e y
C o u n t y District and a d e p u t y General M a n a g e r is not
a p p o i n t e d u n d e r this section before such leave or in­
capacity or h a v i n g been so a p p o i n t e d is removed u n d e r
this section d u r i n g such leave or incapacity, the p o w e r of
a p p o i n t i n g the d e p u t y General M a n a g e r u n d e r this
section shall be exercisable a t any time d u r i n g such leave
or incapacity by the c h a i r m a n .
(3) I n every case the power of r e m o v i n g the
d e p u t y General M a n a g e r u n d e r this section shall be exer­
cisable by the Council only.
(4) T h e d e p u t y General M a n a g e r shall, d u r i n g
the continuance of the leave or incapacity on account of
which he is a p p o i n t e d or until he is removed u n d e r this
section, have all the p o w e r s and a u t h o r i t i e s a n d shall
exercise a n d p e r f o r m all the duties a n d functions of t h e
General M a n a g e r a n d for t h a t p u r p o s e all references in
this P a r t to the General Manager (other t h a n the refer­
ences to the General M a n a g e r in this section and t h e
references in this P a r t to the a p p o i n t m e n t a n d r e m u n e r a ­
tion of the General M a n a g e r ) shall be construed as
including the deputy General M a n a g e r .
(5)
(5) T h e r e shall be paid by the Council to the
d e p u t y General M a n a g e r such r e m u n e r a t i o n (if any) as
t h e Council m a y determine.
0 9 . T h e General M a n a g e r shall appoint a n d employ
s u c h s e r v a n t s of the Council as he m a y deem n e c e s s a r y
for the p u r p o s e s of this P a r t .
7 0 . (1) T h e Sydney County Council shall appoint a
p e r s o n to be t h e Chief E n g i n e e r of the electricity u n d e r ­
t a k i n g of the Council.
(2) T h e Chief E n g i n e e r shall, u n d e r a n d subject
to the direction, control, a n d full supervision of the
General M a n a g e r , have the principal oversight of all
works in or connected with the Council's electricity
undertaking.
(3) The Chief E n g i n e e r shall by v i r t u e of such
a p p o i n t m e n t be a s e r v a n t of the Council.
(4) T h e Chief E n g i n e e r shall be paid such s a l a r y
a s the Council m a y determine.
7 1 . (1) The Sydney County Council shall a p p o i n t a n d
employ a person as S e c r e t a r y of the Council.
(2) The S e c r e t a r y shall by v i r t u e of such a p p o i n t ­
m e n t be a s e r v a n t of the Council.
(3) The S e c r e t a r y shall be p a i d such s a l a r y as the
Council m a y determine.
(4) The S e c r e t a r y shall p e r f o r m such duties as
m a y be prescribed.
7 2 . (1) The provisions of section ninety-nine of the
P r i n c i p a l Act r e l a t i n g to i n q u i r y before dismissal shall
a p p l y with respect to the dismissal by the Council of the
G e n e r a l M a n a g e r , the Chief E n g i n e e r a n d the S e c r e t a r y .
(2) If either of the p e r s o n s a p p o i n t e d as Chief
E n g i n e e r or S e c r e t a r y respectively w a s an officer or ser­
v a n t of the S y d n e y Municipal Council who h a s been
t r a n s f e r r e d to the S y d n e y C o u n t y Council u n d e r subsec­
tion two of section forty-seven of this Act, he shall r e t a i n
a n d enjoy the r i g h t s a n d privileges conferred upon t r a n s ­
f e r r e d officers a n d s e r v a n t s by t h a t subsection and the
provisions of t h a t subsection shall a p p l y to him a s if he
h a d before his t r a n s f e r held the office of Chief E n g i n e e r
or
or S e c r e t a r y of the E l e c t r i c i t y D e p a r t m e n t of the M u n i ­
cipal Council of Sydney, as the case m a y be, a n d h a d been
t r a n s f e r r e d to the S y d n e y County Council as the h o l d e r
of t h a t office.
DIVISION
6—Accounts and
audit.
7 3 . (1) T h e S y d n e y County Council shall cause to be
kept p r o p e r books of account, a n d shall, on or before t h e
t h i r t i e t h d a y of J u n e in each y e a r , p r e p a r e a n d s u b m i t
to the A u d i t o r - G e n e r a l s t a t e m e n t s of account s e t t i n g
f o r t h the financial position a n d the t r a n s a c t i o n s of t h e
Council for the whole of the y e a r ending on the thirty-first
d a y of December of the p r e c e d i n g year, t o g e t h e r w i t h a n
a n n u a l balance-sheet m a d e u p a s a t the said thirty-first
d a y of December.
Such s t a t e m e n t s of account a n d balance-sheet shall be
in a form a p p r o v e d by the A u d i t o r - G e n e r a l .
T h e A u d i t o r - G e n e r a l shall a u d i t the books of
account a n d the said s t a t e m e n t s of account a n d
balance-sheet, a n d shall certify on such balance-sheet
w h e t h e r or not all his r e q u i r e m e n t s as a u d i t o r h a v e been
complied with a n d w h e t h e r in his opinion the balancesheet is a full a n d fair s t a t e m e n t p r o p e r l y d r a w n u p
so as to exhibit a full a n d t r u e view of the Council's
affairs, a n d w h e t h e r it is in accordance w i t h t h e
books of the Council a n d the p r o v i s i o n s of this A c t a n d
the ordinances.
H e shall also certify the a m o u n t which the Council
m a y b o r r o w by w a y of limited o v e r d r a f t in p u r s u a n c e of
section one h u n d r e d a n d seventy-four of the P r i n c i p a l
Act.
A f t e r such a u d i t the Council shall f o r t h w i t h t r a n s m i t
the said s t a t e m e n t s of account a n d balance-sheet t o t h e
M i n i s t e r for p r e s e n t a t i o n to P a r l i a m e n t .
(2) Such s t a t e m e n t s of account a n d balancesheet shall be laid before both H o u s e s of P a r l i a m e n t
w i t h i n f o u r t e e n s i t t i n g d a y s after the receipt thereof b y
the M i n i s t e r if P a r l i a m e n t is in session, a n d if not, t h e n
within fourteen s i t t i n g d a y s after the commencement of
the n e x t session.
74.
7 4 . (1) Subject to the provisions of this P a r t —
(a) the A u d i t o r - G e n e r a l shall, in respect of such
audit, h a v e all the p o w e r s conferred on the
A u d i t o r - G e n e r a l by a n y law now or h e r e a f t e r
to be in force r e l a t i n g to the a u d i t of public
accounts; and
(b) the A u d i t Act, 1902, a n d A c t s a m e n d i n g the
same shall a p p l y to a n d in respect of the Council
a n d its officers a n d s e r v a n t s in t h e same m a n n e r
as it applies to accounting officers of public
departments.
(2) T h e books of account of the Sydney County
Council shall a t all reasonable times a n d w i t h o u t fee or
r e w a r d be open for inspection by t h e c h a i r m a n o r a n y
councillor or the A u d i t o r - G e n e r a l or a n y p e r s o n
t h e r e u n t o a u t h o r i s e d in w r i t i n g b y the council of a n y
a r e a which is included in whole or in p a r t within t h e
S y d n e y C o u n t y D i s t r i c t ; a n d a n y p e r s o n so entitled to
inspect the books of account m a y also t a k e copies of o r
m a k e e x t r a c t s t h e r e f r o m d u r i n g office h o u r s w i t h o u t a n y
payment.
(3) A n y s e r v a n t of the council h a v i n g charge
of t h e said books of account refusing to p e r m i t a n y
such p e r s o n to inspect or take copies or m a k e e x t r a c t s
f r o m such books in accordance w i t h subsection two of
this section shall be liable to a p e n a l t y n o t exceeding five
p o u n d s for every such offence.
(4) The council of a n y a r e a which is included
wholly or in p a r t in t h e S y d n e y C o u n t y D i s t r i c t m a y
m a k e objection before the A u d i t o r - G e n e r a l to any of the
accounts of the S y d n e y C o u n t y Council.
7 5 . (1) W i t h o u t limiting the g e n e r a l i t y of the powers
c o n f e r r e d by subsection one of section seventy-four, the
A u d i t o r - G e n e r a l m a y disallow a n y expenditure, t r a n s f e r
o r e n t r y in the books of account of the Council which h a s
been i n c u r r e d or m a d e in c o n t r a v e n t i o n of any Act or a n y
o r d i n a n c e , regulation, or by-law.
(2) The A u d i t o r - G e n e r a l m a y , subject to the
p r o v i s i o n s of section five h u n d r e d a n d eighty-three of the
P r i n c i p a l Act, s u r c h a r g e the a m o u n t of a n y such dis­
allowance upon the c h a i r m a n or councillors or s e r v a n t s of
t h e Council by whom the expenditure, t r a n s f e r , or e n t r y
w a s i n c u r r e d or m a d e or o r d e r e d to be i n c u r r e d or m a d e .
(3)
(3) T h e A u d i t o r - G e n e r a l m a y s u r c h a r g e on t h e
c h a i r m a n or a councillor or s e r v a n t of the Council the
a m o u n t of a n y deficiency or loss i n c u r r e d by the culpable
negligence or misconduct of such c h a i r m a n or councillor
or s e r v a n t , or of a n y sum which ought to have been b u t
is not b r o u g h t into account by such chairman, councillor
or s e r v a n t .
(4) Before s u r c h a r g i n g the a m o u n t of a n y such
disallowance on a n y p e r s o n the A u d i t o r - G e n e r a l shall,
if practicable, extend to the p e r s o n upon whom he p r o ­
poses to m a k e the s u r c h a r g e a n o p p o r t u n i t y to a d v a n c e
a n y r e a s o n s why such s u r c h a r g e should not be m a d e .
(5) T h e A u d i t o r - G e n e r a l m a y certify on the face
of every account examined by him a n y money, books,
deeds, p a p e r s , goods, or chattels found by him to be d u e
from a n y p e r s o n .
(6) I m m e d i a t e l y upon s u r c h a r g i n g a n y sum on
any p e r s o n the A u d i t o r - G e n e r a l shall give notice to t h e
p e r s o n concerned.
(7) The A u d i t o r - G e n e r a l m a y at a n y time with­
d r a w a n d revoke a n y s u r c h a r g e or disallowance m a d e
by him u n d e r t h i s section.
(8) A n y p e r s o n u p o n whom a s u r c h a r g e is m a d e
by the A u d i t o r - G e n e r a l m a y , within one m o n t h a f t e r
notice thereof, in accordance with subsection six of t h i s
section, a p p e a l if the a m o u n t of the s u r c h a r g e does n o t
exceed five h u n d r e d p o u n d s either to the Governor or t o
t h e Court of P e t t y Sessions holden a t the C e n t r a l Police
Office or the District C o u r t for the M e t r o p o l i t a n D i s t r i c t ,
o r if the a m o u n t of the s u r c h a r g e exceeds five h u n d r e d
p o u n d s , to the S u p r e m e Court. T h e decision of t h e
G o v e r n o r or the court, as t h e ease m a y be, to confirm,
reduce, or a n n u l the s u r c h a r g e shall be final a n d shall be
c a r r i e d into effect.
(9) If the p e r s o n concerned do not within t h e
p e r i o d p r e s c r i b e d in subsection eight of this section
a p p e a l , or if on a p p e a l the decision of the G o v e r n o r or
the court be a g a i n s t such p e r s o n , the Council, the Minister,
or a n y c r e d i t o r of the Council, or the council of a n y
a r e a included in the S y d n e y C o u n t y D i s t r i c t m a y r e c o v e r
in a court of competent jurisdiction the a m o u n t of the
s u r c h a r g e (or a n y deficiency which m a y r e m a i n after t h e
appropriation
a p p r o p r i a t i o n of a n y moneys in the possession of the
Council the p r o p e r t y of such p e r s o n ) ; a n d the money so
recovered shall be p a i d to the Council.
(10) If t h e r e a r e a n y m o n e y s in the possession
of the Council the p r o p e r t y of such person, the Council
m a y a p p r o p r i a t e so much of t h e m as m a y be n e c e s s a r y
t o satisfy the a m o u n t s u r c h a r g e d .
(11) If a n y s u r c h a r g e on a n y p e r s o n he n o t
within six m o n t h s after it is m a d e , satisfied by p a y m e n t
or annulled on a p p e a l as hereinbefore provided, such
p e r s o n shall, d u r i n g such f u r t h e r time as the a m o u n t of
the s u r c h a r g e r e m a i n s u n p a i d , be t h e r e b y disqualified to
hold office as c h a i r m a n or councillor of the Sydney
C o u n t y Council.
(12) F o r the p u r p o s e of this section a " s u r ­
c h a r g e " shall be a n e n t r y in an account of the Council
m a d e or caused to be m a d e by the A u d i t o r - G e n e r a l , and
p u r p o r t i n g to show the a m o u n t s u r c h a r g e d as a n a m o u n t
due by t h e p e r s o n s u r c h a r g e d .
(13) N o t h i n g in this or a n y o t h e r Act shall
preclude a n y disallowance or s u r c h a r g e being m a d e , or
the a m o u n t thereof being recovered or deducted before
or after the e x p i r a t i o n of six m o n t h s from the time when
the m a t t e r of the disallowance or s u r c h a r g e arose.
7 6 . (1) The A u d i t o r - G e n e r a l shall, a s soon as
practicable after the completion of his audit in each y e a r
m a k e a n d sign a n d f o r w a r d to t h e Council a n d the
Minister a r e p o r t on a n d in relation to his a u d i t of the
books of account of the Council for the p r e c e d i n g y e a r .
(2) Such r e p o r t shall include a s t a t e m e n t as to—
(a) w h e t h e r or not in his opinion, due provision
h a s been m a d e for t h e r e p a y m e n t of l o a n s ; a n d
(b) his decision u p o n a n y objection to the accounts
m a d e before h i m ; a n d
(c) a n y b r e a c h of law revealed b y his a u d i t ; and
(d) a n y other m a t t e r s which in his j u d g m e n t call
for notice.
7 7 . (1) F o r t h e p u r p o s e of a n y audit of accounts,
t h e A u d i t o r - G e n e r a l m a y take evidence u p o n oath or
affirmation (which oath or affirmation he is h e r e b y
e m p o w e r e d to a d m i n i s t e r ) , a n d m a y , b y summons u n d e r
h i s h a n d , r e q u i r e such p e r s o n s a s he thinks fit to a p p e a r
personally
p e r s o n a l l y before him, at a time a n d place to be fixed in
a n d by such s u m m o n s , and to produce to him such books
a n d p a p e r s a s a p p e a r n e c e s s a r y for such audit, a n d m a y
examine such witnesses as he thinks fit.
(2) A n y p e r s o n so r e q u i r e d who, without j u s t
excuse—
(a) neglects or refuses to comply with such
summons; or
(b) refuses to be examined on oath or affirmation,
or to take a n oath or affirmation; or
(c) refuses to a n s w e r such lawful questions as a r e
p u t to him,
shall be liable to a t e r m of i m p r i s o n m e n t n o t exceeding
twelve m o n t h s , or a p e n a l t y not exceeding t w e n t y p o u n d s .
7 8 . A reference in t h i s Division of this P a r t to the
A u d i t o r - G e n e r a l shall be deemed to include a reference
to a p e r s o n acting as d e p u t y of the A u d i t o r - G e n e r a l ,
a n d to a n y officer of the Public Service a p p o i n t e d by the
A u d i t o r - G e n e r a l or such d e p u t y to exercise a n d discharge
on his behalf the p o w e r s , a u t h o r i t i e s , duties a n d func­
tions conferred a n d imposed on t h e A u d i t o r - G e n e r a l b y
this Division of this P a r t of t h i s Act.
7 9 . T o w a r d s d e f r a y i n g the cost a n d expenses of the
a u d i t by the A u d i t o r - G e n e r a l the Council shall p a y to
the Consolidated R e v e n u e F u n d the a m o u n t involved a s
certified to b y the A u d i t o r - G e n e r a l at such p e r i o d s as
the M i n i s t e r m a y decide.
7—Revision of charges made for electricity
by
the Electric Light and Power Supply
Corporation,
Limited.
DIVISION
8 0 . (1) N o t w i t h s t a n d i n g a n y t h i n g contained i n t h e
B o r o u g h of B a l m a i n E l e c t r i c L i g h t i n g A c t or in a n y
a g r e e m e n t m a d e by v i r t u e of the said A c t between the
Electric Light and Power Supply Corporation Limited
a n d a n y of the Councils of the Municipalities of B a l m a i n ,
Newtown, L e i c h h a r d t , P e t e r s h a m a n d Ashfield, the
c h a r g e s for electricity supplied by the said c o r p o r a t i o n
in a n y such m u n i c i p a l i t y or for a n y m e t e r or appliance
used for or in connection with such supply shall n o t be
a l t e r e d except in accordance with an a g r e e m e n t e n t e r e d
i n t o u n d e r subsection three of this section.
(2)
(2) T h e r e shall he a j o i n t committee consisting
of five p e r s o n s who shall be a p p o i n t e d respectively by
each of the five Councils r e f e r r e d to i n subsection one
of this section.
A p e r s o n shall n o t be qualified to be so a p p o i n t e d b y
a n y such council unless he is a n a l d e r m a n of t h a t council.
T h e joint committee shall a p p o i n t a s e r v a n t of one of
such councils to be the executive officer of the j o i n t
committee.
The joint committee shall notify the said C o r p o r a t i o n
of the n a m e a n d a d d r e s s of the executive officer.
(3) (a) A t a n y t i m e d u r i n g the p e r i o d of t h r e e
months next following the issue of the a n n u a l accounts
of the said C o r p o r a t i o n for a n y y e a r , w r i t t e n notice m a y
be given by the said C o r p o r a t i o n to the joint committee
or by the j o i n t committee to t h e Corporation, r e q u e s t i n g
the joint committee or the C o r p o r a t i o n as the case m a y be,
to enter into an a g r e e m e n t as p r o v i d e d in this subsec­
tion for the a l t e r a t i o n of a n y charge for the time being
m a d e by the C o r p o r a t i o n for the supply of electricity
in a n y of the five municipalities mentioned in subsection
one of this section, or for a n y m e t e r or appliance used in
connection with such supply.
(b) W h e r e a notice u n d e r this subsection h a s
been given within the p r e s c r i b e d period, it shall be law­
ful for the C o r p o r a t i o n a n d the joint committee to e n t e r
into an a g r e e m e n t for the a l t e r a t i o n of any such c h a r g e
in the m a i m e r a n d to the extent mentioned in the a g r e e ­
ment.
The a g r e e m e n t shall specify the new charge a n d t h e
d a t e on a n d from which such charge is to take effect.
(c) Such new charge shall, on and from t h e
d a t e specified in the agreement, be substituted for t h e
charge as existing on the d a t e u p o n which the notice re­
f e r r e d to in p a r a g r a p h (a) of this subsection w a s given,
a n d shall r e m a i n in force until a l t e r e d by a f u r t h e r
a g r e e m e n t entered into between the C o r p o r a t i o n a n d the
joint committee u n d e r this subsection.
(d) W h e r e the provisions of this subsection
a r e inconsistent with the provisions of the B o r o u g h of
B a l m a i n E l e c t r i c L i g h t i n g Act or with a n y a g r e e m e n t
m a d e by v i r t u e of t h a t Act between the said C o r p o r a t i o n
and
a n d a n y of the five councils r e f e r r e d to in subsection one
of this section the provisions of this subsection shall to
the extent of such inconsistency prevail.
(e) F o r the p u r p o s e s of this subsection the
decision of a m a j o r i t y of the m e m b e r s of the joint
committee shall be deemed to be the decision of the joint
committee a n d shall be given effect to accordingly.
(f) If an a g r e e m e n t u n d e r this subsection is
n o t entered into within a period of two m o n t h s immedi­
a t e l y following the date u p o n which the notice r e f e r r e d
to in p a r a g r a p h (a) of this subsection is given, the ques­
tion w h e t h e r the charge r e f e r r e d to in the notice should
be altered, and, if so, in w h a t m a n n e r a n d to w h a t extent
a n d from w h a t date shall, unless the a u t h o r i t y which

be r e f e r r e d to a r b i t r a t i o n u n d e r a n d in p u r s u a n c e of the
provisions of the A r b i t r a t i o n Act, 1902, or of a n y Act
a m e n d i n g or replacing t h a t Act.
(g) T h e decision given upon a n y such refer­
ence shall, for the p u r p o s e s of this Act, have the same
force a n d effect as, a n d be deemed to be, an a g r e e m e n t
i n c o r p o r a t i n g the t e r m s of such decision e n t e r e d into
between the joint committee a n d the said C o r p o r a t i o n .
(h) A n a g r e e m e n t u n d e r this subsection, p r o ­
viding for the increase at a n y time d u r i n g the p e r i o d of
t h r e e y e a r s immediately following the commencement of
t h i s P a r t of a n y c h a r g e as existing at such commence­
ment, shall not be entered into unless the cost of p r o ­
duction a n d s u p p l y of electricity b y the said C o r p o r a t i o n
h a s been increased d u r i n g such p e r i o d by r e a s o n of
increases of t a x a t i o n (other t h a n income t a x ) or of wages
a w a r d s , or b y r e a s o n of a n y strike, lockout or other
circumstance over which the C o r p o r a t i o n h a s no control.
(i) No increase of a n y c h a r g e shall be m a d e
u n d e r this subsection if the u n d e r t a k i n g of the said
C o r p o r a t i o n is n o t b e i n g conducted economically a n d
efficiently.
(j) Ordinances m a y be m a d e
P r i n c i p a l Act p r e s c r i b i n g the f o r m a n d basis
for the supply of electricity a n d for m e t e r s
ances used in connection with such supply,

PART
VII.
E M E R G E N C Y PROVISIONS.
8 1 . (1) W h e n e v e r it a p p e a r s to t h e G o v e r n o r t h a t
from a n y cause the available s u p p l y of g a s or electricity
is or is likely to become less t h a n is sufficient for the
reasonable r e q u i r e m e n t s of the community, the G o v e r n o r
m a y from time to time exercise all or a n y of the p o w e r s
c o n f e r r e d on h i m by or u n d e r this section a n d do a n d
p e r f o r m all such acts, m a t t e r s a n d t h i n g s as a r e neces­
s a r y or expedient for c a r r y i n g into effect the p u r p o s e s of
t h i s section.
(2) T h e G o v e r n o r m a y from time to time by p r o ­
clamation declare t h a t on a n d a f t e r t h e d a t e of the
publication of the p r o c l a m a t i o n or a l a t e r d a t e specified
t h e r e i n the provisions of this section shall h a v e effect.
(3) So long a s a n y such p r o c l a m a t i o n r e m a i n s
u n r e v o k e d the G o v e r n o r m a y m a k e such r e g u l a t i o n s a s
he thinks fit for or with r e s p e c t t o —
(a) r e g u l a t i n g or p r o h i b i t i n g the sale, supply, use or
consumption of g a s or electricity, w h e t h e r
generally or for a n y p u r p o s e or p u r p o s e s
specified in such r e g u l a t i o n s ;
(b) p r o v i d i n g for the a p p o i n t m e n t of a n y p e r s o n or
body of p e r s o n s to exercise such functions as
a r e p r e s c r i b e d for the p u r p o s e s of this section
a n d such r e g u l a t i o n s ;
(c) c o n f e r r i n g or i m p o s i n g u p o n such p e r s o n or
body of p e r s o n s so a p p o i n t e d such p o w e r s a n d
duties as a p p e a r n e c e s s a r y or expedient to c a r r y
into effect the p u r p o s e s of this section or such
regulations; and
(d) generally, p r e s c r i b i n g all such m a t t e r s or t h i n g s
as a r e n e c e s s a r y or expedient to be p r e s c r i b e d
for c a r r y i n g into effect the p u r p o s e s of this
section a n d such regulations.

(4)
(4) A n y such r e g u l a t i o n s —
( a ) m a y be m a d e so as to a p p l y to or h a v e o p e r a t i o n
t h r o u g h o u t the whole or a n y p a r t of New South
"Wales or t h r o u g h o u t the whole or a n y p a r t of
a n y a r e a within t h e m e a n i n g of the Local Gov­
e r n m e n t Act, 1919, or the City of S y d n e y ;
(b) m a y be m a d e so as to o p e r a t e for a n y period or
p e r i o d s or for a n y time or times or for a n y
occasion or occasions specified t h e r e i n ;
(c) m a y be of g e n e r a l o p e r a t i o n or of specially
limited o p e r a t i o n according to a n y specified
times, places, circumstances, conditions or
restrictions;
(d) m a y impose a p e n a l t y of n o t m o r e t h a n five
h u n d r e d p o u n d s for a n y offence a g a i n s t such
r e g u l a t i o n s , a n d in the case of a continuing
offence, a f u r t h e r p e n a l t y of not m o r e t h a n t e n
p o u n d s for each d a y on which a n y offence is
continued a f t e r conviction or o r d e r of a n y court.
(5) T h e p r o v i s i o n s of subsection t h r e e of section
eighty-five of this A c t shall extend to r e g u l a t i o n s m a d e
u n d e r this P a r t .
(6) A body c o r p o r a t e shall be liable for any
offence a g a i n s t a n y r e g u l a t i o n u n d e r this section a s if
it w e r e a p r i v a t e p e r s o n , a n d shall be subject to t h e
same penalties as if it w e r e a p r i v a t e p e r s o n ; a n d if a n y
c h a i r m a n , m e m b e r of the g o v e r n i n g body, director,
m a n a g e r , s e c r e t a r y or officer of such body c o r p o r a t e
knowingly a u t h o r i s e s or p e r m i t s the commission of a n y
such offence he shall also be liable therefor.
(7) E v e r y r e g u l a t i o n m a d e u n d e r t h i s section
shall (unless it sooner expires or is revoked) continue in
o p e r a t i o n until the p r o c l a m a t i o n u n d e r the a u t h o r i t y of
which it w a s m a d e is r e v o k e d ; b u t the e x p i r a t i o n or
revocation of a n y such r e g u l a t i o n shall n o t affect a n y
p e n a l t y , f o r f e i t u r e o r p u n i s h m e n t i n c u r r e d in respect of
a n y offence committed a g a i n s t such r e g u l a t i o n or affect
a n y investigation, legal p r o c e e d i n g or r e m e d y in r e s p e c t
of a n y such p e n a l t y , f o r f e i t u r e or p u n i s h m e n t ; and a n y
such investigation, legal p r o c e e d i n g or r e m e d y m a y be
i n s t i t u t e d , continued or enforced a n d a n y such p e n a l t y ,
forfeiture or p u n i s h m e n t m a y be imposed as if such
r e g u l a t i o n h a d not expired or h a d n o t been revoked.
(8)
(8) E v e r y p r o c l a m a t i o n u n d e r this section—
( a ) m a y be amended, v a r i e d or revoked b y a l a t e r
proclamation; and
(b) shall be judicially noticed.
( 9 ) T h i s section shall have effect n o t w i t h s t a n d i n g
a n y t h i n g , w h e t h e r expressed or implied, in a n y o t h e r
sections of t h i s A c t or in a n y other Act or in a n y law,
p r o c l a m a t i o n or r e g u l a t i o n or in a n y j u d g m e n t or o r d e r
o r in a n y c o n t r a c t or a g r e e m e n t , w h e t h e r o r a l or w r i t t e n ,
or in a n y deed, document, security or w r i t i n g w h a t s o e v e r .
(10) All p o w e r s given by or u n d e r this section or
a n y p r o c l a m a t i o n or r e g u l a t i o n t h e r e u n d e r shall be in
aid of a n d n o t in d e r o g a t i o n from a n y other p o w e r s
exercisable a p a r t from this section.
(11) No action, claim or d e m a n d w h a t s o e v e r shall
lie or be m a d e or allowed by or in favour of a n y p e r s o n
whomsoever a g a i n s t H i s M a j e s t y or a n y responsible
M i n i s t e r of t h e Crown or any officer or p e r s o n a c t i n g in
the execution of t h i s section or a n y p r o c l a m a t i o n or
r e g u l a t i o n t h e r e u n d e r for or in respect of a n y d a m a g e ,
loss or i n j u r y sustained or alleged to be sustained by
r e a s o n of the p a s s i n g of this section or of its operation,
or of a n y t h i n g done or p u r p o r t i n g to be done u n d e r this
section or any p r o c l a m a t i o n or r e g u l a t i o n t h e r e u n d e r .
(12) T h i s P a r t of this Act shall bind t h e Crown.
P A R T VIII.
GENERAL.
8 2 . A f t e r the commencement of this A c t a p e r s o n
shall not be a p p o i n t e d by a g a s c o m p a n y to s u p e r i n t e n d
its g a s w o r k s unless he holds the p r e s c r i b e d certificate as
to his technical qualifications.
8 3 . (1) A p e r s o n who c o n t r a v e n e s a provision of this
Act or of a r e g u l a t i o n m a d e u n d e r this Act shall, if no
p e n a l t y is specifically p r o v i d e d for such contravention,
be liable u p o n s u m m a r y conviction to a p e n a l t y not
exceeding t e n p o u n d s .
(2)
(2) A p r e s c r i b e d p e n a l t y m a y be imposed by a n d
recovered before a s t i p e n d i a r y or police m a g i s t r a t e or
a n y two justices in p e t t y sessions.
8 4 . ( 1 ) Schedule Two to t h i s Act m a y be a m e n d e d ,
revoked or replaced by r e g u l a t i o n m a d e u n d e r this Act.
(2) T h e M i n i s t e r shall, before r e c o m m e n d i n g t o
the G o v e r n o r the m a k i n g of a r e g u l a t i o n a m e n d i n g ,
revoking, or replacing Schedule T w o , give notice of t h e
p r o p o s e d a m e n d m e n t to each g a s c o m p a n y affected.
If within fourteen d a y s after the giving of such notice
a gas c o m p a n y informs the Minister in w r i t i n g t h a t it dis­
a p p r o v e s the p r o p o s a l the Minister shall constitute a
b o a r d for the p u r p o s e of i n v e s t i g a t i n g t h e m a t t e r .
T h e b o a r d shall r e p o r t to the Minister, a n d the M i n i s t e r
shall, if he considers t h a t the p r o p o s a l , w i t h or without
a m e n d m e n t , should be proceeded with, convey the sub­
stance of the r e p o r t to the G o v e r n o r with his recom­
mendation.
8 5 . (1) T h e G o v e r n o r m a y m a k e r e g u l a t i o n s n o t
inconsistent with this Act p r e s c r i b i n g all m a t t e r s which
a r e r e q u i r e d or p e r m i t t e d to be p r e s c r i b e d or which a r e
n e c e s s a r y or convenient to be prescribed for c a r r y i n g
out or giving effect to this Act a n d in p a r t i c u l a r a n d
w i t h o u t limiting t h e g e n e r a l i t y of the foregoing p o w e r
the G o v e r n o r m a y m a k e r e g u l a t i o n s : —
(a) for the control a n d licensing of g a s f i t t e r s ;
(b) for the control of the installation, a l t e r a t i o n ,
connection and disconnection of g a s m e t e r s ,
pipes, fittings a n d a p p a r a t u s ;
(c) p r o h i b i t i n g interference with g a s m e t e r s , fittings,
p i p e s a n d a p p a r a t u s by u n a u t h o r i s e d p e r s o n s ;
(d) for the testing, s t a m p i n g a n d e x a m i n a t i o n of
g a s m e t e r s , and the fees to be c h a r g e d for such
purposes;
(e) c o n f e r r i n g u p o n a g a s c o m p a n y p o w e r to refuse
or discontinue a supply of gas w h e r e t h e condi­
tions of such supply or u s e a r e d a n g e r o u s to
life, h e a l t h or p r o p e r t y , a n d r e g u l a t i n g t h e
exercise of such p o w e r ;
(f)
(f) p r e s c r i b i n g the p r o c e d u r e a t inquiries of a b o a r d ,
the p a y m e n t of expenses (including w i t n e s s e s '
expenses) of such inquiries a n d the fees p a y a b l e
to m e m b e r s ;
(g) for the examination of c a n d i d a t e s for the super­
intendence of gas w o r k s , the issue of certificates
to successful candidates, a n d the fees t o be
c h a r g e d for such examination a n d certificates;
and
(h) p r e s c r i b i n g the qualifications of g a s e x a m i n e r s .
(2) T h e r e g u l a t i o n s m a y p r o v i d e a p e n a l t y not
exceeding ten p o u n d s for a n y breach thereof.
(3) T h e r e g u l a t i o n s shall—
(a) be published in the G a z e t t e ;
(b) take effect from the d a t e of such publication o r
from a l a t e r d a t e to be specified in the regula­
tions; and
(c) be laid before both H o u s e s of P a r l i a m e n t within
fourteen sitting d a y s a f t e r the publication
thereof if P a r l i a m e n t is in session, a n d if not,
t h e n within fourteen s i t t i n g d a y s a f t e r the com­
mencement of the n e x t session.
If either H o u s e of P a r l i a m e n t p a s s e s a resolution of
which notice h a s been given a t a n y time within fifteen
s i t t i n g d a y s after such r e g u l a t i o n s h a v e been laid before
such H o u s e disallowing a n y r e g u l a t i o n or p a r t thereof,
such r e g u l a t i o n or p a r t shall t h e r e u p o n cease to h a v e
effect, b u t w i t h o u t prejudice to the validity of a n y t h i n g
done in t h e m e a n t i m e .
PART
P A R T IX.
ELECTRICAL CONTRACTORS AND ELECTRICIANS L I C E N S I N G .
8 6 . T h i s P a r t shall be r e a d a n d c o n s t r u e d with the
Local G o v e r n m e n t Act, 1919, as a m e n d e d by subsequent
Acts.
8 7 . (1) T h e E l e c t r i c a l C o n t r a c t o r s L i c e n s i n g Act,
1924, the E l e c t r i c a l C o n t r a c t o r s Licensing ( E l e c t r i c i a n s )
A m e n d m e n t Act, 1927, a n d the E l e c t r i c a l C o n t r a c t o r s a n d
E l e c t r i c i a n s L i c e n s i n g ( F u r t h e r A m e n d m e n t ) Act, 1928,
arc repealed.
(2) T h e E l e c t r i c a l C o n t r a c t o r s a n d E l e c t r i c i a n s
L i c e n s i n g B o a r d c o n s t i t u t e d u n d e r t h e A c t s so r e p e a l e d
is dissolved.
T h e m e m b e r s of such b o a r d holding office i m m e d i a t e l y
before the commencement of this Act shall u p o n such
commencement cease to hold such office a n d shall n o t be
entitled to receive a n y f u r t h e r fees or r e m u n e r a t i o n in
respect of such office.
(3) All licenses issued u n d e r a n y A c t r e p e a l e d by
this section a n d in force a t t h e commencement of this Act
shall, subject to t h e p r o v i s i o n s of the Local G o v e r n m e n t
Act, 1919, as a m e n d e d by subsequent A c t s , including this
Act, a n d of a n y ordinances m a d e t h e r e u n d e r , continue in
force until t h e i r e x p i r a t i o n by effluxion of time.
8 8 . T h e Local G o v e r n m e n t Act, 1919, a s a m e n d e d by
subsequent Acts, is amended—
( a ) b y i n s e r t i n g n e x t a f t e r section 512i, a s i n s e r t e d
by section thirty-five of this Act, t h e following
new Division:—
DIVISION 2C—Electrical contractors
and
electricians.
5 1 2 j . (1) A p e r s o n shall n o t u n d e r t a k e or
c a r r y out a n y electrical w i r i n g w o r k unless
he is licensed a s p r e s c r i b e d , or unless he is i n
the e m p l o y m e n t of a n d c a r r i e s out such w o r k
u n d e r the p e r s o n a l supervision of a p e r s o n so
licensed.
(2)
(2) A n electrical c o n t r a c t o r u n d e r t a k i n g
a n y electrical w i r i n g work, if h e does n o t
himself c a r r y out the work, with or without
assistance, shall c o n s t a n t l y employ on t h e w o r k
u n t i l it is completed a t least one p e r s o n licensed
a s prescribed.
Where the work is c a r r i e d out u n d e r the p e r ­
sonal supervision of a p e r s o n licensed a s p r e ­
scribed, a n d consists of fixing, connecting, a n d
m a i n t a i n i n g overhead electrical conductors n o t
in conduits, or of o t h e r work usually c a r r i e d
out by a linesman, this subsection shall n o t
extend to such work.
(3) The holder of a n electrician's li­
cense shall not u n d e r t a k e or c a r r y out a n y elec­
trical w i r i n g w o r k save as the employee of a n
electrical c o n t r a c t o r ; b u t this provision shall
n o t a p p l y w h e r e a licensed electrician u n d e r ­
t a k e s or c a r r i e s out electrical w i r i n g w o r k on
his own p r e m i s e s .
(4) Nothing in this section shall p r e v e n t
t h e employment of or the c a r r y i n g out of elec­
trical w i r i n g work by an a p p r e n t i c e or a t r a i n e e
a p p r e n t i c e w o r k i n g u n d e r the supervision of h i s
master under regulations made under the
I n d u s t r i a l A r b i t r a t i o n Act, 1912, as amended
b y subsequent Acts, or a n y other Act g o v e r n i n g
the electrical i n d u s t r y in the S t a t e .
(5) A p e n a l t y for t h e breach of a n y
provision of this section m a y be sued and
proceeded for by a n y p e r s o n whomsoever.
512K. N o t h i n g contained in this Division shall
preclude a n y unlicensed p e r s o n from u n d e r ­
t a k i n g electrical w i r i n g w o r k a s p a r t of a
c o n t r a c t for building or construction work if the
installation is c a r r i e d out by or u n d e r the per­
sonal supervision of a p e r s o n holding a license
as an electrical c o n t r a c t o r or a licensed elec­
trician.
512L. N o t w i t h s t a n d i n g a n y t h i n g contained in
this Division a n y p e r s o n , firm, company, p a r t ­
n e r s h i p , society, association or b o d y of p e r s o n s ,
c o r p o r a t e or u n i n c o r p o r a t e , not t r a d i n g a s a n
electrical
electrical c o n t r a c t o r , a n d who or which is em­
ploying a licensed electrician for t h e p u r p o s e of
m a k i n g or m a i n t a i n i n g the installations neces­
s a r y for t h e conduct of t h e business of such
p e r s o n , firm, company, p a r t n e r s h i p , society,
association or body of p e r s o n s , need n o t be
licensed u n d e r or in p u r s u a n c e of this Act, a n d
a n y licensed electrician so employed m a y c a r r y
out the duties of such employment.
512M. A n y p e r s o n a u t h o r i s e d in w r i t i n g by
t h e council or by the M i n i s t e r shall h a v e p o w e r
to e n t e r a n y p r e m i s e s a t a n y reasonable time for
the e x a m i n a t i o n of a n y electrical installation on
such p r e m i s e s .
512N. T h i s Division, a n d a n y ordinances m a d e
in p u r s u a n c e of p a r a g r a p h (h8) of subsection
one of section five h u n d r e d a n d t h i r t e e n , shall
extend to a n d a p p l y w i t h i n the City of S y d n e y
a n d t h e W e s t e r n Division.
512o. I n this Division—
" E l e c t r i c a l c o n t r a c t o r " includes a
firm,
company, p a r t n e r s h i p , society, associa­
tion or body of p e r s o n s , c o r p o r a t e or
u n i n c o r p o r a t e , t r a d i n g as a n electrical
c o n t r a c t o r , a n d a n y p e r s o n licensed u n d e r
or in p u r s u a n c e of t h i s Act a s a n electrical
contractor.
" E l e c t r i c a l i n s t a l l a t i o n " m e a n s a n y appli­
ances, wires, fittings or o t h e r a p p a r a t u s
placed in, on, u n d e r , or over a n y p r e m i s e s
(including p r e m i s e s held u n d e r lease from
t h e Crown for p r i v a t e p u r p o s e s a n d
p r e m i s e s occupied for p r i v a t e p u r p o s e s
which a r e supplied with electricity by the
C r o w n ) a n d used for or for p u r p o s e s
incidental to the conveyance, control or
use of electricity supplied or i n t e n d e d to
be supplied by an electricity s u p p l y
a u t h o r i t y , a n d w h e t h e r such appliances,
w i r e s , fittings or a p p a r a t u s a r e or a r e
not supplied by the p e r s o n c o n t r a c t i n g or
undertaking
u n d e r t a k i n g to instal the same a n d in­
cludes additions, a l t e r a t i o n s a n d r e p a i r s
to a n electrical i n s t a l l a t i o n ; but does n o t
include—
(a) a n y electricity supply m a i n or
service line of a n electricity supply

(b) a n y appliances, wires, fittings or
a p p a r a t u s connected to and beyond
a n y electrical outlet socket which is
installed for the p u r p o s e of con­
necting p o r t a b l e electrical appli­
ances, fittings or a p p a r a t u s a n d at
which fixed w i r i n g t e r m i n a t e s ; or
(c) a n y appliances, wires, fittings or
a p p a r a t u s which a r e placed in on
or over a n y p r e m i s e s owned or
occupied by the electricity supply
a u t h o r i t y a n d which a r e not used
for the consumption of electricity
on such p r e m i s e s or which a r e n o t
used solely for p u r p o s e s incidental
to the conveyance or control of
electricity so c o n s u m e d ; or
(d) a n y electrical

o r a n y franchise a g r e e m e n t u n d e r this
Act or otherwise.

P A R T X.
Amendment
of Sydney
Corporation
Act,
1932-1934.
8 9 . T h e S y d n e y C o r p o r a t i o n Act, 1932-1934, is
a m e n d e d by i n s e r t i n g n e x t a f t e r section sixty-one the
following now section:—
61A. (1) W h e r e the council p r o p o s e s to t e r ­
m i n a t e the employment of the t o w n clerk, t h e
city t r e a s u r e r , t h e h e a l t h officer, t h e city
engineer, t h e city s u r v e y o r , or the city building
s u r v e y o r , it shall either o r d e r a n i n q u i r y h e r e ­
u n d e r or s u s p e n d him.
(2) W h e r e a n y such officer is s u s p e n d e d
the council shall s t a t e the r e a s o n s for t h e
suspension.
(3) W i t h i n one week a f t e r s u s p e n s i o n
the officer m a y (if a n i n q u i r y u n d e r this section
h a s n o t a l r e a d y been held) a p p l y to the council
for an inquiry. T h e r e u p o n the council shall
o r d e r a n inquiry. If the officer does n o t a p p l y
for a n i n q u i r y the council m a y proceed to
d e t e r m i n e the m a t t e r .
(4) T h e i n q u i r y shall be held by some
p e r s o n a p p o i n t e d b y the Governor.
(5) T h e p e r s o n holding t h e i n q u i r y
shall r e p o r t to t h e council; a n d his r e p o r t shall
be r e a d in open council.
(6)
(6) W h e r e a n i n q u i r y is o r d e r e d t h e
decision of the council shall not be given until
a f t e r the r e a d i n g of t h e r e p o r t a s aforesaid.
(7) T h e p e r s o n holding t h e i n q u i r y shall
h a v e the p o w e r s conferred b y the R o y a l Com­
missions Act, 1923-1934, on a commissioner
a p p o i n t e d u n d e r Division 1 of P a r t I I of t h a t
A c t a n d the said Act, section t h i r t e e n a n d
Division 2 of P a r t I I excepted, a n d t h e p r o ­
visions of section one h u n d r e d a n d fifty-two of

(8) T h e council shall p a y to the M i n i s t e r

(9) T h e p e r s o n holding the i n q u i r y m a y
a w a r d costs a n d expenses (including t h e ex­
p e n s e s of the p e r s o n holding t h e i n q u i r y ) to
a n a m o u n t assessed by him a g a i n s t either the
council or t h e officer. A n y costs or expenses
so a w a r d e d m a y be recovered a s a debt.
(10) T h e p e r s o n holding t h e i n q u i r y
shall also d e t e r m i n e w h e t h e r t h e officer shall or
shall n o t be p a i d his s a l a r y or a n y p a r t thereof
for the p e r i o d of his suspension.

SCHEDULE TWO.
Method
of Testing
for Heating
Power.
T h e h e a t i n g power of gas m e a n s , for t h e purpose of t h i s Act, t h e
n u m b e r of B r i t i s h t h e r m a l u n i t s gross produced by t h e combustion
of one cubic foot of t h e g a s m e a s u r e d a t s i x t y degrees F a h r e n h e i t
u n d e r a pressure of t h i r t y inches of m e r c u r y a n d s a t u r a t e d w i t h water
vapour.
W h e n t h e calorimeter prescribed is so designed as to m o s t con­
veniently register t h e h e a t i n g power in calories, t h e r e s u l t shall be
c o n v e r t e d to B r i t i s h t h e r m a l u n i t s by m u l t i p l y i n g t h e n u m b e r of
calories by 3.968.
A calorie shall be u n d e r s t o o d to be t h e a m o u n t of h e a t r e q u i r e d to
r a i s e one k i l o g r a m m e of w a t e r one degree of t h e c e n t r i g r a d e t h e r ­
mometer.
I n order to t e s t t h e gas for h e a t i n g power w h e n a flow c a l o r i m e t e r
is used, t h e gas shall first pass t h r o u g h a n efficient m e t e r a n d
governor.
W h e r e a flow c a l o r i m e t e r is used t h e gas is to be lighted a n d t h e
water to be flowing t h r o u g h t h e calorimeter for a t least t h i r t y
minutes
minutes before the beginning of the testing. Not less than three
readings are to be made of the thermometers on the inlet and outlet
water supply of the calorimeter, and the average of these readings
is to be taken as the inlet and outlet temperature for that testing.
Where a Boys flow calorimeter is used each testing shall include
fifteen readings of the temperature of the outlet water made at
intervals of one quarter of one minute, and four readings of the
temperature of inlet water made at intervals of one minute. The
average of each set of fifteen and four readings, respectively, is to
be taken as the outlet and inlet temperature for that testing.
Where a recording calorimeter is used it shall be standardised by
a gas examiner upon its installation against a flow or portable calori­
meter of a type approved by the Minister, and at any time thereafter
at the discretion of the gas examiner or at the request of a company.
In the event of the heating power being at any time ascertained
to be below five hundred and fifty British Thermal units gross, or
the standard prescribed by proclamation in the Gazette in lieu of
five hundred and fifty British Thermal units gross in respect of any
particular company, a second test shall be made at an interval of not
less than one hour from the time of making the first test at that
testing-place, and the average of the two tests shall be deemed to
be the heating power of the gas at such testing place on that day.
The apparatus used for the purpose of testing the heating power
of gas shall be such as may, from time to time, be approved by the
Minister.
The Minister may, subject to such conditions as he may from
time to time impose, authorise any other method of testing approved
by a board appointed for the purpose.
Method of Testing for Purity.
The gas shall be passed through the glass vessel containing a
strip of bibulous paper moistened with the solution of acetate of
lead containing sixty grains of crystallised acetate of lead dissolved
in one fluid ounce of distilled water.
Method of Testing Pressure.
A self-registering pressure gauge shall at a point within two feet
of the building line of any premises be connected to the inlet service
pipe by a flexible or other suitable pipe, which shall be ga3-tight.

S C H E D U L E FOUR.
Amendment
of Municipal
Council of Sydney Electric Lighting
1896-1928.
Act,
The Municipal Council of Sydney Electric Lighting Act, 18961928, is amended as follows:—
(a) (i) by inserting in section two at the end of the definition
of " Council" the words " but after the day appointed
under section forty-seven of the Gas and Electricity Act,
1935, shall be deemed to refer to the Sydney County
Council constituted by that Act";
(ii) by omitting from the same section the definition of
" P u b l i c purposes" and by inserting in lieu thereof the
following new definition:—
" Public purposes " includes the lighting of or use of
electricity for any purpose in connection with
any building or land belonging to or subject to
the control of the Sydney County Council, but
does
does not include the lighting of or use of
electricity in connection with any public park
or reserve or any public street, bridge, jetty, wharf,
road, ferry, or other place which the public are
entitled to use, or any building belonging to the
Municipal Council of Sydney or any other muni­
cipal or shire council.
(b) (i) by inserting in section three after the word " Council"
the words " t o purchase a n d / o r " ;
(ii) by inserting in the same section after
"generate a n d " the word " t o " ;
the words
(iii) by omitting from the same section the words " city of
Sydney" and by inserting in lieu thereof the words
"Sydney County D i s t r i c t " ;
(c) by omitting section six and by inserting in lieu thereof the
following new section:—
6. The costs and expenses of the execution and administra­
tion of this Act shall be borne by the Council out of the;
Trading Fund of the Council.
(d) by omitting section seven;
(e) by omitting section eight;
(f) by omitting section nine;
(g) by omitting section ten;
(h) by omitting section eleven;
(i) by omitting section twelve;
(j) by omitting section thirteen;

(k) by omitting from section eighteen the words " the Metro­

Sydney or the council of the area in which the work is to be
executed " ;
(1) (i) by omitting from section twenty the word " regulations "
and by inserting in lieu thereof the words " ordinances
under the Local Government Act, 1919, as amended by
subsequent Acts " ;
(ii) by omitting from the same section all words after the
word " otherwise " ;
(m) by omitting section 21A;
(n) by omitting from section thirty-nine the word and figures
"of 1892" and by inserting in lien thereof the figures "1902"';
(o) by omitting from section forty the words " by distress and
sale of the goods and chattels of the person ordered to pay
the same and in default of sufficient distress such person
shall be liable in the event of the conviction being for an
offence under this Act, to be imprisoned with or without
hard labour for any term not exceeding three months unless
such money costs or expenses be sooner paid " and by insert­
ing in lieu thereof the words " in the manner prescribed
in section eighty-two of the Justices Act, 1902, as amended
by subsequent A c t s " ;
(p) by omitting from section forty-one the words "electric light
account" and by inserting in lieu thereof the words
" T r a d i n g Fund of the Sydney County Council";
(q) by omitting from section forty-two the words and figures
" t h e Criminal Law Amendment Act of 1883 in respect of
appeals from summary convictions thereunder" and by
inserting in lieu thereof the words and figures " P a r t V of
the Justices Act, 1902, relating to appeals to a court of
quarter sessions under that A c t " ;
(r) by omitting section forty-three;
(s) (i) by omitting from subsection one of section forty-four
the words " City of Sydney " and by inserting in lieu
thereof the words " Sydney County D i s t r i c t " ;
(ii) by omitting from the same subsection the words " (other
than the power to raise a lighting rate) within any
Local Government A r e a " and by inserting in lieu
thereof the words "within the area of any council out­
side the Sydney County D i s t r i c t " ;
(iii) by omitting paragraph (iv) of the same subsection;
(iv)
(iv) by omitting subsections two and three of the same sec­
tion;
(t) by omitting from section forty-five all words after the word
" aforesaid " ;
(u) by omitting section forty-seven;
(v) by omitting the Schedule;
(w) by omitting from the title the words " and for the above
purposes to raise by debentures the sum of two hundred
and fifty thousand pounds."
