VALUATION OF LAND (AMENDMENT) ACT.

An Act to amend the Valuation of Land Act,
1916, the Local Government Act, 1919, and
certain other Acts in certain respects; and
for purposes connected therewith. [Assented
to, 10th December, 1951.]

b y a n d with t h e advice a n d consent of t h e Legis­
lative Council a n d Legislative Assembly of New South
Wales in P a r l i a m e n t assembled, a n d b y t h e a u t h o r i t y of
t h e same, as follows :—

1. ( 1 ) T h i s A c t m a y be cited as the " V a l u a t i o n of
L a n d ( A m e n d m e n t ) Act, 1 9 5 1 " .

2. T h e Valuation of L a n d Act, 1 9 1 6 , as amended by
subsequent A c t s a n d by this Act, m a y be cited as the
V a l u a t i o n of L a n d Act, 1 9 1 6 - 1 9 5 1 .

3 . T h e V a l u a t i o n of L a n d Act, 1916, a s amended by
subsequent Acts, is a m e n d e d —
( a ) by i n s e r t i n g in section two after the word
" d i s t r i c t " the w o r d s " o r a n y p a r t of a d i s t r i c t " ;
(b) b y i n s e r t i n g in subsection one of section four
next a f t e r the definition of " M i n i s t e r " the
following new definition:—
" M u n i c i p a l i t y " includes a City.
(c) by i n s e r t i n g at the end of section five the follow­
ing new subsection:—
(2) I n d e t e r m i n i n g the i m p r o v e d value of a n y
l a n d being p r e m i s e s occupied for t r a d e , business,
or m a n u f a c t u r i n g p u r p o s e s , such value shall not
include the value of a n y plant, machines, tools,
or other appliances which a r e not fixed to the
p r e m i s e s or which a r e only so fixed t h a t they
m a y be r e m o v e d f r o m the p r e m i s e s without
structural damage thereto.
(d) by i n s e r t i n g a t the end of section seven the
following new subsection:—
(2) I n d e t e r m i n i n g the assessed a n n u a l value
of a n y land being p r e m i s e s occupied for t r a d e ,
business, or m a n u f a c t u r i n g p u r p o s e s such value
shall n o t include the value of a n y plant,
machines, tools, or o t h e r a p p l i a n c e s which a r e
n o t fixed to the p r e m i s e s or which a r e only so
fixed t h a t t h e y m a y be r e m o v e d from the
p r e m i s e s without s t r u c t u r a l d a m a g e t h e r e t o .
(e) by o m i t t i n g subsection one of section eighteen
a n d by i n s e r t i n g in lieu thereof the following
subsection:—
( 1 ) A valuation, other t h a n a v a l u a t i o n m a d e
u n d e r section seventy of this Act, shall be deemed
to be m a d e as a t the d a t e on which the official
v a l u e r r e c o r d s the v a l u a t i o n m a d e by him. T h e
v a l u a t i o n a n d the d a t e on which it was m a d e
shall be e n t e r e d in the v a l u a t i o n roll as soon a s
p r a c t i c a b l e a f t e r a p p r o v a l b y or on behalf of the
v a l u e r - g e n e r a l a n d shall be signed or initialled
b y the v a l u e r - g e n e r a l or a n officer a p p r o v e d in
that
t h a t behalf by the valuer-general. T h e valuation
roll so signed or initialled shall be conclusive
proof of the m a k i n g of the valuation on the d a t e
shown therein.
( f ) by omitting section t w e n t y a n d b y i n s e r t i n g in
lieu thereof the following section:—
20. T h e following p e r s o n s , t h a t is to say—
the holder of a n e s t a t e in fee s i m p l e ;
the m o r t g a g e e in p o s s e s s i o n ; a n d
a n y lessee who is liable to p a y r a t e s ,
m a y , by notice in or to the effect of the prescribed
form a n d on p a y m e n t of the p r e s c r i b e d fee
r e q u i r e the valuer-general to m a k e a new
valuation of his land or of his estate or interest
therein, as the case m a y b e ; a n d in a n y such case
the new valuation snail be e n t e r e d in the
valuation roll.
( g ) by omitting sections twenty-one, twenty-two,
twenty-three, twenty-four a n d twenty-five a n d
the short h e a d i n g t h e r e t o a n d by i n s e r t i n g in
lieu thereof the following sections a n d short
headings:—

21. (1) W h e r e t h e r e a r e m o r e owners t h a n one
of the freehold of a n y land the sum of the values
of the i n t e r e s t s of all the said owners in the land
shall be not less t h a n the a m o u n t a t which the
i m p r o v e d value of the land would be estimated
if held by one owner in fee simple.
(2) W h e r e t h e r e a r e m o r e owners t h a n
one of a leasehold i n t e r e s t in a n y l a n d the sum
of the values of the i n t e r e s t s of all the said
o w n e r s shall be n o t less t h a n the a m o u n t a t which
the value of the said leasehold i n t e r e s t would be
e s t i m a t e d if held by one lessee.
Interests
of lessors and lessees.
22. The value of the i n t e r e s t of a lessor or a
lessee in the i m p r o v e d value of l a n d is the
c a p i t a l sum which such i n t e r e s t m a y be expected
t o realise if offered for sale on such reasonable
t e r m s a n d conditions as a bona fide seller would
require.
(h)
(h) b y o m i t t i n g subsection two of section t w e n t y seven a n d by i n s e r t i n g in lieu thereof t h e
following subsection:—
(2) L a n d s which do n o t adjoin or which a r e
s e p a r a t e d by a road, or a r e s e p a r a t e l y owned,
shall be s e p a r a t e l y v a l u e d : P r o v i d e d t h a t t h e
v a l u e r - g e n e r a l m a y include in one valuation
l a n d s owned by the same p e r s o n and of the same
class of t e n u r e but s e p a r a t e d by a road if worked
as one holding for a g r i c u l t u r a l or p a s t o r a l
purposes.
(i) by i n s e r t i n g after p a r a g r a p h (a) of section
t h i r t y - f o u r the following new p a r a g r a p h : —
( a l ) t h a t the a r e a , dimensions or description
of the l a n d a r e n o t correctly s t a t e d ;
(j) by omitting section thirty-seven a n d by i n s e r t i n g
in lieu thereof the following section:—
37. (1) T h e v a l u e r - g e n e r a l shall, when objec­
tions to v a l u a t i o n s in respect of the l a n d in a n y
district or g r o u p of adjacent districts have been
received by him, p r e p a r e , as soon as p r a c t i c a b l e ,
in respect of each d i s t r i c t a list showing
p a r t i c u l a r s of all objections which have not been
w i t h d r a w n or which have n o t been a l t e r e d to t h e
extent claimed in the objection or to such extent
as m a y have been a g r e e d u p o n between the
objector a n d the valuer-general.
(2) T h e v a l u e r - g e n e r a l shall f o r w a r d the
list to the r e g i s t r a r of the L a n d a n d Valuation
C o u r t for h e a r i n g a n d d e t e r m i n a t i o n b y t h a t
c o u r t of such objections as a p p e a r therein.
(k) b y o m i t t i n g subsection one of section forty-two
a n d by i n s e r t i n g in lieu thereof the following
subsection:—
(1) T h e r e g i s t r a r of the L a n d a n d Valuation
C o u r t shall give notice to each objector, to the
v a l u e r - g e n e r a l a n d to the official v a l u e r for the
district of the d a t e fixed for the h e a r i n g of such
objections a s a p p e a r in the list f o r w a r d e d to him
by the v a l u e r - g e n e r a l u n d e r subsection two of
section thirty-seven of this Act.
(1)
(1) by o m i t t i n g from section forty-eight t h e w o r d s
" A v a l u a t i o n list shall also be f u r n i s h e d a t least
once in every t h r e e y e a r s a f t e r a list is first
furnished h e r e u n d e r " a n d by i n s e r t i n g in lieu
thereof
the
following
proviso
and
new
subsections:—
P r o v i d e d t h a t in a n y case w h e r e the valuerg e n e r a l considers it desirable to do so he m a y
furnish a valuation list in sections by giving such
p a r t i c u l a r s of all land within a n y one or m o r e
r i d i n g s or w a r d s of a shire or m u n i c i p a l i t y in
different y e a r s .
(2) A v a l u a t i o n list shall also be furnished at
least once in every six y e a r s after a valuation
list is first furnished h e r e u n d e r :
P r o v i d e d t h a t in a n y case w h e r e the valuerg e n e r a l considers it desirable to do so he m a y
f u r n i s h such a list in sections by giving such
p a r t i c u l a r s in respect of all l a n d within a n y one
o r m o r e r i d i n g s or w a r d s of a shire or
m u n i c i p a l i t y in different y e a r s b u t so t h a t all
land in each r i d i n g or w a r d is included in a
valuation list at least once in every succeeding
p e r i o d of six y e a r s .
(3) A v a l u a t i o n list in respect of all land
within one or m o r e r i d i n g s or w a r d s of a shire
o r municipality furnished p u r s u a n t to subsection
one or two of this section shall be deemed to be
the v a l u a t i o n list for all p u r p o s e s of t h i s Act
or a n y other Act.
( m ) by omitting subsection two of section
fifty-nine;
( n ) by omitting subsection two of section s i x t y ;
( o ) by i n s e r t i n g in section sixty-one after the w o r d s
" b a s i s of its r a t e or t a x " the w o r d s " i n respect
of a n y land included in a n y such l i s t " ;
(p)
( p ) (i) by i n s e r t i n g in subsection one of section
sixty-two
after
the
words
"taxing
a u t h o r i t y " the w o r d s " i n respect of a n y
l a n d included in a n y such l i s t s " ;
(ii) by i n s e r t i n g in the same subsection after t h e
w o r d s " t a x i n g y e a r " the w o r d s " o r w h e r e
p a r t of a s e p a r a t e p a r c e l of l a n d h a s been
sold or r e s u m e d before the commencement
of the r a t i n g or t a x i n g y e a r " ;
(iii) by i n s e r t i n g in subsection two of the s a m e
section a f t e r t h e w o r d " e x c e p t " w h e r e
firstly o c c u r r i n g the w o r d s " t o the e x t e n t
n e c e s s a r y to give effect to the provisions of
subsection one of this section o r " ;
(iv) b y i n s e r t i n g a t the end of the same subsection
the w o r d s " o r m i s d e s c r i p t i o n " ;
(q) by omitting subsection one of section seventy
a n d by i n s e r t i n g in lieu thereof t h e following
subsection :—
(1) T h e v a l u e r - g e n e r a l shall, on application
m a d e by a n y p e r s o n who h a s or h a d an e s t a t e
or i n t e r e s t in the l a n d a t the d a t e a t which h e
r e q u i r e s the v a l u a t i o n m a d e a n d on p a y m e n t of
the p r e s c r i b e d fee, m a k e a fresh v a l u a t i o n t o
d e t e r m i n e the value of a n y l a n d a t a d a t e before
or a f t e r the d a t e of the m a k i n g of the l a s t
v a l u a t i o n of such l a n d u n d e r this Act.
This
subsection
shall
apply
only
to
applications m a d e for v a l u a t i o n s to be used for
a n y of the p u r p o s e s mentioned in this P a r t .
( r ) (i) b y o m i t t i n g the s h o r t h e a d i n g to section
seventy-six a n d by i n s e r t i n g in lieu thereof
the following s h o r t h e a d i n g : —
Certificates
of valuation,
certified
copies and
extracts.
(ii) by omitting subsection one of the s a m e
section a n d by i n s e r t i n g in lieu thereof t h e
following subsection:—
(1) T h e v a l u e r - g e n e r a l shall, on applica­
tion m a d e in w r i t i n g a n d on p a y m e n t of t h e
prescribed
p r e s c r i b e d fee, s u p p l y to a n y p e r s o n in
such f o r m as the v a l u e r - g e n e r a l m a y
d e t e r m i n e a certified copy u n d e r seal or an
e x t r a c t of a n y e n t r y in a valuation roll.
The
valuer-general
shall
supply
a
certificate of valuation to the a p p l i c a n t
t h e r e f o r in respect of a new v a l u a t i o n m a d e
p u r s u a n t to an application u n d e r section
t w e n t y or section seventy of t h i s Act.
A n y such certified copy u n d e r seal or a n y
such certificate of v a l u a t i o n shall in all
proceedings a n d for all p u r p o s e s be evidence
of the m a t t e r s a n d things s t a t e d t h e r e i n a n d
t h a t the valuation mentioned t h e r e i n h a s
been duly m a d e in accordance with this Act.
( s ) by o m i t t i n g from section eighty-four the w o r d s
" a n d e x p e n d i t u r e u n d e r this A c t in respect of
such y e a r " a n d by i n s e r t i n g in lieu thereof the
w o r d s "of, a n d e x p e n d i t u r e by the d e p a r t m e n t
of the v a l u e r - g e n e r a l in respect of such y e a r " .
P A R T III.
A M E N D M E N T OF T H E LOCAL GOVERNMENT A C T , 1919,
AS
A M E N D E D BY SUBSEQUENT A C T S .
4. (1) T h e Local G o v e r n m e n t Act, 1919, a s amended
by subsequent Acts, is a m e n d e d —
(a) by omitting subsection one of section one
h u n d r e d and t h i r t y - t h r e e a n d by i n s e r t i n g in lieu
thereof the following subsection:—
(1) T h i s section shall not a p p l y in a n y a r e a
until a valuation list u n d e r the V a l u a t i o n of
L a n d Act, 1916-1951, is furnished to the council
of the a r e a in respect of all l a n d within the a r e a :
P r o v i d e d t h a t in a n y case where a n y such
valuation list is furnished in respect of p a r t only
of t h e a r e a this section shall t h e r e u p o n a p p l y
to a n d in respect of all land within such p a r t .
(b)
(b) by i n s e r t i n g a t the end of subsection one of
section one h u n d r e d a n d t h i r t y - s i s the following:
new p r o v i s o : —
P r o v i d e d t h a t w h e r e a valuation list is
furnished or supplied to the council by t h e
V a l u e r - G e n e r a l in respect of p a r t only of t h e
a r e a the v a l u a t i o n book shall be constituted b y
such v a l u a t i o n list ( t o g e t h e r with a n y s u p p l e ­
m e n t a r y list so furnished or supplied) a s to t h e
land within t h a t p a r t a n d by the v a l u a t i o n book
k e p t as p r e s c r i b e d u n d e r Schedule I I I of t h i s
Act as to the residue of the l a n d within the a r e a .
(c) (i) by i n s e r t i n g in subsection t h r e e of section
one h u n d r e d a n d thirty-seven a f t e r t h e
figures " 1 9 1 6 " the w o r d s " i n respect of t h e
whole or in respect of p a r t of the land w i t h i n
its a r e a " ;
(ii) by omitting from the same subsection t h e
w o r d s " w i t h respect to t h a t c o u n c i l " a n d b y
i n s e r t i n g in lieu thereof the w o r d s " i n
respect of the l a n d within the a r e a or w i t h i n
t h e p a r t of the a r e a included in s u c h
v a l u a t i o n list, as the case m a y r e q u i r e " ;
( d ) by o m i t t i n g section 137A;
(e) by i n s e r t i n g a t the end of section 1 of ScheduleT h r e e the following w o r d s " i n r e s p e c t of which
a v a l u a t i o n list h a s n o t been f u r n i s h e d to t h e
council by the V a l u e r - G e n e r a l in accordance w i t h
the V a l u a t i o n of L a n d Act, 1916-1951";
(f) by o m i t t i n g subsection (2) of section 10 of t h e
same Schedule a n d b y i n s e r t i n g in lieu t h e r e o f
the following subsection:—
(2) L a n d s which do n o t adjoin or which a r e
s e p a r a t e d by a r o a d , or a r e s e p a r a t e l y owned,
shall be s e p a r a t e l y v a l u e d : P r o v i d e d t h a t l a n d s
owned by t h e same p e r s o n a n d of the same class
of t e n u r e b u t s e p a r a t e d b y a r o a d m a y be
included in one v a l u a t i o n if worked a s oneholding for a g r i c u l t u r a l or p a s t o r a l p u r p o s e s .
(2)
(2) T h i s subsection shall a p p l y to a n y shire within
which, immediately before the commencement of t h i s
A c t , the v a l u a t i o n of r a t a b l e land had, p u r s u a n t to section
137A of the Local G o v e r n m e n t Act, 1919, as enacted
i m m e d i a t e l y before such commencement, been m a d e for
the p u r p o s e s of the Local G o v e r n m e n t Act, 1919, a s
a m e n d e d b y subsequent Acts, in accordance with t h e
p r o v i s i o n s of Schedule I I I of t h a t Act, as so amended.
The v a l u a t i o n of r a t a b l e l a n d within a n y such shire
shall continue to be m a d e for the p u r p o s e s of the Local
G o v e r n m e n t Act, 1919, as so amended, in accordance with
the provisions of the said Schedule I I I until a v a l u a t i o n
list or lists h a s or have been furnished to the council of
such shire by the V a l u e r - G e n e r a l in accordance with the
V a l u a t i o n of L a n d Act, 1910-1951.
W h e r e a valuation list h a s been so furnished in respect
•of the whole shire or in respect of a n y r i d i n g thereof the
p r o v i s i o n s of the said Schedule shall cease to be in force
w i t h respect to land within such shire or riding, as the
c a s e m a y be.
P A R T IV.
AMENDMENT
1948,
OF T H E LOCAL GOVERNMENT
(AREAS)
ACT,
AS A M E N D E D BY SUBSEQUENT A C T S .
5. (1) The Local G o v e r n m e n t ( A r e a s ) Act, 1948, as
a m e n d e d by subsequent Acts a n d by this Act, m a y be
cited as the Local G o v e r n m e n t ( A r e a s ) Act, 1948-1951.
(2) The Local G o v e r n m e n t ( A r e a s ) Act, 1948, as
a m e n d e d by subsequent A c t s , is a m e n d e d by omitting
subsection four of section seventeen a n d b y i n s e r t i n g in
lieu thereof the following subsection:—
(4) The
Valuer-General
shall
as
soon
as
practicable after the commencement of the Valuation
of L a n d ( A m e n d m e n t ) Act, 1951, f u r n i s h to the
council of each united a r e a a v a l u a t i o n list or lists in
•respect of t h a t a r e a .
This
This subsection shall not operate to require the
Valuer-General to furnish any valuation list or lists
in respect of any united area or parts thereof in
respect of which a valuation list or lists has or have
been furnished pursuant to the subsection which this
subsection replaces.
