Annual Corporate Declaration Criterion:
The manufacturer shall demonstrate the following requirements are met for all end-of-life equipment
collected by the manufacturer (or their contractual agent) pursuant to the “Required—Provision of product
take-back service” criterion contained herein:
The manufacturer utilizes a government-approved program for end-of-life electronics processing in which
the manufacturer does not control the selection of initial service providers for the covered product in the
jurisdiction.
or
The manufacturer utilizes initial service providers that meet one of the following:
1) are certified by an independent certification body1 to a publicly available qualified electronics
recycling standard that meets Minimum Technical Requirements (a) through (h), below, such as:
 The Responsible Recycling (R2) Standard for Electronics Recyclers,
 The E-Stewards Standard for Responsible Recycling and Reuse of Electronic Equipment;
 EN 50625
Or
2) demonstrate conformance through annual third-party audits to a qualified electronics recycling
standard that meets Minimum Technical Requirements (a) through (h), below. The audit shall be
performed by a third-party conformity assessment body operating to ISO/IEC 17021.
For products declared in the US and Canada, manufacturers shall conform with paragraph 1) above.
For either option 1 or 2 above, the manufacturer may use an initial service provider in another country that
meets the requirements of paragraph 1), above and in compliance with international laws and agreements.
Footnote 1: “Independent Certification Body” is a body that has been accredited by a national accreditation
body, is a signatory to the International Laboratory Accreditation Cooperation (ILAC) Mutual Recognition
Arrangement (MRA) or the International Accreditation Forum (IAF) Multilateral Recognition Arrangement
(MLA)
If a government-approved program applies to a limited scope of products (e.g., consumer but not
institutional/commercial products), the manufacturer shall deliver a program that utilizes initial service
providers that meet a qualified standard for all other end-of-life equipment pursuant to the “Required—
Provision of product take-back service” criterion and not covered by the government-approved program.
The following programs operated by the manufacturer (or their contractual agent) are exempt from the
requirements of this criterion:


Trade-in/exchange programs where the customer surrenders the product to the manufacturer (or
their contractual agent) in return for compensation or replacement product.

Product servicing and/or warranty programs, operated by the manufacturer, or their contractual
agent, where a product (or similar product) is returned to a customer.
For the preceding exempted programs, the manufacturer shall provide documentation that addresses
the manufacturer’s compliance with the legal requirements of importing, exporting and transit
countries for transboundary trade to the point of repair or refurbishment.
In addition, manufacturers shall ensure that any residual equipment and components (including
unrepairable equipment/components or equipment/components with no reuse value or market), scrap, and
materials derived from equipment that result from these exempt programs are processed by a recycler
certified to a qualified recycling standard and that any transboundary trade to the certified recycler meets
the legal requirements of importing, exporting and transit countries. Such equipment/components returned
under the exempt program that are under warranty may instead be returned to the original parts supplier.
A qualified electronics recycling standard shall either meet the following Minimum Technical
Requirements a) through h) or shall meet Consensus Development Requirement i) below and be listed on a
publicly available website of an independent CB or registry service. An independent CB or a registry
service providing a registry of products declared to conform to this Standard shall determine whether an
electronics recycling standard is qualified.
For the purposes of this criterion, a manufacturer’s internal technical performance requirements for initial
service providers may qualify, if they meet the above requirements for a qualified electronics recycling
standard.
Minimum Technical Requirements:
a) The standard is applicable within the country(s)/region(s) being declared to, and is applicable to the
scope of equipment covered by this criterion.
b) The standard includes a definition for “materials of concern” (or analogous term identifying
materials with hazardous characteristics or materials with special handling needs) and requires initial
service providers to have a written management plan for these materials that protects human health and
the environment.

c) The standard requires that initial service providers shall maintain, review annually, and update as
needed, an environmental, health and safety management system.
d) The standard requires that material intended for reuse, repair, refurbishment, remanufacturing,
recycling and/or disposal shall be managed in accordance with applicable trade and transporting laws
of the exporting, transit, and importing countries.
e) The standard requires that, prior to shipping by any party in the recycling chain, and in conformance
with the laws of the importing and exporting countries:

equipment/components that contain materials of concern and are being sold or transferred for
reuse/resale be tested to confirm that key functions are working and ensuring that all equipment
and components are clean and free of major cosmetic defects, AND
if key functions are determined not to be working, equipment/components shall be sent to a
qualified service provider for repair, refurbishment, or recycling.

Prior to sale to final end user, equipment must be configured with the appropriate legally licensed
software where required for basic operations and device specific drivers for hardware.
The standard requires that equipment/components going for reuse, repair or
refurbishment shall be tested to confirm that key functions of the equipment/components
are working properly, prior to export by any vendor in the recycling chain in conformance with the
laws of the importing country.
f) The standard requires the initial service provider to dispose of “materials of concern” in a hazardous
material disposal facility or alternatively they may be managed by other facilities in accordance with
country/region laws.

g) The standard requires that initial service providers shall control, document and track the material
flow of all equipment, components, and materials covered by the standard, that pass through its
facilities.
h) The standard requires initial service providers to track all “materials of concern” to final disposition,
and to ensure that the downstream take-back service providers are meeting the requirements of items c)
through h).
Consensus Development Requirement:
i) The standard (1) was developed or adopted by a voluntary consensus standards body;2 (2) is
applicable within the country(s)/region(s) being declared to, and is applicable to the scope of
equipment covered by this criterion; (3) at a minimum, defines the handling, tracking, and disposition
of “materials of concern” (or analogous term identifying materials with hazardous characteristics) by
initial service providers and downstream service providers to protect human health and the
environment; and (4) requires intellectual property (IP) relevant to the standard be made available by
the IP owner on a non-discriminatory, royalty-free or reasonable royalty basis to all interested parties.
Applies to: All products that are declared to conform to this standard, in the country(s)/region(s) within
which conformance is publicly declared.
Verification requirements:
1) Declaration from manufacturer.
2) For each of the country(s)/region(s) within which the manufacturer is declaring the product conformant,
the following shall be documented:
a.
Government sanctioned or operated program(s)3 utilized by the
manufacturer, and the scope of entity covered by the program. (e.g., consumer,
commercial/institutional, or both)
Evidence of participating in the government sanctioned or operated program in that
country/region; and/or,
b.
For each initial service provider that performs take-back services outside of
a government sanctioned or operated program, in conformance with a qualified recycling standard:
i.
Copy/evidence of a current certification, performed by an independent CB,
to the qualified recycling standard(s), and/or
ii. Findings (including all non-conformances) and planned/implemented resolutions of
current second- or third-party audit reports examining the performance of the initial
service provider against the qualified recycling standard and Manufacturer statement that
the initial service provider performance is acceptable and either in substantial

Below are the existing EOL processing Verification requirements from .2 and .3:
1) Declaration from manufacturer
2) Complete list of subscriber’s initial service providers for the declared country/region
3) Declaration of which standard(s) in each country is being met by each initial service provider in
each country
4) Evidence that the initial service providers utilized are performing take-back services to the declared
qualified recycling standard

by all of their initial service providers, or
 For use only during the 18-month grace period, copies of second- or third-party audit reports of
their initial service providers indicating conformance to the declared qualified recycling
standard(s)
5) For programs exempt from this criterion’s requirements for certification to a qualified recycling
standard, the manufacturer shall provide documentation of certification to qualified recycling
standard, or documentation that addresses the manufacturer’s compliance with the legal
requirements of importing, exporting, and transit countries for transboundary trade to the point of
repair or refurbishment
6) For programs exempt from this criterion’s requirements for certification to a qualified recycling
standard, the manufacturer shall provide evidence that residual equipment and components, scrap,
and materials derived from equipment from these programs are processed by a recycler certified to a
qualified recycling standard; and documentation that addresses the manufacturer’s compliance with
the legal requirements of importing, exporting, and transit countries for transboundary trade to the
certified recycler
