DECISION
ON THE APPROVAL OF ENVIRONMENTAL IMPACT ASSESSMENT REPORT
FOR "VINH TAN 4 THERMAL POWER PLANT" PROJECT
MINISTER OF NATURAL RESOURCES & ENVIRONMENT MINISTRY
Pursuant to the Environment Protection Law dated November 29, 2005;
Pursuant to Decree No. 21/2013/ND-CP dated March 4, 2013 of the Government defining
the functions, tasks, powers and organizational structure of the Ministry of Natural Resources
and Environment;
Pursuant to Decree No. 29/2011/ND-CP dated April 18, 2011 of the Government on
regulations in strategic environmental assessment, environmental impacts assessment, and
environmental protection commitment;
Pursuant to Circular No. 26/2011/TT-BTNMT dated July 18, 2011 of the Ministry of Natural
Resources and Environment detailing a number of articles of the Government's Decree No.
29/2011/ND-CP dated April 18, 2011 on strategic environmental assessment, environmental
impact assessment and environmental protection commitment;
According to the Proposal of the Appraisal Council of the Environmental Impact Assessment
(EIA) report for Vinh Tan 4 Thermal Power Plant project within the framework of the meeting
held in May 13, 2013;
With regard to contents of the EIA report of Vinh Tan 4 Thermal Power Plant project which
was modified, supplemented and enclosed with the Document No 1204/ANDVT-KTKH dated
September 5, 2013 of Vinh Tan Thermal Power Management Board;
According to the Proposal of Head of Vietnam Environment Administration (VEA),
DECIDES:
Article 1: To approve the contents of the EIA report of Vinh Tan 4 Thermal Power Plant
project (hereinafter called "the Project") located in Vinh Tan Commune, Tuy Phong District,
Binh Thuan Province compiled by the Vinh Tan Thermal Power Management Board (the
Project's Owner) with details as below:

1. Scope, scale and capacity of the Project:
1.1. The project includes two units with total capacity of 1200 MW;
1.2. Activities of compensation, site clearance, resettlement; ground leveling, ash yard; water
supply system, electricity supply system; passageway dredging; mines (land mines, quarry,
sand mines, limestone) in service of construction of the power plant do not fall within the
scope of this EIA report.
2. Requirement on environmental protection for the Project:
2.1. To collect waste soil and stone, domestic waste and industrial waste generated during the
construction process for the purpose of ensuring all requirements on safety and sanitation;
2.2. To design, construct and operate a system servicing the collection and treatment of
exhausted gases to ensure the whole volume of air emission generated from the Plant will be
collected and treated to meet Vietnam's National technical regulations: QCVN
22:2009/BINM before being discharged into the environment;
2.3.To design, construct and operate a system servicing the collection and treatment of
wastewater to ensure the whole volume of wastewater generated from the Plant will be
collected and treated to meet Vietnam's National technical regulations: QCVN
40:2011/BTNMT (for industrial wastewater) and QCVN 14:2008/BTNMT (for domestic
wastewater) before being discharged into the environment;
2.4. To collect, transport, and treat the whole volume of domestic solid waste, usual solid waste,
and hazardous solid waste generated from the implementation of the Project, complying with
regulations stipulated in the Decree No. 59/2007ND-CP dated April 09, 2007 of the
Government on solid waste management and the Circular No. 12/2011/TT-BTNMT dated
April 14, 2011 of MONRE on hazardous waste management;
2.5. To design, construct and operate a system servicing the intake and discharge of cooling
water for the purpose of no negative impact on the aquatic - ecosystem, the quality of coastal
seawater and cooling water demand of other plants within the Vinh Tan Power Complex;
2.6. To design, install and operate receiving systems for coal, oil as well as other materials and
fuels in service of the Project, complying with technical procedures, and ensuring safety and
not polluting to the surrounding environment;
2.7. To install a continuous monitoring system to control discharge flow and concentrations of
dust, SO,,, NON, and CO in the flue gas stream before emitting from stacks; flow,
temperature, the residual chlorine of cooling water at discharging point;
2.8. To implement monitoring program on the environment and the constructions, measures for
environmental protection as per pointed out in the approved EIA report; to archive
monitoring data for the Governmental environment protection Authorities to inspect as
needed;

3. Concomitant conditions:
3.1. To incorporate with the local authorities to implement the compensation, resettlement for
households and people who will be affected by the implementation of the Project according
to the current legislation;
3.2. To incorporate with the local authorities to define dredged mud disposal site during
construction and operation process of the Project and only dispose the dredged mud with
permission from the local authorities; to apply appropriate technical and managing methods
ensuring no negative impact on economic activities, people's livelihood, ecosystems and
meeting all requirements on environmental sanitation;
3.3. To comply with regulations on protection, conservation of Hon Can Marine Protected Area;
3.4. To comply with regulations on waterway transportation, fire fighting and prevention,
incidents responses, labor safety and related technical regulations during the performance of
the Project's activities;
3.5. To comply with current regulations on water resources use and exploitation permission, as
well as on the discharge of wastewater to water sources during the implementation of the
Project.
Article 2: The responsibility of the Project's Owner includes:
1. To make, approve and publicize the environmental management plan for the Project before
implementing the Project;
2. To strictly comply with requirements on environmental protection stipulated at Clause 2,
article 1 of this Decision and other responsibilities according to the law provisions on
environmental protection;
3. To compile a dossier to propose the test and confirmation of completed works of
environmental protection methods in service of operation stage of the Project, sending to
competent authorities to test and confirm before officially operating the Plant.
Article 3: All changes to the contents of Articles I and 2 of this Decision during the Project's
implementation shall be informed and reported via official documents by the Project's Owner.
These changes shall only be legal and ready for performing after being approved in written
consent by MONRE.
Article 4: The Decision on approval of EIA Report of the Project is basis to determine the
project investment; also basis for the competent authorities to examine and inspect the
performance of environmental protection of the Project.
Article 5: To assign the Vietnam Environment Administration sponsor, incorporate with
Binh Thuan Department of Natural Resources and Environment and other related agencies of

MONRE to examines inspect and confirm the implementation of the environmental protection
contents in the ETA report approved by this Decision.
Article 6: This decision is valid for implementation from the date of signing./.
