Page i Notice of Requirement for Alteration to Designation: Retaining Wall 603 (Unitec) 1. Introduction The New Zealand Transport Agency (NZ Transport Agency) gives notice of a requirement to alter a designation under Section 181(1) of the Resource Management Act 1991 (the RMA or the Act). The notice is set out in the prescribed forms contained in Appendix A. The alteration of the designation is required to enable the widening of State Highway 16 (SH16) as part of the Waterview Connection Project. Two additional areas of land measuring 3m2 and 65m2 are required to accommodate the construction of a new retaining wall adjoining the site at 1 Carrington Road, Mt Albert. This notice can be considered as a minor Alteration to the Designation in accordance with Section 181(3) of the RMA which provides that: “A territorial authority may at any time alter a designation in its district plan or a requirement in its proposed district plan if— (a) the alteration— (i) involves no more than a minor change to the effects on the environment associated with the use or proposed use of land or any water concerned; or (ii) involves only minor changes or adjustments to the boundaries of the designation or requirement; and (b) written notice of the proposed alteration has been given to every owner or occupier of the land directly affected and those owners or occupiers agree with the alteration; and (c) both the territorial authority and the requiring authority agree with the alteration— and sections 168 to 179 shall not apply to any such alteration.” In regards to (a), Sections 5 and 4 confirm that the alteration involves no more than a minor change to the effects on the environment and involves only a minor adjustments to the boundaries of the designation. In regards to (b), written notice of the proposed alteration has been given to the Unitec Institute of Technology (Unitec) as the directly affected landowner and Unitec agree with the alteration. Their written agreement is contained in Appendix B. In regards to (c), as the requiring authority the NZ Transport Agency agree with the alteration. 2. The Designation The designation is identified in the Operative Auckland City District Plan: Isthmus Section (1999) as: “A07-01E Motorway: Western Ring Route - Waterview Connection, Alteration to Designation A07-01 SH16 between Great North Road and St Lukes Interchange” The designation is shown on Auckland City Council District Plan Map D04, Planning Map No.2 contained in Appendix C. The Site to which the Requirement Applies The land is legally described as Lot 5 DP 314949. It is bounded by Carrington Road on the eastern boundary and SH16 on the northern boundary. The location of site is shown on plan DG-GK-3211 contained in Appendix D. 4. The Nature of the Proposed Work As part of the Waterview Connection Project, SH16 is to be widened between Carrington Road and the Great North Road off-ramp. This widening necessitates the removal of the existing retaining wall adjoining the Unitec campus site at 1 Carrington Road, Mt Albert. A new retaining wall (referred to as Retaining Wall 603) will be constructed approximately 4 metres from the existing retaining wall. The location of the new retaining wall is determined by the necessary safe sight distances and visibility for traffic on the SH16 west-bound to SH20 south-bound ramp of the Great North Road Interchange. Two additional areas of land measuring 3m2 and 65m2 are required to accommodate the widening of SH16 and construction of the new retaining wall. The alteration is limited to these two areas of land, being a total of 68m2. Figure 1 shows the location of the affected land and the existing designation and Appendix D contains the land requirement plan. Figure 1: Affected Land 025-RCA-01010 Page 2 Revision 0 12/11/2013 Notice of Requirement for Alteration to Designation: Retaining Wall 603 (Unitec) In addition to these two areas of land, the construction of the retaining wall also requires sub surface soil nails encroaching into Unitec owned land. These are shown as the red and yellow lines in Figure 1. The NZ Transport Agency and Unitec are currently negotiating an easement for the soil nails. 5. The Effects on the Environment The effects of the retaining wall construction and motorway operation in this area were considered in depth in the assessment of effects prepared by the NZ Transport Agency (dated August 2010) and the subsequent Board of Inquiry into the New Zealand Transport Agency Waterview Connection Proposal in 2011. Altering the boundaries of the designation to incorporate the two small additional areas of land results in no more than a minor change to these effects and does not necessitate any change of conditions of the designation. As a result of the alteration to the designation, two sections of the existing basalt stone wall measuring approximately 5 metres and 70 metres need to be removed and rebuilt on the new legal boundary (being also the proposed designation boundary). Those parts of the stone wall that are located within the Unitec site are included in the Auckland City District Plan scheduled area for the former Carrington Hospital Building (ACC Map 2, D04-01) which includes the main building and site surrounds. Within the Plan, ‘Site Surrounds’ means - “all that land between the building and the site boundaries to the north (motorway) east (Carrington Road) and west site boundaries…” Consultation has been undertaken with the New Zealand Historic Places Trust (NZHPT) to ascertain whether the stone wall has any specific historic importance. The NZHPT has confirmed that the wall appears to be of late 20th Century origin and is not a heritage item. Reviews of historical aerial photographs for the area indicate that the stone wall did not exist in this location prior to the construction of the motorway in the 1960s. This section of the motorway was also widened in the early 1980’s and the stone wall was also altered at that time to accommodate those works. Given that the stone wall is of 20th century origin and therefore is not a heritage/ archaeological feature, the NZHPT has confirmed that an application for an authority under the Historic Places Act is not be required for the relocation of the stone wall. The two affected sections of the stone wall will be removed to a stockpile prior to the adjacent motorway retaining wall works commencing. The wall will be rebuilt on the new site boundary once the initial soil nails and capping beam have been constructed. This is expected to be in June 2014). A specialist stone mason has been engaged to undertake the stone wall reconstruction works. The NZ Transport Agency (via the Well-Connected Alliance) has been in discussions with Unitec regarding the stone wall relocation and reconstruction. These discussions have covered the form of the final wall, the likely construction programme, construction access and construction effects. The certified Construction Environmental Management Plan (Rev 4 Certified February 2013) sets out the measures proposed for managing effects during construction including noise, traffic, and communication. 025-RCA-01010 Page 3 Revision 0 12/11/2013 Notice of Requirement for Alteration to Designation: Retaining Wall 603 (Unitec) 6. Alternative Sites, Routes and Methods During detailed design of the retaining wall, the Well-Connected Alliance have investigated a number of options to achieve the necessary safe sight distances and better visibility for vehicles on SH16 which would avoid additional land acquisition. Based on the geometric safety audits undertaken by the NZ Transport Agency, the proposed design is the only option which achieves full compliance for safe site distance on SH16. All alternatives within the existing designation result in compromises for safe site distances and are therefore not acceptable to the NZ Transport Agency. Therefore there are no acceptable alternative sites, routes and methods to achieve the widening of SH16 in this location. 7. Objectives of the Requiring Authority The widening of SH16, to provide for the new Great North Road Interchange, necessitates the removal of the existing motorway retaining wall and construction of a new section of retaining wall. Two additional areas of land are required to accommodate the widening where the new retaining wall cannot fit within the existing designation. The new retaining wall has been designed to achieve the necessary safe sight distances and better visibility for vehicles travelling on the SH16 exiting to the Great North Road westbound off-ramp and the southbound ramp to the SH20 tunnel. The NZTA cannot achieve the necessary safe sight distances within the existing designation and therefore seek an alteration to include the two additional areas of land. 8. Consultation Consultation has been undertaken with representatives of the directly affected landowner, Unitec. The NZTA and Unitec are engaged in negotiations for the purchase of the affected property. As the only directly affected landowner, Unitec has provided its written agreement to the alteration. This agreement is contained in Appendix B. Consultation has also been undertaken with the NZHPT to ascertain whether the basalt stone wall on the existing property boundary is of historic importance. As noted in Section 5, the NZHPT have confirmed that the wall is not an archaeological feature under the Historic Places Act 1991. No other parties are considered likely to be affected by this alteration. Notwithstanding this, regular and ongoing consultation with the community and other stakeholders is part of the existing designation conditions. 9. Conclusion This notice of a requirement to alter a designation has been prepared in accordance with Section 181(3) of the RMA for the addition of two areas of land measuring 3m2 and 65m2 at 1 Carrington Road, Mt Albert.
