AQUASTAT USER AGREEMENT Please read this User Agreement carefully before using any data from AQUASTAT This Data and Web Site User Agreement (“User Agreement”) is between you and the Food and Agriculture Organization of the United Nations (“FAO”), which administers the AQUASTAT web site and any information contained therein with the home page http://www.fao.org/nr/water/aquastat/main/index.stm (the “Web Site” or “AQUASTAT”). The rights and obligations concerning use of AQUASTAT in accordance with this User Agreement are personal to you and are not transferable to any other person or entity. From time to time, FAO may modify these terms and conditions. Accordingly, please continue to review the terms and conditions whenever accessing or using AQUASTAT, since any use by you after any such changes, modifications, or additions shall be governed by this User Agreement. By using the Web Site, and/or accessing or using information (the “Information”) from the AQUASTAT website, you agree to and are bound by the following terms and conditions: I. GOALS AQUASTAT is FAO’s global information system on water and agriculture, operational since 1993. It collects, analyses and disseminates data and information by country and by region. Its aim is to provide users interested in global, regional and national analysis, such as policymakers, decision-makers, researchers, with comprehensive information related to water resources, water use and agricultural water management across the world. II. USE OF INFORMATION AQUASTAT contains proprietary information and thus is protected by international intellectual property agreements and copyright laws and regulations worldwide. FAO hereby grants you a license to view, use, download, analyse and print the information contained in AQUASTAT solely for your own non-commercial purposes and in accordance with this User Agreement. Reproduction and dissemination of material contained in AQUASTAT for educational or other non-commercial purposes are authorized without any prior written permission from the copyright holders provided the source is fully acknowledged. Reproduction of material for resale or other commercial purposes is prohibited without the written permission of the copyright holders. Any requests for permission to reproduce or otherwise use any material contained on or otherwise made available to you in AQUASTAT other than as provided for herein, should be made by filling in the Licence Request Form. III. WEB SITE AND INFORMATION 1. Warranty and Disclaimers. The web site and all information contained therein are provided by FAO under this user agreement "as is" without warranty of any kind, either 1 express, implied, statutory or otherwise, including, but not limited to, the implied warranties of title, non-infringement, merchantability or fitness for a particular purpose. To the maximum extent permitted by law, FAO will have no liability related to the information and data arising under applicable law to this agreement on intellectual property rights, libel, privacy, publicity, obscenity or other applicable law as defined in this user agreement. FAO also disclaims all liability with respect to the misuse, loss, modification, or unavailability of any information. The use of the web site and all information contained therein is done at your own discretion and risk and with your agreement that you will be solely responsible for any damage to your computer system, loss of data, or other harm that results from such activities or the use of the website and the information contained therein. FAO assumes no liability for any computer virus or other similar software code that is downloaded to your computer from the web site or in connection therewith. 2. Limitation of Liability. In no event shall FAO, its trustees, officers, employees, independent contractors, or agents be liable to you or any third party for any special, punitive, incidental, indirect or consequential damages or losses of any kind, or any damages or losses whatsoever, including those resulting from loss of use, data or profits, whether or not foreseeable or if FAO has been advised of the possibility of such damages or losses, and on any theory of liability, including breach of contract or warranty, negligence or other tortuous action, or any other claim arising out of or in connection with: (1) the access or use of or the inability to access or use the web site; (2) the statements or actions of any third party on or via the web site; (3) any unauthorized access to or alteration of the website; (4) any information that is sent or received or not sent or received; (5) any failure to store or loss of data or other content; (6) any services available that are delayed or interrupted; (7) any web site referenced or linked to from this web site; or (8) your access to or use of or inability to access or use any linked site. 3. The designations employed and the presentation of material in AQUASTAT do not imply the expression of any opinion whatsoever on the part of the FAO concerning the legal or development status of any country, territory, city or area or of its authorities, or concerning the delimitation of its frontiers or boundaries. the mention of specific companies or products of manufacturers, whether or not these have been patented, does not imply that these have been endorsed or recommended by FAO in preference to others of a similar nature that are not mentioned. the designations employed and the presentation of material in FAO do not imply the expression of any opinion whatsoever on the part of FAO concerning the legal or constitutional status of any country, territory or sea area, or concerning the delimitation of frontiers. 4. Indemnification. You agree to indemnify, defend and hold FAO and its trustees, officers, employees, independent contractors and agents harmless from any and all third-party claims, including reasonable attorneys' fees, due to or arising from: (a) Information that you may access or use through the Web Site, including your reliance on the accuracy, completeness or usefulness of the Information; (b) your access to or use of the Web Site of the Information; (c) your connection to the Web Site; (d) your violation of this User 2 Agreement; and (e) your infringement of any third party’s copyright, trademark, or other proprietary rights, violation of privacy rights or publicity rights, and libel or violation of any other law in connection with this User Agreement. IV. GENERAL 1. Choice of Law. This User Agreement shall be governed by general principles of law, to the exclusion of any single national system of law. Any dispute, controversy or claim arising under or pursuant to this User Agreement shall be settled by mutual agreement. If FAO and you are unable to reach agreement on any question in dispute, either party shall have the right to request arbitration in accordance with the Arbitration Rules of the United Nations Commission on International Trade Law. FAO and you agree to be bound by any arbitration ruling rendered in accordance with the above, as the final adjudication of any such dispute. 2. Nothing contained in or related to this User Agreement shall be deemed a waiver, express or implied, of the privileges and immunities of FAO, nor as conferring privileges or immunities of FAO to you. 3. International Users. The Web Site is controlled, operated and administered by FAO. FAO makes no representation that the Web Site and Information are appropriate or available for use at any location. If you access the Web Site, you are responsible for compliance with all laws applicable to you. 4. Modification. FAO may, in its sole discretion, modify portions of this User Agreement at any time. FAO may notify you of any changes by posting notice of such modifications on the Web Site or sending notice via e-mail, postal mail or other means. Your continued use of the Web Site following notice of such modifications shall be deemed to be your acceptance of any such modifications to this User Agreement. 5. Termination. Either you or FAO may terminate this User Agreement at any time, effective immediately, with or without prior notice to the other party. Termination of this User Agreement automatically terminates your license to use AQUASTAT and any content or other material contained therein. The provisions of Section II, III and IV.1, IV.2, IV.3 shall survive any termination of this User Agreement. 6. Titles. Section headings within this User Agreement are for convenience only. 7. Entire Agreement. This User Agreement constitutes the entire agreement between you and FAO and supersedes all prior or contemporaneous understandings, communications or agreements, written or oral, regarding such subject matter. 3
