*MANUFACTURERS DEFECTS - The sellers warrants to User/Buyer that the equipment and machinery listed on the shipping document and the
corresponding received warranty card shall be free from defects of materials or workmanship under normal use and maintenance for a period or four
(4) years from date of shipment, or eight thousand (8,000) hours of operation, whichever occurs first. The liability of sellers under this warranty shall
be limited to the repair of replacement, at seller’s option, of any part of component that may prove to be defective under normal use, service and
maintenance after Seller, in its sole discretion, determines same to be defective. This warranty is conditioned upon Buyer giving Seller immediate
written notice of an alleged defect, and refraining from the attempted repair of alleged defects without prior written consent of Seller. The Seller makes
no warranty whatsoever with respect to accessories or components not supplied by Seller. For any components purchased by Seller for use on or
in conjunction with the equipment that is the subject of this contract, the Seller extends to the Buyer only the same warranty granted to Seller by the
component vendor or manufacturer.
WEAR PARTS - The Seller warrants to User/Buyer that the wear items included in the pump listed on the shipping document and the corresponding
received warranty card shall not require replacement under normal use and pumping of “standard“ coatings for a period of two (2) years from date of
shipment, or four thousand (4,000) hours of operation, whichever occurs first. The liability of Seller under this warranty shall be limited to the replacement of the worn part or component that may prove to be defective under normal use, service and maintenance after Seller, in its sole discretion,
determines same to be defective. Labor for replacement of the component(s) is the responsibility of the buyer. This warranty is conditioned upon Buyer
giving Seller immediate written notice of an alleged defect, and refraining from the attempted repair of alleged defects without prior written consent of
Seller. The Sellers makes no warranty whatsoever with respect to accessories or components not supplied by Seller. For any components purchased
by Seller for use on or in conjunction with the equipment that is the subject of this contract, the Seller extends to the Buyer only the same warranty
granted to Seller by the component vendor or manufacturer.
A “Standard” coating is defined as any coating without excessive abrasive properties, pre or post catalyzed 2 component materials and coatings with
a pot life of greater than four hours.
The performance and safety of the equipment mentioned herein in contingent upon proper installation, the use of suitable process materials, and
operation and maintenance by properly trained personnel. Seller makes no warranty whatsoever as to the inclusion of the equipment supplied by
Seller into buyer’s manufacturing process, Seller’s warranty being limited solely to the operation of its equipment sold hereunder in accordance with
the specifications therefore.
THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY
AND FITNESS FOR USE. IT IS ESPRESSLY AGREED THAT UNDER NO CIRCUMSTANCES SHALL THE SELLER BE HELD LIABLE FOR ANY
SPECIAL OR CONSEQUENTIAL DAMAGES OR LOSS OF PROFIT ARISING FROM ANY CAUSE, AND SELLERS’S LIABILITY SHALL BE STRICTLY
LIMITED AS STATED HEREIN.
