X X Joint Owner Signature Date Joint Owner Signature Date X Primary Owner Signature Date Teller ID ___________ Date_________ Regulation E Disclosure and Cardholder Agreement Definitions: ATM Transactions “You” and “your” mean each person who has signed the CSE Credit Union request for an ATM card or who uses your CSE ATM card with your consent. “We”, “us”, “our” and “Credit Union” mean CSE Credit Union through which you applied and received your CSE ATM card. “Account” means each and all of your accounts with us for which you may use your card. “Card” means your CSE ATM card. “Number” means your personal identification number. “ATM” means an automated teller machine. “POS” means point of sale transactions. POS transactions are all transactions except those made at an ATM. “Transfer” means a withdrawal of money by the use of your card. I hereby apply to CSE Credit Union for CSE ATM card privileges and agree to all the following terms and conditions. 1. 2. 3. 4. 5. 6. 7. All POS transactions will be charged against my share draft (checking) account. Funds in my savings account cannot be used for POS transactions. The Credit Union issues the CSE ATM card for my use only. I assume responsibility for transactions made through the CSE ATM card. The card is the property of the Credit Union and is subject to cancellation at any time. The card must be returned to the Credit Union upon request or may be impounded automatically by a machine. I may cancel card privileges by notification to us in writing and physically surrendering the card. I will be assigned a personal identification number (PIN). At no time will I reveal or make available directly or indirectly the personal identification number to any person. Any loss or theft of this card and/or PIN will be promptly reported. The use of this card is subject to regulations on share draft and regular share accounts. I agree not to withdraw funds in excess of the available balance in my account. Nothing in this agreement shall annul, limit, or in any way modify any other obligation or relationship I may have with the Credit union now, or hereafter. Disclosure Information Provided in Compliance with Regulation E Consumer’s Liability for Loss or Theft Prompt reporting of loss or suspected theft of your CSE ATM card is essential for your protection. If a loss or suspected theft is reported within 2 business days, you can lose no more than $50, should someone else use your card without your permission. If the Credit Union could have prevented the unauthorized use of your card had you reported within 2 business days, you could lose as much as $500. If delayed reporting to the Credit Union of such loss or theft is attributable to extenuating circumstances – hospitalization, extended travel, etc., the specified period may be lengthened a reasonable time. Consumer’s Liability for Unauthorized Use of CSE ATM Card Study the statement of your CSE ATM card transactions carefully. If a statement shows a transaction that you did not authorize, notify the Credit Union at once. You have 60 days from the date of the statement to report any unauthorized transactions. If you fail to do so, you are liable for the unauthorized transactions that appear on the statement or that occur within the 60 day period. You are also liable for any unauthorized transactions that occur after the 60 day period and before you gave notice – if these losses would not have occurred had you given notification within the 60 days. Telephone Number and Address for Reporting Loss, Theft, or Unauthorized Use of Your CSE ATM Card Telephoning is the best way to prevent losses or keep them at a minimum. Business Days Credit Union business days are Monday through Friday from 9:30 AM to 4:00 PM, exclusive of holidays. Types of Electronic Fund Transfers Available Through Your CSE ATM Card You may use your CSE ATM card at machines having the NYCE or Cirrus network logo, for the following types of transactions: POS Transactions Withdrawing funds from your share draft (checking) account to pay for goods and get “Cash Back” up to $300 depending upon the retailers’ policies. Withdrawing cash from your share draft (checking) account or your regular share account (savings). Inquiring about balances in your share draft or regular share account. Transfer between your share and share draft accounts. Limitations on Amounts of Withdrawals Assuming available funds are in your account, you may withdraw up to $300 within a 24-hour period from an online ATM and POS machine. If the ATM or POS machine is not online, the maximum is $100. Charges for EFT Transactions After three (3) free ATM transactions per month, there will be a 75¢ charge for each withdrawal, transfer, or balance inquiry when using your CSE ATM card at an ATM. There will be no charge for transactions at a POS machine. The Credit Union will not increase these charges unless we provide you 30 days advance written notice. Minimum Balance Requirement I agree to maintain a minimum balance of $100 in my share account at all times. This balance is not available for withdrawal or transfer. Documentation of EFT Transactions You can receive a receipt at the time your make any transactions from your account using your CSE ATM card. Please retain these receipts for your records. You will receive a monthly statement of your share draft account and a quarterly statement of your regular share account. CSE Credit Union Liability for Failure to Make Electronic Funds Transfers If the Credit Union does not complete a transfer from your account on time, or in the correct amount according to our agreement with you, the Credit Union is liable for losses or damages, except in the following instances: If, through no fault of the Credit Union, you do not have sufficient funds in your account to make the transfer. If the ATM machine where you made the transfer does not have enough cash, and despite information to that effect on the screen, you proceed with the transaction. If the ATM or POS machine was not functioning properly and you knew of the breakdown before you started the transaction. If circumstances beyond the control of the Credit Union (such as flood or fire) prevent the transfer despite reasonable precautions that have been taken. Any other exceptions listed in your agreement with the Credit Union. Account Information Disclosure We will disclose information to third parties about your account in order to comply with government agency or court orders; if you give us written permission; or in order to verify the existence and condition of the account for a third party, such as a merchant or credit bureau. In Case of Errors or Questions About Your Electronic Transfers If you think that a statement of or a receipt for an electronic transfer is wrong, or if you need more information about a transfer listed on the statement or receipt, contact the Credit Union at once: (860) 522-5388 or write to: Connecticut State Employees Credit Union 84 Wadsworth St Hartford, Connecticut 06106-1794 We must hear from you within 60 days after the first statement has been sent on which the suspected error or problem appeared. You should furnish: Your name and account number. A description of the error or transfer you are concerned about, explaining as clearly as you can why you believe it to be an error or why you need more information. The dollar amount of the suspected error. Should you contact us orally, you may be asked to send your complaint or question in writing within 10 business days. We will inform you of the results of the investigation within 10 business days after the Credit Union has heard from you. Any errors will be corrected promptly. In the event that more time is needed, we may take up to 45 days to investigate the matter. Should this be necessary, your account will be credited within 10 business days for the amount you think is in error. You will then have the use of the amount in question during the time it takes to complete the investigation. However, if you are asked to put your questions in writing and you do not do so within 10 business days, we may not be able to credit your account. Should no error be found, a written explanation will be sent to you within 3 business days after the investigation is completed. You may ask for copies of the documents that were used in the investigation.
