BOARD MEETING FOR
AUGUST 5, 2014
The meeting was called to order at
9:00 a.m. by Board Chair Don Evers,
followed by the Pledge of Allegiance.
Commissioners present were Larry
Hansen, Joan Jagt, Curt Blumeyer,
Rick Hamer and Don Evers. Also present were Auditor Kathy Schreurs and
County Attorney Glen Petersen. No
conflicts of interest were noted.
The Board approved consent agenda
items which included: minutes from
July 15, 2014 and the August 5, 2014
agenda.
Cara Nielsen, Transit, reported that
the Lincoln County Transit preliminary
2015 budget must be submitted to the
State of Minnesota. The preliminary
budget has been set at $295,298.000.
A final budget will be submitted at a
later date. The Board approved Resolution No. 23-2014 (Preliminary Budget).
Nielsen reported that the Lincoln
County Transit is scheduled to merge
with Western Community Action Transit Department by January 2016.
Robert Olsen, Environmental, reported that enforcement action is scheduled to proceed on August 8, 2014 due
to lack of a Planning and Zoning application and permit for new construction
in Lake Benton Township.
Olsen reported that notice has been
served on a property owner in Verdi
Township for a nuisance violation as
the property owner is not in compliance with a court order for cleanup.
Olsen reported that a property owner
on Lake Benton is in violation of Lincoln County’s Zoning Ordinance as the
property owner is advertising and renting their home as commercial property. The Board approved the order to
cease and desist the commercial rental
by property owners of Capital Cove on
Lake Benton lake.

• Reported on project/maintenance
updates.
• CSAH 7 paving pre-construction
meeting (Tyler to Ruthton) is scheduled for August 19, 2014 at 1:30 p.m.
• Sump pumps for fuel tanks are being replaced.
• Gravel crushing will be starting at
the Fredrick’s Pit.
• Meeting with Pipestone County on
August 6, 2014 to discuss Engineering
services.
Hauschild reported that Southwest
Health & Human Services (SWHHS)
has approved an addendum to the current Information Technology (IT) contract to allow for IT services one day
per week. The Board approved addendum to IT contract with SWHHS.
Jeanna
Sommers,
Emergency
Management, reported that she had
contacted the Southwest Regional
Development regarding broadband
connectivity but has not received a
reply.
Sommers reported that Lincoln
County is eligible for a $15,729.00
Emergency Management 2014 Performance Grant. The Board approved
2014 EMPG Grant Agreement.
Sommers reported on the Safety
Committee meeting held on July 29,
2014.
Sommers reported that the emergency siren at Hole-in-the-Mountain
Park has been repaired at a cost of
$1,600.00. County Attorney, Glen Petersen has sent a bill to the original
installation contractor for reimbursement.
Chair Evers presented Jeanna Sommers with a plaque in appreciation for
her work as Emergency Management/
Safety Director in Lincoln County.
Sommers has accepted a Regional
Emergency Management position.
The Board approved “On-Sale” Wine
License for Marty Sterzinger, owner
of 19 & 75 Filling Station LLC pending all required paperwork. License to
run from July 1, 2014 to December 31,
2014.

County Attorney, Glen Petersen, reported that he and Robert Olsen had
met with the Attorney General’s Office,

of Judicial Ditch 13 L&L. Specifically
the Main and Branch 1. The affected

Judicial Ditch13 L&L Main and Branch
1 consists of the following: Open ditch
cleaning to the original grade, resloping and crossing replacement.
Main: Starting point at approximately 2,000 ft. northeast of the Lincoln
and Lyon County line on 125th Street
in Lincoln county. General course
approximately following the existing
main in a southwesterly course to the
center of section 24 Hope Township
then traveling south approximately
3000 feet to the NW corner of the NW
¼ located in Section 30 then traveling
west southwest to the SW ¼ of the NE
¼ of section 25 Hope Twp. terminating
the Main.
Branch 1: Starting in NW ¼ of the
NW ¼ Section 30, Shelburne Township with the Main and traveling east
northeast 3,400 feet to the northeast
corner of the SE ¼ of the SW ¼ section
19 Shelburne township.
The engineer has submitted and
filed his final detailed survey report to
the Drainage Authority. The property
owner’s report and the viewers’ report
for the repair and redetermination of
benefits have been submitted and filed
and the petition is still pending.
The drainage authority will also hear
a detailed survey report prepared by
the engineer discussing separable
maintenance costs to the rest of the
drainage system of Judicial Ditch 13
L&L Main and Branch 1 petition as
in Minnesota Statute §103E.701 and
103E. 215 Subd. 6.
You are further notified that a public hearing has been ordered to be
held in the Lyon County Government
Center, 607 W. Main, Marshall, MN.
In the Commissioners Room 1 & 2, on
Monday September 8th at 1:00 p.m.
The purpose of the hearing is to consider the engineer’s final report for the
Repair and Redetermination of benefits to Judicial Ditch 13 L&L Main
and Branch 1 Petition and to accept
the viewers’ report, property owners’
report, and determine a proportionate
cost of separable maintenance.

AUGUST 19, 2014
The meeting was called to order at
9:00 a.m. by Board Chair Don Evers,

Bruce Nielsen, County Assessor,
reported that he had received signed
contracts from several cities and
towns in Lincoln County. The Board
approved contracts for assessing from
the cities of Hendricks, Ivanhoe, Lake
Benton and Tyler and the Townships
of Alta Vista, Diamond Lake, Hansonville, Hope, Lake Benton, Marshfield,
and Verdi contingent on receipt of contracts from Hansonville and Verdi.
Nielsen reported that several employees had participated in the Pictometry
training held on August 6, 2014.
The Board reviewed bids for the sale
of property located at 400 W. Rotherwood, Ivanhoe, MN. The Board accepted the high bids from Mark Paluch
for $131.60 for the east garage and
$35.10 for the west garage (both to be
removed). There were no bids for the
house.
The Board approved Resolution No.
24-2014 (SWHHS Defense and Indemnification).
The Board approved “Majority Vote”
for the PERA Local Government Correctional Service Employees Retirement Plan and Social Security.
The Board approved Resolution No.
25-2014 (Aquatic Invasive Species).
The Board reviewed a letter/comments of “Waters of the United States”
Under the Clean Water Act Docket
ID No. EPA-HQ-OW-2011-0880 composed by Rinke Noonan, Attorneys at
Law, on behalf of 25 counties, 9 watershed districts, and one city, which
addresses many of the concerns and
issues that the counties etc. have with
the proposed rules.

ramp locations are currently non-compliant and 8 locations are compliant
under the ADA (Americans with Disabilities Act). Ramps will be replaced
on county roads as upgrades are completed over the next several years.
Cheryl Glaeser, Southwest Initiative
Foundation, provided the Board with
an overview of the Foundation and an
update of loan and grant awards that
directly benefited Lincoln County.
