I agree to participate in this Alternative Dispute Resolution (“ADR”) process in good faith. I affirm my willingness to speak honestly and disclose information important to bringing this matter to a meaningful outcome. 2. I understand that although I agree to participate in the ADR process in good faith, I am not required to settle my case during the process. 3. I understand that the ADR Professional is an impartial person whose role is to provide us with useful information and/or to help us reach an agreement that is fair to all, without making the decisions for us. 4. I understand that the ADR Professional is not providing me with legal advice or counseling services and although it is not required, I understand that it is recommended that I consult an attorney prior to signing any settlement agreement. 5. I understand that I will receive approximately seven (7) hours of ADR services, to include both ADR sessions and administrative tasks as determined necessary by the ADR Professional. I also understand that I may receive more than seven (7) hours of ADR services if so ordered by the court, or by agreement with the ADR Professional. 6. I understand that, except as otherwise required by law or rule, everything said or written during the ADR process is confidential. The parties and the ADR Professional will hold confidential the written and oral communications that occur prior to, during, or after the ADR process. 7. I understand that I will not be able to subpoena the ADR Professional as a witness in, or request the ADR Professional’s records for, any court, legal or administrative proceeding arising from the ADR process and I understand that the ADR professional will destroy any notes taken before or during the ADR process. 8. I acknowledge that if settlement is reached through the ADR process, any signed agreement generated by the process shall be legally binding and may be enforced by the court.
