Regulations of the “Addvantage” partnership programme for institutions 9th edition §1 Subject of the Regulations 1. These regulations shall define the rules, scope, terms and conditions of participation in the 9th edition of the Addvantage partnership programme for institutions which register groups of candidates for examinations offered by the British Council, hereinafter referred to as the programme. 2. The programme shall be organised by Fundacja British Council with its seat in Warsaw, at Koszykowa 54, hereinafter referred to as the British Council. 3. The 9th edition of the programme shall be executed in the period from 29 April 2015 – 11 May 2017. 4. The programme shall be divided into two phases: phase one – from 29 April 2015 to 11 May 2016 the British Council shall collect information on the number of candidates registered by particular institutions subject to this programme through group entries over the course of this period for examinations offered by the British Council; phase two – from 1 June 2016 to 11 May 2017, on the basis of the collected information, the offer shall be executed (subject to the provisions contained in §3.IV.2 of these regulations). §2 Rules for participation in the programme I. Rules for participation in the programme 1. The programme may be joined and participated in by every language school, educational institution and company which, in the period between 29 April 2015 to 11 May 2016 registers through a group entry at least five of its students or employees for examinations which are subject to this programme, i.e. a) Cambridge English: Young Learners (YLE), b) Cambridge English: Key (KET), c) Cambridge English: Key for Schools (KET for Schools), d) Cambridge English: Preliminary (PET), e) Cambridge English: Preliminary for Schools (PET for Schools), f) Cambridge English: First (FCE), g) Cambridge English: First for Schools (FCE for Schools), h) Cambridge English: Advanced (CAE), i) Cambridge English: Proficiency (CPE), j) Cambridge English: Business (BEC – Preliminary, Vantage, Higher), k) International English Language Testing System (IELTS), l) Cambridge English: Financial (ICFE), m) Cambridge English: Legal (ILEC). 2. The time of the registration is considered to be the moment of submitting to the examination centre registration documents and proof/proofs of payment for the particular examination in accordance with the examination regulation valid for the specific examination and session. 3. British Council Examination Centres may participate in the programme according to the rules binding for other institutions participating in the programme. 4. Institutions which join the programme shall be hereinafter referred to as “participants”. 5. Institutions which have registered candidates for examinations which are subject to this programme through a group entry and have submitted in the examination centre lists of candidates which include different contact details of these institutions shall be regarded as separate programme participants even if they appear under the same brand. II. Participation declaration 1. An institution interested in participation in the programme declares its willingness to join the programme in writing, on the application form provided by the British Council, once the British Council has calculated the number of candidates registered by the institution in the first phase of the programme and sent to this institution information on the rights resulting thereof. The information shall be sent to the institution till 5th June 2016. 2. The application, sent to the British Council, shall contain the following data: a) Full name of the participant b) Address, telephone number as well as the e-mail address of the participant c) Indication of agreement or lack of for the transfer of the participant’s contact data to the programme partner – Cambridge University Press, with its seat at Sienna 86/25, 00-815 Warszawa and Cambridge Assessment Overseas Limited Sp. z o.o. Przedstawicielstwo w Polsce (a representation of Cambridge English Language Assessment in Poland), with its seat at Sienna 86/99, 00-815 Warszawa as per §3.IV.4 of these regulations. d) Signature of the person authorised to represent the institution registering with the programme. 3. The application shall be sent to the British Council between till 30th June 2016. 4. The programme participant shall be obliged to inform the British Council of changes in the data listed above in points 2a and 2b at every stage of the programme. 1 III. Waiver of participation in the programme 1. A participant terminating their participation in the programme shall be obliged to send a termination notification to the British Council as per the manner stated in §2.II.2 of these regulations. 2. In the event of a termination of participation, the right to receive the products within the offer the participant was entitled to shall expire and shall not be transferred onto other institutions. §3 Rules of the Programme I. Categories of participants 1. The offer which particular participants of the programme are entitled to shall be dependent on the number of candidates collectively registered in the first phase of the programme, i.e. between 29 April 2015 and 11 May 2016, for the examinations listed in §2 of these regulation by a given institution. 2. The programme participants shall be divided into three categories: a) Bronze – participants of the programme who in the first phase of the programme registered from 5 to 25 candidates through a group entry for the examinations listed in §2 of these regulations; b) Silver – participants of the programme who in the first phase of the programme registered from 26 to 75 candidates through a group entry for the examinations listed in §2 of these regulations; c) Gold – participants of the programme who in the first phase of the programme registered more than 75 candidates through a group entry (i.e. the so-called Block Entry Forms) for the examinations listed in §2 of these regulations. II. First phase of the programme 1. The British Council undertakes to collect, by 20 May 2016, information from all British Council examination centres in Poland on the number of candidates registered through a group entry by particular institutions between 29 April 2015 and 11 May 2016 for examinations listed in §2 of these regulations. 2. Following the collection of the above mentioned information the British Council shall contact the institution, by 5th June 2016, by e-mail – provided it meets the terms and conditions of participation in this programme listed in §2 of these regulations – and shall inform it of the number of candidates registered in the abovementioned period, of the category granted to it therefrom, of the offer it is entitled to therefrom and shall offer the institution participation in the programme. 3. Institutions wishing to join the programme should complete the formalities listed in §2.II of these regulations. III. List of products available to the participants qualified for particular categories 1. The programme participants qualified for the “Bronze” category shall receive: a) The right to register their students/employees for the following Cambridge English tests and examinations: YLE, KET, KET for Schools, PET, PET for Schools, FCE, FCE for Schools, CAE, CPE, BEC, ICFE and ILEC at a discount fee which shall be announced by the British Council Director not later than one month prior to the commencement of registration for subsequent examination sessions of the abovementioned examinations. b) Two sets of Cambridge English Past Paper Packs funded by Cambridge English Language Assessment and Cambridge University Press. Test levels can be chosen from amongst those levels available at the time of placing the order. c) A certificate in English, issued by the British Council confirming that the programme participant registers groups of candidates for Cambridge English examinations, of the following content: “This is to certify that in the school year 2015/16 (name of programme participant) was a British Council Supplier Institution for Cambridge English examination*” with a note: “*This certificate has been issued on the basis of confidential criteria regarding candidate entries”. d) A certificate in English, issued by Cambridge English Language Assessment confirming that the programme participant registers groups of candidates for Cambridge English examinations, of the following content: “Cambridge English Preparation Centre, 2015/16. This is to certify that (name of programme participant) prepares and enters candidates for Cambridge English examinations, the world’s leading range of qualifications for the learners of English”. e) Regular e-mail briefings about British Council examinations activities and general events. f) 50% discount on methodological seminars for teachers organised by the British Council in the region where the programme participants operates. g) A guarantee of three places at each free methodological seminar for teachers organised by the British Council in the region where the programme participant operates. Where possible, the seminars will be accompanied by product (books & examinations) presentations organised by partners and textbook sales at discount fees. 2. The programme participants qualified for the “Silver” category shall receive: a) The product listed in point III.1 of this paragraph included in the “Bronze” category. b) Certificates for teachers preparing students for Cambridge English examinations in the particular institution, c) A copy of Penny Ur’s “Discussions and More: Oral fluency practice in the classroom” – a publication funded by Cambridge University Press. d) The right to use the “Cambridge English Preparation Centre” logo in their promotional materials and on their websites in accordance with the rules stated by the Cambridge English Language Assessment in the attachment to this Regulations. e) Three units of the on-line Learning Technologies for the Classroom training, for 2 teachers, funded by the British Council. f) 50% discount on any Cambridge English examination taken in an open session for one member of staff employed by the participant confirming their experience in this area. 2 3. In order to be able to take advantage of this offer, the participant shall fulfil the following conditions: register a group of a minimum of 30 candidates (jointly) for any or all of the following examinations: FCE, CAE or CPE. The chosen examination sitting should be held on dates in close proximity to each other in order to allow the Speaking test for all three levels to be conducted on the same day. The minimum number of candidates registered for any test level to be conducted on the same day. The minimum number of candidates registered for any test level should not be lower than 5; secure (provide or rent at the programme participant’s expense) a room or rooms in which the candidates shall take the oral part of the examination (Speaking). An employee of the examination centre shall accept the selected rooms and is entitled to refuse to conduct an examination in such rooms in the event where by they do not meet the requirements imposed by Cambridge English Language Assessment (list of requirements available at the British Council and in the examination centre operating in the region of the programme participant’s activity). The programme participant is entitled to appeal against the decision to the British Council within 5 working days. IV. Second phase of the programme – offer execution and programme completion 1. Execution of the offer, understood as providing the programme participants with the products listed in point III of this paragraph, pursuant to their qualification for a particular category shall take place between 1 June 2016 and 11 May 2017, but not earlier than the time when the institution declares its willingness to join the programme in writing to the British Council and subject to the provisions contained in §3.IV.2 of these regulations. 2. Benefits which are dependent on the participant’s decision, such as taking advantage of discount fees, organization of a presentation or examination on the participant’s premises are forfeited should the participant not take 3 3. 4. 5. 6. 7. 8. advantage of them by 11 May 2017. Should the programme participant wish to organize speaking papers on their premises they are obliged to inform the examination centre or the British Council of this fact in writing by 11 May 2017 at the latest which will extend the execution of this specific benefit till the end of June 2017. Benefits listed in points III.1.c and d as well as III.2.b shall be executed by the British Council during the second phase of the programme by post (at the British Council’s expense). The programme participant will receive the benefits funded by Cambridge University Press and Cambridge English Language Assessment under the condition that they indicate agreement (in writing on the application form) to the transfer of the participant’s contact data, the name and surname of a contact person and the level of membership to which the participant is entitled to Cambridge University Press, with its seat at Sienna 86/25, 00-815 Warsaw and Cambridge English Language Assessment Overseas Limited sp. z o.o., Przedstawicielstwo w Polsce (a representation of Cambridge English Language Assessment), with its seat at Sienna 86/99, 00-815 Warsaw. The publications will either be delivered to the programme participant by the programme partner’s representatives or sent to the participant’s address provided by the British Council. The decision as to the form of delivery lies with the programme partner. Should the publications be delivered by the programme partner’s representative, the representative may wish to set up a meeting with a representative of the programme participant’s institution. This will happen only should the programme participant indicate agreement to such an eventuality (in writing on the application form). Upon completion of the 9th edition of the programme all rights of the programme participant related to its registration of a given number of candidates through a group entry between 29 April 2015 and 11 May 2016, shall be forfeited. In the event of launching another edition of the programme, the rights of the programme participant from the previous edition shall not be transferred onto the next one and shall not cumulate. The programme participant shall not receive any financial equivalent for the products listed in point III of this paragraph. The rights of the programme participant shall not be transferred onto other institutions. §4 Use of information of participation in the programme for promotion and advertising purposes 1. The programme participants are entitled to use the logo “Member of the British Council Exams Partnership Programme Addvantage©” in their promotional materials and on their websites for the duration of the 9th of the programme, in accordance with the rules stated below. 2. All promotional, advertising and informational materials produced by the programme participant, e.g. websites, posters, leaflets, banners, advertisements and other press, radio, cinema and television information as well as materials in other media which mention any rights of the programme participant related to participation in the programme, its activities resulting therefrom, including any offers available for the participant’s clients, in particular those which use the logo described in the previous point of this paragraph of these regulations must receive the written approval of the British Council by which it will accept the contents and form of the materials and express consent to their publication. The programme participant must submit all such materials by e-mail (addvantage@ britishcouncil.pl) to the British Council for approval prior to their use. The British Council has 5 working days to approve the submitted materials. 3. All the materials listed in point 2 of this paragraph belong to the programme participant and shall be protected by Polish copyright law. The British Council undertakes not to make the received designs accessible to any other entitles. §5 Final provisions I. Complaints 1. The programme participant shall be entitled to lodge complaints pertaining to its qualification for a given participants’ category and to the way the offer has been executed to the British Council in the manner provided in §2.II.2 of these regulations. II. Participant’s exclusion from the programme by the British Council 1. The British Council reserves the right to exclude a participant from the programme in the event the participant fails to timely fulfil its financial obligations towards the British Council or breaches the terms and conditions of these regulations. 2. In such an event, all the rights acquired by the programme participant before its exclusion from the programme shall expire. 3. The British Council shall inform the participant of the exclusion in writing. III. Amendments to the regulations 1. The British Council reserves the right to end the programme prior to the date mentioned in §1 of these regulations or to extend it beyond the date mentioned in §1 of these regulations. 2. 2. The British Council reserves the right to introduce amendments to these regulations and undertakes to inform the programme participants of the amendments by e-mail or post. 3. 3. Amendments to the regulations and a change to the programme completion date must not breach the rights acquired by the participants before the introduction of those amendments. IV. Civil code and resolution of disputes 1. 1. In matters not stipulated by these regulations the relevant provisions of the Civil Code shall apply. Disputes which may arise during the execution of the programme shall be resolved by a relevantly competent court in Warsaw. 4 ATTACHMENT NO 1 To the Regulations of the “Addvantage” partnership programme for institutions 9th edition Regulations for use by preparation centres (Silver and Gold Addvantage Members) Cambridge English Language Assessment logo and promotional materials Regulations for use by preparation centres These regulations relate to the use of the Preparation Centre Logo (the ‘Preparation Centre Logo’), introduced worldwide in July 2014. Compliance with these regulations is a condition of the registration of your organisation as a Cambridge English Language Assessment preparation centre (‘preparation centre’) by your local examination centre, where you have fulfilled the criteria set by your local Cambridge English Language Assessment representative. We are happy to provide schools and institutions which actively prepare candidates for our exams with the Preparation Centre Logo (which is a Cambridge English Language Assessment trademark) to help promote exam preparation courses. Please remember that in doing so, we are granting the right to use a valuable piece of intellectual property, owned by the University of Cambridge, and that we need to protect the interests of the many departments of the University and of other centres. As such, we must enforce these regulations vigorously. Permission to use the Preparation Centre Logo is dependent on you continuing to prepare students and your agreement (by use of any of this Preparation Centre Logo) to comply with these regulations. You are welcome to use this Preparation Centre Logo in your publications or websites, as specified below, but in doing so you must accept that permission to use it may be withdrawn at any time, and that you must then cease to use it (and withdraw any publications in which it is printed) if requested to do so. For the avoidance of doubt you are NOT permitted to use in any way the Cambridge English Language Assessment shield logo which appears at the top of your preparation certificate (other than by display of that original certificate). When using the Preparation Centre Logo you must not state or imply that Cambridge English Language Assessment has approved the quality of teaching or other services provided by your preparation centre.
