Laws and Regulations Pertaining to
Public Accommodation Plan Review
PLAN REVIEW SUBMISSION AND APPROVAL-NAC for reference
NAC 447.100 Construction and remodeling: Application and approval required; plans and specifications. (NRS
439.200, 447.185)
1. Any person who desires to construct a hotel or to remodel or add to an existing hotel must apply in writing
to the appropriate health authority on forms furnished by the health authority, giving the name of the hotel and
its location together with such other information as may be required. The application must be accompanied by
plans, specifications and supporting data.
2. Plans and specifications for hotels must have been prepared by a professional engineer who is registered in
this State, an architect who is registered in this State, or a licensed contractor who holds a license issued by the
State Contractors’ Board in the appropriate classification and subclassification. A licensed professional engineer
or a registered architect shall include his seal and signature on any plans and specifications submitted to the
health authority. A licensed contractor shall include his signature on any plans and specifications submitted to the
health authority.
3. The plans must be drawn to scale, include a north arrow, and be accompanied by proper specifications to
permit a comprehensive engineering review.
4. The submitted plans must be approved in writing before any construction is undertaken. [Bd. of Health,

Approvals from all other governmental agencies requiring permits, licenses, or other
authorizations must be received by the responsible person prior to the initial operation of
any public accommodation facility.
In the event that there are any conflicts between these requirements, the more stringent
requirement must be met.

Licensing Agencies
There are six separate licensing agencies of jurisdiction with which you may need to do business.
Please determine the physical area in which your public accommodation facility is located or
planned to be located. Once a determination has been made, contact the correct licensing agency
from the list below. Call them for further requirements specific to their area of control.
Depending on the nature of your business, you may need both a city and a county business license.
Call the agency for advice.
The agency of jurisdiction will provide a packet of information, forms, and checklists to guide you
through the process. Once all items from the packet are complete, the packet must be returned to the
appropriate agency for processing.

The Federal Welfare Reform Act was implemented by the 1997 Session of the Nevada Legislature by SB 356. In all

submitting your application by mail, completion of the CHILD SUPPORT COMPLIANCE STATEMENT OR
EXEMPTION FORM is required with appropriate signatures and social security numbers.
Fictitious Firm Name (DBA)
If your business is using a fictitious firm name (DBA), you must register your fictitious firm name with the Clark County
Clerks Office, Clark County Courthouse, 200 S. Third St., 3rd floor. (702) 455-3156. A satellite office is located on the
1st floor of the County Government Center at 500 S. Grand Central Pkwy. The fee is $20.00.
Fire Department Survey Form
Completion of the Clark County Fire Department’s Permit Survey Form is required of all applicants. This form is
available at the Business License Department, 3rd floor of the Clark County Government Center, 500 S. Grand
Central Pkwy or on the Internet at www.accessclarkcounty.com. Choose Public Records, Business License, Business
License Forms.
Proof of Rights to Business Property
LEASE / RENT AGREEMENT - If you are leasing or renting a location, a signed agreement with the Owner /
Landlord is required.
OR
SHARING SPACE - If you are sharing space with another business, a signed letter of authorization from the Owner is
required.
OR
PROOF OF OWNERSHIP- Copy of Deed.

Application for Non Therapist Massage - OWNER ONLY
If you will be owning/operating massage business or massage establishment and not personally administering
massage, you must sign an affidavit and have it properly notarized. It is unlawful to administer massage in
unincorporated Clark County unless or until you have been issued a work identification card for massage therapy by
the LVMPD.
Child Support
The Federal Welfare Reform Act was implemented by the 1997 Session of the Nevada Legislature by SB 356.
Detailed explanation is provided with the license application packet. CHILD SUPPORT COMPLIANCE EXEMPTION
FORM This form must be completed for all businesses claiming exemption from SB 356, these include multiple
shareholder corporations, limited liability companies and partnerships registered with the State of Nevada. CHILD
SUPPORT COMPLIANCE STATEMENT All owners of businesses not exempt, must provide a completed and signed
compliance statement.
Description of Hotel Property
A description of the hotel property is required.
Health Card
A Clark County Health Card is required. The Clark County Health Department is located at 625 Shadow Lane, Las
Vegas (702) 383-1226.
Rock Concert Addendum
A completed Application Addendum for Rock Concert Promoter is required. (Clark County Code 6.65)
Waiver
A Clark County Business License Waiver form must be signed and witnessed.

A $10,000 Surety Bond Payable to Clark County is required. The Original Bond must be submitted to Clark County
with the application.
Documents Specific to Business Location
Floor Plan
An interior diagram of your business on an 8-1/2 x 11 sheet of paper is required. Include location of store room, cash
register, slot machines, rest rooms, kitchen, dining tables, bar, etc. (including location and description of physical
barriers between restaurant/dining areas and any bar/lounge areas.
Lease Agreement
Provide the executed lease agreement, assumption and/or assignment of lease (with landlord consent & master
lease) or deed to the property.
Management Agreement
Provide the executed management agreement and employee contracts if sharing or managing in revenue.
Participation/Space Lease Agreement
Provide the participation/space lease agreement with slot route operator.
Purchase Agreement
Provide the executed purchase agreement, bill of sale, and/or closing escrow instructions (with both parties
signatures), if business location is existing.
Temporary Liquor License
If you are requesting a temporary liquor license, please submit the following additional documents: Consent letter
(provided by this Department),and a request for Temporary Liquor License (provided by this department). A
temporary liquor license may only be issued for the type of liquor license held by the previous owner and the previous
owner's liquor license must be active and in good standing.
Waiver
A Clark County Business License Waiver form must be signed and witnessed for each applicant.
Las Vegas Metropolitan Police Department Suitability Documents-PrivilegedBirth Certificate A certified copy of a
birth certificate or naturalization papers for each applicant is required.
Color Photo A recent, passport size color photograph is required per each individual applicant.
LVMPD Background Investigation
DURING THE LVMPD BACKGROUND INVESTIGATION, you will be referred for a LVMPD WORK CARD and/or
REQUIRED FINGERPRINTING.
After your application has been submitted to Business License, it will be referred to the LVMPD, Special
Investigations Section, and assigned to a detective for completion of your background investigation. During your
investigation, the assigned LVMPD, SIS detective will contact you and refer you to the LVMPD Fingerprint Bureau for
a work identification card and/or fingerprint processing. Along with your referral, you will need to take the following to

LVMPD Background Investigation
DURING THE LVMPD BACKGROUND INVESTIGATION, you will be referred for a LVMPD WORK CARD and/or
REQUIRED FINGERPRINTING.
After your application has been submitted to Business License, it will be referred to the LVMPD, Special
Investigations Section, and assigned to a detective for completion of your background investigation. During your
investigation, the assigned LVMPD, SIS detective will contact you and refer you to the LVMPD Fingerprint Bureau for
a work identification card and/or fingerprint processing. Along with your referral, you will need to take the following to

along with a check or money order for $75.00. Please note on your questionnaire that you have also applied for a
Massage Business License, and that you would like the investigation completed simultaneously with the background
investigation for licensure.
