Food Truck Regulations and Policy Food Truck Discussion Steve Ravezzani presented a 1st Draft copy of Food Truck language and reviewed the questions brought forth in a Food Truck document dated January 5, 2016 submitted by Dan Reszka. Clearly the question of whether the community wants food trucks is still to be determined through process. Steve has defined a food truck as a motorized vehicle or trailer pulled behind a vehicle and recommended calling these Mobile Food Units. There was much discussion. The members present agreed with much of the Draft document content. They did make the following recommendations: -No Mobile Food Units shall be parked or in operation between the hours of 9:00PM and 7:00AM -Annual Application fee of $50.00 -Operating fees of $35 per day or $500 per month -The fees collected would be equally shared between The Village General Fund and DDA. -The Draft Ordinance would not address number of allowed units or allowing provisions for outside dining – chairs, tables etc. -Allowed locations for a Mobile Food Unit would be parking spots in front of Memorial Beach, Dam Beach Parking Lot, Rotary Park, Industrial Park and Cedar Street municipal lot. Steve recommended that as we go forward that we consider a trial period similar to Harbor Springs, re-evaluating after a year/season before drafting and approving an ordinance. He will submit another draft version with the member recommendations to our March DDA meeting. c) Part-time DDA Director – Discussion began Andy LaPointe expressed that he was meeting with members of NLEA and East Jordan DDA and would like to present our top 5 priorities resulting from the surveys sent to members. It was already after 9:00AM, there was a desire for discussion on this but members had to leave. Motion by Wayne, Second by Wittbrodt to schedule a Planning Session to discuss Strategic Plan Priorities. We went through a description of each, discussed cost, resources and how some may overlap. Andy then asked each member present to list their top 4 priorities. Andy also tallied the votes that were sent in by the excused members. With everything going on, the last few meetings have been pushing up against 9:00 am. Overview: #1: Meetings start 7:30 am and the goal is to have meetings finished by 8:15 – 8:30 am #2: I reached out to different boards in Elk Rapids. They mentioned when a board takes on policy related issues, meetings can last 2 – 3 hours. Recently the DDA has been taking on several policy related items. A few considerations: #1: Create a consent agenda #2: When appropriate, limit the size of the agenda to only include the policy issues. #3: The DDA can hold a vote at a pre-determined time during the meeting to decide if the DDA would like to continue with the meeting or end the meeting, even if the agenda hasn’t been completed. #4: Change the meeting time to the evening #5: The DDA is a volunteer board, if a member does need to leave early any time prior to the end of the meeting, they can leave the DDA meeting early for other obligations. We’ll try to accomplish what is on the agenda in reasonable time or until we do not have quorum. A regional public/private economic development organization serving Antrim, Charlevoix, Cheboygan and Emmet Counties, Michigan, USA Contract to Provide Administrative Services for the Elk Rapids Downtown Development Authority (DDA) The Elk Rapids Downtown Development Authority (DDA) agrees that the Northern Lakes Economic Alliance shall provide services as outlined in this contract. PURPOSE: The Elk Rapids DDA has certain projects, as listed in the Work Plan, that they would like to dedicate resources towards accomplishing. The Northern Lakes Economic Alliance (NLEA) has the staff expertise, resources, and prior experience to complete the desired services for the community. SCOPE OF WORK: The NLEA will dedicate 20 hours per week to accomplishing the items listed in the communities Work Plan. The Work Plan may be amended at any point of this contract with agreeance by both parties to allow for flexibility in priorities. RESPONSIBILITIES OF THE NLEA: The NLEA will manage and monitor the progress of each project listed in the Work Plan with appropriate personnel. The NLEA will prepare monthly reports and will provide the necessary training and orientation for DDA Board of Directors to be successful. RESPONSIBILITIES OF THE ELK RAPIDS DDA: The East Jordan DDA will attend the orientation and training, they will provide an adequate work space for NLEA employees within their community (when needed). They will voice any concerns they have to the Village Manager who will contact the NLEA President. PAYMENT: The Elk Rapids DDA agrees to pay the NLEA $30,000 annually to complete these services. Payments are to be made the first day of the month in the amount of $2,500. Payments late in excess of 30 days will incur a 5% interest fee. CONTRACT DATE: This will be a 12 month contract that will begin at the time services start taking place. Such other information as may be required by the Village Clerk in order to fully determine the kind and character of the proposed activity solicitation and as to whether or not such activity solicitation will in any way affect the health, safety, welfare and property of the citizens of the village. Activities conducted under either a peddler, transient merchant, or solicitor’s license shall meet the following requirements: peddler's permit or solicitor's permit shall contain the following provisions: 1. No Activity authorized under this Section shall be prohibited between the hours of 9:00 p.m. and 7:00 a.m. unless otherwise authorized by the Village Council. whether soliciting or selling, shall occur prior to 8:00 a.m., nor continue after 9:00 p.m. 2. A peddler or transient merchant license permit shall be valid for no more than three consecutive days, and no applicant shall receive more than two such licenses permits in any calendar year, being January 1 to December 31. 3. A solicitor license permit shall be valid for no more than 15 consecutive days, and no applicant shall receive more than two permits in any calendar year, being January 1 to December 31. 4. No licensee permittee shall peddle or solicit within the village parks, beaches or recreational areas unless otherwise authorized by the Village Council. 5. No licensee permittee may use loud, excessive noise generating equipment items or amplified announcements to attract attention to his goods, wares or items for sale. 6. No licensee permittee shall approach drivers of automobiles or in any way interfere with vehicular traffic. 7. No licensee permittee shall have a fixed stand or location and shall not stop in any one place upon any street, alley or sidewalk any longer than necessary to make a sale to a customer willing to buy. Any licensee permittee using a motor vehicle, whether motorized or not, when DRAFT 03.01.16 CH. 1, ART. II 4 CODE OF ORDINANCES, VILLAGE OF ELK RAPIDS CHAPTER 1: GENERAL PROVISIONS ARTICLE II – PEDDLERS, TRANSIENT MERCHANTS, SOLICITORS, MOBILE FOOD VENDORS stopped, shall place the his vehicle parallel to and within 12 inches of the curb, and shall depart from such place as soon as he has completed sales with customers actually present. b. Supplementary requirements for mobile food vendors. 1. No operator of a mobile food unit shall park, stand or move such unit, or conduct business within areas of the Village where the license holder has not been authorized to operate. The Village Council shall by resolution identify those streets and public areas where parking by mobile food vendors is permitted. (DDA recommends Dam Beach Parking lot, North half of Cedar St. lot, Rotary Park, Veterans Memorial Park, Industrial Park) 2. The customer service area for mobile food unit shall be on the side of the unit that faces the curb, lawn or sidewalk when parked. No food service shall be provide on the driving lane side of the unit. No food shall be prepared, sold, or displayed outside of the mobile food unit. 3. The provision of outside dining areas, including but not limited to tables, chairs, booths, stools, benches or stand up counters, shall be prohibited. (Recommendation of DDA) Awnings for mobile food units shall have a minimum clearance of 7 feet between the ground level and the lowest point of the awning or support structure. 4. Customers shall be provided with single service articles such as plastic utensils and paper plates. All mobile food vendors shall provide a waste container for public use which the vendor shall empty at its own expense. All trash and garbage originating from the operation of mobile food unit shall be collected and disposed of off-site by the operators each day. Spills of food or food by-products shall be cleaned up and no dumping of waste water on the streets is allowed. 5. No mobile food unit shall make or cause to be made any unreasonable or excessive noise. The operation of all mobile food units, including generators, shall meet the Village of Elk Rapids noise ordinance. Loud music, or other high deciblel sounds, horns, or amplified announcements shall be prohibited. 6. Signage is only allowed when placed on mobile food unit. No separate free-standing signs are permitted. 7. Flashing, moving, blinking, or strobe lighting is prohibited on mobile food units or on related signage when the unit is parked and engaged in serving customers. Mobile food units when parked on public streets shall be parked in conformance with all applicable parking restrictions, and shall not hinder the lawful parking or operation of other vehicles. 9. A mobile food unit shall not be parked on the street overnight or left unattended and unsecured at any time. Any mobile food unit found to be unattended shall be considered a public safety hazard and may be ticketed and impounded. 10. A vendor shall not operate a mobile food unit within 500 feet of any fair, festival, special or civic event that is licensed or sanctioned by the Village unless the vendor has obtained permission from the event sponsor. 11. Mobile food units shall not be parked within 150 feet of an existing brick and mortar restaurant during the hours when such restaurant is open to the public for business. 12. The issuance of a mobile food vendors license does not grant or entitle the vendor to the exclusive use of any service route or parking space to the license holder. 13. A vendor shall not operate on private property without first obtaining written consent from the affected private property owner. A private property owner shall not permit the operation or parking of a mobile food unit until a Zoning Compliance Permit has been obtained from the Planning and Zoning Administrator to allow such use. 14. Power required for the mobile food unit shall be self-contained, no cable or equipment shall be extended at or across any Village street, alley or sidewalk, and a mobile food vehicle shall not use utilities drawn from the public right-of-way unless authorized to do so by the Superintendent, Department of Public Works. Mobile food units on private property may use electrical power from the property being occupied or an adjacent property, but only when the property owner(s) provide written consent to do so.
