YARRA RANGES PLANNING SCHEME
AMENDMENT C158
EXPLANATORY REPORT
Who is the planning authority?
This amendment has been prepared by the Yarra Ranges Shire Council, which is the
planning authority for this amendment.
The Amendment has been made at the request of Yarra Ranges Council.
Land affected by the Amendment
The Amendment applies to a number of sites covered by a Heritage Overlay, as identified in
the table accompanying this report.
What the amendment does
The Amendment deletes a number of redundant and unjustified provisions in the Heritage
Overlay relating to external painting, internal modification and vegetation controls, and
amends a number of planning scheme maps to correct and realign the boundaries of the
mapped overlay areas.
The Amendment replaces the existing Schedule to the Heritage Overlay with a new
schedule in accordance with the attached document, and amends Heritage Overlay maps 8,
12, 15, 18, 19, 20, 21, 23, 27, 34, 36, 40, 41, 45, 46, 47, 52, 53, 58, 66, 67, 68, 69, 75, 76,
and 77 to revise the location of mapped boundaries of the Heritage Overlay.
Strategic assessment of the Amendment
Why is the Amendment required?
The amendment is required to delete redundant and unjustified provisions from the
Schedule to the Heritage Overlay and to rationalise the boundaries of the mapped overlays
so that they more accurately reflect the actual heritage assets of the properties.
How does the Amendment implement the objectives of planning in Victoria?
The amendment achieves the fair and orderly planning of land by updating the Heritage
Overlay and improving its functionality.
How does the Amendment address any environmental, social and economic
effects?
The amendment will be neutral in terms of environmental impact. It is expected that the
amendment will have overall beneficial social and economic impacts by improving the
function of the planning scheme and removing unnecessary controls.
Does the Amendment address relevant bushfire risk?
The amendment will be neutral in terms of bushfire risk.
Does the Amendment comply with the requirements of any Minister’s Direction
applicable to the amendment?
The amendment is consistent with the Minister’s Direction on the form and content of
planning schemes.
How does the Amendment support or implement the State Planning Policy
Framework and any adopted State policy?
The amendment supports the SPPF by improving the functioning of the Heritage Overlay
and removing unnecessary provisions from it.
How does the Amendment support or implement the Local Planning Policy
Framework, and specifically the Municipal Strategic Statement?
The amendment supports the LPPF by improving the functioning of the Heritage Overlay
and removing unnecessary provisions from it.
Does the Amendment make proper use of the Victoria Planning Provisions?
The amendment makes proper use of the Heritage Overlay.
How does the Amendment address the views of any relevant agency?
The views of relevant agencies will be addressed through the exhibition process.
Does the Amendment address relevant requirements of the Transport
Integration Act 2010?
The amendment will not have any impacts on the requirements of the Transport Integration
Act 2010.
Resource and administrative costs

What impact will the new planning provisions have on the resource and
administrative costs of the responsible authority?
The amendment will have an overall beneficial effect on resourcing and administrative costs
by reducing the overall need for planning approvals under the Heritage Overlay.

The Amendment can also be inspected free of charge at the Department of Environment,
Land, Water and Planning website at www.dtpli.vic.gov.au/publicinspection, and on Yarra

Submissions
Any person who may be affected by the Amendment may make a submission to the
planning authority. Submissions about the Amendment must be received by 21 March
2016.
A submission must be sent to the Manager Strategic Planning, Yarra Ranges Council, PO
Box 105, Lilydale VIC 3140.
Any submissions about the Amendment must:

Be made in writing, giving the submitter’s name, address and, if practicable, a phone
number for contact during office hours.

Set out the views on the Amendment that the submitter wishes to put before Council
and indicate what changes (if any) the submitter wishes made to the Amendment.

State whether the person/s making the submission/s wishes to be heard in support of
their submission.
