LOUTH COUNTY COUNCIL COMHAIRLE CONTAE LÚ TEMPORARY RESIDENT ENGINEER Water Conservation Project Stage 3:- Dundalk and Drogheda Bundles QUALIFICATIONS 1) Education, Training: Each Candidate on the latest date for receipt of completed application forms must: (a) Hold an honours degree in Civil Engineering (level 8 in the National Framework of Qualifications) or equivalent professional qualification in engineering. (b) Have a satisfactory knowledge of civil engineering works, building construction, and project management; (c) Be capable of writing clear and concise reports and keeping works records; (d) Be proficient in the use of computers in relation to document handling and production of reports; (e) Have a satisfactory knowledge of civil engineering construction contracts; in particular contract carried out under The Department of Finance’s Capital Works Management Framework, CWMF) (f) Hold a full clean current driving licence. (g) Have a current Safe Pass Card. 2) Experience: Each candidate must: (a) Have at least five years satisfactory experience, at least three years of which was in the project management, on-site supervision or contract administration of civil engineering works. 1 (b) Satisfy the local authority that he/she has adequate experience of a type that would render him/her suitable to perform satisfactorily the duties of the post for which he/she is a candidate. (c) Have a thorough knowledge, understanding and experience of the application of the Department of Finance Public Works Contracts including the methods of dispute resolution appropriate to them. (d) Have detailed experience of the design / operation of Temporary Traffic Management Plans and their role in the context of the Safety Health and Welfare at Work (Construction) Regulations, 2006 (e) Have detailed knowledge and experience of civil engineering measurement and materials quality control. (f) Have a knowledge, experience and understanding of the installation of watermains using open-dig and no-dig methods (g) Have a knowledge, experience and understanding of the techniques for the rehabilitation of existing watermains. Depending on the number of applications received, a short- listing process may be applied. A panel may be formed from which vacancies arising during the life of the panel may be filled. 2 RESIDENT ENGINEER PARTICULARS OF OFFICE 3) GENERAL The Water Conservation Project Stage 3, Dundalk and Drogheda Bundles comprises of the replacement and rehabilitation of approx 30km of watermain predominately within the two urban areas at a cost of approx €6.5million. This comprises of the various techniques ranging from open dig to “no-dig” rehabilitation, the project will most likely be split into four separate contracts (one Site Investigation Contract, one advanced works contract consisting of approx 10km of watermain outside the main urban areas and two further contracts which will be based, at this stage on geography i.e. one in Dundalk and one in Drogheda). The orderly execution of this work will require tight construction works activity programming, effective management of communications and interaction with all stakeholders and the maintenance at all times of an effective traffic management regime. The office is wholetime and temporary. • Persons who become pensionable officers of a local authority who are liable to pay the Class A rate of PRSI contribution will be required in respect of their superannuation to contribute to the local authority at the rate of 1.5% of their pensionable remuneration plus 3.5% of the net pensionable remuneration (i.e. pensionable remuneration less twice the annual rate of social insurance old age contributory pension payable at the maximum rate to a person with no adult dependant or qualified children). • Persons who become pensionable officers of a local authority who are liable to pay the Class D rate of PRSI contribution will be required in respect of their superannuation to contribute to the local authority at the rate of 5% of their pensionable remuneration. • All persons who become pensionable officers of a local authority will be required in respect of the Local Government (Spouses and Children’s Contributory Pension) Scheme to contribute to the local authority at the rate of 1.5%of their pensionable remuneration in accordance with the terms of the scheme. The Resident Engineer is responsible to the Employer’s Representative and shall report to the Senior Resident Engineer (where one is appointed) or directly to the Employer’s Representative. The Resident Engineer’s primary role on this Contract is to ensure the works are constructed in accordance with the Employer’s Representative’s Requirements and that the Contractor carries out all his obligations under the Contract. The duties and responsibilities of the Resident Engineer are outlined as follows: a. To be responsible to the Employer’s Representative and supervise, under the directions of the Employer’s Representative, the construction, completion and maintenance of all works required as set out in the scheme drawings and specifications and to ensure that they are executed fully in accordance with the Contract Documents. b. To report to the Senior Resident Engineer or the Employer’s Representative on all matters pertaining to the work on site c. To observe and implement all instructions issued by the Senior Resident Engineer or Employer’s Representative d. To ensure that events and parameters having contractual implications are properly recorded 3 e. To assess the Contractors interim and final accounts f. To carry out baseline surveys prior to commencement of construction and check the Contractor’s setting-out during construction g. To ensure that all materials used in the works are in accordance with the Specification. h. To execute or supervise tests carried out on site and to inspect materials and manufacture at source other than that which may be carried out by the Employer's Representative head office staff. i. To draft change orders and to pass them to the Employer's Representative for approval if variations from the Contract Documents are considered necessary. j. To examine methods proposed by the Contractor for executing the work and temporary works to ensure the safe and satisfactory execution of the permanent work. k. To note that the Contractor is required to employ One Temporary Works Designer who takes overall design responsibility for stability of the works during the construction process or as stated in the contract, and ensure that works are carried out in compliance with Temporary Works Designer plans. l. To record and check the progress of the work against the programme including regular monthly updating of the programme and of the cash flow statements. m. To be fully familiar with all the Safety, Health and Welfare at Work Legalisation including the Safety, Health & Welfare at Work (Construction) Regulations 2006. n. To attend, if required, Progress Meetings on site with the Employer’s Representative, the Contractors and others usually on a Monthly basis. o. To be fully familiar with the traffic management plans for the project and with any code of practice for traffic management in any specification relating to works carried out under the contract, and ensure works are carried out in compliance with these plans. p. To carry out any other duties allocated by the Senior Resident Engineer or the Employer’s Representative 4 4) MEASUREMENT a. To measure independently and agree with the Contractors staff on a monthly basis the quantities of work executed so that they may be certified by the Employer’s Representative. b. To check day work records on a regular basis and all other documentation related to variations. c. To agree quantities for sections of the work as completed, to enter these in a master Register from which the Final Account must be compiled and presented to the Employer’s Representative. d. To attend regular measurement meetings with the Employer’s representative where any difficulties with interim measurement are to be discussed. e. To examine in detail any claims submitted by the Contractor and to make written reports on same. 5) DIARY, RECORDS, REPORTS, ETC. a. To keep a comprehensive diary constituting a detailed history of the work of construction and of significant happenings at the site and to make a weekly written report to the Employer’s representative or Senior Resident Engineer. A copy of the diary to be forwarded to the employer’s representative at the end of each week. b. To record with particular detail information relating to delays, industrial disputes, adverse physical conditions, disputes with landowners, breaches of safety regulations and all Contractors plant and labour and all sub-contractors plant and labour. c. To record on the daily report sheets all information relating to each separate element of the work. d. To record on drawings for the purposes, the actual level and nature of all foundations, the strata encountered in excavation, the standing water levels and full details of any deviations from the working drawings. e. To keep comprehensive records of the location of existing and relocated services and utilities within the contract limits and to prepare maps showing their depth and location. f. To arrange for regular photographic records of the progress of the works. g. To record the number of employees engaged by the Contractor on site in their different classes and agree on a weekly basis with the Contractor the number of hours worked per employee, in particular for works pertaining to Change Orders in the Contract. h. To ensure that all directions given to the Contractor are done in writing. All diaries and copies of Instructions and Report Sheets must be carefully preserved and handed over to the Employer's Representative on request or at the end of the Contract. All entries shall be clearly and legibly written. i. To submit a Weekly Construction Report Sheet duly completed to the Employer’s representative / Senior Resident Engineer not later than Monday of the following week. j. To carry out inspections at regular intervals to ensure that the Contractors are meeting their obligations with regard to the payment of PAYE, PRSI and Pension Fund/Sick Pay contributions on behalf of their employees. k. To ensure “As Constructed” drawings are prepared by the main contractor as the work progresses and verify the accuracy of these drawings. On completion of the project all 5 completed “As Constructed” drawings shall be handed over to the Employer's Representative / Senior Resident Engineer. l. To attend regular site meetings and to take minutes for circulation to all relevant personnel. m. To assist in the preparation of all Final Accounts related to every Contract associated with the project and to be available to the Employer's Representative for consultations on all matters related to the project. n. To make all necessary arrangements to ensure adequacy of supervision of all aspects of the Works during leave taking, sickness or otherwise following consultations with the Employer's Representative / Senior Resident Engineer. o. Record, assess and report on the performance of the Contractors Temporary Traffic management Plans at a local level and in context to the performance of the Traffic Impact Strategy (prepared by the Employers Rep) 6) LIAISON a. To liaise, in a timely manner, with the Local Authority and Traffic Authority on all matters related to traffic management, road closings, local access, special agreements etc. b. To liaise, in a timely manner, with the local Authority (in particular the Water Services Section and Water Inspectors) and other utility providers on all matters related to construction works. c. To liaise, in a timely manner, with the stakeholders (landowners, businesses, and residents) located in the vicinity of works and the wider area or who may be otherwise affected by the works (i.e. water shut off’s). d. To provide timely information and attend regular meetings with local business, customers who may be otherwise affected by the works. e. To liaise with Statutory Undertakers to ensure that all existing services affected by the works are protected and relocated in a satisfactory manner. f. To receive and log all complaints from the general public or third parties, to inform the Employer's Representative / Senior Resident Engineer of same and on their advice to initiate remedial measures. 7) SAFETY, HEALTH AND WELFARE AT WORK (CONSTRUCTION) REGULATIONS 2006 a. To fully familiarise him/herself with the Safety, Health and Welfare at Work Regulations 2006. b. To note the responsibilities of the Project Supervisor for Design Process of the works. c. To note that the Main Contractor in consideration of the acceptance of its tender and by way of Collateral Agreements to the Main Contract, shall provide the services of Project Supervisor Construction Stage within the meaning of Safety Health and Welfare at Work (Construction) Regulations, 2006. d. To note in particular situations where other Contractors in addition to the Main Contractor will be working on the same site. In this case there is a requirement that the Main Contractors appoint a competent person to act as Health and Safety Co-ordinator. e. To ensure that the Project Supervisor Construction Stage (i) Develops before the commencement of the construction work the Safety and Health Plan for the construction site. 6 (ii) Prepares and keeps up to date information for regular and timely submission to the PSDP to compile the Safety File. (iii) Submits on a regular basis (usually monthly) a report from the PSCS/Contractor’s Safety Advisor or Safety Officer, dealing with the observance of the requirements of the Safety Regulations and specific site safety arrangements. f. To submit on a regular basis (usually by way of the weekly report) his/her observations on the manner in which the Safety Health and Welfare at Work (Construction) Regulations are being carried out and observed on site. g. To observe the implementation of any traffic management plan and all temporary traffic measures which shall have with regard to the health, safety and welfare of employees, visitors and the general public and to observe the application of the current Traffic Signs Manual – Chapter 8 – Signs for Roadworks. h. To report immediately to the Employer’s representative if he/she observes any blatant transgression of the Traffic Management Plan or the traffic safety arrangements as set out therein or agreed with the Local Authority/Garda. i. To familiarise himself/herself with the details of the Preliminary Safety & Health Plan and to note that the particular risks, other residual risks and envisaged methods/sequences of construction therein are reflected in the Safety & Health Plan developed by the PSCS and to be satisfied that the controls developed in respect of these are observed on site. To review Method Statements, which are required to be prepared by the Contractor in relation to the items identified in the Preliminary Safety & Health Plan. j. To report immediately to the Employer’s representative if he/she observes any blatant transgression of the Safety (Construction) Regulations or the Site Safety Arrangements as set out by the PSCS in Safety & Health Plan. k. To note that the PSCS is required to report to the PSDP any changes or unforeseen conditions that may affect design. 8) Salary €59,680 - €68,030 per annum, fully inclusive, salary determined in accordance with previous experience. 9) CONDITIONS a. The Resident Engineer is responsible to the Employer’s Representative and shall report directly to the Senior Resident Engineer (where one is appointed) or directly to the Employer’s Representative. b. The base for working purposes shall be the work site c. The employment shall be for the specific purpose for the completion of the ‘Water Conservation Project Stage 3 – Dundalk and Drogheda Bundles’ as specified by the advertisement. d. The Resident Engineer shall be present on site during the Contractor’s working hours and outside of these hours where necessary to ensure that the project is supervised and administered to the Employer’s Representative’s satisfaction including site hours with night time and weekend work as required. There will be no additional remuneration or time off in lieu for extra hours worked and Flexi-time will not be available for the duration of the project. e. Annual leave shall be taken during the official Construction Holidays as taken by the Contractor and in consultation with the Employer's Representative. Other than during these periods, only one member of staff shall be on annual leave at any time. 7 Annual holidays shall be taken at the times as set down by the Construction Industry. Your annual leave allowance will be 29 days per annum on a pro-rata basis. f. Application for annual leave entitlement outside of the official Construction Holidays shall be submitted to the Employer’s Representative for approval as follows:Leave Duration Up to 2 days 3-5 days 1 Week or greater Prior Notification 1 Week 2 Weeks 4 Weeks g. Employment may be terminated by either side by giving at least two calendar months notice. In the event that employment is terminated prior to the completion of the Contract, the appointee shall co-operate with the Consultants in ensuring that all records are up to date and presented in an acceptable manner. A lesser period of notice may be acceptable if agreed by both parties. h. The Resident Engineer shall be present on site as directed hereunder or if unavoidably absent through illness or otherwise shall communicate same to the Senior Resident Engineer or the Employer’s Representative. i. Staff timesheets shall be submitted to the Employer’s Representative on a weekly basis j. No member of the Resident Engineering Staff may disclose to any third party, verbally, in writing or by any other means, any information concerning the project other than is necessary in conjunction with the performance of the duties as laid down by the Employer’s Representative 10) PROBATION A. A nine month probationary period will be served during which there will be an ongoing review of performance by means of a monthly/quarterly appraisal. The probationary period may be extended at Louth Local Authorities discretion. B. Employment may be terminated by either party during the probationary period or at the end of the probationary period, whether or not it has been extended, by the serving of one weeks notice. In any event, the appropriate period of notice set down in the Minimum Notice and Terms of Employment Act, 1973 – 1991 will apply. In the event of such termination, Louth Local Authorities may, at the discretion of the County Manager, pay in lieu of notice. 11) RESIDENCY: A. The holder of the office shall reside in the district in which their duties are to be performed or within a reasonable distance thereof. 12) RECRUITMENT A. The local authority may decide, by reason of the number of persons seeking admission to a competition, to carry out a short listing procedure. B. The number of persons to be invited, in these circumstances, to interview shall be determined by the local authority having regard to educational qualifications, relevant experience and the likely number of vacancies to be filled. C. The appointment will be made on the result of an interview conducted by, or on behalf of Louth Local Authorities. Candidates may be shortlisted on the basis of relevance and extent of their previous experience and these applicants only will be called for interview. 8 13) HEALTH A. For the purpose of satisfying the requirements as to heath it will be necessary for each successful candidate, before he/she is appointed, to undergo at his/her expense a medical examination by a qualified medical practitioner to be nominated by the local authority. On taking up appointment, the expense of the medical examination will be refunded to the candidate. The successful candidate must comply, at his/her own expense, with such remedial requirements as the Council considers necessary. 14) RETIREMENT AGE: A. There is no mandatory retirement age for new entrants to the public service as defined in the Public Services Superannuation (miscellaneous Provisions) Act 2004. Anyone who is not a new entrant to the public service, as defined in the Public Service Superannuation (Miscellaneous Provisions) Act 2004, is subject to compulsory retirement age of 65 years. 15) PERIOD FOR ACCEPTANCE OF OFFER A. Louth Local Authorities shall require persons to whom appointments are offered to take up such appointments within a period of not more than one month and if they fail to take up the appointment within such period or any longer period agreed, the Local Authorities shall not appoint them. 9
