PART 1—PRELIMINARY
100. Title
These Regulations may be cited as the Marine
(Fees) Regulations 1988.
101. Authorising provisions
These Regulations are made under sections 105,
108 and 109 of the Marine Act 1988.
102. Objective
The objective of these Regulations is to prescribe
fees which are authorised to be imposed under the
Marine Act 1988.
103. Definition
(1) In these Regulations—
"power units" means—
(a) in relation to any internal combustion
engine—the number determined by
squaring the measurement in
millimetres of the internal diameter of
one of the cylinders of the engine,
multiplying the number so found by the
number of cylinders, and dividing the
product by 1613; and
(b) in relation to an engine other than an
internal combustion engine—the power
units indicated by the manufacturer or,
where they are not so indicated, the

power units declared by the owner to be
the power units of the engine.
(2) A reference in these Regulations to the Uniform
Shipping Laws Code is a reference to the Code as
published from time to time.

revalidation of a Certificate of Competency is
$30.00.
The fee which must be paid to the Board for issue
of a certificate where no examination is
undertaken at its offices is $24.00.

303. Fee for eyesight tests
The fee which must be paid to the Board for an
eyesight test at its offices is $13.00.
304. Maximum fee payable
If in relation to any applicant for a certificate fees
are payable under more than one part of any item
or for each examination in a set of examinations
the total fee to be paid under this Part must not in
any case exceed $110.00.

AND ADJUSTMENT OF COMPASSES
700. Definitions
In this Part—
"Class 1 Vessel" means a vessel referred to in
clause 6.1 of section 1 of the Uniform
Shipping Laws Code;
"Class 2 Vessel" means a vessel referred to in
clause 6.2 of section 1 of the Uniform
Shipping Laws Code;
"Class 3 Vessel" means a vessel referred to in
clause 6.3 of section 1 of the Uniform
Shipping Laws Code.
701. Fees payable
(1) The fee which must be paid to the Board for the
survey of a Class 1 or Class 2 vessel described in
Column 1 of the following table and for the
examination of plans and information relating to
the construction and equipment of that vessel is
the corresponding amount set out in Column 2.

(1) Except as provided in sub-regulation (2), the fee
which must be paid to the Board for boating
facilities and safety education for a vessel
described in Column 1 of the following table is
the corresponding amount set out in Column 2.

(2) The fee prescribed in sub-regulation (1) is not
payable if a vessel is—
(a) used or intended to be used primarily for
search and rescue purposes; and
(b) is approved by the Road Traffic Authority
for those purposes.
(3) The Board may, by notice published in the
Government Gazette, exempt with or without
condition any person or any class of person in
respect of any vessel or any class of vessel from
the requirements of sub-regulation (1).
(4) If an exemption given by the Board under subregulation (3) is to be subject to any condition, the
conditions that can be applied are—
(a) that the vessel is of a particular type;

(b) that the vessel is owned by a particular body,
person or organisation;
(c) that the vessel is operated by a particular
body, person or organisation;
(d) that the vessel is of a type which—
(i) is temporarily being operated on State
waters; and
(ii) is exempt from registration as a vessel
in the State or Territory of the
Commonwealth in which the owner of
the vessel ordinarily resides;
(e) that the vessel is of a type which—
(i) is temporarily being operated on State
waters; and
(ii) is registered as a vessel in a State or
Territory of the Commonwealth; and
(iii) displays in accordance with any Act or
regulation of the State or Territory an
identifying plate, mark or number
issued or allocated by the relevant
authority for the vessel;
(f) that the vessel complies with particular
regulations made under the Act;
(g) that the vessel is owned by a discharged
member of the forces and that—
(i) that person is subject to a particular
level of incapacity; and
(ii) that the Board is satisfied that an
exemption is appropriate having regard
to ownership of the vessel, use of the
vessel and any other circumstances.

(5) A person must comply with any conditions to
which exemption given under this regulation is
subject.

NOTES
1. General Information
The Marine (Fees) Regulations 1988, S.R. No. 492/1988 were made on
20 December 1988 by the Governor in Council under sections 105, 108 and
109 of the Marine Act 1988, No. 52/1988 and came into operation on
20 December 1988.
The Marine (Fees) Regulations 1988 will sunset 10 years after the day of
making on 20 December 1998 (see section 5 of the Subordinate Legislation
Act 1994).
