StrikeStop Monetary Coverage from Duke Energy One Duke Energy One will warrant to its residential customers who purchase StrikeStop Monetary Coverage that the Duke Energy One StrikeStop meter-based surge protector will prevent damage to appliances and electronic equipment from Power Surges (including lightning), as provided below, which enter such customer's home but which may not pass through the meter or the StrikeStop unit. "Power Surges" include only transitory voltage spikes or impulses (less than a millisecond in duration), or other power transient voltages, not sustained over-voltages. 1. The StrikeStop Monetary Coverage applies to only those electronic devices and appliances, which are not primarily used for business purposes, within the home in which the Duke Energy One StrikeStop unit is installed. 2. Duke Energy One, in its sole discretion, will make the determination to pay for, repair, or replace equipment damaged as provided above. If replacement is deemed necessary, Duke Energy One will pay the actual cash value of the damaged equipment, which shall be the replacement cost less applicable depreciation or betterment. 3. The StrikeStop Monetary Coverage is limited to a maximum per-event payout of one thousand ($1000) dollars or the amount of the customer’s homeowner’s insurance deductible, whichever is less, and maximum lifetime coverage of ten thousand ($10,000) dollars per customer. 4. StrikeStop Monetary Coverage protection may only be purchased within one (1) year of the installation of the Duke Energy One StrikeStop unit. An initial claim thereunder may not be made within the first thirty (30) days of the StrikeStop Monetary Coverage protection. 5. Purchase of the StrikeStop Monetary Coverage subsequent to the acquisition of a Duke Energy One StrikeStop unit will be in effect for a period concurrent with the unit’s manufacturer’s warranty unless earlier terminated by Duke Energy One. Purchase of StrikeStop Monetary Coverage protection contemporaneous with the StrikeStop unit will remain in effect for a period of ten (10) years from the date of installation unless earlier terminated by Duke Energy One and provided the customer makes all payments therefore as set forth on the customer's monthly bill. StrikeStop Monetary Coverage claims will not be honored on then-currently past-due accounts. The StrikeStop Monetary Coverage will be cancelled after three (3) months of nonpayment. 6. The minimum term of coverage which a customer may purchase is twelve (12) months. If the customer cancels the StrikeStop Monetary Coverage at any time after the twelve (12) month minimum, it may not be renewed at a later date. 7. Duke Energy One may, at its option, investigate any or all claims, as appropriate. The customer must provide reasonable availability for such investigation. Duke Energy One may deny, in its sole discretion, any claim that Duke Energy One reasonable believes is fraudulent or does not result or arise from a Power Surge. The StrikeStop Monetary Coverage requires a recurring monthly payment, which may be subject to change after the first twelve (12) months thereof. If a StrikeStop Monetary Coverage charge does not currently appear on your Duke Energy bill, the items listed in enumerated paragraph 1 above are not now covered. The StrikeStop Monetary Coverage is not available in instances in which the electric meter is not physically attached to the structure on which the Duke Energy One StrikeStop surge protector is installed (e.g., farm load center poles or other pedestals). B. The StrikeStop Monetary Coverage is applicable only to consumer electronic devices and appliances which are located inside the customer’s residence; it does not cover electronic devices or appliances which are primarily used in at-home businesses or for business purposes or to equipment outside the dwelling. C. DUKE ENERGY ONE MAKES NO OTHER WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, (INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE), OR ARISING OUT OF ANY COURSE OF DEALING OR USAGE OF TRADE. D. Notwithstanding anything to the contrary herein, Duke Energy One may terminate StrikeStop Monetary Coverage offered to any or all customers at any time. In the event of such termination by Duke Energy One, StrikeStop Monetary Coverage shall continue through the last month that an affected customer has paid for such coverage, and thereafter Duke Energy One shall have no obligations to affected customer(s) relating to StrikeStop Monetary Coverage.
