DESCRIPTION OF EXISTING PROPERTY AND USES: "The site is an 825 square foot restaurant within a multi-tenant commercial building. located at the southwest corner of Broadway and Maryland Avenue. The restaurant occupies a ground-floor space with pedestrian access from Maryland Avenue. There is also outdoor dining of approximately 200 square feet, for which the owner has obtained a Sidewalk Dining Permit on July 25, 2008 The building has no on-site parking, but the City garage is located in the same block of South Maryland Avenue. The hours of operation are currently 8:30 a.m. to g p.m., Monday through Saturday, and closed on Sundays. REQUIRED FINDINGS Pursuant to Section 30.42.030 of the Glendale Municipal Code, a conditional use permit may be granted only if the following findings of fact can be made: A. That the proposed use will be consistent with the various elements and objectives of the general plan. B. That the use and its associated structures and facilities will not be detrimental to the public health or safety, the general welfare, or the environment. C. That the use and facilities will not adversely affect or conflict with adjacent uses or impede the normal development of surrounding property. D. That adequate public and private facilities such as utilities, landscaping, parking spaces and traffic circulation measures are or will be provided for the proposed use. Further, this request requires that additional findings of fact be made, as follows: For applications involving the sale, serving or consumption of alcoholic beverages, the following criteria shall be considered in making the findings in subsection a. through d. above: 1. That where an existing or proposed on-site use is located in a census tract with more than the recommended maximum concentration of on-site uses or that where an existing or proposed offsite use is located in a census tract with more than the recommended maximum concentration of off-site uses, both as recommended by the California Department of Alcoholic Beverage Control, such use does not or will not tend to intensify or otherwise contribute to the adverse impacts on the surrounding area caused by such over concentration; 2. That where the existing or proposed use is located in a crime reporting district with a crime rate which exceeds twenty (20) percent of the city average for Part I crimes, as reported by the Glendale Police Department, such use does not or will not tend to encourage or intensify crime within the district; 3. That the existing or proposed use does not or will not adversely impact any church, public or private school or college, day care facility, public park, library, hospital or residential use within the surrounding area; 4. That adequate parking and loading facilities are or will be provided for the existing or proposed use, or other reasonable alternatives satisfy the transportation and parking needs of the existing or proposed use; and 5. That, notwithstanding consideration of the criteria in subsections 1 through 4 above, the existing or proposed use does or will serve a public necessity or public convenience purpose for the area. ANAL YSIS OF CUP REQUEST The proposal will help sustain a small restaurant serving the downtown area; a healthy business community well-supported by such services is in keeping with the City's General Plan. The restaurant is existing and the sale of beer and wine should not require any new City services, harm public safety and welfare, or be in conflict with existing or anticipated surrounding land uses. Adequate parking exists to serve the use, and addition of beer and wine service is not anticipated to intensify parking demand to any significant degree. According to the Glendale Police Department, the census tract in which the property is located has 18 alcoholic beverage sales licenses, where four would be permitted. However, the fact that there is an over-concentration of licenses does not appear to be an issue because this type of use is suitable in the 2 downtown area. Moreover, the number of crimes in the census tract is within one percent of the city average. No churches, schools, parks, libraries, hospitals or residential areas are in the immediate vicinity. The small scale of the restaurant and its location in the downtown area make it unlikely that transportation and parking will be serious issues. Currently, the existing restaurant has an encroachment permit to serve food at the sidewalk sitting area and if the applicant decides to serve alcohol there, then the applicant will be required to renew the encroachment permit through the Engineering Department. The Police Department has been notified of this matter and there are no concerns. RECOMMENDATIONS: Staff believes that all of the findings can be made in a positive manner, due to the project's small scale, the lack of any likely impacts and the community benefit derived from a healthy network of support services for the business and residential communities and the fact that alcohol sales is consistent with restaurant uses in the downtown area. Staff recommends approval of the conditional use permit. Staff suggests that the hearing officer consider the following conditions: • Limit hours of alcohol sales to 8:30 a.m. to 12 midnight, seven days a week. This would allow flexibility in future operations while protecting against possible impacts from latenight alcohol consumption. • Require that a new CUP be applied for if the restaurant wishes to sell alcoholic beverages other than beer and wine. • Require renewal of the conditional use permit in three years. • Require renewal of the encroachment permit if alcohol is to be served at the sidewalk silting area.
