DEMURRAGE
A charge of $60.00 per hour may be charged after the first 30 minutes of waiting time
BACK ORDERS
Sydney Metro: No delivery charge for standard stock items. Standard delivery charge will apply to non standard products and special orders.
Outside Sydney Metro: Delivery charges will apply for both standard and non standard products. Order early to avoid these charges.
RE‐DELIVERIES
If goods have to be returned to store for re‐delivery due to the customer not meeting any obligations made at the time of order, the customer will be charged for the cartage of the original delivery, the cartage for return to store and the later re‐delivery.
SPECIAL ORDERS
Special size products e.g. Studs, Furring Channels, etc. are available from FASTSTUD provided that the minimum quantity is a stock pack size for the product concerned. A written confirmation of the purchase order is required before manufacturing.
All special orders will be billed within 30 days of date ready for despatch. Storage fees may apply if goods are not picked up or delivered within the 30 day period.
PACKAGING
With few exceptions, FASTSTUD products are packed in workable quantities of stock packs and sub packs. In such cases, minimum quantities sold are limited to sub packs.

The Flush Finish Cavity Slider
Cavkit can be used to transform standard cavity sliders into architrave free, flush finish cavity sliders. This also compliments and tones in with the Ezyjamb® flush finish door jamb system. The Cavkit is made up of Ezyreveal® and Ezycap® to trim and cap the plaster edges around the door penetration. Custom made closer cap can be produced to suit any specification.

Standard Door Frame with stud clip fixing
Available in a range of standard sizes, these are the most economical metal door frames
for dry wall applications. Stud clips are available to suit linings of 6mm, 10mm, 13mm and 16mm.

An alternative method for concealed fixing of standard metal door frames. May be used with steel

No need to bother with fiddly stud clips. New Generation frames take the hassle out of installing metal door frames in dry wall applications. A recess is formed within the frame for the plasterboard

General Notes on Door Frames
Unless specified otherwise frames will be supplied in assembled form in 1.1mm zinc anneal with 2 off 100 x 75 zinc plated heavy duty hinges welded to the frame and preparation for 1 only Universal striker at standard height.
Frames can also be supplied in knock down (dissasembled) form or fully welded, dressed and primed if requested.
For FIRE RATED applications please ensure this is specified at time of ordering. Door frames are generally made to order therefore no returns will be accepted and no order cancellations will be accepted after production of frames has commenced.

Bradford Anticon™ is a lightweight roofing blanket constructed from a glasswool blanket adhered to an impermeable reinforced reflective foil facing. It is designed as a Thermal insulation specifically for use in residential and commercial buildings.
The thermofoil facing extends 150mm beyond one longitudinal edge of the blanket to provide an overlap when installed.

Polymax Absorb is ideal for use behind perforated paneling and ceilings designed to eliminate or reduce echo and increase reverberation times in a single space such as sports halls, cinemas, studios, industrial enclosures, HVAC ducts, silencers or plant rooms. Absorb is also recommended as a
cavity infill where where low frequency noise seperation through walls and ceilings is required. Absorb can also be used behind decorative woven
fabrics as acoustic panels or baffles to cut reverberation and echo in restaurants and areas where hard surfaces predominate and cause unwanted
noise. Absorb can also be laid above suspended ceilings to reduce flanking noise between rooms.

TERMS AND CONDITIONS OF SALE
The Terms and Conditions set out below (“the Terms”) shall apply to
all products and services supplied by FASTSTUD (referred to as FS) to the
Customer his employees or agent (referred to as “the Customer”).
FS is not bound by any variation to its Terms unless expressly agreed
upon in writing and signed by a duly authorised Representative of FS and
the Customer. These Terms herein shall apply notwithstanding any
provision to the contrary which may appear on any order form or other
document issued by the Customer or any other party. FS may at any time
and from time to time alter these Terms.
GENERAL
1. No quotation given by FS shall constitute an offer.
2. A Contract is formed when FS has received an order and either sends
the Customer a written acceptance or despatches the goods pursuant to
the order.
3. If a Customer cancels or alters any order for products after FS has
received the order then FS reserves the right to charge to the Customer
the additional costs incurred in cancelling or altering any order or part
order together with the costs of any labour and handling to the date of
such cancellation or alterations.
PRICES
4. Unless otherwise stated prices quoted are exclusive of GST and other
duties and taxes payable.
5. Prices quoted are firm for thirty (30) days from date of quotation.
6. The Customer shall arrange and bear the cost of any delivery made ex
FS store, including insurance and any other associated costs, unless
otherwise agreed by FS.
TERMS OF PAYMENT
7. Unless otherwise stated on the invoice all prices are strictly net. The
granting and continuation of credit to a Customer shall be at the
absolute discretion of FS and unless otherwise demanded by FS the
Customer shall make payment within thirty (30) days from the end of
the month of invoicing.
8. If the Customer fails to make payment in accordance with clause 7, FS
shall be entitled to:
(a) Require the payment of cash upon delivery of any further products
and services;
(b) Charge default interest at a rate equal to prevailing bank overdraft
interest rates applicable to FS on a cumulative basis on all overdue
amounts (including late payment charges and amounts other than
the price) calculated on a day to day basis on any monies due but
unpaid, such interest to be computed from the due date for
payment AND the parties agree that such default interest is not a
penalty but is a true measure of damages incurred by FS.
Payments received from the Customer will be credited first against
any default interest and all such charges shall be payable on
demand;
(c) Claim from the Customer all costs, commissions, and legal costs
and expenses on a full indemnity basis whatsoever arising from
the collection of any overdue monies. Such interest, costs and
commissions and legal expenses may be recovered as liquidated
damages, and
(d) Cease any further deliveries to the Customer and to terminate any
agreement in relation to products and services that have not been
delivered.
DELIVERY
9. Any date or time quoted for delivery is an estimate only and FS shall
endeavour to effect delivery at the time or times requested by the
Customer but failure to do so shall not confer any right of cancellation
or refusal of delivery on the Customer or render FS liable for any loss
or damages directly or indirectly sustained by the Customer as a result
thereof.
10. The Customer shall not be relieved of any obligation to accept or pay
for products by reason of any delay in delivery or any strike, lockout,
unavailability of raw materials, accidents to machinery, differences
with workman, breakdowns, shortages of supplies or labour, fires,
floods, storm or tempest, transport delays, acts of God, restriction or
interventions imposed by any laws, regulations, governments or
agencies thereof and any other cause beyond the control of FS or any
other cause whatsoever.
11. FS’s obligation to deliver, if any, shall be discharged on arrival of the
products at the Customer’s nominated delivery destination, nominated
transport company, nominated agent or the address appearing on the
invoice. The Customer shall unload the products upon delivery,
provided that if the Customer is unable or unwilling to accept physical
delivery of the products when the products are ready for delivery FS
shall be entitled to charge a fee for any delay experienced or arrange
for the storage of the products at the risk and cost of the Customer
including all transportation, storage and other consequential costs.
12. FS may at its discretion make and invoice partial deliveries and each
partial delivery shall be a separate sale pursuant to these Terms and
Conditions of Sale. FS reserves the right to charge a handling fee for
orders less than $100.00 and if less than $500.00 for a reseller or
where express freight or special packaging is required.
INSPECTION AND CLAIMS
13. The Customer shall examine the products immediately after delivery
and FS shall not be liable for any claims for misdelivery, shortage,
defect unless FS receives details in writing within seven (7) days of
the date of delivery of the products and services.
PROPERTY AND RISK
14. Notwithstanding delivery of the products or their installation, property
in any given products shall remain with FS until the Customer has paid
and discharged any and all other indebtedness to FS on any account
whatsoever (including all applicable sales taxes, GST and other taxes,
levies and duties). Any payment made by or on behalf of a Customer
which is later voided by the application of any Statutory Provision
shall be deemed not to discharge the Customer’s indebtedness and, in
such an event, the parties are to be restored to the rights which each
respectively would have had if the payment had not been made.
15. The risk in the products shall pass to the Customer upon delivery to
the Customer or his agent or to a transport company nominated by the
Customer.
16. The Customer acknowledges that it is in possession of the products
solely as a bailee for FS until payment as defined in clause 14 has been
made in full to FS and until such payment:
(i) The Customer shall be fully responsible for any loss or damage to
the products whatsoever and howsoever caused following delivery;
and
(ii) The Customer shall store the products separately from its own
goods and those of any other party and in a manner which clearly
identifies the products whether as separate chattels or as
components, as the property of FS.
17.
The Customer hereby irrevocably grants to FS, its agents and servants, an
unrestricted right and licence, without notice to enter premises occupied
by the Customer to identify and remove any of the products the property of
FS in accordance with these Terms without in any way being liable to the
Customer or any person claiming through the Customer. FS shall have the
right to sell or dispose of any such products removed or otherwise in its
sole discretion and shall not be liable for any loss occasioned thereby.
18. FS licences the Customer to sell products and sell products manufactured
using products of FS. If the products are affixed to other material, the
totality thereof shall be the sole and exclusive property of FS until
payment as defined in clause 14 has been made in full to FS, unless the
other material or part thereof are or is the property of a party or parties
other than the Customer in which case the totality thereof shall be deemed
to be owned as tenants in common with such other party other than the
Customer in shares corresponding to the respective amounts paid or
payable by the Customer in respect of such other party or parties.
19. The Customer shall be at liberty to agree to sell the products
(independently or affixed to the materials) subject to the condition that
until payment has been made in accordance with clause 14, the Customer
shall sell as an agent and bailee for FS and the entire proceeds from the
sale thereof shall be segregated for the account of FS until FS is paid in
full.
20. The right to on-sell, deal or otherwise dispose of FS’s products in the
normal course of trade may be revoked at any time and shall automatically
cease if a Receiver is appointed over any of the assets or the undertaking
of the Customer or if a winding up order is made against the Customer or
if the Customer goes into Voluntary Administration or Liquidation
(otherwise than for the purpose of reconstruction or amalgamation) or calls
a meeting of creditors or makes any arrangements or composition or
commits any act of bankruptcy or where the Customer is in default of any
of its obligations to FS.
WARRANTY
21. Subject to payment in full being made as defined in clause 14, FS shall as
a non manufacturer use its endeavours to pass on to the Customer the
benefit of any warranties or guarantees it receives in respect of products or
parts thereof supplied to the Customer provided the products or parts
thereof have been installed in accordance with the manufacturers’
recommendations or specifications or relevant Australian Standards. Such
warranties or guarantees exclude liability for any special, consequential,
direct or indirect loss, damage harm or injury suffered as a result of any
product defect to the extent permitted by law and shall be restricted to any
one or more of the following:
(i) repair the defective goods free of charge or,
(ii) replace the defective goods or part of those goods, or
(iii) supply equivalent replacement goods, or
(iv) credit the Customer such amount as the manufacturer in its sole
discretion considers reasonable having regard to the price paid for the
goods and the use of the goods enjoyed by the Customer
LIMITATION OF LIABILITY
22. These Terms do not exclude, restrict or modify the application of any
provisions of any Commonwealth, State or Territorial Law which by law
cannot be excluded, restricted or modified.
23. In no circumstances will FS incur any liability in respect of or arising out
of or in connection with any special, consequential, direct or indirect loss,
damage, harm or injury suffered or incurred by the Customer.
(a) Sale to Non-Consumers
(i) In the case of products supplied by FS to a Customer who is not a
“consumer” (as defined in the Trade Practices ACT, 1974 as
amended from time (“ the Act”), if the products do not correspond
with the description of them on the invoice or are defective, then
provided that the products are preserved intact and made available
for inspection by a representative of FS and are returned to FS in
the same order and condition as that in which they were delivered,
FS shall at its option replace those products or reimburse the
Customer for the amount of the purchase price paid for them, but
any claim in this respect must be made in writing within seven (7)
days of the date of delivery of those products.
(ii) Should the Customer seek indemnity from FS in respect of any
claim by a consumer on the warranty implied by the Act in a
contract for the supply of products by the Customer to that
consumer, sub-paragraph (i) will not apply and in respect of
products that are of a kind ordinarily acquired for personal,
domestic or house hold use or consumption (“consumer goods”),
FS liability is limited to indemnifying the Customer in accordance
with the Act, limited to a liability to pay to the Customer an
amount equal to the cost of replacing the products or the cost of
obtaining equivalent products or the cost of having the products
repaired, whichever is the lesser amount.
(b) Sales to Consumers
In the case of products supplied by FS to a Customer who is a
consumer, to the extent that the products are not consumer products or
goods, the liability of FS to the Customer for breach of any warranty
or condition (other than a warranty or condition implied by section 69
of the Act ) or for breach of any duty of care shall in all cases be
limited, at the option of FS to any one or more of the replacement of
the products or the supply of equivalent products, the repair of the
products, the payment of the cost of replacing the products or
acquiring equivalent products or the payment of the cost of having the
product repaired.
(c) Except for those conditions and warranties implied by the Act or other
sale of products or consumer protection legislation which may not be
excluded, the Customer agrees that :
(i) It has not relied on any inducement, representation or statement
made by or on behalf of FS in purchasing the products and there are
no implied conditions or warranties herein and no
collateral contracts in connection herewith (except such as may be in
writing and signed by a duly authorised representative of FS); and
(ii) This clause sets out the entire liability of FS in respect of its liability
under the Act or otherwise in respect of liabilities to the consumer
for a breach of a condition or warranty with respect to the sale of
products or goods.
24. The applicant, or Customer as the case may be, releases and discharges
FS from any claim arising out of or in connection with the installation
and/or finishing of the FS product supplied by FS and indemnifies and
holds harmless FS in respect of any such claim .
25. Any claim in connection with any act, default or omission (including any
breach of contract or breach of duty including, but not limited to,
negligence) on the part of FS must be notified to FS in accordance with
Clause 13 otherwise:
(a) FS shall not be liable on the claim; and
(b) the Customer or applicant, as the case may be, hereby releases and
indemnifies FS in respect of any such claim.
26. The liability of FS in respect of any claim notified under the preceding
clause shall be limited to the cost of the product supplied by FS.
27. These terms do not exclude, restrict or modify the application of any
provision of any Commonwealth, State or Territorial law which, by law,
cannot be excluded, restricted or modified.
FORCE MAJEURE
28. FS shall not be liable for any failure or delay to supply or deliver the
products where such failure or delay is wholly or partly due to cause or
circumstance whatsoever outside the reasonable control of FS including,
but not limited to, war, strikes, lockouts, industrial disputes or unrest,
government restrictions or intervention, transport delays, fire, act of God,
breakdown of plant, shortage of supplies or labour, storm or tempest, theft,
vandalism, riots, civil commotions or accidents of any kind.
TERMINATION
29. If the Customer fails to comply with any of these Terms or being a natural
person or persons commits any act of bankruptcy, or being a corporation
passes a resolution for Voluntary Administration or winding up or
liquidation (other than for the purposes of reorganisation or reconstruction)
or enters into any composition or arrangement with creditors or if a
receiver or manager is appointed FS may, in addition to exercising all or
any of its rights against the Customer, suspend any further deliveries and
immediately recover possession of any products not paid for in accordance
with these Terms.
RETURNS
30. Other than in respect of FS’ obligations pursuant to Clause 23 hereof, FS
shall not be liable to accept any returned products but may in its absolute
discretion accept the return of products provided that such products shall
only be accepted for credit and with the prior written approval of a duly
authorised representative of FS Products returned for credit pursuant to
this clause must be returned with packing slip and invoice and will be
subject to a handling and administration charge equivalent to fifteen
percent (15%) of the invoiced value of the returned products. Return
freight and other expenses will be paid for by the Customer and no returns
of non standard products will be accepted.
SUPPLY
31. FS reserves the right to decline any order for products when the size of the
order or the requested delivery date inhibits or prejudices FS’ ability to
fulfil its contractual commitments to its franchisees, licensees or other
Customers.
ADVERTISING
32. The Customer shall not advertise in any media the sale or disposal of
products and services purchased from FS, without the written consent of a
duly authorised Representative of FS. The Customer shall indemnify and
hold indemnified FS against any liability including any special,
consequential, direct or indirect loss, damage harm or injury suffered as a
result of false, misleading or deceptive advertising and untrue
representation or statements made to any person by the Customer in the
course of advertising. The Customer further warrants and acknowledges
that it will not use any existing logo or brand name of FS or used by FS or
that similar to, or attempt to register a trade mark or trade name or that
similar to those of FS without the written consent of a duly authorised
Representative of FS.
INTELLECTUAL PROPERTY
33. The Customer shall indemnify and hold indemnified FS against any claim,
suit, proceedings or demand made by a third party for loss, damage,
suffered whether directly or indirectly by infringement of its intellectual
property rights.
CONFIDENTIAL INFORMATION
34. The Customer warrants that it will not disclose to any person confidential
information of FS that the Customer may be shown or comes into contact
with in the course of purchasing products and services or from any other
source including but not limited FS materials, procedures, tests, reports and
equipment, without the written consent of a duly authorised Representative
of FS.
PALLETS AND GLUTS
35. Unless otherwise stated, gluts, pallets and containers used to deliver
products to the Customer, will remain the exclusive property of FS and
shall be returned to FS at the Customer’s expense within thirty (30) days of
the date of delivery. FS reserves the right to invoice the Customer for any
glut, pallet or container not returned by the due date.
GOVERNING LAW
36. The Customer agrees that these Terms shall be construed according to the
laws of the State or Territory as FS may in its sole discretion determine.
Proceedings may be instituted in such State or Territory as FS may in its
sole discretion determine. Failing such determination the Customer
consents to any proceedings being instituted and heard by any appropriate
Court sitting in the State of New South Wales applying the laws of the
State of New South Wales.
ELECTRONIC AND OTHER COMMUNICATIONS
37. (a) The Customer agrees to accept service of notices of Court documents
and notices under the Building and Construction Industry Security of
Payment Act 1999 (NSW) via email (in addition to any and all other forms
of service authorised under the Act (including Section 31 of the Act), or
regulations made pursuant to the Act).
(b) In addition to delivery in person, via post and via facsimile, the
Customer agrees to have invoices sent by email.
(c) The Customer agrees that email communications from FS to the
Customer constitute an “electronic communication” within the meaning of
the Electronic Transactions Act 2000 (NSW).
(d) The Customer agrees that in agreeing to receive invoices by email, and
the service of notices of Court documents and notices under the Building
and Construction Industry Security of Payments Act 1999 (NSW) via
email, the Customer is in both instances designating “an information
system for the purpose of receiving electronic communications” within the
meaning of the Electronic Transactions Act 2000 (NSW).
(e) The Customer agrees that evidence of the “despatch” (within the
meaning of the Electronic Transactions Act 2000 (NSW)) by FS of an
email is also prima facie evidence of the “receipt” of the email by the
Customer within the meaning of the Act. Unless the contrary is proven the
time of receipt will be deemed to be twenty (20) seconds after the time of
the “despatch” of the email.
