Dear Ms. Runyon:
In response to the TNRCC Inspection conducted on September 25, 2001, Hazy Bills Water
System is requesting an extension of 180 days to address the outstanding alleged violations.
The following alleged violations need additional time for resolution:
1. Clearwells and potable storage tanks

The Receiver and his attorney have been negotiating with an adjacent land owner to
purchase property to install a new ground storage tank. The land acquisition has not
been finalized. The new tank will eliminate the leak. Once the land purchase has been
finalized the new tank will be ordered. There is an 8•10 week shipping time on the tank.
Documentation will be submitted to TNRCC once the tank installation is completed.
2. Overflows in accordance with AA'WA standards.

capacity of 10 gallons per minute per conrrection.
The pumps will be upgraded once the new ground storage tank is installed and the piping
improvements associated with the new tank is designed and completed.

The constructed wells, No. 2 and 3, and related facilities cannot be approved for use at this time
and may not be placed into service based on our review of well completion material and as-built
plans received on November 4, 2002, with your letter dated November l, 2002. The project generally
meets the minimum requirements of the TCEQ's Chapter §290 - Rula and

Water Systems (Rules) except the following and the items marked on the attached checklists:
We do not find record of receiving the well completion data for Well No. 2 that was given
an emergency approval on December 12, 2002. Please submit completion data as required
by our approval letter. Please include the well pump capacity and a statement regarding the
installation of a well vent scrce.,n. We are attaching a well completion checklist for your
reference.

Please submit a copy of a county deed recorded sanitary control easement for well No. 3.

An application to amend CCN No. 11145 to include all areas served by Hazy Hills but not
currently certificated must be submitted.
The completion data for well No. 3 consisted of the following:

Additional system components include a 15,000-gallon ground storage tank, a 2,000-gallon steel
hydropneiuaatic tank, a service pump station, a chlorination system and, water distribution system
of unknown quanties, diameters and pipe specification.
We will retain these documents for 60 calendar days. Revisions or additional information must be
submitted to the TCEQ (Plans Review & Rate Design Team, MC-1 53) within that time or the entire
package must be resubmitted for review.
Please refer to Utility Creation & Plan Review Team Log No. 211-019 in all correspondence for thi s
project. This will help complete our review and prevent it from being considered a new project.

I am writing today in response to your December 16, 2002 review letter.
After reviewing your comments in Item #1 and my October 31, 2002 Engineering Report it became
obvious to me that maybe you do not have a copy of that report available to you.
Well 02 was constructed over 5 years ago and has been in continuous service since. Well #2 was cited in
the recent survey for being improperly sealed with no casing vent These two items were corrected the
first part of this year by Eco Resources. I did not expand upon the sanitary survey line Item violations for
Well #2 in my October 31 report because It was my understanding that documentation for this was
submitted to your agency after completion of corrective action.
All violations identified in that sanitary survey for Well #3 and appurtenant items at the Well #3 site have
been corrected as described in my October 31 report and 'as built plans.
All information regarding Well #3 in Item #1 is in the bound October 31 report I addressed the October 31
submittal to Dave Laughlin, PE so if he doesn't have it I will be glad to provide you an additional copy.
Please advise.
Item #2: Also included in that report are copies of certified maiUreturn receipt sent to the two adjacent
residential property owners requesting the easement At this time it appears that they are unwilling to
grant an easement and Ian herewith, on behalf of Hazy Hills Water System, requesting a variance to this
requirement by providing monthly water analysis monitoring reports to your agency for Well #3.

item #3: It has been my understanding since the PUC was fonned and rules promulgated in the late
I g70's that a retail utility service provider could extend service outside its certificated area up to % mile as
long as the area was not certificated to another utility offering the same service or another utility offering
the same service objected. Check this with Doug Holcomb, PE. The connections you are referring to are
within this distance from the easterly certificated area line as I have approximated its location from TCEQ
water maps and the Travis County Tax map that was included in my October 31 submittal. Again if you
don't have this please let me know and I will provide another.
You attached the foiiowing TCEQ standard forms to your December 16 letter.

Well #3 was constructed under written authorization, July 23, 2001, from Dave Laughlin, PE. A
copy of this letter is included in my October 31 report. I had assumed that the checklist was
submitted with the emergency request for construction approval. If there is no copy in your files, I
assume you have looked, I offer the following observations made on site, December 20, 2002,
between the hours of 9;00 and 10:30 am:
•
There are no abandoned or inoperative wells and existing/potential pollution hazards within'/. mile
of Well M.
•
There are no sewage treatment plants, lands on which sewage plant or septic tank sludge is
applied lands irrigated by sewage plant effluent animal feed lots livestock and animal pens solid
waste disposal sites within 500 feet of Well #3
•
There are no sewage wetwells sewage pump stations ditches containing sewage treatment waste
or industrial waste within 300 feet of well 83
•
There are no septic tank perforated drain fields absorption beds evapotranspiroation beds privies
underground fuel storage tanks cemetery areas irrigated by low dosage low angle spray on site
sewage fepiities underground petrochemical storage tanks of pipelines water wells that do not
meet public drinking water standards within 150 feet of Well #3
•
There are no Me or concrete sanitary sewers septic tanks livestock in pastures or storm sewers
with in 50 feet of Well #3
•
Well casing is as described in the October 31 report it complies with the referenced specification
•
