WHEREAS, On January 13, 2016, the New Jersey Department of
Transportation through its Bureau of Local Government Services - Newark advised the Office of the County Engineer, that the Federal Highway
Administration authorized an additional $139,133.00 funding for the above referenced project based on a bidding analyses performed by the RBA Group, Inc. dated November 19, 2015 and that an Agreement Modification#1 to Federal Aid
Agreement No. 2015-DT-BLA-210 for the reimbursement of additional funds must be executed; and
WHEREAS, this agreement establishes the State's financial obligation for the reimbursement of the cost associated with the Federal Local Safety Funds portion of construction for the project; and
WHEREAS, it is the desire of the State by this agreement to specify the conditions applicable to the financing of costs of the project out of the Project
Fund and the obligations of the County and the State with respect to the project; now, therefore, be it

INTRODUCTION:
On January 13, 2016, the New Jersey Department of Transportation through its Bureau of Local Government
Services-Newark advised the Office of the County Engineer, that the Federal Highway Administration authorized an additional $139,133.00 funding for the above referenced project based on a bidding analyses performed by the RBA Group, Inc. dated November 19, 2015 and that an agreement modification #1 to
Federal Aid Agreement No. 2015-DT-BLA-210 for the reimbursement of additional funds must be executed.
This agreement establishes the State's financial obligation for the reimbursement of the cost associated with the Federal Local Safety Funds portion of construction for the project. It is the desire of the State by this agreement to specify the conditions applicable to the financing of costs of the project out of the Project Fund and the obligations of the County and the State with respect to the project.
RECOMMENDATION AND REASONS:
It is recommended by the Office of the County Engineer that Essex County Board of Chosen Freeholders adopts a resolution authorizing the execution of this agreement; execution of this Agreement will require the
County Executive to sign and affix the County Seal, five (five) copies of the enclosed Agreement
Modification, with original signatures and properly sealed, and five (5) certified copies of a supporting resolution should be returned to the Office of the County Engineer so they may be forwarded to the
State.

IN ACCORDANCE WITH THE PROVISIONS OF THE ABOVE NOTED AGREEMENT, THE SPONSOR AND THE STATE

2. Areement Contract Term
2.1. This Agreement shall be effective upon proper execution by the State and the Recipient and shall continue in effect until the project is completed and all vouchers have been paid subject to Section 7 below, Allowable costs incurred for the performance of work in the attached Scope of Work in this Cost Reimbursement Agreement shall be eligible for reimbursement from the effective date of September 16, 2015. All such work shall be completed by September 16, 2018, unless either terminated or extended by written authorization of the State.
