Guardian Warranty Coverage for Power Transfer Switches
ASCO Power Technologies (seller) warrants its products, herein designated and defined "Power Transfer
Switches" and/or "Parts", to be free from defects in material and workmanship for a period from one (1) to ten
(10) years from date of shipment from it's factory in accordance with the coverage schedule below:
Years 1 and 2
Seller warrants all associated Power Transfer Switches designated herein to be free from defects in material
and workmanship for a period of two (2) years from the date of shipment from it's factory. Coverage to include:
parts, labor and associated travel/lodging expense, if on-site labor is required.
Years 3 through 5
Seller warrants all associated Power Transfer Switch Parts against material defects for a period of five (5) years
from the date of shipment from it's factory.
Years 6 through 10
Seller warrants all associated Power Transfer Switch Main Contacts against material defects for a period of ten
(10) years from the date of shipment from its factory.
All warranty claims of defective materials or workmanship over said warranty period will be subject to inspection
and verification by Seller's authorized service personnel.
All equipment under warranty within the first two (2) year coverage period will be replaced or put in proper
operating condition, free of all charges, and the correction of any defects by repair or replacement by Seller shall
constitute fulfillment of all obligations and liability of Seller to the Buyer.
Two-Year Warranty
(Years 1 and 2 as specified above) protection will include parts, labor, travel expenses, and labor to remove
and/or repair said equipment as designated under item 1 in the schedule of coverage.
All warranty repair or replacement of said equipment will be performed at seller's option at Seller's service facility
location, factory, or customer's installation site by Seller's certified service personnel as deemed most practical
by Seller.
Seller is not responsible for damages to or defects in any products) furnished hereunder to the extent such
damage or defects is attributable to improper installation, maintenance, use, repair or adjustment, or attempt to
operate above its rated capacity or voltage, intentionally or otherwise, or for unauthorized repairs.
Five-Year Warranty
(Years 3 through 5 as specified above), shall include replacement of defective parts for the entire five-year
coverage period, and main contact replacement up through the end of ten years (years 6 through 10 as specified
above) after shipment. Installation of such replacement parts shall be performed only by Seller's certified service
personnel.
The Buyer is responsible for all labor, travel and any incidental expenses beyond the extended two-year warranty
period as described above. In no case, will deductibles be applicable to the above said warranty.

Limitation of remedies of buyer and others. The remedies of buyer and all others claiming by, under or
through buyer are expressly limited to the repair or replacement of said defective products within the terms
of the warranty set forth in this document or, at sellers option, to repay the contract price therefor.
Limitation of liability: notwithstanding any other provision or term of this warranty or any other document
now or in the future forming part of this contract, the limit of the seller’s liability with respect to any products)
furnished hereunder, whether in contract, in tort, under any warranty, or otherwise, shall be the contract
price herein of the specific product on which such liability is based, the seller shall not be liable for special or
consequential damages in any claim, action, suit or proceeding arising under this transaction, nor shall
there be any liability thereunder for claims or labor, loss of profits or goodwill, repairs, delay damages, direct
or indirect penalties or any other consequential or incidental expenses, costs or damages.
No other representations, guarantees, or warranties, expressed or implied, are made by seller and the
foregoing warranty is in lieu of all other representations and warranties, expressed or implied, which are
hereby expressly disclaimed and waived by buyer, including any warranty of merchantability or fitness for
particular purpose.
