WHEREAS, the County and the Contractor entered into a certain Public Contract for Services to acquire therapeutic placement prevention services for the 2013-2014 State fiscal year (the "Contract"); and, WHEREAS, the County desires to amend the Contract by expanding the scope of work performed to adequately meet the needs of the population served; and WHEREAS, the County desires to amend the Contract by increasing the Maximum Contract Liability by Thirty Thousand Dollars ($30,000) which may be paid to the Contractor; and WHEREAS, the Contractor desiresto perform additional services for County pursuant to these amendments to the Contract; and WHEREAS, County has budgeted and appropriated the necessaiy finds to satis1' the financial obligations to be incurred by expanding the scope of work performed pursuant to this Contract. Services provided outside of this scope of service may be deemed gratuitous and are sub] ect to non-payment at the Department's discretion. All services must be performed in accordance with the Guiding Principles (Attachment A). 1. Services A. General Home Based Services Definition - Home Based services are short-term, family-centered, in-home or community, therapeutic services for high-risk families used for the purpose of preventing out-of-home placement, maintaining the child(ren) in the home or to prepare a family for reunification. This service is intended to primarily stabilize family functioning and address safety risks to children. In addition, this service may teach families to work with community agencies, assist in the development and enhancement of parenting skills, stress reduction, problem solving, and communication skills. Services should be flexible and individualized to each family in aligmnent with the Department's Family Services Plan. This in-home service may include intervention with the identified individual, individual family members or the entire family and may include 24-hour crisis response. Frequency/Duration - Services usually occur at least once a week or more; Provider may provide up to 15 hours of direct service per month as authorized by the Human Services Caseworker and indicated in the Authorization for Services. Provider Credentials - Providers must have, at minimum, a Bachelor's degree in one of the Human Services fields with two years of direct client experience in a human services field. A Masters degree in one of the Human Services fields may substitute for one year of required experience. B. Substance Abuse Individual Therapy After completing a thorough assessment, individual therapy Definition services are tailored to each patient's level of clinical severity and are designed to help the patient achieve changes in his or her alcohol or other drug-using behaviors. Treatment must address major lifestyle, attitudinal and behavioral issues that have the potential to undermine the goals of treatment or to impair the individual's ability to cope with major life tasks without the non-medical use of alcohol or other drugs. Services must also address the primary safety concerns for Human Services involvement as noted in the Family Services Plan. Frequency/Duration One (1) to Three (3) Group sessions per week. Sessions may last from one (1) to three (3) hours each. Average length of group sessions before completion is 6 to 9 months. Authorizations will be approved in 3 month increments. 3 AMENDMENT TO PUBLIC CONTRACT FOR SERVICES (PCS) (iii) Provider Credentials Unless treating a client with a co-occurring mental health disorder, providers at minimum, must have a Bachelors Degree in a Human Services related field from an accredited college and no less than a Certified Addiction Counselor II (CAC II) certification. For treatment of a co-occurring disorder, providers must have Master's Degree from an accredited college in a Human Services related field and have passed the Colorado State licensing exam in one of the licensing areas (LMFT, LPC, LCSW, LAC). C. Substance Abuse Group Therapy Definition - Therapeutic/Process Group therapy is recognized as the most effective methodology for substance abuse treatment. Group therapy is a therapeutic intervention that occurs primarily in a clinical setting. Group Therapy should progress toward measurable goals/outcomes that are consistent with the FSP and/or treatment plan. Therapeutic Groups address many different issues of substance abuse to include, frequency, health, accountability/responsibility, identity, cessation, anger management, self-esteem, relationship dynamics, conflict, coping skills, relapse prevention, and may include a single group of people, family or may be multi-family oriented. Frequency/Duration - One (1) to Three (3) Group sessions per week. Sessions may last from one (1) to three (3) hours each. Average length of group sessions before completion is 9-12 months. Provider Credentials - Unless treating a client with a co-occurring mental health disorder, providers at minimum, must have a Bachelors Degree in a Human Services related field from an accredited college and no less than a Certified Addiction Counselor II (CAC II) certification. It should be solution focused, and may take many form inclàding Brief Therapy, EMDR, behavior modifications, play therapy, etc,. Individual therapy should identi& measurable goals / outcomes that are consistent with the Human Services FSP. Frequency/Dutation - Up to 1.5 hours of service per week or as authorized by the Caseworker. Provider Credentials - Must hold a Master's Degree from an accredited college in a Human Services Related field and have passed the Colorado State licensing exam in one of four licensing areas toward certification (LMFT, LPC, LCSW, LAC). E. Mental Health Family Therapy (i) Definition Family Therapy is family-centered and focuses on the interactions 4 AMENDMENT TO PUBLIC CONTRACT FOR SERVICES (PCS) of family members (and other systems that impact the family (i.e., DHS). It helps the family identify destructive patterns and define new healthy patterns for interaction. Family therapy focuses on resolving the presenting problem and may include two or all members of the family in the office with the therapist at one time. It generally occurs in a clinic, however, it may take place in the home or community. Family therapy should be individualized to each family and should identify measurable goals / anticipated outcomes that are consistent with the FSP. Frequency/Duration - Up to 1.5 hours of service per week. Services are initially authorized for 3 months but may be extended with reauthorization signed by the casework supervisor. Must hold a Master's Degree from an accredited Provider Credentials college in a Human Services Related field and have passed the Colorado State licensing exam in one of four licensing areas toward certification (LMFT, LPC, LCSW,LAC) F. Supervised Visitation Definition - Supervised Visitation provides a safe, child-friendly environment that allows parents to engage in monitored contract with their child(ren). Supervised Visitation services are used primarily when children are placed out-ofhome as a result of child abuse or neglect and are unable to return to their home. Upon entry into the Supervised Visitation service, an assessment will be conducted to ascertain parenting abilities, strengths, needs and potential risks. Results of the assessment are used by visitation workers to guide the level of monitoring, support and education that will be provided to parents during visitation sessions. Visitation workers ensure child safety and confidentiality by assisting the transition from foster home parent or physical care-taker into the visitation and, at the end of visitation, back to physical care-taker. During visitation sessions, workers maintain the safety of the child while educating, mentoring and training parents to encourage bonding and healthy parenting. Visitation workers also provide role modeling to foster healthy parent-child interactions. As a result, clients are able to make positive changes in the quality of each parenting interactions with their child(ren). Frequency/Duration - The average length of Supervised Visitation services is 2-3 months. Services continuing longer than 3 months are subject to supervisor or division manager approval. Provider Credentials Minimum qualifications for Supervised Visitation services worker is a Bachelor's degree in one of the Human Services fields with two (2) years of direct experience in human services field. A Masters degree in one of the Human Services fields may substitute for one year of required experience. G. Life Skills Parenting Group (1) Description - Life Skills parenting may take a variety of forms such as psycho-educational group intervention or in-home parenting education. Groups typically occur in a clinical setting. Groups should identify concerns and topics 5 AMENDMENT TO PUBLIC CONTRACT FOR SERVICES (PCS) that are consistent with the FSP and br treatment plan. Groups may specifically address ninny different issues using an established or evidence-based parenting curriculum approved by the Department. In-home family parenting is a flexible curriculum that may be used to teach parenting skills and may also assist with basic skills such as finance budgeting, shopping, cooking, cleaning and job skills and connecting to community resource. Frequency/Duration - Services can be provided for up to 15 hours per month for in-home services and 3 hours a week for Psycho-educational groups as determined by the Human Services assessment. Additional months may be authorized by the caseworker and casework supervisor. Provider Credentials - Minimum qualifications to provide Basic Life Skills services is a high school diploma and two years of direct experience working with individuals in a similar capacity. Providers instructing in-home parenting and psycho-educational groups must have, at minimum, a Bachelor's degree in one of the Human Services fields with two years of direct experience in human services field. H. Substance Abuse Monitoring (i) Definition - On-site drug tests and laboratory screening for substance abuse is a tool used to help a parent or other person responsible to overcome denial, or complete an assessment process to determine the presence or absence of a substance abuse problem. Urinalysis and other methods are useflul as a part of a comprehensive array of outpatient services and should not be conducted, except for assessment purposes, independent of a written, co-developed, measurable treatment plan. Urine screens may be appropriate for drugs. For alcohol, breathalyzer monitoring should be used in conjunction with urinalysis as a confirmation for positive breath tests. Selection of the appropriate methods of testing, including frequency, should be determined by qualified certified substance abuse clinicians using generally accepted standards of care. (ii) Types of Tests a. 7 Panel Urine Analysis Includes screening for Amphetamines, Cocaine, Opiates, Phencyclidine (PCP), TUC, Barbiturates, Benzodiazepine. Breath Tests Measures the release of gases from lungs of the participant through a straw and into a devices to determine existing levels of alcohol in the body. Ethyl Glucuronide (EtG) Test A urine test that measures alcohol consumption up to 48-72 following the period of use. (iii) Frequency Frequency of random substance abuse monitoring is dependent on the types of substances used, frequency of use, treatment plan and progress in treatment. Frequency must be maintained within the units/hours indicated on the referral for services. 6 AMENDMENT TO PUBLIC CONTRACT FOR SERVICES (PCS) I. Mental Health Court Testimony (i) Description - Professional Court Testimony is only a billable service through Core Services when providers are subpoenaed by the court or county attorney to provide professional testimony. To be considered a billable service, the provider must have provided a professional service to the individual or family for which the subpoena was issued. Professional testimony provided by a provider who has had no previous involvement with a family is not a billable service through Core Services. The following types of activities are billable activities and must be documented in detail and submitted with billing to be paid. Preparation Assembling notes, communication, dictation, meetings. Testimony In court testimony Deposition - Out-of-court oral or written testimony (ii) Frequency/Duration - As subpoenaed by the Court or County Attorney (iii) Provider Credentials Provider credentials may vary depending on the services provided and topic for which the subpoena was issued. 2. Referral for Services The services and rates that will be paid are noted in Exhibit B of this Agreement unless specifically noted otherwise as an approved exception on the "Referral for Service" and authorized through the County Representative or designee. The services will be provided at the location(s) noted on the "Referral for Service". The Department's approved "Referral for Service" must be received by the provider prior to the commencement of services. P. The "Referral for Service" will include identifring information such as the name and address of the family, social history, medical and educational information, as appropriate. 3. Responsibilities A. The Department shall: Determine the eligibility of each person referred for services as appropriate. Provide information regarding rights and fair hearings. Monitor the provision of contracted services. B. The Contractor shall: Bill only for services authorized, amount of services authorized and actually provided per the "Referral for Service". Hold the necessary license(s) which permit the performance of purchased service, and/or meet applicable Colorado Department of Human Services Qualification requirements, comply with the requirements of Tile VI of the 7. AMENDMENT TO PUBLIC CONTRACT FOR SERVICES (PCS) Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, Title II of the Americans with Disabilities Act of 1990, the Age Discrimination Act of 1975, and the Regulations of the U.S. Department of Health and Human Services issued pursuant to the above statues at Title 45 Code of Federal Regulations (CFR) Parts 80, 84, and 91, and Title 28 CFR Part 35, (iii)Comply with all mandatory child abuse and neglect reporting laws and policies (C.R.S § 19-3-307). (iv)Safeguard information and confidentiality of the child and the child's family in accordance with the Colorado Revised Statute (CRS § 19-3-313.5) and rules of the Colorado Department of Human Services and Douglas County Department. (v) Provide the Department with the following client reports for services: Service Plan Within thirty (30) days following the initial client contact by the provider, submission of a provider service plan for the child/child's family with specific objectives and target dates. The provider service plan is subject to Department approval. Monthly Progress Reports Provide monthly reports from the time of enrollmentlparticipatioh that include the number of client contact hours, types of services provided, progress and barriers in achieving provisions of the provider's service plan. Missed Appointments/Significant Events - Notice of missed appointments shall be provided to the County. Any events considered clinically significant, i.e., family deaths, discovery of new relevant mental health issues, missed urine analysis appointments or other events that could be considered pertinent to client welfare shall also be reported within 48 hours. Discharge Summary/Reports - Discharge summary/reports are due to the Department within ten working days from the close of service. Discharge reports, at the conclusion of treatment, should render the provider's opinion of the success of services for the client and any ongoing recommendations. 4. Credentialing Criteria Contractor shall ensure that all employees/subcontractors who provide services to clients under this contract meet the credentials/qualifications specific to the County's identified credentialing standards and C.R.S Title 12, Article 43 and in the Social Services Manual Volume 7.000.6(M) (12 CCR 2509-4). The County has the right to approve Contractor's employees/subcontractors who will be performing services under this contract prior to the commencement of the work and shall have the right to review the employee(s)'/subcontractor(s)' employment files prior to granting approval. Contractor must retain copies of employee credentialing qualifications and background checks in personnel files and make 8 AMENDMENT TO PUBLIC CONTRACT FOR SERVICES (PCS) such records available to the County Representative upon request. Contractor shall obtain reference and background checks, including fingerprintbased police (CBI andlor FBI) checks (if required by statute or regulation or if there will be unsupervised contact with children), checks of Department records, and Sexual Offender Registry checks and receive, at minimum, preliminary results before assigning/hiring employees/subcontractors to perform under this contract. In the event that the County becomes dissatisfied with Contractor's employee(s)/subcontractor(s), the County will notifS' Contractor of its concerns about the employee(s)/subcontractor(s). Disciplinary measures, if any, will be the sole responsibility of Contractor.
