Filed Record of Site Condition # 214947 on 2014/10/08 No 15 of 18 Qualified Person’s Statements and Certifications As the qualified person, I certify that: A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. A phase two environmental site assessment of the RSC property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary. As of 2012/11/02, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that would interfere with the type of property use to which the RSC property will be put, as specified in the RSC. Ground water sampling has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. I have, within the six months immediately before the submission of this record of site condition, given written notice of intention to apply non-potable ground water site condition standards to the clerk of the local municipality in which the property is located and the clerk of any upper-tier municipality in which the property is located. As of 2012/11/02, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the RSC property meets the applicable full depth generic site condition standards prescribed by section 37 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this RSC is filed, except for those contaminants (if any) specified in this RSC at Table 2, Maximum Contaminant Concentrations Compared to Standards Specified in a Risk Assessment. As of 2012/11/02, the maximum known concentration of each contaminant in soil, sediment and ground water at the RSC property for which sampling and analysis has been performed is specified in this RSC at Table 1, Maximum Contaminant Concentrations Compared to Applicable Site Condition Standards. I am a qualified person and have the qualifications required by section 5 of the regulation. I have in place an insurance policy that satisfies the requirements of section 7 of the regulation. I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry. The Phase Two Conceptual Site Model is part of the report entitled “Phase Two Environmental Site Assessment, Mississauga Road and Steeles Avenue West, Brampton, Ontario” prepared by Terraprobe Inc. The Phase Two Environmental Site Assessment was conducted based upon the findings and recommendations of the Phase One Environmental Site Assessment completed for the Property by Terraprobe Inc. dated October 22, 2013. 1.1 Property Description The Property is a parcel of land located at the northwest corner of Steeles Avenue West and Mississauga Road in the City of Brampton. The Phase Two Property information is provided in Table 1.1, below. It is proposed to develop the site with a new commercial office building for Canon Canada. The Property will change land use from agricultural to commercial, which is less sensitive. O. Reg. 153/04 as amended does not require a Record of Site Condition (RSC); however, it is understood that the City of Brampton has requested a RSC for the site as part of the development approval process. Terraprobe Page No 1 Phase Two ESA Conceptual Site Model Steeles Ave. West & Mississauga Rd, Brampton, Ontario 2.0 March 13, 2014 File No. 13-12-2156 INFORMATION FROM THE PHASE ONE ENVIRONMENTAL SITE ASSESSMENT 2.1 Areas Where Potentially Contaminating Activity Has Occurred The following Potentially Contaminating Activities (PCAs) were identified in the Phase One ESA for the Property: ï‚· #40 Pesticides (including Herbicides, Fungicides and Anti-Fouling Agents) Manufacturing, Processing, Bulk Storage and Large-Scale Applications. ï‚· #28 Gasoline and Associated Products Storage in Fixed Tanks. ï‚· Other – Ontario Spills. The following Areas of Potential Environmental Concern (APECs) resulting from the PCAs were identified by the Phase One ESA: 2.2 A. APEC A is a result of the possible herbicides and/or pesticides application as part of the historical agricultural use of the Property. The Property has been agricultural in use for several decades. The APEC encompasses the entire Property. The potential Contaminants of Concern (CoCs) include Organochlorine Pesticides (OCs) and Metals based on the historic agricultural/rural and undeveloped state of the Property. B. APEC B is a result of the gas station located approximately 60 metre east of the southeast corner of the Property, at 1990 Steeles Avenue West. The APEC is located at the southeast portion of the Property. The potential CoCs include petroleum hydrocarbons (PHCs), volatile organic compounds (VOCs), benzene, toluene, ethylbenzene and xylenes (BTEX). C. APEC C is a result of a former gas station located approximately 60 metre southeast of the Property, at 7991 Mississauga Road. The APEC is located at the southeast portion of the Property. The potential CoCs include petroleum hydrocarbons (PHCs), volatile organic compounds (VOCs), benzene, toluene, ethylbenzene and xylenes (BTEX). D. APEC D is a result of a diesel fuel spill in 1994 on Steeles Avenue West, adjacent to the south of the Property. The APEC is located at the south portion of the Property. The potential CoCs include petroleum hydrocarbons (PHCs), volatile organic compounds (VOCs), benzene, toluene, ethylbenzene and xylenes (BTEX). Subsurface Structures and Utilities The subject property is not currently serviced. There is a regional water main on the north side of Steeles Avenue West, on the southeast portion of the Property. It is possible that contaminated ground water, if present, could migrate horizontally along the water main trench. As such, infiltration of storm water from the ground surface would pose as potential pathway for possible contaminants. Terraprobe Page No 3 Phase Two ESA Conceptual Site Model Steeles Ave. West & Mississauga Rd, Brampton, Ontario 3.0 PHYSICAL SETTING OF THE PHASE TWO PROPERTY 3.1 Site Stratigraphy March 13, 2014 File No. 13-12-2156 Detailed geological information for the site is presented on the borehole logs in Appendix A and geologic cross sections are presented on Figure 4 and Figure 5. The geology is summarized below. 3.1.1 Surficial Materials No surficial materials (granular or asphalt) were encountered at any borehole locations on the Property. 3.1.2 Fill Materials No fill materials were encountered at any borehole locations on the Property. 3.1.3 Native Soil Topsoil was encountered at all borehole locations on the Property and extended to depths up to 0.45 m below grade. Weathered/disturbed glacial till was encountered underlying the topsoil and extended to depths ranging from 0.8 to 1.5 m across the site. The unweathered glacial till deposit was encountered underlying the weathered or disturbed zone. The undisturbed native soils predominantly consisted of sandy silt that is clayey to containing some clay and trace gravel. The unweathered glacial till were found at elevations approximately between 189.9 m and 177.5 m above sea level (masl). Complete borehole logs are presented in Appendix A. Results of soil grain size analyses are provided in Appendix B. 3.1.4 Bedrock Inferred bedrock was only encountered in Borehole P7, at the northeast corner of the site. The glacial till was underlain by the inferred bedrock at a depth of 2.3 m (Elev. 188.4 m). The bedrock is inferred based on auger grinding, split spoon bouncing and samples retrieved in the split spoon sampler. The bedrock fragments recovered were reddish brown and were consistent with the bedrock of the Queenston Formation which is typically found in this area of Brampton. 3.2 Approximate Depth to Water Table Ground water levels were measured within all monitoring wells available at the site using a Solinst interface probe. There was no evidence of light non-aqueous phase liquid (LNAPL) in the monitoring wells when water levels were measured on October 29, 2012 and November 2, 2012. The ground water levels are summarized below. The ground water table is located in the unweathered glacial till and is considered unconfined. Ground water contours are presented on Figure 3. The ground water tables are presented on the cross sections in Figure 5. 3.3 Site Hydrogeological Characteristics The hydraulic conductivity of the glacial till as measured from slug tests at BH 106 and BH 114 ranged from approximately 1 to 6 x 10-8 m/s. The slug test data are provided in Appendix C. The horizontal hydraulic gradient of the ground water was determined to be approximately 0.01. The vertical hydraulic gradient could not be reliably determined from the available data. 3.4 Approximate Depth to Bedrock Inferred bedrock was only encountered at Borehole P7, located at the northeast corner of the Property. The depth to bedrock at this location is 2.3 m (Elev. 188.4 m). Recovered samples indicated that the bedrocks is red shale of the Queenston Formation. 3.5 Section 41 or 43.1 Section 41 of the regulation (Environmentally Sensitive Areas) does not apply to the Phase Two Property. Section 43.1 of the regulation (shallow soil property or water body) does not apply to the Property. 3.6 Soils Placed On, In or Under the Phase Two Property No soils have been imported or placed on, in or under the Phase Two Property since the Phase One ESA was completed in October 2012. No fill materials were found at the Phase Two ESA Property. 3.7 Proposed Buildings It is proposed to develop the site with a new commercial office building for Canon Canada. The Property will change land use from agricultural to commercial, which is less sensitive. Terraprobe Page No 5 Phase Two ESA Conceptual Site Model Steeles Ave. West & Mississauga Rd, Brampton, Ontario 4.0 March 13, 2014 File No. 13-12-2156 CONTAMINATION IN OR UNDER THE PHASE TWO PROPERTY Applicable Site Condition Standard The applicable soil and ground water Standards for the Property were determined to be those in Table 3 of the April 15, 2011 Ontario Ministry of Environment (MOE) “Soil, Ground Water and Sediment Standards for use under part XV.1 of the Environmental Protection Act” for Industrial/Community/Commercial property use in a non- potable ground water condition for mediumfine textured soil (Table 3 ICC Standards). These are considered to be the applicable Standards for the following reasons: ï‚· The Property will be developed for commercial purposes. ï‚· Soil at the Property was determined to be medium/fine textured based on grain size analysis of eleven representative soil samples. ï‚· Bedrock across the Property is located at a depth of greater than 2 m. ï‚· The site is located in the City of Brampton, which obtains its potable water from surface water sources. ï‚· The site is not located within 30 m of a surface water body. Media Investigated Based on the potentially contaminating activities identified in the Phase One ESA for the Property, it was decided that sampling and analysis was required only for both soil and ground water on the Property. Sample locations were selected to investigate all APECs as identified in the Phase One ESA. No surface water was present on the Property; therefore, sediment sampling or surface water sampling was not conducted. 4.1 Areas Where Contaminants are Present The results of chemical analyses indicated that all analyzed parameters meet the MOE Table 3 Standards for Industrial/Commercial/Community use.
