A hearing will be held in this case before the Florida Elections Commission on August 26, 2015, at 8:30 am, or as
soon thereafter as the parties can be heard, at the following location: Senate Office Building, Room 110-S, 404 South
Monroe Street, Tallahassee, FL 32399 .
Failure to appear in accordance with this notice will constitute a waiver of your right to participate in the hearing
Continuances will be gr anted only upon a showing of good cause.
This hearing will be conducted pursuant to Section 106 25, Florida Statutes, which governs your participation as
follows:
If you are the Respondent, you may attend the hearing, and you or your attorney will have 5 minutes to present your

SUMMARY: Dennis Hinds was a candidate for City Commissioner, Seat 1 in the 2015 elections. Barry
Bell is his treasurer.
Dennis Hinds is appealing the fine claiming that he needed assistance filing the report. According to Mr.
Hinds, his treasnrer was unavailable due to a hectic tax season. Mr. Hinds, as deputy treasnrer, took on the
responsibility of filing. He states that he submitted the correct information but due to new online reporting
software, he erred by not going to another page to submit. Mr. Hinds states that he had technical
difficulties that required assistance; however, the office of the City Clerk was closed for business. He
notes that first thing Monday morning he spoke with the City Clerk and the error was corrected and the
report was filed.

My name is Dennis Hinds, former candidate for City of Miramar Commissioner
2015. I am writing to appeal the fine that was bestowed on this former candidate. I take full
responsibility for the error that occurred. I am appealing on the grounds of mercy, forgiveness, and
technical challenges.
Please allow me to take a moment to thank and applaud our City Clerk Denise Gibbs. She is very helpful
and is a professional that keeps all candidates well informed. Unfortunately for me the day I needed
advice from Ms. Gibbs, the City of Miramar is closed on Fridays. I had no one to consult for assistance.
My treasurer is an accountant and due to tax season, his schedule was extremely hectic. I being the
deputy treasurer added the expenses and contributions correctly. Unfortunately this being new
software online reporting, I made an error by not going to another page to submit.
First thing Monday morning I spoke with our City Clerk and the error was corrected. Again the error was
totally my fault. I understand and respect the law and penalties that apply. I due ask for a one time
courtesy on behalf of being technology challenged. We had successfully submitted 13 consecutive
reports without an error. We will continue to serve and volunteer in our community that we love so
dearly.

Dear Mr. Hinds:
Your Campaign Treasurer's Report (2015 G7), which was due on March
6, 2015, and was not submitted until March 9, 2015.
Section 106.07(8)(b), Florida Statutes, provides a fine of $50 per day for
the first 3 days a report is late and, thereafter $500 per day, although a fine
cannot exceed 25% of the total receipts or expenditures, whichever is
greater, for the period covered by the late report. However, for the reports
immediately preceding each primarv and general election, the fine is $500
per day for each late day, not to exceed 25% of the total receipts or
expenditures, whichever is greater, for the period covered by the late
report.
Since your G7 Report which immediately precedes the March 10, 2015
Election was deemed filed on March 9, 2015, you are hereby fined $87.50
which represents 25% of the contributions during the reporting period.
The fine must be paid to the City of Miramar within 20 days of receipt of
this notice unless appealed to .the Florida Elections Commission. Please
note that as a candidate, the fine is not an allowable campaign expenditure
and must be paid from personal funds.
If you wish to appeal to the Florida Elections Commission, you must
submit a notice of appeal to the Conunission, in writing within 20 days of
the date of receipt of this notice. (See Section 106.07(8)(b), Florida
Statutes, and Rules 2B-1.005, 1.0052 and 1.0055, Florida Administrative
