assumptionofrisk,termsandconditions,courserules
ParticipantsandVolunteersyoumustreadthisdocumentcarefully
beforeagreeingtoenterintothisevent
Thiswaiverhasimportantlegalconsequencesandmaylimitoreliminatetheabilityofyou
oryourchildren,spouse,guardians,legalorpersonalrepresentatives,executors,
administrators,successorsandassigns,oranyoneelsewhomightclaimorsueon
participant’sbehalf,tobringfuturelegalactionsorobtaincompensation,includinginthe
eventofyourinjuryordeath.Itisaconditionofyouragreement,entryintoand
participationoftheevent“REBOUNDRACE”(hereinreferredtoasthe“Event”)thatyou
acceptthesetermsandconditions.Ifyoudonotacceptallthetermsandconditionsas
listedbelow,youmustnotenterorparticipateintheEventREBOUNDRACE.
RISKWARNING
ThisEventisphysicallydemandingandcarriespotentialandinherentdangerousriskand
physicalharmtotheparticipant.Thesepotentialriskscannotbecompletelyeliminated,
indoingsowouldcompletelychangethenatureofthisEvent.Thisisaphysically
demandingandchallengingEventregardlessofthecareandsafeguardsReboundRacehas
engagedin.
1. IacknowledgeandacceptthatparticipationintheEventmayinvolvetheriskof
temporaryorpermanentphysicalinjuryorharm(injury)orevendeath,arisingfrom
varioushazardsincludingbutnotlimitedtovehicleandpedestriantraffic,
hypothermia,spectatorcollision,participantcollision,heatexhaustion,personal
injury,slipperyandunevensurfaces,breakagesordefectsat/intheEventsiteor
equipment,failureorunsuitabilityofaparticipant’sequipment(includingmine),
overexertion,stroke,permanentdisability,spinalinjuries,paralysis,heartattack,
dehydration,inhalationoffoam,encounterwithobstacle(naturalorman-made),
andencounterwithwater(pooloronroad),unevensurfacehazards,inadequate
firstaidoremergencyprocedures,accidentswithothercompetitors,spectatorsor
roadusers,andweatherhazards/conditions.IfurtheracknowledgethatIcouldbe
subjecttocommonminorinjuriessuchasscrapes,bruises,cuts,abrasions,sprains,
nausea.IfurtheracknowledgeIcouldbeexposedtoinfection,brokenbones,torn
ligaments,heat/coldrelatedillnesses,exhaustion,concussion,badjudgement/error,
erraticbehaviouroffellowparticipantsormyself,contactwithnaturalhazards,e.g.,
lightningstrikes,unevenground,ticks/insects,wildlife,poisonousplants;
2. Iacknowledgeandacceptthatinjuryordeathmayresultnotonlyfrommyactions
(includingphysicalexertion)butalsofromtheactions,omissionsornegligenceof
otherpeopleinconnectionwiththeEvent.
3. IunderstandandagreethatparticipationintheEvent,separatelyandcumulatively,
mayconstitutea“dangerousrecreationalactivity”undertheCivilLiabilityAct2002
(NSW).
4. IwarrantIhavesufficientandnecessarycompetence,trainingandexperienceto
participateintheEvent.
5. PriortoparticipatingintheEvent,Ihavehadtheopportunitytoconsultamedical
practitioner,especiallyifIampregnant,disabled,haveacommunicablediseaseor
haverecentlysufferedanyillness,injuryorimpairment,physicalormental.Iagree
itismyresponsibilitytodeterminewhetherIamsufficientlyfit,healthy,skilledand
physicallytrainedtosafelyparticipateintheEvent,andIundertaketowithdraw
fromtheEventandnotparticipateifonthedateoftheEventIamnotingood
healthandproperphysicalcondition.IwarrantthatIhavenophysical,medicalor
mentalconditionsofwhichIamawareorshouldbeawarethatwouldaffectmy
abilitytosafelyparticipateintheEvent,orwhichwouldresultinmyparticipation
creatingariskofdangertomyselforothers,greaterthantheriskassumedbya
healthypersonofasimilarageasme.IfurtherwarrantIhavenotbeenadvisedor
cautionedbyamedicalpractitionernottoparticipateintheEvent.
6. Iconsenttoreceivinganyfirstaidandmedicaltreatmentwhichmaybedeemed
advisableintheeventofaccident,injuryand/orillnessasaresultofmyinvolvement
intheEvent.
7. Iagreetoacceptallcostsassociatedwithanyemergencymedicalcare/procedure
andtransportationintheeventthatitmayberequired
9. IacknowledgeSwitchBackEventsPtyLtdisnottheowneroftheEventsite,which
mayincludepublic/privateland,andIunderstandandagreethattheowner(s)ofthe
eventsiteowe/snodutyofcareorcontractualobligation/stome.
10. Iacknowledgeandacceptthatthereisariskofloss,theft,damageanddestruction
tomypersonalpropertyattheEvent.IagreethatIamsolelyresponsibleforthe
securityofmypersonalpossessionsandequipmentbefore,duringandafterthe
Event.
11.InconsiderationofbeingallowedtoparticipateintheEvent,I(onmyownbehalf
andonbehalfofmyexecutors,administrators,heirs,nextofkin,successorsand
assigns):
(a)tothemaximumextentpermittedbylaw,agreethatSwitchbackEventsPty
Ltd,includingtheirrespectivedirectors,officers,employees,agents,events
sponsors,volunteers,communityorganisations,allState,FederalandLocal
GovernmentauthoritiesinwhichjurisdictiontheEventmaybestagedandthe
owners,licenseesoroccupiersofanypropertywhichIenterandtheirrespective
officers,directors,employees,independentcontractors,sponsors,
representatives,agents,membersandvolunteers,includingmedicaland
paramedicalpersonnelarenotliabletoanypersonwhetherincontract,tort,
understatuteorotherwiseforanypersonalinjury,propertydamage,direct,
indirectorconsequentiallosssufferedbyme(unlesslicitlyimposed),causedby
orconnectedwithmyparticipationintheEvent(collectivelyreferredtoasthe
“harm”),includingharmsufferedbymeduetoanyperson’snegligence;and
(b)irrevocablyindemnifyreleaseandholdharmlessthepersonsorentities
mentionedinparagraph9(a)(theOrganisers)fromandagainstanyandall
liabilities,claimsoractions(includingfornegligence)whateverorhowever
caused,arisingasaresultorinconnectionwith,directlyorindirectly,my
participationinandtravellingtoandfromtheEvent,includinganyclaimbymy
supportcreworanypersonassistingme.
(c)ReleasingPartiesinclude:theparticipantaswellasparticipant’sspouse,
children,parents,guardians,heirs,nextofkin,andanylegalorpersonal
representatives,executors,administrators,successorsandassigns,oranyone
elsewhomightclaimorsueonparticipant’sbehalf.
10.IaccepttheEventpoliciesandconditionsrelatingtocommunications,search,
rescueandmedicalaidarrangementsandallotherpoliciespublishedbythe
Organisersandeachofwhichwillbemadeavailableonmyrequest.
11.IunderstandandagreethatanysafetyprecautionsundertakenbytheOrganisers
(suchascoursesupervision,obstaclesupervision,racesafetybriefings,andsafety
checks)areaservicetomeandothercompetitorsbutdonotguaranteemysafetyor
avoidancefromharm.
12.IunderstandtherespectiveOrganisers’publicliabilityinsuranceislimitedanddoes
not(andisnotrequiredbymeto)coverorprotectmefromanyinjuryordamageI
causeorcontributeto,whethertomeortoothers,oranylossorharmIsustainoris
causedbymewhilstparticipatingintheEvent(andbeforeandaftertheEvent)andI
amadvisedtoobtain,andIremainresponsibleforobtaining,myowninsurancesand
cover(includingfullprivatehealthinsuranceandadequateincomeprotection
insurance).IcanconfirmthatIhaveobtainedprivatehealthinsurancewhichis
appropriateformypersonalcircumstances(andtheriskswhicharedisclosedinthis
Waiver/termsandconditions),orwhichareasonablepersonwouldexpecttooccur
whenundertakingthisEvent.
13.IunderstandtheOrganisersreservetherighttoaltertheadvertisedcourseorclose,
postpone,rescheduleorcanceltheEventattheirdiscretion,includingforthe
followingreasons:ifnaturalorman-madeemergenciesmakeadministeringthe
Eventunreasonableduetoweatherconditions,naturaldisaster,actsofgod,
terrorism,bombthreats,evacuation,waroranyotherreason(attheorganisers’
discretion),andthatmyentryfeewillbenon-refundable.Inthecircumstancesthat
theEventberescheduledafteronemonthoftheoriginaldateandIcannotmakeit,I
willbeentitledtotransfertoanotherEvent(withnotransferfee)orbeentitledtoa
refundprovidedIadvisetheOrganiserswithin10daysoftheannounceddate
change.
14.IagreetoactappropriatelyatalltimesattheEvent,includingobeyingalllaws,
regulations,EventrulesandthedirectionsofEventofficialsandIunderstandthat
myentrymaybevoidedifthroughmyactionsorbehaviour,intheopinionsofthe
Organisers,Ihavebrokentheserules,anylaworregulationorbroughttheEvent
intodisrepute.IfurtherunderstandthattheOrganisersreservetherighttoreject
anyentrywithouthavingtojustifyorgivereasonsfortheiractions.
15.IacknowledgethatIwillnotbeundertheinfluenceofanyillegalsubstances,
alcoholordrugsoneventdayasitwouldimpairmydecisiontoparticipateonthe
obstaclesandattheeventandfurtheracknowledgethatIwillberemovedfromthe
EventifIamintoxicatedbyeitheralcoholordrugs.
16.IgrantpermissiontoSwitchBackEventsPtyLtd(anditsaffiliatesorcontractors)to
recordandphotographmyinvolvementintheEvent(the“Recordings”)andtouse
suchRecordings(includingallcontentonthoseRecordings)inanymediaandforany
purposewithoutmyconsentorcreditingmeandwithoutpaymentand/or
compensationtome.TheRecordingsarethesolepropertyofSwitchbackEventsPty
Ltdtouseforanypurpose,includingbutnotlimitedtoitspromoting,advertising
andmarketingactivities.TotheextentImayowntheRecordingsoranycontentin
theRecordings,IherebyassigntheRecordingsandsuchcontenttoSwitchback
EventsPtyLtd.
17.Iunderstandmyemailaddressmaybeusedtocommunicateinformationaboutthis
andothersportsevents,maybegiventosponsorsofthisEventandorbesent
informationaboutcompetitionsandotherSwitchbackEventsPtyLtdfromwhichI
mayunsubscribetoatanytime.
18.Iacknowledgeandacceptthatifalternativearrangementsaremadeforindividuals
tocollectanEventregistrationpackonmybehalfnoresponsibilitywillbeallocated
againsttheOrganisersincaseofloss,theftordamage.
19.IunderstandthatmyregistrationfortheEventistransferabletootherpeopleat
Transferfeeof$10.00IfIamunabletocompete,providedtheysignawaiver,orif
theEventiscancelled,myregistrationfeeisnon-refundable.
20.Iunderstandthatthisparticipantwaiverconstitutesa“riskwarning”undertheCivil
LiabilityAct2002(NSW).
21.Ifaparticipantisagedbetween13-18yearsofaged,theymusthaveaparentor
legalguardiansigntheirwaiver
22.Ifaparticipantorspectatorisagedbetween7-12yearsofage,theyMUSTbe
accompaniedbyaparentorlegalguardianatalltimeswhilstparticipatingor
spectatingatthisevent,thatmeansonthecourse/obstacle/event
centre/toilets/viewingarea,parentorlegalguardianisresponsibleforensuring1
childper1adultratioforchildrenintheircare–noexceptions
23.Waiverscannotbesignedforsomeoneelseunlessyouaretheparentorlegal
guardian,suchasinthecasethatparticipantsareagedbetween7-17.

DisobeyingReboundRaceruleswillseetheparticipant’sorgroupsbeingremoved

Participantsmustnotifycourseofficials,eventstaff,volunteersimmediatelyifthere
isaninjury,emergency,anobstaclethatlooksorisunsafe,obstaclemishaps,trip
hazardsoranyotherconcernthatmayarisewhilstoutonthecourseorparticipating
atthisevent
Itisillegalforadultstosignotherparticipatingadult’swaivers–unlesstheyrequire
legalguardianship.
Ifaparticipantisagedbetween7–17–aparentorlegalguardianMUSTsigntheir
waiver–noexceptions.
Ifparticipantisachildagedbetween7–13theymustbewithanadultatalltimes
whilstparticipatingintheEventandwhilstoneventgrounds–1adultper1child–
strictlynoexceptions
IagreetofollowReboundRaceeventrules(asoutlinedabove)andinstructionsas
instructedbyeventstaffatalltimes.IfIfailtofollowtherules,disobeyinstructionsor
displaybehaviourthatmaythreatenothers,Iwillberemovedfromthecourseandevent
precinctaltogether–noexceptions.
Ihavereadandfullyunderstandtheaboveimportantinformation,riskwarning,
assumptionofrisk,waiverandreleaseofclaimsandcertifyIam18yearsofageorolder.
Ifunder18,aparentorlegalguardianMUSTsignthiswaiver.Ifchildrenareaged
between7and13,theyMUSTbeaccompaniedbyanadultatalltimes(1adultper1child)
–noexceptions.
Ifurtheragreethatitismyresponsibilitytonotifyeventstaff/managementoreventcrew
immediatelyintheinstancethatInoticeanythingaroundthecourse,orwithanobstacleor
personsactingunlawfully,thatIseeasbeingunsafeorposingaseriousriskorharmto
fellowparticipants/spectators/volunteers/eventstaff.
IdeclarethatIunderstandtherisksandseriousdangerthatcanoccuratthiseventand
thereforeamwillinglyandvoluntarilyparticipatingintheevent.
IfurtherdeclarethatIhavehadahealthchecktomakesurethatIamfitandableto
participateinthiseventthatrequiresmetobephysicallyable,andhavenotbeentold
otherwisebyanymedicaloralliedhealthprofessional.
IfurtherdeclarethatIamsigningmyownwaiver,andnotsomeoneelse’sunlessIamthe
parentorlegalguardian.
