Terms of Use – DAAD Alumni Service Area Regarding use of the DAAD Service Area for Alumni, the following Terms of Use shall apply to relations between the Users and the DAAD (German Academic Exchange Service): 1. Definition of terms (1) The provider of the DAAD Service Area for Alumni (hereinafter referred to as "Service Area") is the Deutsche Akademische Austauschdienst e.V. (hereinafter referred to as DAAD), Kennedyallee 50, 53175 Bonn, Germany. (2) "Scholarship holder" is anyone who has received a Letter of Award from the DAAD and is currently or will in future be sponsored by the DAAD. (3) "Alumni" is anyone who has received a Letter of Award from the DAAD but is currently no longer sponsored by the DAAD. (4) "User" is any scholarship holder or alumni who has registered to use the Service Area. 2. Function and purpose of the Service Area (1) The main purpose of the Service Area is to provide Users with information. A variety of features are available to Users in the Service Area: a) Every user is given a profile in the Service Area (see "Update my contact details"). The profile contains the contact data saved by DAAD about the User. Users can update contact data in their profile at any time. b) In the Service Area, Users have the opportunity to sign up for electronic newsletters. Users can also subscribe to print media, e.g. the "DAAD Letter", some of which are subject to a fee. Other information about the content of and ways to subscribe to the DAAD Newsletter and print media is available under menu items "DAAD Letter" and "DAAD Newsletter" in the Service Area or under https://www.daad.de/der-daad/unsere-aufgaben/alumniarbeit/veroeffentlichungen/de/. (2) The DAAD may also use the User's contact details to inform the latter by e-mail about certain events, to send out invitations, and to inform the User about the activities of the DAAD and its partners. (3) The User has no legally binding claim to the features offered in the Service Area. The DAAD reserves the right to change, remove or add to features in the Service Area without authorisation. (4) Use of the Service Area is free of charge. (5) DAAD reserves the right to change or discontinue in part or in whole the Service Area or individual parts thereof. The User has no claims in this respect vis-à-vis the DAAD. The User is free at any time to continue to use the (changed) Service Area or to end the user relationship. DAAD reserves the right to end the user relationship with individual users at any time. (6) The availability of the Service Area at all times is not guaranteed. In particular, maintenance, security and capacity issues as well as events for which the DAAD is not responsible (such as disruptions to public communication networks, power cuts, etc.) may lead to disruptions or temporary suspensions of the service. 3. Registration of the User (1) Only natural persons who are scholarship holders or alumni members of the DAAD are entitled to register. (2) Registration is possible under https://alumni.daad.de/profil/login. The Service Area with its features and content is only available for use after the User has registered. (3) When registering electronically – so-called "initial login" – scholarship holders or alumni must enter their personal identification number ("PKZ") and date of birth. Scholarship holders are informed of their personal identification number in the Letter of Award. Scholarship holders or alumni must also select a user name and password. A current e-mail address must also be given. Users must accept these Terms of Use by clicking a check box to gain access to the Service Area. (4) If the scholarship holder or alumni enters the wrong personal identification number or date of birth when logging in for the first time, he or she will be informed that login is not possible after registration has been attempted. In such cases, scholarship holders or alumni should contact the Service Area administrator (alumni@daad.de). (5) Users are obliged to protect their personal login data (user name and password) against unauthorised use by third parties. Login data may not be passed on to third parties; users may update their user name and password at any time in the Service Area under menu item "Update my contact details / Service Area user data" or apply for a new password via the link on the registration page "Do you have a problem or have you forgotten your login data?". When activating the service, users should not choose passwords they have used for other services. Users must change their password immediately or have their account blocked by the DAAD (e-mail alumni@daad.de) if there are reasons to believe that unauthorised persons have gained knowledge of their password. (6) The Users are obliged to use the Service Area only in accordance with the features described in Item 2. In particular, users may not use any of the Service Area content unlawfully, such as by violating copyright or personality rights. 4. Other reasons for processing your data in the DAAD Alumni Service Area When registering, you can voluntarily provide information about your current career level. The following options are possible: "No comment / Lower management / Middle-level management / Upper management / No classification possible". This information enables us to contact you on the basis of your specified career level and if applicable to enlist your help as a speaker at (specialist) conferences, presenter, consultant, mentor or reviewer for scholarship selection procedures, etc. within the framework of DAAD's services. 5. Termination of user relationship, deletion of account (1) Users may end the user relationship for the Service Area at any time by contacting the administrator of the Service Area (alumni@daad.de) and requesting the deletion of their account. (2) The DAAD is entitled to delete created accounts if the Service Area is discontinued in part or in whole. 6. Responsibility and liability (1) As a service provider, the DAAD is responsible for its own content in the Service Area in accordance with the statutory provisions. (2) DAAD assumes no liability for the accuracy, relevance or completeness of the information contained on the website. (3) Claims by the User for damages shall be excluded. Exceptions to this are liability for damages resulting from injury to life, body or health or from the violation of fundamental obligations and liability for other damage resulting from a negligent or intentional breach of duty by the DAAD, by its legal representative or persons assisting in the performance of obligations. Fundamental obligations are those on which the User relies regularly and on which he/she is entitled to rely. (4) In the event of a violation of fundamental obligations, DAAD shall be liable only for typical, predictable damage, if this was caused due to simple negligence, unless these claims for damage from the User result from injury to life, body or health. (5) The User shall use the Service Area at his/her own risk. In particular, the DAAD shall not be liable for any technical disruption that prevents access to the Service Area. (6) If the liability of DAAD is excluded or limited according to these Terms of Use, this shall also apply to the personal liability of employees, legal representatives, entities and persons assisting in the performance of the obligations of DAAD. 7. Release from liability The User shall release the DAAD and any persons assisting in the performance of obligations in full from any claims by third parties which are asserted as a result of unlawful use of the Service Area and related services by the User or with his/her approval. This applies in particular to any violation of copyright, trademark rights, patent rights, or personality rights or breaches of competition, data protection, criminal, youth protection, telemedia or telecommunication law, which may be associated with use of the Service Area. Release also means the reimbursement of costs which the DAAD incurs or has incurred as a result of judicial proceedings/legal defence which are necessary in this connection. If the User realises or is forced to realise that such a violation is imminent, he/she is obliged to inform the DAAD immediately. 8. Miscellaneous (1) If a provision of these Terms of Use is invalid either in part or whole, this shall not affect the validity of the remaining provisions. (3) The business relationship between the DAAD and the User are governed by the law of the Federal Republic of Germany to the exclusion of all international and supranational (contract) legal orders. 11.01.2016
