stale checks-Commissioner Buhler.

$1,166.03-District Attorney.

Acknowledge receipt of correspondence from Sheriff Jones regarding the sole source purchase of
10 Taser Axon Flex body worn cameras with multi-mounting option kits and video storage at a
cost of$15,629.00 with funding from the Special LE Trust Fund State Forfeiture.

past, through itself and its predecessors in title, has been in the actual, open, adverse and exclusive

of them, have or claim to have some right, title, interest or estate in or to said real estate or some part
thereof, the exact nature and extent of which claims plaintiff does not know and cannot state; but plaintiff
alleges that whatever said claims may be, they are wholly void, valueless, and without right, and subject,
junior and inferior to the right, titie, interest and estate of plaintiffs in and to said real estate.

Board of Commissioners approval is requested for the attached Independent Contractor Agreement
for Services for a Mobil Food Vendor. Contracts are a valuable tool used by Parks+ Recreation to
provide compensation to individuals and/or partners who desire to share their service, skills and
talent with the public as independent contractors.
One of the recomm~ndations of the Master Plan is to develop and review partnerships. The Master
Plan suggested the following approach to organizing the depmiment's partnership pursuits. The
depruiment is now using the following five (5) areas of focus to organize existing and future
pminerships.
·
Operational Partners: Other entities and organizations that can support the efforts of Shawnee
County Parks + Recreation to maintain facilities and assets, promote amenities and park usage,
support site needs, provide programs and events, and/or maintain the integrity of natural/cultural
resources through in-kind labor, equipment, or materials.
Vendor Partners: Service providers and/or contractors that can gain brand association and
notoriety as a preferred vendor or supporter of Shawnee County Parks + Recreation in exchange
for reduced rates, services, or some other agreed upon benefit.
Service Partners: Are nonprofit organizations and/or friends groups that support the efforts of
the depmiment to provide programs and events, and/or serve specific constituents in the
community collaboratively.
Co-Branding Partners: Are private for-profit organizations that can gain brand association and
notoriety as a supporter of Shawnee County Parks and Recreation in exchange for sponsorship or
co-branded programs, events, marketing and promotional campaigns, and/or adve1iising
opportunities.
Resource Development Partner: A private, nonprofit organization with the primary purpose to
leverage private sector resources, grants, other public funding oppo1iunities, and resources from
individuals and groups within the community to support the goals and objectives of the department
on mutually agreed strategic initiatives.

The following contract is an example of a Vendor Partnership that help the department meet the
Community Vision for programs and events.

Robert Santacroce, dba Big Boyz, to provide food and/or beverages to the citizens of Shawnee
County in our parks in accordance with the rules and regulations set forth, no compensation from the
County.
The community's vision is "to reach out to people of all ages too encourage them to experience parks
and recreation facilities through well designed programs that create a lifetime of memories". To
meet this vision, a goal was established to "continue existing core programs of; preschool-age
programs, athletics for youth and adults, youth and adult life skill programs, camps, wellness and
fitness programs, senior programs, aquatic programs, and special events and include new core
programs in outdoor adventure, adaptive recreation and senior services".

INDEPENDENT CONTRACTOR AGREEMENT FOR SERVICES
THIS AGREEMENT is between THE BOARD OF COUNTY COMMISSIONERS OF THE
COUNTY OF SHAWNEE, KANSAS (County) and Robert Santacroce dba Big Boyz (Contractor).
1.
SERVICES TO BE PERFORMED
Contractor agrees to perform the following services for County:
To provide food and beverage to the citizens of Shawnee County 111 our parks m
accordance with the food truck permit.
This Agreement shall commence on

2016, unless this Agreement is terminated sooner or extended in accordance with its terms.
2.
PAYMENT
In consideration of the services to be performed by Contractor, County agrees to pay
Contractor as follows:

Contractor shall be responsible for all expenses incurred while performing services under
this Agreement. This includes equipment; supplies; telephone expenses; automobile and
other travel expenses; meals and entertainment; insurance premiums; and all salary,
expenses and other compensation paid to Contractor's employees or contract personnel
Contractor hires to complete the work under this Agreement.
3.
INDEPENDENT CONTRACTOR STATUS AND CERTIFICATION
Contractor is an independent Contractor, not a County employee. Contractor's employees
· or contract personnel are not County employees. Contractor and County agree to the
following rights consistent with an independent Contractor relationship:
a. Contractor has the right to perform services for others during the term of this
Agreement.

b. Contractor has the sole right to control and direct the means, manner and
method by which the services required by this Agreement will be perfonned.
c. Contractor shall not be assigned a work location on County premises, and
Contractor has the right to perfonn the services required by this Agreement at
any place, location or time.
d. Contractor will furnish all equipment and materials used to provide the services
required by this Agreement.
e. Contractor has the right to hire assistants as subcontractors, or to use
Contractor's employees to provide the services required by this Agreement.
f.
Contractor or Contractor's employees or contract personnel shall perform the
services required by this Agreement and Contractor agrees to the faithful
perfonnance and delivery of described services in accordance with the time
frames contained herein; County shall not hire, supervise or pay any assistants
to help Contractor.
g. Neither Contractor nor Contractor's employees or contract personnel shall
receive any training from County in the skills necessary to perfonn the services
required by this Agreement.
h. County shall not require Contractor or Contractor's employees or contact
personnel to devote full time to performing the services required by this
Agreement.
Fmiher, Contractor hereby ce1iifies:
1.
That Contractor is not an employee of County and thereby Contractor waives
any and all claims to benefits otherwise provided to employees of the County,
including, but not limited to: medical, dental, or other personal insurance,
retirement benefits, unemployment benefits, and liability or worker's
compensation insurance.
j.
Contractor must provide Federal Tax or Social Security Number on required
Form W-9.
k. That Contractor understands that he/she is solely responsible, individually for
all taxes and social security payments applicable to money received for services
herein provided. Contractor understands that an IRS Fann 1099 will be filed by
the County for all payments received.
4.
INDEMNIFICATION AND HOLD HARMLESS
Contractor shall save, hold harmless, and indemnify County, its officers, agents and
employees, from and against all claims, causes of action, liabilities, expenses and costs,
including reasonable attorneys' fees, for injury of any person or damage to prope1iy arising
out of, or c01mected with, work perfo1med under this Agreement which is the result of any
acts or omissions, whether negligent or otherwise, of Contractor, its officers, agents,
subcontractors or employees.
5.
INSURANCE

The County shall not be required to purchase, any insurance against loss or damage to any
personal prope1iy to which this contract relates, nor shall this contract require the County to
establish a "self-insurance" fund to protect against any such loss or damage. Subject to the
provisions of the Kansas To1i Claims Act (K.S.A. 75-6101 et seq.), the Contractor shall
bear the risk of any loss or damage to any personal property to which Contractor holds title.
6.
OWNERSHIP OF PRODUCTS/DOCUMENTS
Contractor hereby assigns to County all rights to all products, repo1is, documents,
photographs, videos, data, and drawings produced by Contractor as a result of its services
to County during the term of this Agreement.
7.
TERMINATION DUE TO LACK OF FUNDING APPROPRIATION.
Shawnee County is subject to the Kansas Cash Basis Law, K.SA. 10-1101 et seq. If, in the
judgment of the Financial Administrator, Audit-Finance Office, sufficient funds are not
appropriated to continue the function perfonned in this agreement and for the payment of
the charges hereunder, County may te1minate this agreement at the end of its cmTent fiscal
year. County agrees to give written notice of termination to Contractor at least thirty (30)
days prior to the end of its current fiscal year. Contractor shall have the right, at the end of
such fiscal year, to take possession of any of Contractor's equipment, leased or otherwise,
provided to County under the contract. County will pay to the Contractor all regular
contractual payments incmTed through the end of such fiscal year, plus contractual charges
incidental to the return of any such equipment. Upon termination of the agreement by
County, title to and possession of any equipment purchased by the County under the
contract, but not fully paid for, shall reve1i to Contractor at the end of County's current
fiscal year. The tennination of the contract pursuant to this paragraph shall not cause any
penalty to be charged to the County or the Contractor.
8.
ANTI-DISCRIMINATION CLAUSE.
The Contractor agrees: (a) to comply with the Kansas Act Against Discrimination (K.S.A.
44-1001 et seq.) and the Kansas Age Discrimination in Employment Act, (K.S.A. 44-1111
et seq.) and the applicable provisions of the Americans With Disabilities Act (42 U.S.C.
12101 et seq.) [ADA] and to not discriminate against any person because ofrace, religion,
color, sex, disability, national origin or ancestry, or age in the admission of access to or
treatment or employment in, its programs or activities; (b) to include in all solicitations or
advertisements for employees, the phrase "equal opportunity employer"; (c) to comply with
the rep01iing requirements set out in K.S.A. 44 1031 and K.S.A. 44-1116; (d) to include
those provisions in every subcontract or purchase order so that they are binding upon such
subcontractor or vendor; (e) that a failure to comply with the repo1iing requirements of (c)
above or if the Contractor is found guilty of any violation of such acts by the Kansas
Human Rights Commission, such violation shall constitute a breach of contract; (f) if the
contracting agency detennines that the Contractor has violated applicable provisions of
ADA, that violation shall constitute a breach of contract; (g) if (e) or (f) occurs, the contract
may be cancelled, tenninated or suspended in whole or in paii by the County. Parties to this

contract understand that subsections (b) through (e) of this paragraph number 5 are not
applicable to a Contractor who employs fewer than four employees or whose contract with
the County totals $5,000 or less during this fiscal year.
9.
ACCEPTANCE OF CONTRACT.
This contract shall not be considered accepted, approved or otherwise effective until the
required approvals and ce1iifications have been given and this is signed by the Board of
County Commissioners of the County of Shawnee, Kansas.
10. ARBITRATION, DAMAGES, WARRANTIES.
Notwithstanding any language to the contrary, no interpretation shall be allowed to find the
County has agreed to binding arbitration, or the payment of damages or penalties upon the
occmTence of a contingency. Fmiher, the County shall not agree to pay attorney .fees and
late payment charges; and no provisions will be given effect which attempts to exclude,
modify, disclaim or otherwise attempt to limit implied warranties of merchantability and
fitness for a pa1iicular purpose.
11. REPRESENTATIVE'S AUTHORITY TO CONTRACT.
By signing this document, the representative of the Contractor thereby represents that such
person is duly authorized by the Contractor to execute this document on behalf of the
Contractor and that the Contractor agrees to be bound by the provisions thereof.
12. TERMINATION OF AGREEMENT
This Agreement may be terminated by either paiiy by giving the other party written notice
of the intent to tenninate. The notice must specify a date upon which the termination will
be effective, which date may not be less than 7 calendar days from the date of mailing the
notice. Only services satisfactorily perfonned up to the date of receipt of notice shall be
compensated by County and such compensation shall be pursuant to the tenns of this
Agreement. Notice shall be deemed received 3 days after mailing in the United States
mail, using first class mail, postage prepaid.
13.
MISCELLANEOUS PROVISIONS
a. This Agreement shall be entered into in Shawnee County, Kansas, and shall be
construed and interpreted according to the law of the State of Kansas.
b. All notices and other communications in connection with this Agreement shall

States mail, using first class mail, postage prepaid, to the recipient's address as
stated in this Agreement.
c. Contractor shall comply with all federal, state and local laws requiring business
pennits, ce1iificates and licenses required to caiTy out the services to be
performed under this Agreement.

d. Contractor may not assign any rights or obligations under this Agreement
without County's prior written approval.
e. This Agreement constitutes the entire agreement between the parties and may
only be modified or extended by a written amendment signed by the parties
hereto.

The invalidity, illegality, or unenforceability of any provision of this Agreement
or the occurrence of any event rendering any portion or provision of this
Agreement void shall in no way affect the validity or enforceability of any other
po1iion or provision of this Agreement. Any void provision shall be deemed
severed from this Agreement, and the balance of this Agreement shall be
construed and enforced as if this Agreement did not contain the particular
portion or provision held to be void.
g. Nothing in this Agreement shall be construed to give any rights or benefits to
anyone other than County and Contractor.

I am requesting approval to reimburse Andrea Forbes $1,344.00 for tuition at Washburn
University upon completion of one class with the required grades. Andrea is currently
working to obtain a Masters Degree in Accountancy at Washburn. This reimbursement
would be for three credit hours of accounting classes. Andrea has provided detailed
information on the subject matter of this class which is attached.
This class, as well as the Master of Accountancy, directly relates to Andrea's current
position at Shawnee County. As Accountant II and Internal Auditor, Andrea will use the
skills and knowledge obtained in this class on a regular basis as she performs her duties.
Andrea, if approved, will receive reimbursement at such time that she has completed the
class with the required grade. She will provide the necessary documentation prior to
reimbursement. Reimbursement of these expenses also requires Andrea to remain
employed by Shawnee County for nine months (one month per each $150) or to pay back a
pro-rata portion should she voluntarily leave employment with the County before the

I am currently working to obtain my Masters Degree in Accountancy (MAcc) in order to complete the
requirements necessary to take the CPA exam. Commercial Transactions will be my last course needed
to complete the degree requirements and will also qualify me to sit for the CPA exam. Commercial
Transactions focuses on the nature and sources of commercial law, legal process, common, and
statutory law as they pertain to sales, negotiable instruments, secured transactions, suretyship,
insurance and bankruptcy.
Commercial transactions addresses, from a professional perspective, the study of business law as it
relates to the formation of commercial contracts, the legality and enforcement of commercial contracts,
remedies available to the seller and buyer based upon the breach of commercial contracts and an
overview of areas of the law directly related to commercial transactions such as product liability,
product warranty, secured transactions and bankruptcy. Emphasis will also be placed on the law of
negotiable instruments as the primary means of facilitating the performance of commercial
transactions.

Washburn's School of Business offers two graduatelevel educational tracks in accounting to meet qualifying
professional certification requirements while earning the
Master of Accountancy (MAcc) degree. To be licensed as
a certified public accountant (CPA) in nearly every state,
including Kansas, candidates for the qualifying exam must
complete at least 150 credit hours of education. Becoming
a CPA opens doors to opportunities not only in accounting
firms but also across the business landscape. The program
also prepares students for the requirements for other
professional certification examination such as the Certified
Management Accountant Examination (CMA) and the
Certified Internal Auditor Examination {CIA). Washburn's
MAcc program prepares students to enter or advance
careers in public accounting, corporate accounting,
management accounting, and governmental accounting,
as well as corporate finance, financial analysis, and law
enforcement.
The 3+2 Program; The first educational track, the
3+2 Program, is available to qualified currently enrolled
Washburn undergraduate accounting majors who have
reached senior status and have completed other specified
requirements. These students complete their 124-hour
undergraduate accounting degree while simultaneously
fulfilling the 30-hour addition'al requirement for the MAcc.

The 30-hour Flexible Program: The second
educational track is the Master of Accountancy 30-hour
Flexible Program. This program is available to qualified
students who have completed a bachelor degree
equivalent to a Washburn University undergraduate
accounting degree. This program of study can be
completed in as little as twelve months or may be
extended to be completed over a period of up to five
years while taking one course per semester. Admission
requirements include an appropriate score on the
Graduate Management Aptitude Test (GMAT). Please see

Provisional Admission
By individual application review and based on
space availability and the applicant's previous academic
record, a limited number of applicants of outstanding
promise, but whose applications are incomplete, may be
granted provisional admission to the MAcc program for
one semester while their application files are completed.
During the semester of provisional admission, the
applicant is required to complete the application file and
may enroll in up to two MAcc courses for a total of no
more than six semester hours. No further enrollment is
possible without full admission to the MAcc program.
International Admission
International students applying for the MAcc Flexible
Program must hold a university credential that is
equivalent to a U.S. regionally accredited baccalaureate
degree;

seek admission to the Intensive English Program.
Native speakers of English or students who have
earned a 4-year degree from a U.S. institution are
exempt from the TOEFL requirement.

Academic Advising
All academic advising for MAcc students is done by
the Director of the MAcc Program. MAcc students are
required to consult with the MAcc director every semester
to decide the student's class schedule for the coming
semester, in part to ensure that courses are taken when
available and to work toward timely graduation. Students
are expected to inform Washburn University and the MAcc
program of any changes of their permanent and current
address and contact information. International students
must inform the International Student Office as well.
Students are expected to check their Washburn University
e-mail regularly, as official communications may be sent by
e-mail.
Academic Status: Full-Time and Part-Time
Graduate Student
Full-time or part-time status of graduate students
during the fall and spring semesters are calculated as
follows:
9 or more semester hours = full time
8 semester hours= three-quarter time
5 to 7 semester hours= one-half time
1 to 4 semester hours= one-quarter time
Grades
The symbols used in grading are as follows: A,
excellent; B, well above average; C, average; D, below
average but passing; F, failure. In computing grade point
averages: A equals 4; B equals 3; C equals 2; D equals 1; F
equals 0. No grade below "C" is acceptable for graduate
credit.
To graduate, MAcc students are required to have at
least a 3.0 grade point average in all graded upper-level
courses. At least 30 upper-level hours (courses numbered
600 and above) must be taken on a graded basis, including
all required upper-level courses. A student will be allowed
to have a maximum of two courses with a grade of "C"
included in his or her MAcc program. A student receiving a
grade of "C" in a MAcc course may retake the course (one
time only).
lncompletes
In accordance with Washburn University policy,
incomplete grades ("I") may be given when most of the
work for the course has been completed (approximately
75%). In order for a grade of incomplete to be turned
into a letter grade, all the required course work must,
at a maximum, be turned in by the end of the regularly
scheduled classes within one regular semester of the
date the incomplete was given. This is the maximum
length of time allowed for a student to complete the
specified course requirements. Otherwise, the incomplete
grade will be converted to a grade of "F". Students
must complete all "I" grades in order to graduate from
the University. Faculty have the right to impose shorter
completion time frames for courses in the MAcc program.
Probation and Dismissal
Students are placed on probation whenever their
graduate grade point average falls below 3.0 or whenever
the student has received two recorded courses grades of C.
Students on probation must work with the MAcc director
to develop a plan of study to be restored to good standing
in the next semester, subject to course availability.
Students who continue on probation for more than one
semester may be dropped from the MAcc program.
Students admitted to the 3+2 MAcc Program must
maintain a cumulative WU grade point average of 3.0
or higher for all coursework completed subsequent
to admission to be considered in good standing in the
program.
Time Limits
A student may be awarded a Master of Accountancy
degree after completing the requirements for the degree
in effect the later of (1) the semester when he/she first
enrolled or (2) the semester when he/she was fully
admitted to the MAcc program. The student may choose
any subsequent catalog In effect within six years prior to
the date of graduation.
WASHBURN UNIVERSITY DUAL
DEGREE PROGRAM
School of Law (J.D.) & School of Business (M.Acc)
Recognizing that legal and business studies
complement each other and that real-world problems
often require solutions from both legal and business
perspectives, Washburn University has developed a dual
degree program to encourage students to obtain Juris
Doctor (J.D.) and Master of Accountancy (MAcc) degrees
during their course of study at Washburn.
On its own, the J.D. program at Washburn
University School of Law requires 90 credit hours; the
MAcc program requires 30 master's level credit hours
beyond the course prerequisites. Thus, pursued separately,
the J.D. and M.Acc. together would require 120 credit
hours. Under the dual degree program, certain courses
are accepted for credit by both schools: six credit hours of
business-related law school courses may count toward the
MAcc and six credit hours of business school courses in the
MAcc may count toward the J.D. Students can therefore
obtain both degrees with a total of 108 credit hours.
Law school courses that transfer to the business
school are those that are business-related (as determined
by the business school); business school courses that
transfer to the law school are core courses in which the
student earns at least a "B." (Grades will not transfer

between schools; for the transferee school, the courses
will be treated as credit/no-credit.) No credits for business
school courses will transfer to the law school until the
student has obtained 12 credits of MAcc (600 series)
business school courses.
Students may choose to begin either their legal studies
or their accounting studies first. Whenever they start the
Jaw school program, students must take the full first-year
curriculum, all of which consists ofrequired courses,
without interruption. Students will not be permitted to
take business school courses during the first year of law
school. After completing the first year of the law school
curriculum, if students simultaneously take courses in
both programs, the total number of credits enrolled in at
one time must stay within the parameters required by the
American Bar Association's standards governing accredited
law schools. Students are also required to participate in
the various orientation and assessment activities of both
programs.
Students must separately apply to and be accepted
by both schools. Students will indicate to each school, at
the time of application that they are applying to the dual
degree program. Students will pay tuition for Jaw school
courses at the normal rate for that school and will pay
tuition for business school courses at the normal rate for
that school.

The Washburn Master of Business Administration
(MBA) program is designed for the business professional
who desires to combine an existing career with formal
educational development. About 900 MBA degrees have
been earned since the program began in 1982, presently
at a rate of 25 to 30 per year. Washburn MBA students
and graduates are employed at all of the major businesses
in Topeka and many are employed outside the region.
International students compose about 25% of the nearly
90 MBA student body.
Broad in nature, the Washburn MBA program aims at
producing general competence for overall management
of corporate enterprises, public and governmental
organizations, health and educational institutions, and
entrepreneurial ventures. Courses are taught in stateof-the-art facilities by faculty who are academically and
professionally qualified. Admission and initial enrollment
can be for the fall, spring, or summer. Each class meets
one night a week for two and one-half contact hours, with
occasional Saturday offerings.
Washburn MBA Graduates will be able to identify,
gather, and analyze relevant information in order to make
effective decisions and improve organizational processes.

Capital Expenditure Requests for April:
• The first Capital Expenditure request that we have for the month of May is for something that we
have already had to do. When we were loading in dirt for the Capital City Carnage which we have
stored in the lawn south of the Expocentre parking lot you might recall that we received a large
amount of rain that week. Because the ground was so wet we had to make an emergency decision
to build a road out to the area so that we could get equipment and trucks there without getting stuck.
We had the excavating contractor that was do the work for the show haul 125 tons of rock to build
a road overnight so they could continue the operation on schedule. We are asking that this be a
capital expenditure instead of a show cost since this road will be useful for all of the other numerous
dirt shows that we use this dirt for as well. The amount of this request is $2,123.36
• The second item was an emergency repair that had to be done to one of the two HV AC units that
condition the Heritage Hall. Last weekend when the unit started for the first time this season one
of the relays shorted out causing the compressor to short out. Two bids were obtained and a call
was placed to Stan Oyler on the Advisory Board. The request was then also brought to the
Advisory Boards attention on Wednesday the 26 111 and was approved. The bids were presented by
PCI and Samco and were very similar in nature so the project was awarded to PCI since they had
done the diagnosis of the problem. The total cost of this request is $15,885.00
The Kansas Expocentre Capital Expenditure Fund has a current balance of no-less-than $135,686.68.
The total of the current request is an amount of no-more-than $18,008.36. Approval of these requests would
leave us with a balance of no-less-than 117,678.32.

Now that we have completed the trade in and lease programs with the skid loader that was
previously approved by the Board of Advisors and the County Commission. As previously
mentioned we would like to continue this same program of switching out aging equipment next
with the two forklifts that we currently have here.

In accordance with Shawnee County Resolution 2012-59, the Compliance Officer
received official notification in writing (via email) on May 25, 2016, indicating that
Stormont Vail Health's Administrative Director of Emergency, Trauma & Surgery
Angela Gamber will be resigning her position as an Advisory Board Member
following the June 29, 2016 meeting.
With that in mind, President and Chief Executive Officer Randy Peterson has
asked that Director of the Stormont Vail Health's Emergency Department
Jennifer "Renea" Wilson be appointed to the Ambulance Advisory Board to fill the
term which will expire on June 11, 2018.
It is therefore requested that the Board of County Commissioners approve the
appointment of Director Wilson to serve a remainder of the three year term on
the Ambulance Advisory Board (Term 6/30/16 to 6/11/2018).
Attached is a chart indicating each of the Board Members and the terms of
appointments.
Please place this item on the agenda for June 2, 2016.

WHEREAS, the Board of County Commissioners of the County of Shawnee,
Kansas has established an Ambulance Advisory Board to advise the Commission on the
provision of ambulance service in Shawnee County; and
WHEREAS, the Board of County Commissioners of the County of Shawnee,
Kansas desires to have the advice of citizens who are knowledgeable in the area of
ambulance services for the residents of Shawnee County; and
WHEREAS, the Board of County Commissioners of the County of Shawnee,
Kansas deems it in the best interest of the citizens of Shawnee County to adopt the
following rules and regulations for the operation of the Ambulance Advisory Board;

2012, does hereby resolve as follows:
1.
Membership of the Ambulance Advisory Board
a. The Ambulance Advisory Board shall consist of the following:

One member from Stormont Vail Hospital, preferably someone
with knowledge of or experience in providing emergency
medical service.
The CEO or other management personnel
from Stormont Vail Hospital shall be invited to recommend a
person for this position.

One member from St. Francis Hospital, preferably someone
with knowledge of or experience in providing emergency
medical service. The CEO or other management personnel
from St. Francis Hospital shall be invited to recommend a
person for this position.
iii. One member from the Topeka Fire Department. The Topeka
Fire Chief shall be invited to recommend a person for this
position.
1v. One member from the Rural Fire Chiefs. The Rural Fire Chiefs
shall be invited to nominate a representative by majority vote.
v. Two members from the public. These persons will preferably
have some knowledge in the areas of emergency medical
service, administration of ambulance service, or other related
areas. No person may serve in this position if such person is
employed by AMR or the Topeka Fire Department or if such
person is employed or volunteers for any of the County's Rural
Fire Departments.
v1. One member shall be the Director of the Shawnee County
Emergency Management Department or his or her designee.
This member shall not vote except to break a tie.

b. Members of the Ambulance Advisory Board shall be appointed by and
serve at the pleasure of the Board of County Commissioners. The
Board of County Commissioners may interview prospective appointees
prior to appointment.
c. All members shall be residents of Shawnee County.
d. Term Limits. Every Advisory Board member shall be appointed for a
three (3) year term. Each member may serve a maximum of two (2)
terms. The terms shall be staggered. For the first members appointed
after this resolution is enacted, the members from the Topeka Fire
Department and the Rural Fire Chiefs shall serve one (1) year terms,
the members from the public shall serve two (2) year terms and the
hospital members shall serve three (3) year terms
Thereafter, all
members shall serve three (3) year terms. These term limits shall not
apply to the position filled by the Shawnee County Emergency
Management Director or his or her designee.
2.
The scope of authority of the Ambulance Advisory Board is advisory to
the Board of County Commissioners on issues relating to the provision of ambulance
service in Shawnee County. A quorum of the Advisory Board will be fqur (4) members.
The Shawnee County Emergency Management Department shall provide clerical support
to the Advisory Board as necessary for the taking of minutes of its meetings. Meetings

shall be held at least once every other month, but the Advisory Board may meet as often
as deemed necessary to accomplish its purpose.

The Advisory Board may request the attendance of the County Counselor
or the County Finance Director or his or her designees at its meetings upon sufficient
notice to these departments.
4.
The Board of County Commissioners may, from time to time, solicit the
recommendations of the Ambulance Advisory Board with respect to any matter that
affects the provision of ambulance services within Shawnee County, Kansas. Any formal
recommendation by the Ambulance Advisory Board to the Board of County
Commissioners shall be on motion passed by a majority of a quorum.
5.
One of the functions of the Ambulance Advisory Board is to assist the
Shawnee County Emergency Management Department with ambulance contract
compliance.
The Shawnee County Emergency Management Department is hereby
authorized to provide all data, records and reports relating to the provision of ambulance
service in Shawnee County to the Ambulance Advisory Board. Upon completion of each
monthly review report by the Emergency Management Department, such report shall be
made available at the next meeting of the Ambulance Advisory Board. If the Ambulance
Advisory Board deems it necessary to have additional information from the ambulance
provider to perform its duties pursuant to this resolution, it may request the Shawnee
County Counselor to assist it in obtaining the records from the provider. Nothing in this

section shall be construed to allow the Ambulance Advisory Board access to confidential
or proprietary records.
6.
In the interest of assuring that Shawnee County is providing adequate and
appropriate ambulance service for its citizens, the Board of County Commissioners
requests that the Ambulance Advisory Board perform long range planning in the area of
ambulance service.
This may include recommendations to the Board of County
Commissioners on such issues as whether ambulance service should be provided by the
government or by private enterprise; whether to request proposals for ambulance service
in the future; government subsidy issues; what type and scope of service should be
provided; the quality of the continuum of care for patients and any other issue that the
Ambulance Advisory Board determines should be discussed regarding the future
provision of ambulance service in Shawnee County.
7.
The Ambulance Advisory Board shall have the authority to make
unsolicited recommendations to the Board of County Commissioners with respect to any
matter that affects the provision of ambulance services within Shawnee County, Kansas.
8.
On all ambulance service related issues, the ambulance service provider
shall present the issues to the Ambulance Advisory Board first for its recommendation
before coming before the Board of County Commissioners.

9.
Neither the Ambulance Advisory Board nor its members shall have the
authority, jointly or severally, to contract, tax, or otherwise take any action which would
in any way bind the Board of County Commissioners of the County of Shawnee, Kansas.
10.
Resolution No. 2002-44, and any other resolution in conflict herewith, are
hereby rescinded.
