INTRODUCTION Pursuant to Rule 6.2 of the Rules of Practice and Procedure of the California Public Utilities Commission (Commission), Southern California Edison Company (SCE) respectfully files its Opening Comments to the Order Instituting Rulemaking (OIR) and the Preliminary Scoping Memo served November 13, 2008. SCE takes no position on whether additional public participation hearings should be held in this proceeding. 1 In these Opening Comments to the OIR, SCE: • Affirms its support for a statewide rulemaking in which all stakeholders can discuss whether and to what extent utility practices should or should not be modified to safely reduce the risk of wildfires, and in which the stakeholders can identify the costs and other implications of those modifications; • Proposes a “straw man” rulemaking schedule to facilitate discussion and consensus on any proposed rule changes, which starts with a prehearing conference followed by additional technical workshops, use of a workshop facilitator, and adoption of a means for soliciting proposed rule changes from any interested party while adhering to the goal to complete the process efficiently and in a timely manner; • Describes the Company’s concerns and recommendations about the proposed scope of the rulemaking; and • Requests that the costs associated with any proposed rule changes be analyzed and that the Commission provide a cost recovery option for all adopted rule changes. II. SCE’S COMMENTS TO THE OIR AND PRELIMINARY SCOPING MEMO A. SCE Supports This Rulemaking With Appropriate Modifications To Its Schedule And Scope A uniform statewide policy regarding the construction and maintenance of utility lines and rights-of-way, and disaster management affecting those lines, is more likely to improve public safety while maintaining reliable, affordable electric service, than are piecemeal local regulations. For this reason, SCE supported opening a statewide rulemaking last year when 2 SDG&E filed its Petition.3 SCE supports this rulemaking subject to a number of modifications to the OIR’s schedule and scope addressed below. Disasters, whether initiated by natural causes or not, will continue to occur throughout California and will affect the service territories of all utilities regulated by the Commission.4 If local authorities having jurisdiction and other state safety agencies come to a consensus in a single proceeding on statewide regulations that ensure cost-effective, safe, and reliable utility service to the growing population of California, while taking appropriate account of the risk of wildfires, such a consensus should and would prevail over piecemeal local regulations. Thus, SCE supports this statewide rulemaking and emphasizes the importance of participation by local authorities and safety agencies with the goal of achieving consensus on statewide regulations to prevent, respond to, and recover from wildfires. Among other things, such local participation can help make clear the dividing line between what regulation is properly the Commission’s and what is legitimately a local issue.5 The impetus for this review of rules and procedures is less the incidence of fires as such than it is the loss of homes and other structures. So understood, this proceeding may help identify the extent to which reducing such losses in the future may be more appropriately addressed and achieved through changes to local land use control and property maintenance regulations than through cost-driving changes to the design, construction, and maintenance standards of the electric system, the costs of which would be borne by all utility customers. 3 P.07-11-007 filed November 06, 2007 4 SCE believes that is it is not only desirable, but essential, that municipal utilities and districts participate actively in this rulemaking, so that any regulatory changes adopted by the Commission may be informed by the broadest array of professional engineering and operational experience and judgment. In so recommending, SCE takes no position on the question of the Commission’s jurisdiction over such entities regarding the subject matter of the requested rulemaking. The public (that is, non-investor-owned) utilities and districts in the state should – at the very least – be encouraged to participate as a matter of intergovernmental comity. 5 An example of such a jurisdictional question is the recent resolutions proposed by the Los Angeles County Board of Supervisors to regulate distribution lines on private property. 3 1. The Schedule Listed In The Preliminary Scoping Memo Should Be Modified To Enable Stakeholders To Reach Consensus On Any Proposed Rules Or Rule Changes The schedule presented in the draft scoping memo is very ambitious. SCE understands and agrees with the notion that, in dealing with issues of public safety, time is of the essence. However, SCE also firmly believes that public safety is not well served by the adoption of regulations which are rushed into place without adequate attention to their wording, their technical validity, and their amenability to fair and effective enforcement. It has been SCE’s experience – and, we believe, the experience of other parties and the Commission – that when rules pertaining to the design, construction, and maintenance of utility facilities are the product of consensus among the regulated industries, the regulators, and other stakeholders, those rules can be more readily implemented, the costs of compliance are more likely to be reasonable, and enforcement can be more effective. Thus, a prehearing conference is essential in this case for the parties to discuss a schedule that does not sacrifice informed, sound rulemaking in the interest of expediency. SCE further recommends that the schedule allow for the submission of proposed rule changes (PRCs) by any party, as well as a sufficient number of technical workshops to enable the parties to evaluate and reach consensus on the PRCs. Finally, SCE respectfully recommends that serious consideration be given to retaining or appointing an experienced workshop facilitator.6 When setting the schedule for this proceeding, the Commission should closely examine the schedule of the three most recent proceedings that considered and adopted rule changes to General Order 95: the 2001 G.O. 95 Rulemaking (R.01-10-001), the wireless antenna rulemaking (R.05-02-023), and the recently concluded pole-top antenna rulemaking (R.07-12 6 SCE also suggests that as this proceeding develops, it may be more efficient for electric utility and telecommunications proposed rule changes to proceed on different tracks. 4 001). Each of these three proceedings began with a petition that included specific PRCs. SCE notes that the proposed schedule in this proceeding would have the process end immediately following the publication of PRCs and a comment period. In each of the three most recent proceedings, however, technical workshops were held in which the parties reached consensus on most or all of the PRCs.7 The workshop reports in these three proceedings presented the consensus proposals to the ALJ along with a few disagreements for decision (except the pole-top antenna proceeding where there were no disagreements). In each of these proceedings the ALJ had the discretion to hold post-workshop evidentiary hearings or rule on any residual disputed items via written comments in advance of issuing a preliminary decision. SCE believes that following that approach in this proceeding would be more fruitful and, with a consensus proposal, could conclude more expeditiously. A consensus approach to PRCs is superior to an approach that limits the participation of the parties. A big risk of the current schedule is that the ALJ will be forced to address and harmonize a vast number of disparate technical and substantive comments filed by numerous parties to rule and code changes drafted by a single entity – the Commission’s Consumer Protection and Safety Division (CPSD). SCE believes that the role of drafting rule revisions is more appropriately filled by technical experts in advance of, or within, a workshop setting. Recent history demonstrates that consensus can be reached on General Order 95 rule revisions, even with many parties participating. A well documented workshop report can list the history of and support for each proposed rule change giving the ALJ a roadmap with which to decide any unresolved matters8. 7 Each of these proceedings also included a workshop facilitator, which improved the efficiency of the workshop process. Another topic of the prehearing conference should be whether to have a facilitator, how to select one (or several), and a mechanism for payment if necessary. 8 See, e.g., R.01-10-001 Workshop Report filed October 28, 2003. 5 SCE believes that a schedule can be developed that applies the lessons learned from the three most recent G.O. 95 proceedings in support of the goal to complete this rulemaking in a timely manner. SCE suggests further that a prehearing conference be convened prior to the scheduled January workshop to discuss this proposed schedule for this proceeding and any others submitted by the parties in Opening Comments. Therefore, SCE will not address the merits of each of the categories here. Instead, SCE focuses, in these comments, on certain concerns it has with the scope of these categories as currently drafted so that consideration can be made to making changes before the Final Scoping Memo is issued. 1) It should be made clear in the first category – “Immediate Reporting of Fire Related Incidents and Full Cooperation with Commission Staff” – that any proposed rule changes cannot 9 OIR (R.08-11-005), at pp. 11-14. 7 affect the scope of the attorney-client privilege and attorney work product doctrine with respect to any matter, both of which are based in statute and have long been upheld by the courts in California. Also with respect to this category, it should be noted that the requirement to report all fire incidents existed in prior years but was abandoned in favor of the current system,10 which puts priority on the amount of loss and the notoriety of the incident. Any proposed changes to reporting requirements should reexamine the reasons for having abandoned the approach used in the past that all incidents, no matter how insignificant, must be reported. 2) When examining the need to – “Apply GO 165 or Similar Maintenance and Inspection Requirements to All Communication Infrastructure Providers and Electric Transmission Facilities” - care should be paid to the current relationship between the electric utilities, the California Independent System Operator (CAISO), the Western Electricity Coordinating Council (WECC), and the North American Electric Reliability Corporation (NERC), especially existing obligations, and the distinction between distribution and transmission facilities. Specifically, SCE recommends removing electric transmission facilities from the scope of this proceeding due to oversight by other entities, including CAISO. 3) On the subject of “pole overloading,” SCE notes that two key General Order 95 rules were revised as a result of R.01-10-001 and D.05-01-030. These revisions were intended to define the requisite safety factors for new and existing poles used exclusively by electric supply and telecommunication companies, and for those new and existing poles used jointly by electric supply and/or telecommunication companies. The parties should take these newly revised rules into consideration when deciding whether additional PRCs are necessary. 4) With regards to the “prompt reporting and resolution of violations discovered by pole tenants,” SCE believes this issue, as described in the preliminary scoping memo, requires clarification. The term “pole tenants” is apparently intended to apply universally to all electric 10 Contrast D.98-07-097, Appendix B, with D.06-04-055, Appendix B (April 27, 2006). 8 utilities, municipalities, and Communication Infrastructure Providers. This is problematic because “tenancy” is typically understood to address the legal or contractual relationship between a property owner and a renter or licensee. Although SCE is willing to discuss circumstances that might qualify as “hazardous conditions,” and the instances where one utility pole occupant might notify another utility pole occupant that a hazardous condition exists, SCE has serious concerns regarding the development and application of new rules that would require utility pole occupants to identify and notify other utility pole occupants of any GO 95 rule violation – even those that do not arise to the level of a “hazardous condition.” Any discussions on these topics must also include an examination of the downstream legal and financial impacts of requiring electric utilities, municipalities, and Communication Infrastructure Providers to assume certain interpretive duties and enforcement responsibilities that are currently under the purview of the Commission’s Consumer Protection and Safety Division (CPSD) and its Utility Safety and Reliability Branch. 5) In consideration of “vegetation management in high risk fire areas,” SCE notes that electric supply utilities are currently allowed to independently establish and manage their own vegetation management programs. SCE is generally satisfied with the current rules and requirements that govern tree trimming and brush clearing in proximity to electric utility lines, however, we are willing to engage in discussions on this topic. Considering the time constraints, we are concerned that the Commission is signaling a move away from performance standards and, instead, contemplating the development of prescriptive standards for electric utility vegetation management programs while simultaneously indicating a need to increase existing tree-to-line clearances. SCE believes that any examination of the existing rules and regulations concerning tree trimming and brush clearing should be very thorough and well documented. The parties must also consider the current legal boundaries that often prohibit timely pruning and brushing activities, and the pruning or removal of trees located on private and publicly held lands where utilities often meet local resistance to tree trimming projects. 9 6) “Mitigating high speed wind dangers.” Under windy conditions, properly constructed and maintained overhead lines (conductors and structures) will typically react in a predictable manner (i.e. the lines will sway or move in the same direction at the same time). Without question there are occasions when erratic or unusual winds apply uneven pressure to overhead lines and as a result conductors may flashover (sometimes due to contact) or the supporting structure may fail. SCE believes that if the Commission is seriously intending to consider and/or enact “measures to mitigate the risk of wild fire ignition in high wind areas,” a dispassionate, methodical approach must be used, and a comprehensive examination of existing GO 95 rules pertaining to the construction of overhead electric utility lines must occur. SCE notes that the GO 95/128 Rules Committee has previously addressed highly technical and sensitive matters related to past GO 95 proposed rule changes,11 and that body might again be of service to the Commission. B. The Scoping Memo Should Make Clear That Safe And Reliable Service At Reasonable Cost Remains The Priority, And A Cost Recovery Option Must Be Provided For Each Adopted Rule Change SCE respectfully suggests that as the Commission and other parties consider proposals in this proceeding, the utilities’ ability to continue to provide reliable electric service that is reasonably priced must remain a critical consideration, consistent with the Commission’s statutory mandates. Since the Commission has regulated the construction and maintenance of utility lines within the State for many decades, a substantial body of administrative regulations and decisional law exists governing those activities. However, a touchstone for the balancing of important public interests in this rulemaking may well be § 451 of the Public Utilities Code: 11 See Decision D.0702030 at pp. 9-10, Petition P.07-07-020, and D.08-10-017. 10 All charges demanded or received by any public utility, or by any two or more public utilities, for any product or commodity furnished or to be furnished or any service rendered or to be rendered shall be just and reasonable. Every unjust or unreasonable charge demanded or received for such product or commodity or service is unlawful. Every public utility shall furnish and maintain such adequate, efficient, just and reasonable service, instrumentalities, equipment , and facilities, including telephone facilities, as defined in Section 54.1 of the Civil Code, as are necessary to promote the safety, health, comfort, and convenience of its patrons, employees and the public. Moreover, to the extent that rule changes, policies, and guidelines are adopted in this rulemaking, such changes must be phased in so that the utilities are able to recover the increased costs that will arise from such changes in their respective General Rate Cases or other ratemaking applications. Moreover, to the extent any rule changes result in additional requirements during times of declared disasters, the Commission should approve a broadened application of the CEMA cost-recovery mechanism. To that end, the final scoping memo in this proceeding should specify that changes resulting in cost increases to utilities will be recoverable in rates. In addition, the Commission should consider and provide clear guidance regarding the fair allocation of cost responsibility among utilities in situations where two or more utilities share facilities (such as joint poles) which, under determinations made in this rulemaking, may be subject to redesign, reconstruction, relocation, or modified maintenance. 11 III.
