PEWSEY NEIGHBOURHOOD DEVELOPMENT PLAN
DECISION STATEMENT (PROCEEDING TO REFERENDUM)
1.
INTRODUCTION
1.1
Pursuant to the Wiltshire Council constitution and in particular Part 3B, the Associate
Director for Economic Development and Planning within whose remit Spatial
Planning falls is authorised to make decisions on Neighbourhood Plan proposals
following the examination of a Neighbourhood Plan proposal in accordance with the
Town and Country Planning Act 1990 (as amended) and the Neighbourhood
Planning (General) Regulations 2012 (as amended) and all other relevant legislation.
2.
BACKGROUND
2.1
The Pewsey Neighbourhood Plan Area, situated in the east of Wiltshire, comprises
the whole of the parish of Pewsey. On 28 May 2013, Wiltshire Council formally
approved that the Pewsey Neighbourhood Area be designated in accordance with
the Neighbourhood Planning (General) Regulations 2012.
2.2
Pewsey Parish Council, the qualifying body, submitted the draft Pewsey
Neighbourhood Development Plan, and supporting documents, to Wiltshire Council
in October 2014 for consultation, independent examination and the remaining stages
of the draft Plan’s preparation in accordance with the Neighbourhood Planning
(General) Regulations 2012.
2.3
Following submission of the draft Pewsey Neighbourhood Development Plan,
Wiltshire Council publicised the Plan and supporting documents and invited
representations during the consultation period 3 November to 17 December 2014.
2.4
In March 2015, Wiltshire Council appointed an independent examiner, Ms Ann
Skippers BSc (Hons) Dip Mgmt (Open) PGC (TLHE) (Open) MRTPI FHEA FRSA
AoU, to review the Plan and consider whether it should proceed to referendum.
2.5
The examiner’s report was received on 17 April 2015 and concluded that subject to
making the modifications recommended in the report, that the draft Plan meets the
Basic Conditions and should proceed to referendum. The examiner also
recommended that the area for the referendum should not extend beyond the
Neighbourhood Area to which the plan relates.
2.6
In accordance with legislation, Wiltshire Council must consider each of the
recommendations made in the examiner’s report, decide what action to take in
response to each recommendation and what modifications should be made to the
draft Plan in order to be satisfied that it meets the Basic Conditions and is compatible
with Convention Rights. If the authority is satisfied then a referendum must be held.
Consideration also needs to be given as to whether to extend the area to which the
referendum is to take place.
3.
DECISION AND REASONS
3.1
Having considered the examiner’s recommendations and reasons for them, the
Council concurs with the examiner’s view and have decided to make modifications to
the draft Pewsey Neighbourhood Development Plan to ensure that it meets legal
requirements including the Basic Conditions as set out in legislation. Appendix 1 sets
out the modifications to be made in response to the examiner’s recommendations,
together with the reasons for them.
3.2
The Council is satisfied that the Neighbourhood Development Plan as modified
complies with the legal requirements and can proceed to referendum.
3.3
The Council also agree with the examiner that there is no reason to extend the
Neighbourhood Plan Area for the purpose of holding the referendum.
3.4
I declare that I have no private interest in respect of this matter that would prevent us
from making this decision.

In terms of the overall thrust of the WCS and saved
policies of the Kennet Local Plan, the NDP reflects the
same general approach; a desire to achieve sustainable
development by permitting growth on carefully selected
urban and suburban sites within the village boundary
(Policy HC21, HC21, HC26, ED8, ED12 WCS policies
CP1, CP2, CP34, CP35 and CP39), ensuring adequate
infrastructure (HC42 and HC43, AT10 WCS policies CP3
and CP61), providing housing and sufficient affordable
housing (e.g. proposals map insert 7 and HC28 WCS
policies CP2 and CP43), reinforcing Pewsey’s role as a

NR6, NR7, NR8). Kennet Transport policy is taken forward

Previously the Regional Spatial Strategy (RSS)
Development Strategy, along with RPG10 and the
Structure Plan, provided strategic planning guidance to the
whole of the South West; but RPG10 and the Structure
Plan were abolished by the Localism Act 2011 and
Paragraph 216 of the National Planning Policy Framework
(NPPF) provides guidance for emerging plans.

The saved policies of the Kennet District Council’s (KDC)
Local Plan remain extant until either deleted, or incorporated
replaced by those of into the WCS Wiltshire Council’s Core

published and adopted as planning guidance by Kennet
District Council KDC. The saved policies of the KDC Kennet

NPPF therefore make up the formal planning context for the
NDP and have been used as a reference in the preparation of
this plan.

Assessment will be published later in 2014. A
Neighbourhood Area Designation Application dated 29th
Jan 2013 was approved by Wiltshire Council following the
statutory period of consultation, establishing the area of
Pewsey Parish as the plan area for the NDP (Appendix 5:
Map 1). An NDP Scoping Report for Pewsey was
published in July 2013 and a Sustainability Appraisal
incorporating a Strategic Environmental Assessment, was
will be published later in 2014.

The longstanding policy of Pewsey Parish Council has
been to contain development within the Pewsey village
settlement boundary limits, defined as the Limits of
Development (LoD) as set out in the KDC Local Plan and
