individual, I represent that I am authorized to accept this Pass on his or
her behalf and that I am authorized to accept and agree to this Agreement
on his or her behalf. If I have any questions regarding this Agreement,

injury, death, or damage results from the inherent risks of the winter sport
or from the participant’s own negligence. The inherent risks of a winter
sport include, among others, risks associated with the land, equipment,
other participants, and animals, as well as the potential for you or another
participant to act in a negligent manner that may contribute to the injury,
death, or damage. You are assuming the inherent risks of participating in a

INDEMNITY AGREEMENT
In consideration of the use of Wintergreen’s facilities, on behalf of
myself, as well as any minor child or other individual on whose behalf that
I am accepting a Slope Access Pass, I agree to indemnify, hold harmless
and defend Wintergreen Resort, its parents, subsidiaries, officers, directors,

to minors and/or other individuals for whom I am accepting a Pass. I do
so regardless of whether Wintergreen Resort is negligent.
I agree that any dispute that relates or pertains to this Agreement,
participation in wintersports activities at Wintergreen and/or the use
of the facilities at Wintergreen, shall be submitted to mediation prior to
filing a lawsuit. Only after mediation has been conducted may a lawsuit
then be filed. Any such lawsuit shall be filed in the U.S. District Court for
the Western District of Virginia (Charlottesville) or the Circuit Court of
Nelson County, Virginia.
THE RESPONSIBILITY CODE
I understand that there are elements of risk in snowsports activities that
common sense and personal awareness can help reduce. I will observe
the code and share with others the responsibility for my snowsports
experience. I will see that the persons for whom I am accepting a pass
do the same.
Be safety conscious! Violation of the code can lead to loss of privileges
without warning and without refund. I understand that I can be held
legally liable for my actions. To enjoy snowsports, I must also know and
be willing to accept the limits of my ability. The same applies to those for
whom I buy a lift ticket or pass. If neither I nor the participant agrees with
this, then we will not participate in snowsports activities at Wintergreen
Resort.
