SECTION 5. PROCEDURES FOR INTERCONNECTION REQUESTS SUBMITTED

PRIOR TO EFFECTIVE DATE OF GENERATOR INTERCONNECTION

PROCEDURES.

5.1 Queue Position For Pending Requests.

5.1.1

Any Interconnection Customer assigned a Queue Position prior to the effective date of the GIP shall retain that Queue Position subject to meeting the requirements below. Any Interconnection Customer that fails to meet these requirements shall have its Interconnection Request deemed withdrawn pursuant to Section 3.6. Further, any Interconnection Request involved in restudies that begin after the transition period defined in section 5.1.2 shall completely conform to these Generator Interconnection

Procedures.

5.1.1.1

All Interconnection Requests for which Generator Interconnection

Agreement negotiation are started as of the effective date of

Section 5.1, will be required to conform to the revised Generator

Interconnection Procedures and shall conform with all data required in Article 11.3 of this GIP. All Interconnection Requests for which Interconnection Facilities Study deposits have been received, including those in Generator Interconnection Agreement negotiation, will not be required to conform to the revised

Generator Interconnection Procedures as of the effective date of

Section 5.1, with the exception of the revised requirements identified in Appendix 6 to this Attachment X. Interconnection

Requests meeting these criteria may suspend performance under the Generator Interconnection Agreement for any reason for a period ending six months after the effective date of this Section

5.1, after which all terms of Article 5.16 of the Generator

Interconnection Agreement shall apply.

5.1.1.2 All Interconnection Requests for which Interconnection Facilities

Studies have been started or are in the System Planning and

Analysis Review of the Definitive Planning Phase System Impact

Study, will be required to conform to the revised Generator

Interconnection Procedures. Within ninety (90) Calendar Days as of the effective date of Section 5.1. Interconnection Customers subject to the revised Generator Interconnection Procedures shall conform with all data required in Section 3.3.1 and either the data and milestone requirements in Section 8 or Section 7 by providing

Appendix 2 of this GIP. All Interconnection Requests that have not yet executed Interconnection System Impact Study agreements will be required to conform to the revised Generator Interconnection

Procedures. Within sixty (60) Calendar Days as of the effective

date of Section 5.1. Interconnection Customers subject to the revised Generator Interconnection Procedures shall revise the previously submitted Interconnection Request to conform with all deposits and data required in Section 3.3.1 of this GIP.

5.1.1.3

All Interconnection Requests that are in the System Planning and

Analysis Phase will be required to conform to the revised

Generator Interconnection Procedures within ninety (90) Calendar

Days of the effective date of Section 5.1. Interconnection

Customers subject to the revised Generator Interconnection

Procedures shall conform with all deposits and data required in

Section 3.3.1 and either Section 7 by providing Appendix 2 or

Section 8 by providing the data and milestone requirements of this

GIP. All Interconnection Requests that have an executed

Interconnection System Impact Study agreement and where constraints have been identified through the stability and first contingency analysis work in the Interconnection System Impact

Study, but have not yet completed the identification of transmission to mitigate those constraints as of the effective date of this Section 5.1 will be required to conform to the revised

Generator Interconnection Procedures within sixty (60) Calendar

Days of the effective date of Section 5.1, including the execution of an Interconnection Feasibility Study under the revised Generator

Interconnection Procedures. This application of the GIP requires updating the previously submitted Interconnection Request to conform with all deposits and data required in Section 3.3.1of this

GIP.

5.1.1.4

All other Interconnection Requests that have executed an

Interconnection Study Agreement will be required to conform to the revised Generator Interconnection Procedures within ninety

(90) Calendar Days of the effective date of Section 5.1.

Interconnection Customers subject to the revised Generator

Interconnection Procedures shall conform to the requirements of

Section 3.3.1 and data and milestone requirements in Section 8 prior to commencement of the System Planning and Analysis

Review of the Definitive Planning Phase Interconnection System

Impact Study or Section 3.3.1 and Section 7 by providing

Appendix 2 prior to commencement of the System Planning and

Analysis Interconnection System Impact Study. All other

Interconnection Requests that have executed Interconnection

System Impact Study agreements will be required to conform to the requirements of Section 8.2 prior to commencement of the

Interconnection Facilities Study.

5.1.2 Transition Period .

To the extent necessary, and in accordance with Section 5.1.1 of this GIP, the Transmission Provider and Interconnection Customers with an outstanding request ( i.e

., an Interconnection Request for which a GIA has not been submitted to the Commission for approval as of the effective date of the GIP) shall transition to the GIP within a reasonable period of time not to exceed sixty ninety ( 6090 ) Calendar Days. The use of the term

"outstanding request" herein shall mean any Interconnection Request, on the effective date of the GIP: (i) that has been submitted but not yet accepted by the Transmission Provider; (ii) where the related interconnection agreement has not yet been submitted to the Commission for approval in executed or unexecuted form, (iii) where the relevant

Interconnection Study Agreement has not yet been executed, or (iv) where any of the relevant Interconnection Studies or restudies are in process but not yet completed.

5.2 New Transmission Provider.

If the Transmission Provider transfers control of its Transmission System to a successor Transmission Provider during the period when an Interconnection

Request is pending, the original Transmission Provider shall transfer to the successor Transmission Provider any amount of the deposit or payment with interest thereon that exceeds the cost that it incurred to evaluate the request for interconnection. Any difference between such net amount and the deposit or payment required by the GIP shall be paid by or refunded to the Interconnection

Customer, as appropriate. The original Transmission Provider shall coordinate with the successor Transmission Provider to complete any Interconnection Study, as appropriate, that the original Transmission Provider has begun but has not completed. If the Transmission Provider has tendered a draft GIA to the

Interconnection Customer but the Interconnection Customer has not either executed the GIA or requested the filing of an unexecuted GIA with FERC, unless otherwise provided, the Interconnection Customer must complete negotiations with the successor Transmission Provider.

SECTION 6. PRE-QUEUE PHASE AND INTERCONNECTION FEASIBILITY STUDY.

6.1 Pre-Queue Customer Education

The Transmission Provider will be available for consultation with the

Interconnection Customer to discuss potential Interconnection Requests. Such discussions may include, but are not limited to: (i) general facility loadings;

(ii) general instability issues; (iii) general short circuit issues; (iv) general voltage
