ATTACHMENT OF WAGES LIMITATION ACT.
Act No. 28, 1957.
An Act to make provision with respect to the
attachment of wages and salaries of employees
of certain employing authorities and of
certain employees of the Crown; to limit the
amount of wage or salary that may be
attached in garnishee proceedings; for these
and other purposes to amend the Common
Law Procedure Act, 1899, the Public Service
Act, 1902, and certain other Acts; and for
purposes connected therewith. [Assented to,
4th May, 1957.]

E it enacted b y the Queen's Most Excellent Majesty,
b y a n d with t h e advice a n d consent of t h e Legis­
lative Council a n d Legislative Assembly of New South
Wales in P a r l i a m e n t assembled, and b y the a u t h o r i t y of
the same, as follows :—
1. (1) T h i s A c t m a y be cited as the " A t t a c h m e n t of
W a g e s L i m i t a t i o n Act, 1 9 5 7 " .
(2) T h i s Act shall commence upon a d a y to be
a p p o i n t e d by the Governor a n d notified by p r o c l a m a t i o n
published in the Gazette.
2. (1) T h e Common L a w P r o c e d u r e Act, 1899, as
a m e n d e d b y subsequent Acts, is a m e n d e d by o m i t t i n g
subsection t h r e e of section one h u n d r e d a n d eighty-one
a n d by i n s e r t i n g in lieu thereof the following subsec­
tion :—
(3) No o r d e r for the a t t a c h m e n t of w a g e s or
s a l a r y of a n y s e r v a n t or employee shall be m a d e in
a n y case w h e r e such w a g e or s a l a r y does not exceed
the
the p r e s c r i b e d r a t e p e r week; a n d w h e r e such wage
or s a l a r y is a t a g r e a t e r r a t e t h a n the p r e s c r i b e d
r a t e p e r week a n o r d e r shall be m a d e only for the
a t t a c h m e n t of a m o u n t s of the w a g e or s a l a r y in
excess of the p r e s c r i b e d r a t e p e r week.
I n this subsection—
" p r e s c r i b e d r a t e " m e a n s a n a m o u n t equal to
four p o u n d s less t h a n the S y d n e y basic
wage.
" S y d n e y basic w a g e " m e a n s —
(a) where the o r d e r is m a d e for the
a t t a c h m e n t of wages or s a l a r y of a
s e r v a n t or a n employee who is a male
p e r s o n , the basic wage for adult
males assessed a n d calculated in
accordance with the provisions of
p a r a g r a p h (a) of subsection two of
section 6 1 K of the I n d u s t r i a l A r b i t r a ­
tion Act, 1940, a s amended by sub­
sequent Acts, a n d as l a s t a d j u s t e d in
accordance with the provisions of
section G 1 M of t h a t Act, as so
amended, before the o r d e r is m a d e ;
(b) w h e r e the o r d e r is m a d e for the
a t t a c h m e n t of w a g e s or s a l a r y of a
s e r v a n t or a n employee who is a
female p e r s o n , the basic wage for
a d u l t females assessed a n d calculated
in accordance w i t h t h e provisions of
p a r a g r a p h (b) of t h e said subsec­
t i o n two a n d a s l a s t adjusted in
accordance w i t h the provisions of the
said section 6 1 M before the o r d e r is
made.
(2) T h e Common L a w P r o c e d u r e Act, 1899, as
a m e n d e d b y subsequent A c t s a n d b y this Act, m a y be
cited a s the Common L a w P r o c e d u r e Acts, 1899-1957.

3. (1) T h e D i s t r i c t C o u r t s Act, 1912, as a m e n d e d by
subsequent Acts, is a m e n d e d by o m i t t i n g subsection two
of section one h u n d r e d a n d seventeen a n d by i n s e r t i n g
in lieu thereof the following subsection:—
(2) No o r d e r for the a t t a c h m e n t of wages or
s a l a r y of a n y s e r v a n t or employee shall be m a d e in
a n y case w h e r e such wage or s a l a r y does not exceed
the p r e s c r i b e d r a t e p e r week; a n d w h e r e such wage
or s a l a r y is a t a g r e a t e r r a t e t h a n the p r e s c r i b e d r a t e
p e r week an o r d e r shall be m a d e only for the a t t a c h ­
m e n t of a m o u n t s of the wage or s a l a r y in excess of
the p r e s c r i b e d r a t e p e r week.
I n this subsection—
" p r e s c r i b e d r a t e " m e a n s an a m o u n t equal to
four p o u n d s less t h a n the S y d n e y basic
wage.
" S y d n e y basic w a g e " m e a n s —
(a) w h e r e the o r d e r is m a d e for the
a t t a c h m e n t of w a g e s or s a l a r y of a
s e r v a n t or a n employee who is a male
p e r s o n , the basic w a g e for a d u l t
males assessed a n d calculated in
accordance with the p r o v i s i o n s of
p a r a g r a p h (a) of subsection two of
section 6 1 K of the I n d u s t r i a l A r b i t r a ­
tion Act, 1940, as a m e n d e d b y sub­
sequent A c t s , a n d a s l a s t a d j u s t e d in
accordance with the provisions of sec­
tion 6 1 M of t h a t Act, as so amended,
before the o r d e r is m a d e ;
(b) w h e r e the o r d e r is m a d e for the
a t t a c h m e n t of w a g e s or s a l a r y of a
s e r v a n t or a n employee who is a
female p e r s o n , the basic wage for
a d u l t females assessed a n d calculated
in accordance with the p r o v i s i o n s of
p a r a g r a p h (b) of the said subsection
two a n d a s l a s t adjusted in accord­
ance w i t h t h e p r o v i s i o n s of the said
section 6 1 M before the o r d e r is made.
(2) T h e D i s t r i c t C o u r t s Act, 1912, as a m e n d e d by
subsequent A c t s a n d by this Act, m a y be cited as the
D i s t r i c t C o u r t s Act, 1912-1957.

4. (1) T h e Small Debts Recovery Act, 1912, as
a m e n d e d by subsequent Acts, is a m e n d e d by omitting
subsection five of section fifty-six a n d b y i n s e r t i n g in
lieu thereof the following subsection:—
(5) No o r d e r for the a t t a c h m e n t of w a g e s or
s a l a r y of a n y s e r v a n t or employee shall be m a d e in
a n y case w h e r e such wage or s a l a r y does not exceed
t h e p r e s c r i b e d r a t e p e r week; a n d w h e r e such wage
or s a l a r y is a t a g r e a t e r r a t e t h a n t h e prescribed
r a t e p e r week a n o r d e r shall be m a d e only for the
a t t a c h m e n t of a m o u n t s of the wage o r s a l a r y in
excess of t h e p r e s c r i b e d r a t e p e r week.
I n this subsection—
" p r e s c r i b e d r a t e " m e a n s a n a m o u n t equal to
f o u r p o u n d s less t h a n the S y d n e y basic
wage.
" S y d n e y basic w a g e " m e a n s —

a t t a c h m e n t of w a g e s or s a l a r y of a
s e r v a n t or a n employee who is a
female p e r s o n , t h e basic w a g e for
a d u l t females assessed a n d calculated
i n accordance w i t h t h e provisions of
p a r a g r a p h (b) of t h e said subsection
two a n d a s l a s t adjusted in accord­
ance w i t h t h e p r o v i s i o n s of t h e said
section 6 1 M before the o r d e r is made.
(2) T h e Small D e b t s R e c o v e r y Act, 1912, a s
a m e n d e d b y subsequent A c t s a n d b y t h i s Act, m a y be
cited as the Small Debts R e c o v e r y Act, 1912-1957.

5. T h e P u b l i c Service Act, 1902, as a m e n d e d
subsequent A c t s , is amended—
by
(a) by o m i t t i n g from subsection t h r e e of section 56A
the w o r d s " a n d shall p a y those sums to the
judgment creditor:
P r o v i d e d t h a t in no case shall a deduction
be m a d e which will reduce t h e a m o u n t to be
received by the officer or employee to less t h a n
four p o u n d s p e r week, or to less t h a n one-third
of the a m o u n t which would, b u t for the provi­
sions of t h i s section, be p a y a b l e to the officer or
employee, whichever is the g r e a t e r " a n d by
i n s e r t i n g in lieu thereof the following w o r d s : —
a n d shall a p p l y those sums in t h e m a n n e r h e r e ­
inafter in this section p r o v i d e d :
P r o v i d e d t h a t in no case shall a deduction
be m a d e which will reduce t h e a m o u n t to be
received b y the officer or employee to less t h a n
a sum p e r week equivalent to t h e a m o u n t ascer­
t a i n e d in accordance with subsection (3A) of
t h i s section.
( b ) b y i n s e r t i n g n e x t after the same subsection the
following new subsection:—
(3A) T h e a m o u n t which, p u r s u a n t to the
proviso to subsection t h r e e of this section, is to
be a s c e r t a i n e d in accordance w i t h this subsec­
t i o n shall—
(a) in t h e a p p l i c a t i o n of t h a t p r o v i s o to a
male officer or employee, be a s c e r t a i n e d
b y d e d u c t i n g four p o u n d s f r o m the
basic wage for a d u l t m a l e s assessed a n d
calculated in accordance w i t h the p r o ­
visions of p a r a g r a p h ( a ) of subsection
two of section 6 1 K of t h e I n d u s t r i a l
A r b i t r a t i o n Act, 1940, a s a m e n d e d b y
subsequent A c t s , a n d as l a s t a d j u s t e d
in accordance w i t h the p r o v i s i o n s of
section 6 1 M of t h a t Act, a s so amended,
before the deduction u n d e r subsection
t h r e e of this section is m a d e ;
(b)
(b) in t h e application of t h a t p r o v i s o to a
female officer or employee, be ascer­
tained b y deducting four p o u n d s from
the basic w a g e for a d u l t females
assessed a n d calculated in accordance
w i t h t h e p r o v i s i o n s of p a r a g r a p h (b)
of the said subsection two, a n d a s l a s t
adjusted in accordance with the provi­
sions of the said section 6 1 M before the
deduction u n d e r subsection t h r e e of this
section is m a d e .
(o) b y o m i t t i n g from subsection five of the same
section the w o r d s " A p a y m e n t m a d e to a j u d g ­
m e n t creditor in p u r s u a n c e of t h i s s e c t i o n " a n d
b y i n s e r t i n g in lieu thereof the w o r d s " A n y
deductions m a d e u n d e r the provisions of sub­
section t h r e e of t h i s section from moneys clue
t o a n officer or e m p l o y e e " ;
(d) b y i n s e r t i n g in subsection six of t h e same sec­
tion after the w o r d " s a t i s f i e d " the w o r d s " , or
is deemed to be s a t i s f i e d , " ;
(e) b y o m i t t i n g from subsection seven of the same
section the w o r d s " I f a n y p a y m e n t m a d e in
p u r s u a n c e of this section exceeds the a m o u n t due
u n d e r t h e j u d g m e n t " a n d b y i n s e r t i n g in lieu
thereof t h e w o r d s " I f a n y deduction m a d e in
p u r s u a n c e of the p r o v i s i o n s of subsection t h r e e
of this section from moneys due to a j u d g m e n t
d e b t o r exceeds t h e a m o u n t due u n d e r the j u d g ­
m e n t a g a i n s t such j u d g m e n t d e b t o r " ;
(f) b y i n s e r t i n g a t the e n d of t h e same section the
following new subsections:—
(9) (a) Out of the sums deducted u n d e r the
provisions of subsection t h r e e of this section
t h e r e shall be r e t a i n e d by the p e r m a n e n t head,
to be p a i d by h i m to the Colonial T r e a s u r e r for
credit of the Consolidated Revenue F u n d , an
a m o u n t equal to five p e r centum (or such other
p e r c e n t a g e as the G o v e r n o r m a y , by order,
notify in the Gazette, which o r d e r the Governor
is h e r e b y a u t h o r i s e d to m a k e ) of such sums, a n d
the balance of such sums shall be p a i d to the
j u d g m e n t creditor.
(b)
(b) W h e n the p e r m a n e n t h e a d makes a
p a y m e n t to a j u d g m e n t creditor u n d e r the
provisions of this subsection, the p e r m a n e n t
h e a d shall f o r w a r d to the j u d g m e n t creditor a
s t a t e m e n t showing—
(i) t h e sums deducted u n d e r the provisions
of subsection t h r e e of this section in
respect of the j u d g m e n t from moneys
due to the officer or employee con­
cerned; and
(ii) the
amount
retained
under
the
provisions of this subsection out of
such sums by the p e r m a n e n t h e a d ; a n d
(iii) the balance of such sums p a i d u n d e r
the p r o v i s i o n s of this subsection to the
j u d g m e n t creditor.
(c) U p o n p a y m e n t being m a d e u n d e r the
provisions of this subsection to the j u d g m e n t
creditor, the j u d g m e n t c r e d i t o r shall credit the
officer or employee concerned w i t h t h e sums
r e f e r r e d to in s u b p a r a g r a p h (i) of p a r a g r a p h
(b) of this subsection, as shown in the s t a t e m e n t
f o r w a r d e d b y the p e r m a n e n t h e a d to the
j u d g m e n t creditor, a n d the j u d g m e n t in r e s p e c t
of which such p a y m e n t w a s m a d e shall for all
p u r p o s e s be deemed to be satisfied to the extent
of those sums, a s so shown.
(10) I n this section, " j u d g m e n t " includes a
j u d g m e n t a g a i n s t joint d e f e n d a n t s .
6. (1) T h e T r a n s p o r t Act, 1930, as a m e n d e d b y
subsequent Acts, is a m e n d e d —
(a) b y o m i t t i n g from subsection t h r e e of section
128A the w o r d s " a n d shall p a y those sums to
t h e j u d g m e n t c r e d i t o r " a n d by i n s e r t i n g in lieu
thereof the w o r d s " a n d shall a p p l y those sums
in t h e m a n n e r h e r e i n a f t e r in t h i s section
provided";
(b) b y o m i t t i n g f r o m the p r o v i s o to the same
subsection the w o r d s " , or to less t h a n one-third
of the a m o u n t which would, b u t for t h e
p r o v i s i o n s of this section, be p a y a b l e to the
officer, whichever is the g r e a t e r " ;
(c)
(c) by omitting p a r a g r a p h s (a) a n d (b) of
subsection four of the same section a n d by
i n s e r t i n g in lieu thereof the following p a r a ­
g r a p h s :—
(a) in the application of t h a t proviso to a
male officer, be a s c e r t a i n e d by deducting
four p o u n d s f r o m the basic wage for
adult males assessed a n d calculated in
accordance with the provisions of
paragraph
(a) of subsection two
of section 6 1 K of the I n d u s t r i a l

in accordance with the p r o v i s i o n s of

(b) in the application of t h a t p r o v i s o to a
female
officer,
be a s c e r t a i n e d
by
deducting four p o u n d s from the basic
wage for adult females assessed a n d
calculated in accordance w i t h the
provisions of p a r a g r a p h (b) of the said
subsection two, a n d as l a s t adjusted in
accordance w i t h the provisions of the
said section 6 1 M before the deduction
u n d e r subsection t h r e e of this section
is m a d e .
( d ) by o m i t t i n g from subsection six of the same
section the w o r d s " A p a y m e n t m a d e to a judg­
m e n t c r e d i t o r in p u r s u a n c e of this s e c t i o n " a n d
b y i n s e r t i n g in lieu thereof the w o r d s " A n y
deductions m a d e u n d e r the p r o v i s i o n s of sub­
section t h r e e of this section from moneys p a y ­
able to an officer or c o n t r a c t o r " ;
(e) b y i n s e r t i n g in subsection seven of the same
section after the w o r d " s a t i s f i e d " the w o r d s " ,
or is deemed to be s a t i s f i e d " ;
(f) b y omitting from subsection eight of the same
section the w o r d s " I f a n y p a y m e n t m a d e in p u r ­
suance of this section exceeds the a m o u n t due
u n d e r the j u d g m e n t " a n d b y i n s e r t i n g in lieu
thereof
thereof the w o r d s " I f a n y deduction m a d e in
p u r s u a n c e of the provisions of subsection t h r e e
of this section from moneys payable to a j u d g ­
m e n t debtor exceeds the a m o u n t due u n d e r the
j u d g m e n t a g a i n s t such j u d g m e n t d e b t o r " ;
(g) by i n s e r t i n g at the end of the same section the
following new subsections :—
(11) (a) Out of the sums deducted u n d e r the
provisions of subsection t h r e e of this section
t h e r e shall be r e t a i n e d by the Commissioner,
to be p a i d by him into the General F u n d estab­
lished by section sixty-eight of t h i s Act, a n
a m o u n t equal to five p e r centum (or such other
p e r c e n t a g e as the Governor m a y , b y o r d e r ,
notify in the Gazette, which o r d e r the G o v e r n o r
is h e r e b y a u t h o r i s e d to m a k e ) of such sums,
a n d the balance of such sums shall be p a i d to
the j u d g m e n t creditor.
(b) "When the Commissioner makes a
p a y m e n t to a j u d g m e n t creditor u n d e r the p r o ­
visions of this subsection, the Commissioner
shall f o r w a r d to the j u d g m e n t creditor a state­
m e n t showing—
(i) the sums deducted u n d e r the provisions
of subsection t h r e e of this section in
r e s p e c t of the j u d g m e n t from m o n e y s
p a y a b l e to the officer or c o n t r a c t o r
concerned; a n d
(ii) the a m o u n t r e t a i n e d u n d e r the p r o v i ­
sions of this subsection out of such sums
by the C o m m i s s i o n e r ; a n d
(iii) the balance of such sums p a i d u n d e r the
provisions of this subsection to the
j u d g m e n t creditor.
(c) U p o n p a y m e n t being m a d e u n d e r the
provisions of this subsection to the j u d g m e n t
creditor, the j u d g m e n t creditor shall credit the
officer or c o n t r a c t o r concerned with the sums
r e f e r r e d to in s u b p a r a g r a p h (i) of p a r a g r a p h
(b) of this subsection, as shown in the state­
m e n t f o r w a r d e d by the Commissioner to t h e
judgment
j u d g m e n t creditor, a n d the j u d g m e n t in respect
of which such p a y m e n t w a s m a d e shall for all
p u r p o s e s be deemed to be satisfied to the extent
of those sums, a s so shown.
(12) I n this section, " j u d g m e n t " includes a
j u d g m e n t a g a i n s t joint d e f e n d a n t s .
(2) T h e T r a n s p o r t Act, 1930, as amended by
subsequent A c t s a n d by this Act, m a y be cited a s the
T r a n s p o r t Act, 1930-1957.
7. (1) The G o v e r n m e n t R a i l w a y s Act,
amended by subsequent A c t s , is a m e n d e d —
(a) by omitting from subsection
107A the w o r d s " a n d shall p a y
j u d g m e n t c r e d i t o r " a n d by
thereof the w o r d s " a n d shall
in the m a n n e r h e r e i n a f t e r
provided";

b y i n s e r t i n g in lieu thereof the w o r d s " A n y
deductions m a d e u n d e r the provisions of sub­
section t h r e e of this section from m o n e y s
p a y a b l e to a n officer or c o n t r a c t o r " ;
(e) by i n s e r t i n g in subsection six of the same section

following new s u b s e c t i o n s : —
(10) (a) Out of the sums deducted u n d e r the
p r o v i s i o n s of subsection t h r e e of this section
t h e r e shall be r e t a i n e d by the Commissioner, to
be p a i d b y him into the F u n d established by
section 4 1 B of this Act, a n a m o u n t equal
to five p e r centum (or such o t h e r p e r c e n t a g e as
the G o v e r n o r m a y , b y o r d e r , notify in the
Gazette, which o r d e r the G o v e r n o r is h e r e b y
a u t h o r i s e d to m a k e ) of such sums, a n d the
balance of such sums shall be p a i d to the
j u d g m e n t creditor.
(b)
(b) "When t h e Commissioner m a k e s a
p a y m e n t to a j u d g m e n t c r e d i t o r u n d e r the p r o v i ­
sions of this subsection, the Commissioner shall
f o r w a r d t o the j u d g m e n t c r e d i t o r a s t a t e m e n t
showing—
(i) the sums deducted u n d e r the p r o v i s i o n s
of subsection t h r e e of this section in
r e s p e c t of the j u d g m e n t f r o m moneys
p a y a b l e to t h e officer o r c o n t r a c t o r
concerned; and
(ii) the a m o u n t r e t a i n e d u n d e r the provi­
sions of t h i s subsection out of such
sums by the C o m m i s s i o n e r ; a n d
(iii) the balance of such sums p a i d u n d e r the
p r o v i s i o n s of this subsection to the
j u d g m e n t creditor.
(c) U p o n p a y m e n t being m a d e u n d e r the
p r o v i s i o n s of this subsection to the j u d g m e n t
creditor, the j u d g m e n t creditor shall credit the
officer or c o n t r a c t o r concerned w i t h the sums
r e f e r r e d to in s u b p a r a g r a p h (i) of p a r a g r a p h
(b) of this subsection, a s shown in the s t a t e m e n t
f o r w a r d e d by the Commissioner to the j u d g m e n t
creditor, a n d the j u d g m e n t in respect of which
such p a y m e n t w a s m a d e shall for all p u r p o s e s
be deemed to be satisfied to the extent of those
sums, a s so shown.
(11) I n this section " j u d g m e n t " includes a
j u d g m e n t a g a i n s t j o i n t defendants.
(2) T h e G o v e r n m e n t R a i l w a y s Act, 1912, as
a m e n d e d by subsequent Acts a n d b y this Act, m a y be
cited a s the G o v e r n m e n t R a i l w a y s Act, 1912-1957.
8. (1) T h e Police R e g u l a t i o n Act, 1899, as amended
b y subsequent A c t s , is amended b y i n s e r t i n g n e x t after
section 12B the following new section:—
12c. (1) W h e r e j u d g m e n t h a s been given b y a n y
c o u r t a g a i n s t a n y m e m b e r of the police force or
special constable for the p a y m e n t of a n y sum of
money,
money, the p e r s o n in whose favour the j u d g m e n t is
given m a y serve on the Commissioner a copy of the
j u d g m e n t certified u n d e r the h a n d of the r e g i s t r a r
or o t h e r p r o p e r officer of the c o u r t b y which the
j u d g m e n t w a s delivered, a n d a s t a t u t o r y declaration
s t a t i n g t h a t the j u d g m e n t h a s n o t been satisfied b y
the j u d g m e n t debtor, a n d s e t t i n g out the a m o u n t
due by the j u d g m e n t debtor u n d e r the j u d g m e n t .
(2) U p o n the service u p o n h i m of a copy of
a j u d g m e n t a n d a s t a t u t o r y declaration in p u r s u a n c e
of this section the Commissioner shall, a s soon as
practicable, notify the j u d g m e n t debtor in w r i t i n g of
the service of the copy j u d g m e n t a n d s t a t u t o r y
declaration, a n d r e q u i r e him to s t a t e in w r i t i n g
within a time to be specified by the Commissioner
w h e t h e r the j u d g m e n t h a s been satisfied, and, if so,
to furnish evidence in s u p p o r t thereof, a n d if the
j u d g m e n t h a s not been satisfied, to s t a t e the a m o u n t
then due u n d e r the j u d g m e n t .
(3) If a m e m b e r of the police force or special
constable fails to p r o v e to the satisfaction of t h e
Commissioner t h a t the j u d g m e n t h a s been satisfied,
the Commissioner m a y , f r o m time to time, deduct
f r o m a n y m o n e y s due to the m e m b e r of the police
force or special constable such sums as a r e , in his
opinion, n e c e s s a r y to enable the j u d g m e n t to be
satisfied, a n d shall a p p l y those sums in the m a n n e r
h e r e i n a f t e r in this section p r o v i d e d :
P r o v i d e d t h a t in no case shall a deduction be m a d e
which will reduce the a m o u n t to be received by the
m e m b e r of the police force or special constable to
less t h a n a sum p e r week equivalent to the a m o u n t
a s c e r t a i n e d in accordance w i t h subsection f o u r of
this section.
(4) The a m o u n t which, p u r s u a n t to the p r o ­
viso to subsection t h r e e of this section, is to be
a s c e r t a i n e d in accordance with t h i s subsection
shall—
(a) in the application of t h a t p r o v i s o to a
m e m b e r of the police force or a male special
constable, be a s c e r t a i n e d by deducting four
p o u n d s from the basic wage for a d u l t m a l e s
assessed
assessed a n d calculated in accordance w i t h
the provisions of p a r a g r a p h (a) of subsec­
tion two of section 61K of t h e I n d u s t r i a l
A r b i t r a t i o n Act, 1940, a s a m e n d e d b y sub­
sequent A c t s , a n d as l a s t a d j u s t e d in
accordance w i t h the p r o v i s i o n s of section
6 1 M of t h a t Act, as so amended, before the
deduction u n d e r subsection t h r e e of this
section is m a d e ;
(b) in the application of t h a t proviso to
a female special constable, be a s c e r t a i n e d
by deducting four p o u n d s from t h e basic
wage for a d u l t females assessed a n d cal­
culated in accordance with t h e provisions of
p a r a g r a p h (b) of the said subsection two,
a n d as last adjusted in accordance w i t h the
provisions of the said section 6 1 M before
the deduction u n d e r subsection t h r e e of this
section is m a d e .
(5) W h e r e m o r e t h a n one j u d g m e n t a n d
s t a t u t o r y declaration a r e served upon the Commis­
sioner in respect of one j u d g m e n t debtor, the
j u d g m e n t s shall be dealt w i t h u n d e r this section in
t h e o r d e r in which copies of the j u d g m e n t s a r e served
u p o n the Commissioner.
(6) A n y deductions m a d e u n d e r the p r o v i ­
sions of subsection three of this section from moneys
due to a m e m b e r of the police force or special con­
stable shall, as between the m e m b e r of the police
force or special constable a n d the Commissioner, be
deemed to be a p a y m e n t by the Commissioner to the
m e m b e r of the police force or special constable.
(7) If a n y deduction m a d e in p u r s u a n c e of
the provisions of subsection t h r e e of this section
from moneys due to a j u d g m e n t d e b t o r exceeds the
a m o u n t due u n d e r the j u d g m e n t a g a i n s t such
j u d g m e n t debtor the excess shall be r e p a y a b l e by
the Commissioner to the j u d g m e n t debtor, a n d in
default of p a y m e n t m a y be recovered by the
j u d g m e n t debtor from the Commissioner in a n y court
of competent jurisdiction.
(8)
(8) A n y p e r s o n to w h o m a p a y m e n t h a s been
m a d e in p u r s u a n c e of t h i s section who fails to notify
the Commissioner i m m e d i a t e l y a j u d g m e n t debt in
r e s p e c t of which the p a y m e n t w a s m a d e is satisfied,
or is deemed to be satisfied, shall be liable to a
p e n a l t y n o t exceeding fifty p o u n d s .
(9) T h e foregoing p r o v i s i o n s of this section
shall n o t a p p l y in r e l a t i o n to a n y m e m b e r of t h e
police force or special constable whose e s t a t e h a s
been s e q u e s t r a t e d e i t h e r v o l u n t a r i l y or compulsorily
for t h e benefit of his c r e d i t o r s a n d who h a s n o t
obtained a certificate of d i s c h a r g e .
(10) T h e r e m e d y p r e s c r i b e d b y this section
shall not, a s r e g a r d s the m e m b e r of the police force
o r special constable, limit or affect a n y o t h e r r e m e d y
which m a y be open u n d e r the o r d i n a r y p r o c e s s of
t h e law, b u t a s r e g a r d s the Commissioner, such
r e m e d y shall be a n exclusive one.
(11) (a) Out of the sums deducted u n d e r the
p r o v i s i o n s of subsection t h r e e of this section t h e r e
shall be r e t a i n e d b y t h e Commissioner, to be p a i d
by h i m to t h e Colonial T r e a s u r e r for credit of t h e
Consolidated Revenue F u n d , a n a m o u n t equal to
five p e r centum (or such o t h e r p e r c e n t a g e a s t h e
G o v e r n o r m a y , by o r d e r , notify in the Gazette, which
o r d e r the G o v e r n o r is h e r e b y a u t h o r i s e d to m a k e )
of such sums, a n d the balance of such sums shall
be p a i d to the j u d g m e n t creditor.
(b) W h e n the Commissioner m a k e s a
p a y m e n t to a j u d g m e n t creditor u n d e r the provisions
of this subsection, t h e Commissioner shall f o r w a r d
to the j u d g m e n t creditor a s t a t e m e n t showing—
(i) the sums deducted u n d e r t h e provisions of
subsection t h r e e of this section in r e s p e c t
of the j u d g m e n t f r o m moneys due to the
m e m b e r of the police force or special
constable c o n c e r n e d ; a n d
(ii) t h e a m o u n t r e t a i n e d u n d e r the p r o v i s i o n s
of this subsection out of such sums b y the
Commissioner; and
(iii)
(iii) the balance of such sums p a i d u n d e r the
provisions of this subsection to the
j u d g m e n t creditor.
(c) U p o n p a y m e n t being m a d e u n d e r
the provisions of this subsection to the j u d g m e n t
creditor, the j u d g m e n t creditor shall credit the
m e m b e r of the police force or special constable
concerned with the sums r e f e r r e d to in s u b p a r a g r a p h
(i) of p a r a g r a p h (b) of this subsection, as shown
in t h e s t a t e m e n t f o r w a r d e d by the Commissioner
to the j u d g m e n t creditor, a n d the j u d g m e n t in
respect of which such p a y m e n t w a s m a d e shall for
all p u r p o s e s be deemed to be satisfied to t h e extent
of those sums, a s so shown.
(12) I n this section—
" j u d g m e n t " includes a j u d g m e n t a g a i n s t joint
defendants.
" s p e c i a l c o n s t a b l e " m e a n s a special constable
u n d e r t h e Police Offences Act, 1901, as
a m e n d e d by subsequent A c t s , employed by
the Commissioner of Police.
(2) The Police R e g u l a t i o n Act, 1899, as amended
by subsequent A c t s a n d by this Act, m a y be cited as
the Police R e g u l a t i o n Acts, 1899-1957.
9. (1) The M a i n R o a d s Act, 1924, as amended by
subsequent Acts, is a m e n d e d b y i n s e r t i n g next after
section 7A the following new section:—
7B. (1) W h e r e j u d g m e n t h a s been given b y a n y
c o u r t a g a i n s t a n y officer or employee of the Com­
missioner (in this section h e r e i n a f t e r r e f e r r e d to as
"officer") f o r the p a y m e n t of a n y sum of money, or
a g a i n s t a n y c o n t r a c t o r to the Commissioner f o r the
p a y m e n t of a n y sum of m o n e y in respect of a n y
dishonoured cheque or p r o m i s s o r y note or upon a n y
g u a r a n t e e or bond or for r e n t of a n y land or for
goods supplied or money lent or for wages due in
connection w i t h his c o n t r a c t with the Commissioner,
the p e r s o n in whose f a v o u r the j u d g m e n t h a s been
given m a y serve on the Commissioner a copy of the
judgment
j u d g m e n t certified u n d e r the h a n d of the r e g i s t r a r
or o t h e r p r o p e r officer of the c o u r t b y which the
j u d g m e n t w a s delivered or in which it w a s obtained
a n d a s t a t u t o r y declaration s t a t i n g t h a t the j u d g m e n t
h a s n o t been satisfied b y the j u d g m e n t debtor
a n d s e t t i n g out the a m o u n t due by the j u d g m e n t
d e b t o r u n d e r the j u d g m e n t .
(2) U p o n the service u p o n him of a copy of a
j u d g m e n t a n d a s t a t u t o r y declaration in p u r s u a n c e of
this section, the Commissioner shall, as soon as p r a c ­
ticable, notify the j u d g m e n t debtor in w r i t i n g of the
service of the copy j u d g m e n t a n d s t a t u t o r y declara­
tion a n d r e q u i r e him to s t a t e in w r i t i n g , within a time
to be specified b y him, w h e t h e r the j u d g m e n t h a s been
satisfied, a n d if so, to f u r n i s h evidence in s u p p o r t
thereof, a n d if the j u d g m e n t h a s n o t been satisfied,
to s t a t e the a m o u n t then due u n d e r it.
(3) If the officer or c o n t r a c t o r fails to p r o v e
to the satisfaction of the Commissioner t h a t the
j u d g m e n t h a s been satisfied, the Commissioner m a y ,
from time to time, deduct from the n e t a m o u n t of
a n y moneys p a y a b l e to the officer or c o n t r a c t o r such
s u m s a s a r e in his opinion reasonable t o w a r d s the
satisfaction of the j u d g m e n t , a n d shall a p p l y those
sums in the m a n n e r h e r e i n a f t e r in this section
provided:
P r o v i d e d t h a t in no case shall a deduction be m a d e
which will reduce the a m o u n t to be received b y a n
officer to less t h a n a sum p e r week equivalent to the
a m o u n t a s c e r t a i n e d in accordance w i t h subsection
four of this section.
(4) T h e a m o u n t which, p u r s u a n t to the proviso
to subsection t h r e e of t h i s section is to be a s c e r t a i n e d
in accordance w i t h this subsection, shall—
( a ) in the application of t h a t proviso to a male
officer, be a s c e r t a i n e d b y d e d u c t i n g f o u r
p o u n d s from the basic w a g e for a d u l t m a l e s
assessed a n d calculated in accordance with
the p r o v i s i o n s of p a r a g r a p h (a) of subsec­
tion two of section 6 1 K of t h e I n d u s t r i a l
Arbitration
A r b i t r a t i o n Act, 1940, a s amended by subse­
quent A c t s , a n d as l a s t a d j u s t e d in accord­
ance with the provisions of section 6 1 M of
t h a t Act, as so amended, before the deduc­
tion u n d e r subsection t h r e e of this section
is m a d e ;
(b) i n the application of t h a t proviso to a female
officer, be a s c e r t a i n e d b y deducting four
p o u n d s f r o m t h e basic wage for adult
females assessed a n d calculated in accord­
ance w i t h the provisions of p a r a g r a p h (b)
of the said subsection two, a n d as last
adjusted in accordance w i t h the provisions
of the said section 6 1 M before the deduction
u n d e r subsection t h r e e of this section is
made.
(5) W h e r e m o r e t h a n one j u d g m e n t a n d
s t a t u t o r y declaration a r e s e r v e d u p o n the Commis­
sioner in respect of one j u d g m e n t debtor, the judg­
m e n t s shall be dealt with u n d e r this section in the
order of service thereof u p o n the Commissioner.
(6) A n y deductions m a d e u n d e r the provisions
of subsection t h r e e of this section from moneys p a y ­
able to an officer or c o n t r a c t o r shall, a s between the
Commissioner a n d t h e officer or contractor, be
deemed to be a p a y m e n t in full in money to the
extent of such p a y m e n t by the Commissioner to the
officer or contractor.
(7) A n y p e r s o n to whom a p a y m e n t h a s been
m a d e in p u r s u a n c e of this section who fails to notify
the Commissioner immediately a j u d g m e n t debt in
respect of which the p a y m e n t was made, is satisfied,
or is deemed to be satisfied, shall be guilty of an
offence u n d e r this Act a n d be liable to a p e n a l t y
n o t exceeding fifty p o u n d s .
(8) If a n y deduction m a d e in p u r s u a n c e of the
provisions of subsection t h r e e of this section from
moneys payable to a j u d g m e n t debtor exceeds the
a m o u n t due u n d e r the j u d g m e n t a g a i n s t such j u d g ­
ment debtor, the excess shall be r e p a y a b l e by the
Commissioner
Commissioner to the j u d g m e n t debtor, a n d in default
of p a y m e n t , m a y be recovered by the j u d g m e n t
debtor in a n y court of competent jurisdiction.
(9) T h e f o r e g o i n g provisions of this section
shall not a p p l y in r e l a t i o n to a n y officer or c o n t r a c t o r
whose e s t a t e h a s been s e q u e s t r a t e d either v o l u n t a r i l y
or compulsorily for the benefit of his c r e d i t o r s , a n d
who h a s n o t obtained a certificate of d i s c h a r g e .
(10) T h e r e m e d y p r e s c r i b e d by t h i s section
shall not, as r e g a r d s a n y officer or c o n t r a c t o r , limit
or affect a n y o t h e r r e m e d y which m a y be open u n d e r
t h e o r d i n a r y process of the l a w ; b u t a s r e g a r d s t h e
Commissioner such r e m e d y shall be a n exclusive
one.
(11) (a) Out of the sums deducted u n d e r the
p r o v i s i o n s of subsection t h r e e of this section t h e r e
shall be r e t a i n e d by the Commissioner to be p a i d by
him into such F u n d established u n d e r this A c t as
the Commissioner d e t e r m i n e s a n a m o u n t equal to five
p e r centum ( o r such o t h e r p e r c e n t a g e a s t h e
Governor m a y , b y o r d e r , notify in t h e Gazette, which
o r d e r t h e G o v e r n o r is h e r e b y a u t h o r i s e d to m a k e )
of such sums a n d the balance of such sums shall
be p a i d to the j u d g m e n t creditor.
(b) W h e n the Commissioner makes a
p a y m e n t to a j u d g m e n t creditor u n d e r the provisions
of t h i s subsection, the Commissioner shall f o r w a r d
to the j u d g m e n t c r e d i t o r a s t a t e m e n t showing—
(i) the sums deducted u n d e r the p r o v i s i o n s of
subsection t h r e e of this section in respect
of the j u d g m e n t from moneys p a y a b l e to the
officer or c o n t r a c t o r concerned; a n d
(ii) the a m o u n t r e t a i n e d u n d e r t h e p r o v i s i o n s of
t h i s subsection out of such sums by the
Commissioner; and
(iii) the balance of such sums p a i d u n d e r the
p r o v i s i o n s of this subsection to the
judgment creditor.
(c)
(c) U p o n p a y m e n t being m a d e u n d e r the
provisions of this subsection to the j u d g m e n t
creditor, the j u d g m e n t c r e d i t o r shall credit the officer
or c o n t r a c t o r concerned with the s u m s r e f e r r e d to
in s u b p a r a g r a p h (i) of p a r a g r a p h (b) of this sub­
section, as shown in the s t a t e m e n t f o r w a r d e d by the
Commissioner to the j u d g m e n t creditor, a n d the
j u d g m e n t in respect of which such p a y m e n t was
m a d e shall for all p u r p o s e s be deemed to be satisfied
to the extent of those sums, as so shown.
(12) I n this section, " j u d g m e n t " includes a
j u d g m e n t a g a i n s t j o i n t defendants.
(2) T h e M a i n Roads Act, 1924, as a m e n d e d by
subsequent A c t s a n d b y this Act, m a y be cited as the
Main R o a d s Act, 1924-19.57.
10. (1) W h e r e j u d g m e n t h a s been given b y a n y court
a g a i n s t a n y employee for the p a y m e n t of a n y sum of
money, or a g a i n s t a n y c o n t r a c t o r to a n employer for the
p a y m e n t of a n y s u m of m o n e y in r e s p e c t of a n y
d i s h o n o u r e d cheque or p r o m i s s o r y note or u p o n a n y
g u a r a n t e e or bond or for r e n t of a n y l a n d or for goods
supplied or money lent or for w a g e s d u e in connection
w i t h his c o n t r a c t w i t h such employer, the p e r s o n in
whose f a v o u r t h e j u d g m e n t is given m a y serve on the
employer of such employee or t h e employer with whom
t h e c o n t r a c t w a s m a d e , as the case m a y be, a copy of the
j u d g m e n t certified u n d e r the h a n d of the r e g i s t r a r or
other p r o p e r officer of the court by which the j u d g m e n t
w a s delivered o r in which it w a s obtained a n d a s t a t u t o r y
declaration s t a t i n g t h a t t h e j u d g m e n t h a s n o t been
satisfied b y the j u d g m e n t d e b t o r a n d s e t t i n g out the
a m o u n t due by t h e j u d g m e n t d e b t o r u n d e r t h e j u d g m e n t .
(2) U p o n the service u p o n h i m of a copy of a
j u d g m e n t a n d a s t a t u t o r y declaration in p u r s u a n c e of
this section, the employer shall, as soon as practicable,
notify the j u d g m e n t debtor in w r i t i n g of the service of
the copy j u d g m e n t a n d s t a t u t o r y d e c l a r a t i o n a n d r e q u i r e
h i m to state in w r i t i n g , within a time to be specified by
t h e employer, w h e t h e r the j u d g m e n t h a s been satisfied,
a n d if so, to furnish evidence in s u p p o r t thereof, a n d if
t h e j u d g m e n t h a s not been satisfied, to state the a m o u n t
then due u n d e r it.
(3)
(3) If the employee o r c o n t r a c t o r fails to p r o v e
to the satisfaction of the employer t h a t the j u d g m e n t h a s
been satisfied, the employer m a y , from time to time,
deduct f r o m the n e t a m o u n t of a n y m o n e y s p a y a b l e
to the employee or c o n t r a c t o r such sums a s a r e in his
opinion reasonable t o w a r d s the satisfaction of the j u d g ­
m e n t , a n d shall a p p l y those sums in the m a n n e r here­
i n a f t e r in this section p r o v i d e d :
P r o v i d e d t h a t in no case shall a deduction be m a d e
which will reduce the a m o u n t to be received b y a n
employee to less t h a n a sum p e r week equivalent to the
a m o u n t a s c e r t a i n e d in accordance w i t h subsection four
of this section.
(4) T h e a m o u n t which, p u r s u a n t to the p r o v i s o
to subsection t h r e e of t h i s section, is to be a s c e r t a i n e d
in accordance w i t h this subsection shall—
( a ) in the application of t h a t p r o v i s o to a male
employee, b e a s c e r t a i n e d b y d e d u c t i n g four
p o u n d s f r o m the basic w a g e for a d u l t males
assessed a n d calculated in accordance with the
provisions of p a r a g r a p h (a) of subsection two
of section 6 1 K of t h e I n d u s t r i a l A r b i t r a t i o n Act,
1940, a s a m e n d e d b y subsequent A c t s , a n d as
last a d j u s t e d in accordance w i t h the p r o v i s i o n s
of section 6 1 M of t h a t Act, as so amended, before
the deduction u n d e r subsection t h r e e of t h i s
section is m a d e ;
(b) in the application of t h a t p r o v i s o to a female
employee, be a s c e r t a i n e d b y d e d u c t i n g four
p o u n d s from the basic w a g e for a d u l t females
assessed a n d calculated in accordance w i t h the
p r o v i s i o n s of p a r a g r a p h (b) of the said sub­
section two a n d a s last a d j u s t e d in accordance
with the p r o v i s i o n s of the said section 6 1 M
before the deduction u n d e r subsection t h r e e of
this section is m a d e .
(5) W h e r e m o r e t h a n one j u d g m e n t
d e c l a r a t i o n a r e served u p o n the e m p l o y e r
one j u d g m e n t debtor, the j u d g m e n t s shall
u n d e r this section i n the o r d e r of service

of such p a y m e n t by the employer to the employee or
contractor.
(7) If a n y deduction m a d e by a n employer in pur­
suance of the provisions of subsection t h r e e of this sec­
tion from moneys p a y a b l e to a j u d g m e n t d e b t o r exceeds
the a m o u n t due u n d e r the j u d g m e n t a g a i n s t the j u d g ­
m e n t debtor, the excess shall be r e p a y a b l e b y the
employer to the j u d g m e n t d e b t o r a n d in default of p a y ­
ment, m a y be recovered by the j u d g m e n t d e b t o r from the
employer in a n y c o u r t of competent jurisdiction.
(8) A n y p e r s o n to whom a p a y m e n t h a s been
m a d e in p u r s u a n c e of this section who fails to notify the
employer i m m e d i a t e l y a j u d g m e n t debt in r e s p e c t of
which the p a y m e n t w a s m a d e is satisfied, or is deemed to
be satisfied, shall upon conviction before a s t i p e n d i a r y
m a g i s t r a t e or a n y two justices in p e t t y sessions be liable
to a p e n a l t y not exceeding fifty p o u n d s .
(9) T h e foregoing provisions of this section shall
n o t a p p l y in relation to a n y employee or c o n t r a c t o r whose
e s t a t e h a s been s e q u e s t r a t e d either v o l u n t a r i l y or compulsorily for the benefit of his c r e d i t o r s a n d who h a s n o t
obtained a certificate of discharge.
(10) T h e r e m e d y p r e s c r i b e d b y this section shall
not, as r e g a r d s a n y employee or contractor, limit or affect
a n y o t h e r r e m e d y which m a y be open u n d e r the o r d i n a r y
process of the l a w ; b u t as r e g a r d s t h e employer of such
employee, o r the employer w i t h w h o m the c o n t r a c t w a s
m a d e , a s the case m a y be, such r e m e d y shall be a n
exclusive one.
(11) (a) Out of the sums deducted u n d e r the p r o ­
visions of subsection t h r e e of this section t h e r e shall be
r e t a i n e d b y the employer, to be p a i d b y him into the
a p p r o p r i a t e account or fund kept by him for the receipt
of moneys in the n a t u r e of revenue, a n a m o u n t equal to
five p e r centum (or such o t h e r p e r c e n t a g e a s t h e
Governor m a y , b y order, notify in the Gazette, which

o r d e r the Governor is h e r e b y a u t h o r i s e d t o m a k e ) of such
sums, a n d t h e balance of such s u m s shall be p a i d to the
j u d g m e n t creditor.
(b) "When a n employer makes a p a y m e n t to
a j u d g m e n t creditor u n d e r the provisions of this subsec­
tion, t h e employer shall f o r w a r d to the j u d g m e n t creditor
a s t a t e m e n t showing—
(i) the sums deducted u n d e r the provisions of sub­
section t h r e e of this section in respect of the
j u d g m e n t f r o m m o n e y s p a y a b l e to the employee
or c o n t r a c t o r c o n c e r n e d ; a n d
(ii) the a m o u n t r e t a i n e d u n d e r the provisions of this
subsection o u t of such sums b y the e m p l o y e r ;
and
(iii) the balance of such sums p a i d u n d e r the p r o ­
visions of t h i s subsection t o t h e j u d g m e n t
creditor.
(c) U p o n p a y m e n t being m a d e u n d e r the
p r o v i s i o n s of this subsection to the j u d g m e n t creditor,
t h e j u d g m e n t c r e d i t o r shall c r e d i t the employee or con­
t r a c t o r concerned with the sums r e f e r r e d to in sub­
p a r a g r a p h (i) of p a r a g r a p h (b) of t h i s subsection, as
shown in t h e s t a t e m e n t f o r w a r d e d b y t h e employer to the
j u d g m e n t creditor, a n d the j u d g m e n t in r e s p e c t of which
such p a y m e n t w a s m a d e shall for all p u r p o s e s be deemed
to be satisfied to the extent of those sums, as so shown.
(12) I n t h i s section—
" c o n t r a c t o r " does not, w h e r e t h e n a m e of the
Commissioner
for
Motor
Transport,
the
Commissioner f o r G o v e r n m e n t T r a n s p o r t , the
Commissioner for R a i l w a y s or the Commissioner
for M a i n R o a d s is a d d e d to t h e Schedule to t h i s
section, include a c o n t r a c t o r to t h e Commissioner
whose n a m e i s so a d d e d in h i s c a p a c i t y as such
contractor.
" e m p l o y e e " m e a n s a n y officer of e i t h e r H o u s e of
P a r l i a m e n t or a n y p e r s o n employed in either of
the d e p a r t m e n t s of the L e g i s l a t u r e u n d e r the
s e p a r a t e control of the P r e s i d e n t or S p e a k e r ,
or
or u n d e r t h e i r j o i n t control a n d a n y officer or
employee in the service of the Crown, not being
a n officer or employee in the service of a n em­
ploying a u t h o r i t y , a n d a n y officer or employee
i n the service of a n employing a u t h o r i t y , not
being—
(a) an officer or employee of the Public
Service to w h o m section 56A of the
P u b l i c Service Act, 1902, as a m e n d e d
by subsequent A c t s a n d b y this Act,
a p p l i e s ; or
(b) w h e r e t h e n a m e of the Commissioner
for M o t o r T r a n s p o r t or the Commis­
sioner for G o v e r n m e n t T r a n s p o r t is
a d d e d to the Schedule to this section,
a n officer or employee to w h o m section
128A of the T r a n s p o r t Act, 1930, as
a m e n d e d b y subsequent A c t s a n d by
t h i s Act, a p p l i e s ; or
(c) w h e r e t h e n a m e of t h e Commissioner
for R a i l w a y s is a d d e d to the Schedule
to this section, a n officer to whom
section 107A of t h e G o v e r n m e n t Rail­
w a y s Act, 1912, a s amended b y
subsequent A c t s a n d b y this Act,
a p p l i e s ; or
(d) w h e r e the n a m e of the Commissioner
of Police is a d d e d to the Schedule to
this section, a m e m b e r of the police
force o r special constable to whom
section 12c of t h e Police R e g u l a t i o n
Act, 1899, a s a m e n d e d b y subsequent
Acts a n d b y this Act, a p p l i e s ; or
(e) w h e r e the n a m e of t h e Commissioner
for M a i n R o a d s is a d d e d to the
Schedule to this section, an officer or
employee t o w h o m section 7B of the
Main R o a d s Act, 1924, as amended b y
subsequent A c t s a n d b y t h i s Act,
applies.
"employer"
" e m p l o y e r " means—
(a) in respect of a n y officer of either H o u s e
of P a r l i a m e n t or a n y p e r s o n employed
in either of t h e d e p a r t m e n t s of the
L e g i s l a t u r e u n d e r the s e p a r a t e control
of the P r e s i d e n t or S p e a k e r , or u n d e r
t h e i r j o i n t control, the p e r s o n for the
time being holding the office of
Parliamentary Accountant ;
(b) in r e s p e c t of a n officer or employee in
the service of, o r a contractor to, an
employing a u t h o r i t y , t h a t employing
authority; and
(c) in respect of a n officer or employee of
the Crown, n o t being a n officer or
employee of a n employing a u t h o r i t y ,
the p e r m a n e n t h e a d of the d e p a r t m e n t
which p a y s t h e w a g e s or s a l a r y of t h a t
officer or employee.
" e m p l o y i n g a u t h o r i t y " m e a n s a n y p e r s o n or b o d y
whose n a m e a p p e a r s in the Schedule to t h i s
section or is a d d e d to t h a t Schedule in p u r s u a n c e
of this Act.
" j u d g m e n t " includes

(13) T h e G o v e r n o r m a y , by o r d e r published in
the Gazette, a m e n d the Schedule to this section by
i n s e r t i n g t h e r e i n the n a m e of a n y p e r s o n , body or
d e p a r t m e n t b y w h o m or b y which p e r s o n s a r e employed
o n behalf of the Crown, or the n a m e of a n y b o d y
constituted b y a n y Act.
(14) N o t h i n g in t h i s section shall affect—
(a) the p o w e r s r i g h t s a n d privileges of the Legisla­
tive Council or the Legislative A s s e m b l y ; or
(b) t h e p o w e r s r i g h t s a n d privileges of or p r e j u d i c e
t h e control exercised b y t h e P r e s i d e n t a n d
S p e a k e r , or either of them, over a n y officer of
either
either H o u s e of P a r l i a m e n t or a n y person
employed in either of t h e d e p a r t m e n t s of t h e
L e g i s l a t u r e u n d e r t h e s e p a r a t e control of t h e
P r e s i d e n t or S p e a k e r , or u n d e r t h e i r joint
control.
