The contractor shall abide by and observe all statutory laws and regulations in matters of Labour Law, Factory Act, Explosive Act, Workmen Compensation Act, Sales Tax, Royalty, Excise Duty, Octroi, Works Contract etc. and shall keep the Institute indemnified against all penalties and liabilities of every kind for breech of any such statute ordinance or law/regulations or By laws. The Contractor shall not employ child labour. Payment to workers must be according to Minimum wages act. COMPLAIANCE WITH OWNERS RULES & REGULATIONS The Contractor shall comply with all norms stipulated by the Owner such as Gate Passes, Checking, Maintenance of Cleanliness, Discipline & Decency at and Around the work site, Safety Precautions and Safety Regulations. ARBRITATION All disputes regarding quality, specifications and rates shall be tried to be settled mutually by making references to conditions of contract documents or prevailing local practices etc., but if not settled mutually, shall be referred to arbitration subject to Arbitration Act of 1940 and its amendments, modifications to-date. Arbitration cost to be shared equally by the owner and the contractor. AUTHORIZATION The Contractor shall submit to the Institute the names and reason and specimen signatures of the persons authorized by him to draw materials, sign joint measurements, bills, receive payments, receive instructions/notices etc. on behalf of the Contractor. SAFETY AND SECURITY Contractor shall abide by the safety code provisions as per safety code framed from time to time by the government. The Bidder should quote firm prices/ rates taking in to account of all Taxes, Duties, Levies, Personal Tax, Corporate Tax, Service Tax and all other expenditure required to be incurred by him/her for providing required services etc. during the contract period as indicated under his contract and afterwards no variation on any account unless otherwise specifically mentioned will be allowed. PRICES, TAXES, DUTIES BID VALIDITY Bid submitted by bidder shall remain valid for a period of TWO Months from the date of opening of offer. Bidder shall not be entitled during this period to revoke or vary the content of Bid or any term thereof. In such case of making any variation subsequent to submission of bid at their own, the offer shall be treated as “REJECTED” and EMD shall be forfeited without any reference to the Bidder. Page 3 of 10 IIMA/CCSP/47/2015-16 dated: 16/11/2015 R-1 revised on 26/11/2015 Post Construction Anti-termite Treatment ACCESS TO SITE The Contractor shall allow unhindered access to the Institute and/or any other party or person, engaged by the Institute to work at the same site and/or to check/ regulate / watch /guard/ measure/inspect, solely or jointly with the Contractor. REJECTION OF TENDER (S): The Owner reserves the right to reject any or all the tenders relating to the work under this Tender Document without assigning any reason whatsoever. QUANTUM OF WORK: The quantities given in the “BILL OF QUANTITIES” are approximate only and may vary in actual course of execution. The Contractor is therefore, advised to quote very carefully. No claim for compensation from the Contractor shall be entertained due to any variation in quantities (irrespective of the quantum of variation) of the various items or deletion of any item(s). The rates shall be firm during entire duration of the contract. ASSIGNMENT & SUBCONTRACTING The Contractor shall not assign, sub-contract or sub-let the whole or any part of the contract in any manner. In case of on unavoidable circumstances, the contractor shall be able to do it with approval of the owner of premises. However the job shall be sublet only to the party approved by the owner. MISCONDUCT: The Contractor shall keep the Owner indemnified from and against all personal and third party claims whatsoever arising out of any commission or omission by Contractor or his employees, or representatives as the case may be. INSPECTION AND TESTING BY THE OWNER: The Owner shall be entitled to inspect and / or test by itself or through any of its representative or an independent agency any premises of the Contractor and materials stored therein for use pursuant to the Contract and/or any ingredient to be used. If any material, item or component intended to be used for the work is found to be unsatisfactory (in which matter the decision of the Owner or his authorised representative shall be final) the Contractor shall not use such material, and shall keep the Owner indemnified from and against any claim. INTERPRETATION The Special conditions of Contract shall be read in conjunction all other documents forming of this contract. Notwithstanding the sub-divisions of the documents into these separate sections, every part of each shall be deemed to be supplementary to and complimentary of every part and shall be read with and into the contract. Page 4 of 10 IIMA/CCSP/47/2015-16 dated: 16/11/2015 R-1 revised on 26/11/2015 Post Construction Anti-termite Treatment VACATION OF PREMISES : The Contractor shall give vacant possession of the facilities/premises made available to the Contractor by IIMA and return all furniture, fixture, equipment and other items made available by IIMA in good condition after the contractual period is over or if the contract is earlier terminated. Handing over of the vacant possession of the premises and equipment etc. shall be effected within 4 days of the completion of the period of contract or termination of the contract. If the Contractor fails to do so, the Owner shall be free to take possession of the premises by opening lock(s), if necessary, and make out an inventory of all furniture material and equipment and shall be free to deduct from the Contractor’s bill(s) or security deposit, any item found to be missing at the replacement cost of the material/equipment, furniture etc. given to the Contractor by the Owner. WATER ELECTRICITY PAYMENT OF BILLS Free of Cost at one point by IIMA Free of Cost at one point by IIMA Payments will be made within 30 days of submission of bills provided the bills are complete and duly authenticated by the specified Officer(s) of the Owner. Bidder should have 07 years of experience in the termite treatment. The main business of the firm should be anti-termite treatment in pest control works. Please submit the details for the registration of the firm and proof that it is continuing in the same business. 2. The minimum average turnover of the firm from anti-termite treatment should be Rs. 20 lakhs per annum for last three years. ( ie for FY 2012-13,2013-14, 2014-15 the total work should be of Rs. 60.00 lakh from work of anti-termite treatment). Relevant work orders to be submitted for the same. 3. Bidder should submit a certificate of CA showing his turnover for last three years (201213,2013-14, 2014-15) from work of anti-termite treatment (Providing and applying). Selling of chemical will not be taken into account. IIMA may ask for Profit and Loss account of the bidders. 4. Bidder should be continuous member of IPCA (Indian Pest Control Association), PCI, PCAI or any other relevant and approved/registered pest control association for last 7 years. Please submit relevant document as the proof of the same. 5. Bidder should hold a valid license under applicable laws for undertaking pest control operations (insecticide license). 6. Bidder should have done one project of same or higher value with a prestigious client in last three years. Price bid will be opened for the bidders who are meeting the pre-qualification criteria. All bidders will be informed about the date and venue of the opening of the price bid. Submission of Bid It is a two bid process. Part A will consist of bid documents, pre-qualification details , Tender fee and EMD. All these documents to be placed in a separate envelope marked as Part A –Technical Bid and Tender Fee Part B will consist of Price bid. It is to be placed in a sealed envelope marked as “Part B Pricebid.” It should also contain EMD. Both the envelopes should be placed in a third envelope. It is to be sealed and submitted and the name of the tender and name of the party should be marked on it. The price bid of successful bidders will be opened. It will be retuned for the unsuccessful bidders. Rate is inclusive of plugging with cement mortar 1:2 to match the existing floor. It includes all electrical conduits inside building and all cable trenches on the periphery of the building. They have to be treated. If the quantity increase above the BOQ quantity it will be paid at the same rates. 4. Rates will be valid for a period of two years from date of submission of tender. IIMA reserves right to give additional work at same rates in this period of two years on mutual agreement. 5. Contractor will have to submit a 10 years guarantee bond on Rs. 100 non judicial stamp paper (as per Performa attached), for the treated areas and will attend all termite related problem in that area for the said period. 6. Approved brands of chemicals: Navigator, Durmet, Pyriban, FMC, UPL, Bayer or TATA (to be approved by the client before application – client’s decision will be final and binding). 7. Submit report of inspection every three months after the completion of work, till defect liability period is over. 8. If termites re-appear, spraying will have to be done up to a period of 3 years from the date of appearance of termite . 9. For doors and windows, both sides have to be treated, but measurement of one side will be taken for payment. 10. Treatment on furniture and door-window will be done on case-to-case basis. Areas affected or likely to be affected will be treated. 11. Contractor has to submit a daily progress report 12. Rates should be inclusive of all taxes including service tax , transportation, octroi, profit etc. 13. All works has to carried out as per the IS 6313-part three latest revision for existing buildings (post construction termite treatment). No escalation will be provided. 14.
