If you service, repair or replace an odometer and you change the odometer reading, you must file this certification with DMV within 10 days of the date the work is completed. (See "EXEMPT VEHICLES AND PENALTIES," below.) This form must be completed by the person who did the work on the odometer. It must be completed in full, signed and dated. I understand that it is a crime under ORS 162.085 to certify the truth of a statement when I know the statement is not true. Such a crime is punishable by a jail sentence of up to six months, a fine of up to $1,000, or both. SIGNATURE DATE X NAME OF BUSINESS EXEMPT VEHICLES AND PENALTIES 1) Oregon Revised Statute (ORS) 815.415 and DMV Administrative Rules state that a person commits the offense of unlawful repair of an odometer if the person services, repairs or replaces the odometer and doesn't comply with the following: a) Whenever possible, the person shall perform work on the odometer without changing the mileage reading. b) If it is not possible to perform the work without changing the mileage reading, the person must do all of the following: A) Adjust the odometer reading to zero. B) Place a permanently affixed notice on the left door frame of the vehicle that includes the following (if the vehicle does not have a door frame, we suggest that the notice be placed as near as possible to the vehicle identification number): 1) 2) 3) 4) 5) 6) Information identifying the form as an odometer repair notice. The name and address of the individual, agency or business that performed the work. The signature of the person who performed the work. The reading prior to the repair, replacement or service. The date the work was performed. Information stating the removal of the notice is a Class C misdemeanor. C) Submit an Odometer Repair or Replacement Certification, Form 6747, to DMV within 10 days of completing the work. 2) The owner or any subsequent purchaser of a vehicle may bring an action in an appropriate court of this state against any person who violates ORS 815.415, and may recover from the person an amount of $500 or twice the actual damages caused by the violation, whichever is greater, plus costs and reasonable attorney fees. Only a single recovery is permitted under this subsection for any single violation of ORS 815.415. 3) A person is not subject to the requirements for work performed on vehicles that are exempt from odometer disclosure requirements. These vehicles are: A vehicle that is not a motor vehicle. A motor vehicle that is not equipped with an odometer at the time of manufacture. A motor vehicle 10 years old or older. A new motor vehicle prior to its first retail sale. A motor vehicle with a manufacturer's gross vehicle weight rating in excess of 16,000 pounds. Snowmobiles, Class 1, Class III, and Class IV all-terrain vehicles. THE UNLAWFUL REPAIR OF AN ODOMETER IS A CLASS C MISDEMEANOR. 735-6747 (11-11)
