Backed By 2-Year Limited Warranty
LIMITED WARRANTY: When properly installed and under normal conditions of use, Hubbell
Incorporated (Delaware) (“Seller”) warrants its tradeSELECT™ and netSELECT® branded
products will conform to catalog specifications and be free from defects in materials or
workmanship for a period of two (2) years from the date of purchase by first end user.
Seller’s obligations under this warranty and the sole remedy for its breach are limited at
Seller’s sole discretion, to the value of repair of any product thereof which proves to be
defective as validated in writing by Seller; or replacement of such product. Further, Seller’s
obligations under this warranty are subject to the following conditions:
1.
All warranty claims must be made: (a) in writing, (b) within thirty (30) days of discovery
of the defect, (c) within the warranty period of two (2) years from the date of purchase
by first end user, and (d) include the dated store receipt/invoice, or other evidence
of purchase.
2.
All warranty claims should be sent to: Hubbell Incorporated (Delaware), Attn: Customer
Claims Department, 40 Waterview Drive, Shelton, CT 06484. Product may be returned
only after a Return Authorization Number has been issued by Seller’s Customer Claims
Department.
3. This warranty shall not apply to any product or the failure of any product due to accidental
damage, improper installation or maintenance, overload, misuse, abuse, installation in
an improper environment or if the product has been altered in any manner.
4.
THE SOLE LIABILITY OF SELLER SHALL UNDER THIS WARRANTY SHALL NOT
EXCEED THE SELLING PRICE OF THE PRODUCT UNDER THE WARRANTY CLAIM.
IN NO EVENT SHALL SELLER BE LIABLE FOR ANY LOSSES OR ACTUAL DAMAGES
TO ANY CLAIMANT, INCLUDING BUT NOT LIMITED TO SPECIAL, INCIDENTAL,
CONSEQUENTIAL, MULTIPLE, OR OTHER SUCH INDIRECT DAMAGES (INCLUDING,
WITHOUT LIMITATION, LOSS OF REVENUES OR PROFITS), WHETHER
ARISING OUT OF OR AS A RESULT OF BREACH OF CONTRACT, WARRANTY
(EXCEPT THOSE SET FORTH HERIN), TORT (INCLUDING NEGLIGENCE), STRICT
LIABILITY, INTELLECTUAL PROPERTY INFRINGEMENT OR OTHERWISE, EVEN
IF THE CLAIMANT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
5.
THIS WARRANTY IS THE SOLE AND EXCLUSIVE REMEDY FOR SUCH PRODUCTS,
AND IS IN LIEU OF ALL OTHER EXPRESS AND IMPLIED WARRANTIES. SELLER
SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, INCLUDING, BUT NOT
LIMITED TO, ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS
FOR A PARTICULAR PURPOSE.
