Department of Health (Departamento de Salud de Minnesota) en respuesta a la aprobación legislativa en 2003 del Acta “Woman’s Right to Know” (Derecho a la información para la mujer). La responsabilidad del padre El padre de un niño tiene la responsabilidad legal de proporcionar manutención, ayuda médica y otras necesidades de su hijo. En Minnesota, esa responsabilidad incluye pagos de manutención de hijos a la madre del niño o a su tutor legal. Los niños tienen derechos de herencia de su padre y pueden calificar, a través de él, para beneficios tales como seguro de vida, seguro social, pensión y beneficios de veteranos o de discapacidad. Además, los niños se benefician del conocimiento del historial médico de su padre y cualquier problema de salud que se pueda heredar genéticamente. En Minnesota la paternidad se puede establecer por medio de: 1. Reconocimiento de paternidad: los padres biológicos juran que son los padres del niño. Este juramento asegura los beneficios del niño. También establece los derechos de paternidad de los padres. 2. Adjudicación: se puede llevar a los tribunales una acción legal para determinar el padre biológico y legal de un menor. Este proceso, además de obtener todos los beneficios del reconocimiento de la paternidad, establece la manutención de hijos, la custodia y los derechos de visita. Una adjudicación también establece la paternidad cuando se duda de ésta. Adopción Las mujeres o parejas que se enfrenten a un embarazo inoportuno y que deciden no aceptar todas las responsabilidades de la paternidad tienen otra opción: la adopción. Planear una adopción es raramente una decisión fácil. Los servicios de terapia y apoyo son una parte fundamental de la adopción y se pueden conseguir a través de un número de agencias de adopción, tanto públicas como privadas. Si está embarazada: Directorio de servicios disponibles en Minnesota 3 Un lugar seguro para los recién nacidos La ley Safe Place for Newborns (Lugar seguro para los recién nacidos) - estatuto de Minnesota 145.902- La ley permite a una madre dejar a su recién nacido, en el plazo de setenta y dos horas del nacimiento, en cualquier hospital del estado. El recién nacido debe estar ileso y se debe entregar a un empleado del hospital dentro de las instalaciones del mismo. El hospital no puede pedir a la madre que se identifique y no puede notificar a la agencia social local acerca del recién nacido hasta que la madre haya abandonado el hospital.
