2016 SUMMER SEMINAR

(Additional fee required to attend)
The Hats ACTEC Fellows Now Wear And May Wear In The Future
Saturday, June 18
Session 1: “Cover Your Bases” — Law
Firms as Fiduciaries (Multiple Models)
8:00 am – 9:30 am
The practice of lawyers serving as fiduciaries has a long
history and is relatively commonplace today in certain
parts of the country, particularly Massachusetts. The scope
of services provided by such lawyers and their firms varies
widely, however. Some will act as trustee and rely on outside
service providers to handle many aspects of the fiduciary
function, such as bookkeeping, accounting, and investment
management. Others offer fully integrated fiduciary
services, including investment management, either through
the law firm itself, or a combination of services provided
by law firm personnel and professionals employed by a
wholly owned or affiliated registered investment adviser or
trust company. This session will explore the phenomenon
of the lawyer as trustee and the different business models
used by law firms to offer integrated fiduciary services,
from both a large and smaller firm perspective. It will
examine the advantages and disadvantages of these models,
the infrastructure needs and overhead, and the general
challenges in building an integrated fiduciary management
practice.
Session II: “Inside Baseball” — Family
Offices (Multiple Models)
9:45 am – 10:30 am
These days the phrase “family office” is pervasive in
financial institutions, law firms, investment firms, and
other companies who work with high net worth clients.
This session will unpack the definitional issues involved
when discussing family offices and their common flavors
(single family offices, multi-family offices and virtual family
offices). The presenters will answer common questions
about family offices. What services do family offices tend
to provide? What are some important issues for attorneys
to keep in mind when interacting in the world of family
offices? What are some ethical traps for the unwary?
Speakers:
Kim Kamin, Chicago, IL

— Trust Directors with Powers to Advise/
Consent/Direct and with Powers of
Protectors
Session IV: “Safe!” Why Doesn’t Everyone
Do It — A Review of the Ethical and
Practice Implications
10:45 am – 11:30 am
The panel will discuss the Model Rules of Professional
Conduct which may apply to wearing one or more of
the hats modeled by the previous speakers. Any relevant
ACTEC Commentaries, ethics opinions or case decisions
will be discussed to provide guidance.
This presentation will discuss the various roles lawyers
fulfill related to our clients’ trusts – advisor, advocate,
amender, approver, consenter, director, enforcer,
mediator, remover, tie-breaker and trustee, are among
some of the titles. Some of these functions involve the
direction of a trustee in carrying out ordinary duties in
administration of a trust, such as directing the trustee as
to trust investments or discretionary distributions from
the trust. Other functions involve decisions that would
otherwise be made by courts or that would not easily be
made by trustees due to the trustees’ fiduciary duties to
beneficiaries. It will examine the issues surrounding the
lawyer fulfilling these various functions, and the scope of
any duties and other considerations for lawyers prior to
agreeing to undertake such functions or roles.
11:30 am – 12:00 pm
Speakers:
Leiha Macauley, Boston, MA
C. Kevin McCrindle, Waterloo, IA
J. Lee E. Osborne, Roanoke, VA

The Art Forger: A Novel by B.A. Shapiro
Saturday, June 18
8:30 am – 10:00 am
Welcome by Larry Ottaway
Facilitated by Elizabeth M. (Beth) Fox
In the early morning hours of March 18, 1990, two men
dressed as police officers bound and gagged two guards at
the Isabella Stewart Gardner Museum and stole thirteen
works of art valued today over $500 million. Despite
thousands of hours of police work and a $5 million dollar
reward, the artwork has never been recovered.
Readers seeking an engaging novel about artists and art
scandals will find this a rewarding read for its skillful
balance of brisk plotting, significant emotional depth
and a multi-layered narration rich with a sense of moral
consequence.
The author B.A. Shapiro will attend this special Books
After Breakfast. She is the New York Times bestselling
author of The Muralist, The Art Forger, The Safe Room,
Blind Spot, See No Evil, Blameless, and Shattered Echoes.
She has also written four screenplays and the non-fiction
book, The Big Squeeze. The Art Forger has been on many
bestseller lists—including the New York Times, Boston
Globe, LA Times, Minneapolis Star-Tribune, Amazon, and
Kindle—and has won many awards including The 2013
New England Book Award for Fiction. She lives in Boston
and is working on her eighth novel.

In the heart of Boston and extending to Brookline, the
historic Emerald Necklace park system serves as the
backyard for city residents and a destination for more than
one million visitors each year.
Stretching from Back Bay to Dorchester, this inviting
green space connects people and nature, just as landscape
architect Frederick Law Olmsted intended when he
designed it more than 100 years ago. With its gardens,
historic bridges and scenic waterway, it’s hard to imagine
the area was once marsh and muddy flats. Surrounding the
park are some of Boston’s finest museums, institutions and
colleges.
Learn about the life and vision of Olmsted and the history
of the park, beginning at the Shattuck Emerald Necklace
Visitor Center, a former gatehouse designed by architect
H.H. Richardson, meander through the Back Bay Fens
and visit the Kelleher Rose Garden and stroll through the
oldest World War II Victory Gardens in America.
Suggested attire: Closed-toe walking shoes, comfortable
attire, hat, sunglasses, and sunscreen are recommended.
Inclusions: Transportation, guide, bottled water,
admission, an illustrated Emerald Necklace Parks map and
guide, taxes, and gratuities.
