Under Section 5 of the Patents Act 1949 each claim of a complete specification has a
priority date. This is the date of filing the complete specification except where the
complete specification was filed within 15 months of one or more applications each
accompanied by a provisional specification, when each claim has as its priority date the
date of filing of that application which provides a fair basis for the claim in its
provisional specification. Also where the complete specification was filed in pursuance
of a convention application filed during the pre ceding 12 months, the claims may take
as their priority date the date of that application.
Under section 5 of the Patents Act 1977 the priority date of an application is the date
of filing the application except where the applicant is declared to be based on one or
more earlier application filed during the preceding 12 months, in which case the priority
date is the date of relevant earlier application which discloses matter which supports the
invention.
This code has no special entry in the Official Journal (Patents). In those cases where
the applicant claims no priority but from the bibliographic data or from the classifying
examiner is possible to establish that the document belongs to a so called technical
family, those documents belonging to the technical family are consider as priorities of
the application. Should this be the case an entry with this code is used for displaying
information about this earlier applications belonging to the same technical family and
therefore suspected to constitute a priority. The command PRION must be active for
this code to appear.
