Proposal for Comprehensive Plan Land Use Designation and Zoning Designation for a 30 Acre Property
Proposed to be Annexed into the City of Moscow and Located Directly East of Mountain View Park:
LUP2016-0008
A public hearing at which you may be present and speak will be conducted by the Moscow Planning and
Zoning Commission at which time the following proposition will be discussed for land generally shown
on the vicinity map below:
• Retaining the current Comprehensive Plan Land Use Designation of Auto-Urban
Residential.
• Rezoning of the 30 acre subject property from the Agriculture Forestry (AF) Zone
to the Moderate Density, Single Family Residential (R-2) Zone.

Notification: The Idaho Code requires that all property owners located within 300 feet of the affected property
must receive notification of the public hearing that is conducted by the Planning and Zoning Commission
regarding rezone requests.
The Planning and Zoning Commission shall have the authority to require any additional information they feel is
necessary to render a fair decision and recommendation on a rezone request. The Commission may
recommend and the City Council may require additional conditions and limitations as specified in Section 4-93C of the Moscow Code.
All questions addressed on this application and the application itself must be filed with the Moscow City
Planner at least twenty-one (21) days prior to the hearing to be held before the Planning and Zoning
Commission. The applicant will be notified by the City as to the time and place of the hearing pertaining to this
application. The applicant or his/her duly-appointed representative must be present at the public hearings held
before both the Planning & Zoning Commission and the City Council.

Township 39 North, Range 5 West, Boise Meridian, Latah County, State of Idaho and more
particularly described as follows:
Beginning at a brass cap monument marking the North Quarter Corner of said Section 9, from
which a brass cap monument marking the Northeast Corner of said Section 9, bears South
89°22'17" East a distance of 2648.74 feet; thence South 89°22'17" East along the North Line of
said Section 9, a distance of 140.00 feet to a 5/8 inch rebar with a PLS 9584 cap; thence South
00°37'43" West a distance of 108.53 feet to a 5/8 inch rebar with a PLS 9584 cap; thence North
80°49'46" East a distance of 20.30 feet to a 5/8 inch rebar with a PLS 9584 cap; thence North

The presenter(s) used the preliminary site plan for the proposed development to illustrate
the project scope. The location and proposed layout of the property are to be developed
under the name Logos School.

• Approximately 35-40 feet. 2 story building with a 3rd story alternate. Will

• No, tax exempt organization. (LS)
• We (Logos School) pay development permit fees to the City of Moscow for
construction of the project. (LS)
"Is there only 1 access road to the school?"
• Service road through Rhenigans property to connect at 'D' Street. An easement is
required. (SB)
"Will the development of the property increase the flood risk to downstream residents?"
• No, a "no-rise" certificate is required. A hydraulic study will be conducted to
investigate flood hazards and implement necessary mitigation measures. (SB)
"Will the development have problems resulting from excess stormwater?"
• No, proper research and design will mitigate any problems. (SB)
"Does the existing groundwater level and soil conditions make it necessary to install
underground storage tanks for stormwater retention?"
• No, stormwater detention ponds are designed to handle this condition. (SB)
"Are wetlands present, and if so, what will happen to them?"
• If wetlands are identified by the authorities then a wetland mitigation plan will be
required. (SB)
• Site design will implement a "park-like" condition. (LS)
"Will the pedestrian bridge be private or public?"

if pet owners are not responsible and the safety of our students is jeopardized.
