COMMISSION REFERRAL ORDER
On March 21, 2003, Nancy Begeot filed a verified formal complaint against the
Harrison Rural Electrification Association, Inc. (HREA). In her complaint, Ms. Begeot
stated that she was unaware that she was to read her meter and assumed that since her
neighbors had “turtles” (an automatic meter reading system) on their meters, she did not need
to read her meter. The Complainant stated that she was attempting to arrange public
assistance to pay her bill and that her doctor has sent HREA letters stating that termination
would be dangerous to her child.
On April 1,2003, HREA filed its response to the complaint. In its response, HREA
agreed to restore electric service to Ms. Begeot if she paid $1,064.00 and kept her current
bills paid during the pendency of this matter. However, that response was not verified.
All formal complaints, answers, applications and petitions must be sworn to, or
verified. &Rules 6.2.d and 7.1 and Forms 1-11 of the Commission’sRules of Practice and
Procedure, 150 C.S.R. Series 1. Within ten (10) days of the date of this order, HREA shall
file a verification to its answer. HREA may use the form verification attached to this order.
For further processing, this case shall be referred to the Division of Administrative
Law Judges.
ORDER
IT IS THEREFORE ORDERED that within ten (10) days of the date of this order,
HREA shall file a verification to its answer.
IT IS FURTHER ORDERED that this proceeding be referred to the ALJ Division for
its decision on or before October 17,2003.
IT IS FURTHER ORDERED that if the participants desire an extension of the
foregoing decision due date, they may seek an extension only upon formal application to the
Commission.
IT IS FURTHER ORDERED that the Commission's Executive Secretary serve a copy
of this order upon all parties of record by United States First Class Mail and upon
Commission Staff by hand delivery.
