a new application will need to be submitted to Manchester City Council two months before

APPENDIX 1
Specified Offences
In deciding whether someone is a fit and proper person to carry on business as a motor
salvage operator, the local authority must have regard to whether the applicant has been
convicted of any of the following offences:

Convictions for offences under Part 1 of the Vehicles (Crime) Act 2001, namely:
a
Carrying on business as a motor salvage operator in the area of a local authority
without being registered for that area contrary to section 1 (1) of the Vehicles
(Crime) Act 2000.
b
Contravening any provision to which section 7 (Keeping of records) applies
contrary to section 7(4) of the Vehicle (Crimes) Act 2001
c
Contravening any provision to which section 8 (Notification of destruction of motor
vehicles) applies, contrary to subsection 8(3) of the Vehicle (Crimes) Act 2001.
d
Offence of making false statements, contrary to section 10(1) of the Vehicle
(Crimes) Act 2001.
e
Failing to give notice to a local authority in accordance with subsections (1), (2) or
(3) of section 11 (Notification Requirements), contrary to section 11(4) of the
Vehicle (Crimes) Act 2001
f
Offence of giving false particulars on sale for salvage, contrary to section 12 of the
Vehicle (Crimes) Act 2001
Convictions for offences of a description that have been specified by the Secretary of
State. At the date of this agreement, these are the offences specified in the Motor
Salvage Operators (Specified Offences) Order 2002, namely:
a
Theft or attempted theft of or from a motor vehicle, contrary to section 1 of the
Theft Act 1968.
b
Taking a motor vehicle without consent, contrary to section 12 of the Theft Act
1986.
c
Aggravated vehicle taking, contrary to section 12 A of the Theft Act 1968.
d
Handling stolen goods, contrary to section 22 of the Theft Act 1968.
e
Going equipped to steal or take a motor vehicle contrary to section 23 of the Theft
Act 1968.
f
Interference with a motor vehicle contrary to section 9 of the Criminal Attempts Act
1981.
g
Tampering with a motor vehicle contrary to section 25 of the Road Traffic Act
1988.

REQUEST FOR A POLICE CHECK IN RESPECT OF APPLICATION TO BE A
REGISTERED MOTOR SALVAGE OPERATOR
Notes for Applicants
You should be aware that as part of your application for registration, or renewal of your
registration, as a Motor Salvage Operator, in accordance with the Vehicle Crime Act 2001:
1) The Local Authority must satisfy itself that you are a fit and proper person to carry
on business as a motor salvage operator.
2) In doing so, the local authority must have regard to whether you have been
convicted of any relevant offence, being offences detailed in Part 1 of the Vehicle
(Crime) Act 2001 and subordinate legislation
3) Convictions or cautions that are regarded as spent under the Rehabilitation of
Offenders act 1974 need not be declared.
Please note: for the purposes of obtaining or renewing your Motor Salvage Operators
Registration, should you knowingly or recklessly make a statement which is false you will be
guilty of an offence and liable to prosecution.
