'~' \ ~~ RECOMMENDATION Reconsider the adoption of a waiver from compliance with General Plan residential density for a prospective condominium conversion at 601 Palm Drive. SUMMARY This item was continued from the regular City Council meeting on May 23, 2006 to a Joint Meeting of the City Council and Housing Authority on June 20, 2006 to provide time for the applicant to meet with Community Development and Housing to discuss affordable housing restrictions. At the previou2 Agenda: Condominium Conversion Density Waiver 2 meeting, the City Council rescinded their previous denial of a waiver request. Following discussion, the City Council directed the project applicant Mr. Kazazian to meet with the Community Development and Housing Department to discuss providing four (4) one-bedroom affordable housing units as part of this over-density condominium conversion waiver request. The Council clarified that their request was for affordable units, not first-time homebuyer restrictions. However, if current tenants qualify for purchase of an affordable housing unit they may also be first-time homebuyers. This request would allow the conversion of28 units where 6 units are permitted by the General Plan. FISCAL IMPACT No fiscal impact. BACKGROUND On December 20, 2005, the City Council identified the process for granting a waiver of general plan density on a case-by-case basis. Process for Waiver The following Density Waiver process was identified: I) Any property owner requesting a density waiver would need to make a written request to Council and submit it to the Director of Planning. Request should be accompanied by: a. Signed Owner!Applicant Affidavit form. b. Verification of property purchase date prior to June 7, 2005 or verification that the property was in escrow on June 7, 2005. c. Verification of the "intent to convert" (other than self-certification) if the property was in escrow on June 7, 2005 or verification of the "substantive steps toward conversion" (other than self-certification) if the property was already in possession of the applicant on June 7, 2005. 2) Planning staff will schedule the waiver request for Council consideration providing a statement of the ownership status as of June 7, 2005, the verification provided by the applicant, and motions to approve and to deny the requested waiver. 3) If Council grants a waiver, then the property owner may file a condominium conversion application. However, the application cannot be accepted until 60-days after tenant notification has been provided. 4) The Zoning Administrator will consider the Council density waiver in making required Subdivision Map Act findings for conversion applications. A waiver of General Plan density requirements has been requested for the proposed condominium conversion project. Attached to this report is a preliminary title report demonstrating ownership status of the property as of June 7, 2005. Also attached are the submitted documents dated prior to June 7, 2005 which address intent to subdivide such as a contract to prepare tentative and final maps. Other information submitted by the applicant dated after June 7, 2005 has not been included in the staff report, but is available in the case file. A request for waiver and supporting documentation was first considered by the Council for this project March 7, 2006. At that meeting, the project engineer spoke on behalf ofthe project. Council denied the waiver. At the following Council meeting, the property owner appeared and said that he was unaware of the meeting the previous week and requested that the Council reconsider his request. Council directed Agenda: Condominium Conversion Density Waiver 3 staff to return with this item for reconsideration on April 11, 2006. Due to illness, the applicant requested that this item be placed on a later meeting. On May 23,2006, the Council rescinded a previous action to deny the waiver. Council discussed the evidence provided by the applicant and discussed parking options. There was also much discussion concerning provisions of affordable units and first-tim~ homebuyers. Council directed the applicant to meet with the Community Development and Housing Department to discuss providing four (4) onebedroom affordable housing units in perpetuity as part of this project. The applicant questioned Council as to whether the Council desired first-time homebuyer or affordable units and the Council clarified that their desire was for affordable units. However, it would be likely that affordable units would go to firsttime homebuyers. Staff was directed to return to Council and report on the meeting with the applicant. A copy of a memorandum of the June 2,2006 meeting between Community Development and Housing Department staff and the applicant is attached as Exhibit 4. Density Waiver Request for 601 Palm Drive This apartment building began construction on April 8, 1986 and has 28 units (eight I-bdrm, fourteen 2bdrms, six 3-bdrms per the applicant) and 49 parking spaces. The project site has 20,980 square feet and is located in the R-3050 Zone. The apartment met the parking requirement at the time of construction and therefore the parking complies with conversion standards; however, a similar size apartment building built today would require 66 parking spaces. Were a new apartment or condominium to be built today on this site, the maximum density would be 6 units. The following information has been submitted in support of the request and is included in Exhibit 2. The items in bold were not included in the previous submittal to Council on March 7, 2006. • • • • • • The property owner Aram Kazasian (JKC Enterprises, Inc representing Palm Drive Holdings, Ltd.) submitted a preliminary title report demonstrating that he owned the subject property by March 1, 2002. The property owner submitted a signed 'professional contract from Techna Land Co., Inc. dated May 23,2005 (applicant signature dated May 25,2005) demonstrating intent to contract for engineering services related to creation and processing of a tentative and final map for condominium conversion purposes at 601 W Palm Drive. Invoice from J. P. Rodriguez for painting ofthe building at 601 Palm Drive dated May 5,2005. Photos of the painting are provided. Inspection report for 601 Palm Drive from Han Kook Termite Co. dated March 22, 2004. Inspection report for 601 Palm Drive from Citrus Valley Exterminators, Inc. dated AprilS, 2004. Mr. Wolfgang Krause verified that the applicant did speak with him in February 2005 to discuss conversion of this building. Phone record showing calls to the Planning Department on January 31, 2005 and February 16, 2005 are provided. This information has been provided to aid Council in considering the requested waiver. A motion to rescind the denial of a waiver of density requirements adopted March 7, 2006, and motions to adopt or deny a waiver of density requirements for the proposed conversion are included with this report for Council consideration. Broadway Glendale, CA 91206 Re: Tentative Tract No. 063488 601 Palm Drive, Glendale, Ca. 91202 Dear City Council Members: On Tuesday, March 7, 2006 the Council rejected our request for a waiver of the ordinance that would allow Palm Drive Holding to convert an existing apartment building into condominiums. We would have gladly been present at the council meeting had we been notified that our request was going to be heard that evening. At this time, we would like to thank the council for allowing us the opportunity to present our case on April 11, 2006. The requirement we were told we had to satisfy was to provide proof that we had begun the process of condo conversion prior to June 7, 2005. We provided a signed contract with Techna Land Co. dated May 25, 2005. Prior to that date, we had consulted with various members of the real estate community in order to obtain information on which company would be the best choice to retain for this project. Techna Land Co. was repeatedly mentioned as not only the best, but the busiest as well. We consulted with Techna Land Co. on May 19, 2005, came to an agreement, received the contract, signed it and returned it. One of the key items we discussed was Techna Land's time frame. They clearly indicated they were busy. As we were not in any particular rush, we agreed to pay them their retainer at the time a tentative tract map was filed and tenant notifications were sent. Had we known there was an impending 601 Palm Olive, Glendale, CA 91202 Tentative Tract Mao No. 063488 01, City ordinance, we would have required they begin the preliminary work immediately; however, there was no rush. Much to our surprise three weeks later, the Council passed the new ordinance. We attended the following council meeting to inquire about the status of buildings that had begun the process of conversion. We were informed that waivers would be issued if paperwork had been submitted to the City prior to June 7, however., it did not address the issue of those that had begun conversion but had not submitted paperwork to the City as of June 7. That was the question we had that day, and it was not answered. We were then caught in a position of uncertainty. Condo conversion is not a decision that is made overnight. We began work in 2004 to upgrade the building in order to reflect the type of community we wished to create. The upgrades included changing pebble floor coverings to decorative tile, renovating exterior balconies, installation of ceramic tile flooring in the kitchens and bathrooms with soundproofing under the tile, painting the building, fumigation of the building, and landscape work for the planters. These expenditures are quite large; therefore they have been done over the course of one and a half years. We felt it was important to ensure the building was at its best before presenting the units for sale. Once the maintenance and upgrades had begun, on February 16, 2005, we contacted Wolfgang Krause, Principle Planner with the City of Glendale to ask questions regarding density, parking and other requirements. Mr. Krause informed us that the density was not an issue, and as long as parking was provided per code during the time of construction, it would not be an issue. He also informed us that the storage lockers would have to be upgraded as they were undersized. We then proceeded with the actual proces's of conversion by contacting Techna Land in May 2005. As mentioned before, we were not in any rush as there never was a need to be in a rush. After the Council passed the ordinance on June 7, we had to make a decision whether to continue with the conversion and work with the City or to stop the conversion process. We decided to continue as substantial costs had already been incurred. Notifications to tenants were sent on July 2, 2005. We believe we were the first ones in this category to send notifications to the tenants. We have continued along the course of conversion as originally planned and have almost come to the end of the process. Approximately two months ago, I attended a City Council meeting when the Council identified the criteria needed for a waiver. I asked if a signed contract prior to June 7 would suffice and was told that it would. I indicated at that time that we did have that proof and would submit it. Based on the information I received that night, we paid the condo conversion fees to the City. On Tuesday, March 7, 2006 our case was presented with the signed contract, yet a waiver was denied for lack of other proof. The only other proof we provided was a painting contract by an outside company, as no other proof other than the contact was required. Furthermore, all other work is done in house as we are not only the owners of the building, but double as a construction com~any as well; therefore, we are responsible for all upgrades. At this time, we have provided color copies of painting done for the interior of the building, a copy of the tenant notifications, the signed contract dated May 25, 2005, fumigation bids from 2004, phone records from January 31, 2005 and February 16, 2005 detailing calls made to Mr. Krause. We hope the Council will take the time to review the attached documents. We are more than willing to provide any information we can in order to satisfy Council's concerns and obtain a waiver of the ordinance. The project involves a 28-unit apartment complex. The developer is proposing to convert the apartment units into a condominium development. However, the proposed project exceeds current General Plan densities by 22 units (6 units allowed versus the 28 proposed). The meeting with CDH staff was in response to City Council direction to the developer with respect to the possible incorporation of affordable housing units into the project as a potential way mitigating the General Plan density and related issues. Staff met with the developer and discussed a number of issues related to affordable housing. First, staff and the developer discussed the differentiation between a "First Time Home Buyer" household and an "Affordable" unit. As explained to the developer, a First Time Home Buyer household is simply defined as someone who has not owned a home in the last three years - there are no sales price restrictions associated with a First Time Home Buyer unit. An Affordable condominium unit is a unit that is reserved for sale at a purchase price that is restricted, and dependent upon the income group to which this unit is designated. Staff explained to the developer that it was their understanding that City Council's direction was to explore the issue of Affordability in his proposed project and not simply First Time Home Buyer. The developer then inquired about the First Time Home Buyer Program and he was told that this is a downpayment assistance program associated with market rate units that are being offered for sale. Households that qualify for the program seek and purchase units that they identify on the open market. The developer was told that this is a separate program and that it was not considered applicable to his proposed project. Finally, staff and the developer discussed the parameters of affordable housing and how an affordable purchase price is detennined, via affordable housing costs. Regulations limit the amount of money a household can expend for their monthly housing costs based upon their income and the number ofbedrool11s in the home they are purchasing. When qualifying bonowers for loans, most lending institutions impose a cap on the amount a household can 'expend on their monthly housing costs. Typically, many first time homebuyers in California are spending up to 40% of their income on their monthly housing costs which are comprised of: • • • • First mortgage principal and interest payments Property taxes and assessments Fire and casualty insurance Homeowner/condominium association fees An affordable housing cost limits buyers to spending between only 28% to 35% of their income toward housing expenses as opposed to the common 40%. In addition, two other expenses must also be covered within the affordable hO'using cost limits: • • Property maintenance and repairs Reasonable utility allowance (including garbage collection, sewer, water, electricity, gas and other fuels, but not telephone service) Staff provided the developer with a Sales Price Worksheet that would help calculate for him an affordable purchase price, depending upon incomes being served and bedroom count of the unit. That worksheet is attached for your information.
