Insurance Program Samsung Galaxy S7 & S7 Edge Phone Insurance ARTICLE A. General Terms and Conditions 1. 2. 3. 4. 5. 6. 7. POLICY HOLDER: ALPAN ELECTROLINE LTD (hereafter “ALPAN”). INSURED DEVICE: Insured device is considered the mobile GSM Samsung Galaxy S7 & S7 Edge that is purchased via CYTA or CYTA’s network partners in Cyprus and is imported only by "ALPAN". BENEFICIARY / INSURED: The owner / holder of the covered device who purchased it for private use and can make a claim under the terms of this insurance policy. INSURER: The Insurance Company «ALLIANZ GLOBAL ASSISTANCE INTERNATIONAL SA» which operates legally in Greece, with her branch in Greece, VAT number 098118029, D.O.Y. FAE Piraeus, based in Agios Dimitrios, Athens, Greece, str. Premetis 10, 173 42, Tel: + 357 22554912, FAX: + 357 22554913 & email: telcoclaims@allianz-assistance.gr INSURANCE POLICY: This insurance program that provides describes and establishes the individual elements of the insurance contract. FORCE AND DURATION OF THE INSURANCE POLICY: The insurance coverage of this insurance program is in force from the purchase date of the insured device, as defined on a CYTA purchase receipt and its inclusion in the group insurance policy GD1500007937 (for device Galaxy S7) or GD1500007939 (for device Galaxy S7 Edge) provided that the inclusion is accurate and timely correct, and for a period of one year (1). Termination of insurance benefits/policy: In case of a claim insurance the insurer will cover all costs required to repair or restore the insured device up to the coverage limit of one (1) claim per annual coverage period which will simultaneously terminate the insurance coverage, or 12 months after the date of purchase. GEOGRAPHICAL AREA OF COVERAGE: The insurance policy covers beneficiaries for events that took place in Cyprus. ARTICLE B. Specific Terms and Conditions INSURED RISKS AND DAMAGES Accidental Damage: The insurance cover applies in case of damage or destruction of the insured device, provided that in such cases the customer has not acted willfully and intentionally caused harm or showed inappropriate or improper handling or negligence result: 1. accidental fall caused by accidental and external cause resulting in breakage or malfunction of the insured device and therefore excluded any damage resulting from the inherent defect of the device or caused by wear and tear. 2. water or humidity ARTICLE C. General Exclusions Insurance coverage will not apply to: 1. damages not such as to prevent the Product’s normal functioning or cannot be attributed to the damage of the product; 2. damages when the purchaser has not exerted the due diligence in order to prevent or reduce the extent of the claim for which indemnity is required under this policy. Due diligence is defined as the correct fulfillment of all care, attention and attendance acts required by normal due diligence to a person who is in the same or similar circumstances to protect a product from any consequence resulting from the damage; 3. repairs outside of Cyprus; 4. any costs, where no damage can be detected on the device; 5. any damage not such as to prevent the Product’s normal functioning or not covered by the original manufacturer's warranty and cannot be attributed to a manufacturing or design error or mistake during assembly of the device; 6. any product which is or was recalled by the manufacturer or importer or distributor for declared or widespread defects; 7. any loss or damage caused by the failure of electrical or electronic components, software (including operating system or to correctly recognize and process any calendar date or time), electronic virus loss of data or information, micro-controller microchips, accessories or associated equipment, external data carriers, subsequent installations, conversions and upgrades, other input devices of all types, toner cartridges, ink cartridges, joysticks and other external controllers, accessories, external parts or additional parts of a set provided that these are not included in the original scope of delivery; 8. any damage incurred by non-observance of the operating and set-up instructions of the manufacturer or other improper installation or repair attempts; 9. any damage incurred through programming, adjustment, repair, overhaul, modification or cleaning of the device; 10. any damage which does not impair the function of the device (scratches, dents, bumps, varnishing, decorative features etc.) or is caused by friction, scratching, dent or requires the reparation of hinges or tops and does not impair the insured product’s normal usability; 11. any damage to additional separately purchased storage batteries for use on the insured device or accessories purchased subsequently; 12. any costs incurred for disposal of the damaged device; 13. any costs associated with deactivation or activation or purchase of a new sim card. Furthermore, insurance coverage is excluded if the damage: 14. is covered by another insurance contract or guarantee or liability of the manufacturer or a third party; 15. is caused by experiments, voluntary overload, testing, misuse, failure to comply with maintenance instructions, any use which is different from or contrary to that recommended by the manufacturer; 16. is caused by the use of any accessory not approved by the manufacturer; 17. is caused or consists of wear and tear, oxidation, corrosion or any form of gradual deterioration; 18. occurred or became apparent on the occasion of or due to any handling, reparation or cleaning of the insured product effected by any other person than persons authorized or approved by the manufacturer or the distributor; 19. is caused by seizure, confiscation and any destruction operation made or decided by public authorities, including customs authorities; 20. is caused by any external cause (e.g., sudden changes of voltage, loss of battery acid, leakage of any liquid from devices put over the insured product, etc.) or block of any mobile or rotating part; 21. is caused by natural disasters or force majeure, natural catastrophes, fire, lightning, explosion, storm, flooding, radiation or any event connected with mutations of the atom’s nucleus; 22. is caused by war, invasion, act of foreign enemy, hostilities (whether war be declared or not), riot, strike, civil commotion, civil war, rebellion, uprising, revolution, social unrest, insurrection or military or usurped power. 23. Claims from the statutory liability for material defects are not covered by this contract. 24. Devices in which their serial number or IMEI for mobile phones has been removed, damaged, is unreadable or defective; ARTICLE D. Restrictions § 1 Scope of services 1. In case of insurance claim, all costs necessary for the reparation or restoration of the insured device will be assumed and paid by the insurer. 2. In the case of total damage or inefficient repair the insurance coverage will be limited to the value of the insured device after depreciation in accordance with the table § 11 below. § 2 Customer’s obligations in case of damage 1. The customer must bring into a CYTA store based in Cyprus the damaged device along with the receipt or invoice of its purchase. Then CYTA will handle covers entitled under this insurance policy. 2. The policyholder must follow the instructions of the insurer and CYTA and make every effort to keep the damage to a minimum. § 3 Proof of Insurance The original receipt or invoice of the device's purchase will be considered as the one and only proof of the insurance coverage. § 4 Fraud & Fake statement Any deliberately false and/or misleading statement and/or fraudulent concealment of information by the Beneficiary, Insured, Policyholder entitles the insurer to terminate the Insurance Contract in accordance with the provisions of the Insurance Greek Law. In this case, all claims arising from this contract shall be canceled, no compensation will be paid and the Beneficiary must reimburse the Insurer any amount already compensated. The Insurer is not obliged to refund premium. § 5 Transfer Where the insured device is transferred, the protection in the present insurance policy will not be transferred to the new owner of the insured device. The contract is not transferable to another device or set of devices. § 6 Proportional coverage Where damage incurred is also covered by another insurance contract we will only be liable for the share not covered by the other insurance contract. § 7 Complaints In case of any kind of problem that arises from this insurance policy please address the CYTA’s Network partners or an authorized service center of Samsung and alternative to the insurer at the contact details set out in Section A in paragraph 4 or the competent Authority consumers. § 8 Notice regarding data processing CYTA records, processes and uses the personal data of the customer, the insured device and the market in which the insurance contract was concluded for the conclusion of the insurance contract between the customer and the Insurer as well as for the processing of this insurance contract. For this purpose, CYTA conveys this personal data of the customer to the insurer and the Samsung stores in Cyprus so that the customer can also assert his claims and rights from the insurance contract there. The Insurer processes and uses personal data of the customer exclusively for the formation and the processing of the insurance contract with the customer. In every case of use of a customer’s personal data will be in compliance with the Federal Data Protection Act. § 9 Amendments of the Contract Amendments of the contract require written confirmation by the Insurer. There are no verbal confirmations and ancillary agreements of any kind and any such will be void. § 10 Final Provisions 1. This Contract is regulated, interpreted and is in effect according to the Greek law. conflict will be resolved by the competent courts of Greece. 2.
