MEGAWORLD CITIBANK CARD CARDHOLDER BENEFITS PROGRAM TERMS AND CONDITIONS 1. Definitions - In these terms and conditions (“Terms and Conditions”), unless the context otherwise requires: “Card” means the Megaworld Citibank Card issued by us and includes a supplementary card where the context requires; “Card Account” means the account maintained with us in respect of the Card; “Rebate/s” means the cash rebate/s that you earn through the usage of the Card as specified in these Terms and Conditions; “Free Movie Tickets” means the movie benefit option that you may choose to receive for a minimum single-receipt purchase of at least P2,500 using your Card; “Free Parking Passes” means the parking benefit option that you may choose to receive for a minimum single-receipt purchase of at least P2,500 using your Card; “Program” means the Megaworld Citibank Card Cardholder Benefits Program, including, but not limited to the Rebate/s, the Free Movie Ticket, and the Free Parking Passes; “Purchase” means a purchase of any goods or services for personal consumption by the use of the Card, including purchase made over the internet, and may, at our absolute discretion and without prior notice, include any Card transaction as determined by us; “Statement Cycle” means the period from the statement date of the current month to one (1) day prior to the statement date of the following month; “We, Our, Us” means Citibank, N.A. - Philippine Branch; and “You, Your” means the principal cardholder, the person to whom the Card is issued and in whose name the Card Account is maintained. This term may also include the supplementary cardholder where the context requires. 2. Participation 2.1 You are entitled to participate in the Program from the date of commencement of the Program or the date when the Card is issued to you, whichever is earlier; provided that your Card Account is and remains open, active an in good credit standing, as determined by us in our sole discretion. 2.2 If your Card is terminated at any time for any reason, whether by you or by us, you and your supplementary cardholders will be disqualified from participating in the Program, and all unused Rebates, Free Movie Tickets and/or Free Parking Passes then accrued shall automatically be forfeited immediately after the voluntary or involuntary cancellation of your Card. 2.3 Any remaining Rebates, Free Movie Tickets and/or Free Parking Passes, including those pending credit into your Card Account, shall immediately cease to be valid, and shall be forfeited, upon the occurrence of any of the following: 2.3.1 The cancellation of the Card; or 2.3.2 The conversion of the Card to any other Citibank credit card, even another co-brand card, and no refund, extension or compensation shall be given by us; or 2.3.3 The delinquency of the Card Account or when the Card Account ceases to be in good credit standing. 2.4 Transfer of Rebates, Free Movie Tickets and/or Free Parking Passes from an expired or closed Card Account to a current Card Account, as well as transfer of Rebates, Free Movie Tickets and/or Free Parking Passes to any other person, will not be allowed. The Rebates, Free Movie Tickets and/or Free Parking Passes (up to 2 passes only for Parking) cannot be combined nor can these be combined across different Citibank Credit Cards. 2.5 If your supplementary card is terminated at any time for any reason, you may still participate in the Program; provided that your Card Account remains open, active and in good credit standing. 2.6 In the event that you avail of debt restructuring, rewrite and other collection programs for your Card Account/s, your unused Rebates, Free Movie Tickets and/or Free Parking Passes shall remain forfeited despite eventual payment of your Card Account. 3. Free Movie Ticket or Free Parking Pass 3.1 For a minimum single-receipt Purchase worth P2,500 using your Card, you will receive an electronic stub, which you can use to redeem either one (1) Free Movie Ticket or one (1) Free Parking Pass. You shall be entitled to redeem onlyone (1) Free Movie Ticket or one (1) Free Parking Pass only per receipt/transaction regardless of the transaction amount or the amount printed on your receipt/charge slip. Each PayLite transaction earns only one (1) Free Movie Ticket or one (1) Free Parking Pass. 3.2 You are entitled to earn electronic stubs and redeem Free Movie Tickets or Free Parking Passes on your Card Account only. Your supplementary cardholder is also entitled to earn electronic stubs and redeem Free Movie Tickets or Free Parking Passes on his/her own supplementary Card. 3.3 The electronic stub will be loaded into your Card Account within three (3) business days from posting date of the Purchase. 3.4 The Free Movie Ticket or Free Parking Pass may be redeemed within thirty (30) calendar days from posting date of the Purchase. Any electronic stub which is not exchanged for a Free Movie Ticket or Free Parking Pass within said period shall be void. 3.5 The Free Movie Ticket may be redeemed at Eastwood Cinemas, Lucky Chinatown Cinemas and Newport Cinemas from Sundays to Thursdays only. The Free Movie Ticket does not qualify for 3D cinemas, Ultra cinemas and special screenings. 3.6 There is no limit to the number of Free Movie Tickets that you can redeem in a day. 3.7 The screening ticket redeemed under this Program must be used on the same day that it is redeemed. 3.8 The Free Parking Pass is valid for the first three (3) hours in a Megaworld Lifestyle Malls parking facility and for the first two (2) hours in the Paseo Center parking facility. You must pay for the parking charges in excess of the said periods. The Free Parking Pass is not valid for overnight parking. 3.9 The Free Parking Pass may be redeemed during mall hours at the Concierge of Eastwood Mall and Lucky Chinatown. It may also be redeemed at the mall administration’s office: The Venice Piazza: 2nd floor across McDonalds; Newport Mall: 4th floor parking level; Burgos Circle: near Distillery; Paseo Center: G/F near Kodak. 3.10 The Free Parking Pass can be used from Sundays to Thursdays at Burgos Circle at Forbes Town Center, Eastwood Mall, Eastwood Citywalk, Venice Piazza, Lucky Chinatown, Newport Mall and Paseo Center only. 3.11 The Free Parking Pass is valid for a single use only. You may combine up to a maximum of two (2) parking passes per car. 3.13 The Free Parking Pass must be surrendered together with the parking card upon exit. 3.12 The Free Parking Pass is valid for a period of 30 days from redemption date. 3.13 You agree not to re-sell the actual screening ticket/s or parking passes redeemed under this Program. The existing terms and conditions of the participating cinemas or of the Megaworld parking facilities, as appropriate, will apply 3.14 The accrual and usage of the electronic stubs for the Free Movie Tickets or Free Parking Passes shall not be specified in your monthly statement of account. You can go to any participating cinema or to the Megaworld mall administration office or concierge with your Card, or call our 24-Hour CitiPhone at 995-9999 in Metro Manila or 234-9999 in Metro Cebu or 1 800 10 995 9999 toll-free from other provinces through PLDT, to inquire how many electronic stubs you have available in your Card at any one time. 3.15 Only one (1) electronic stub will be awarded to you and/or your supplementary cardholder/s per day for transactions made at the same merchant outlet. 3.16 The Free Movie Ticket and the Free Parking Pass are not convertible to cash or credit. 4. Rebate 4.1 You will earn Rebates for Purchases made with your Card at the following rates: 4.1.1 5% Rebate for Purchases at participating dining merchants at Megaworld Lifestyle Malls. 4.1.2 3% Rebate for Purchases at participating shopping apparel merchants at Megaworld Lifestyle Malls. 4.1.3 1% Rebate for Purchases at participating supermarkets at Megaworld Lifestyle Malls. 4.1.4 Additional 2% Rebate for Purchases at participating shopping apparel merchants at Megaworld Lifestyle Malls for a particular Statement Cycle if the total Purchases outside of the Megaworld Lifestyle Malls participating merchants within that Statement Cycle shall be greater than or equal to Fifteen Thousand Pesos (Php 15,000). 4.1.5 Additional 4% Rebate for Purchases at participating supermarkets at Megaworld Lifestyle Malls for a particular Statement Cycle if the total Purchases outside of the Megaworld Lifestyle Malls participating merchants within that Statement Cycle shall be greater than or equal to Fifteen Thousand Pesos (Php 15,000). 4.1.6 PayLite transactions will earn Rebates only on the principal portion of the monthly installment amount/s posted on your Card Account. Any PayLite interest charges will not earn Rebates. Provided that the Rebates earned shall be subject to the cap indicated in clause 5.2 4.2 The Rebates that you can earn shall be subject to a cap of P1,700 per Statement Cycle. If the cap has been met anytime within the Statement Cycle, your succeeding Purchases within that Statement Cycle shall not earn Rebates; you will only begin earning Rebates again for your Purchases on the next Statement Cycle. 4.3 The Rebates will be credited to your Card Account once the transaction is posted. 4.4 Rebates earned on your Card shall expire upon the lapse of two (2) years from your Card Account’s opening date and every two (2) years thereafter. 4.5 The Rebates shall accrue in your (principal cardholder’s) name only, but shall also be earned through the Purchases of your supplementary cardholder. 4.6 Rebates shall be computed on a per transaction basis and shall be rounded off to the nearest centavo, including decimal values. 4.7 In determining the rate of the Rebate to be earned for a particular Purchase, we shall be bound by the merchant category designation made by the acquiring bank as prescribed by VISA. 4.8 You may redeem all your available Rebates in increments of P200. There is no maximum amount of Rebates which you can redeem. 4.9 The Rebates that you have earned and redeemed will be reflected in your monthly statement of account. Unless we hear from you within thirty (30) days from the delivery of your statement of account to your billing address, the Rebates indicated on your statement are considered correct. 4.10 Rebates may be redeemed at participating Rebate merchants. Please visit Citibank Online at www.citibank.com.ph to view the complete listing of participating dining, shopping apparel and supermarket merchants. The Rebates may also be redeemed as payment for charges on your Card upon your request through our 24-hour Citiphone hotline. 4.11 The Rebates are not convertible to cash. 4.12 Where Rebates have been credited to your Card Account and/or redeemed before the Purchase transaction for which such Rebates were earned is charged back, we will debit your Card Account for the credited Rebates. 4.13 Where Rebates have been credited to your Card account, we reserve the right to forfeit the Rebates balance in the event that your Card account becomes delinquent. Delinquent accounts shall have the same meaning as defined in the Terms and Conditions Governing the Issuance and Use of Citibank Credit Cards. 4.14 We shall be entitled to debit such Rebates even if such debiting causes the Card account to have a negative Rebates balance. 5. General 5.1 Only retail purchases/transactions, whether straight or PayLite Installment plan transactions, posted in Philippine Pesos, shall earn Rebates, and electronic stubs redeemable for Free Movie Tickets or Free Parking Passes. Unless otherwise specified, you are not entitled to earn electronic stubs or Rebates from any other categories of transactions. 5.2 However, currently, transactions which do not have POS transaction slips/charge slips, online transactions, transactions made in other countries, and transaction slips/charge slips that reflect foreign currency transactions shall not qualify for the redemption of the Free Parking Pass. 5.3 The following transactions shall not earn electronic stubs or Rebates: Cash Advance availments; Call for Cash transactions; Balance Transfer availments; Balance Conversion transactions; PayLite After Purchase transactions; all fees and charges (including annual membership fees, interest charges, late payment charges, charges for Cash Advance); refunded, disputed, unauthorized or fraudulent retail transactions; traveler’s check purchases; casino chip purchases; and other unauthorized charges. 5.4 The following transactions will not qualify for this the Free Movie Coupon or Free Parking Pass Program: Call for Cash transactions, Cash Advance availment, balance transfer availment, balance conversion transactions, PayLite After Purchase transactions, OneBill transactions, auto-debit enrolments and Split transactions. Split transactions are those that are made at the same store or establishment within the same day or those that are structured in such a way as to create unusual or abnormal transactions to enable the Cardholder to avail to avail of the free movie coupon or parking pass. For online payments made via Citibank Online, only one (1) transaction meeting the P2,500 singlereceipt minimum spend requirement per day shall qualify for the free movie coupon or parking pass, succeeding transactions made on the same day shall no longer qualify for the free movie coupon or parking pass program. 5.5 You may inquire about your Rebates and electronic stubs earned at the cashiers of the participating Rebates merchants and/or at the participating cinemas or parking facilities, respectively. You will be required to swipe your Card at the Citibank POS terminal for your inquiry. 5.6 Redemptions will only be processed for Cards which are valid, active, and in good credit standing (i.e., without any past due payments). You will not be allowed to redeem the Rebates, Free Movie Tickets or Free Parking Passes if you are unable to present your Card, or if your Card does not have any Rebates or electronic stub, as applicable, available for redemption, or if you have any overdue payment on your Card. 5.7 You should personally redeem the Rebates, Free Movie Ticket or Free Parking Pass using your Card. The Rebates, Free Movie Ticket and Free Parking Pass are not transferrable. 5.8 To redeem the Rebates, Free Movie Tickets and/or Free Parking Passes, you must present your Card at the cashier/payment counter of the participating Rebates merchants, participating cinemas and/or participating parking facilities, respectively. The cashier may require you to present your valid I.D. The cashier will swipe your Card at the Citibank POS terminal to process the redemption. You shall be required to sign the charge slip/s for the redemption/s made. The cashier will then check your signature against the signature found at the back of the Card, keep the merchant copy of the charge slip and give you the customer’s copy of the charge slip. 5.9 Citibank and the participating merchants will only honor redemptions complying with the process as specified in the above sections. 5.10 Once the participating Rebates merchant, participating cinema or participating parking facility receives the redemption request, the request cannot be revoked or cancelled, and the Rebates and/or electronic stub cannot be transferred back into your Card Account. 5.11 We reserve the right to suspend or exclude you from participating or continuing to participate in the Program if: 5.11.1 In our opinion you have in any way breached these Terms and Conditions and the Terms and Conditions Governing the Issuance and Use of Citibank Cards; or 5.11.2 In our opinion, you conduct your Card Account in a manner inconsistent with the object and intent of the Program. 5.12 We (Citibank), the participating Rebates merchants, the Megaworld Lifestyle Mall cinemas, and the Megaworld parking facilities shall not be obliged to recognize or replace any item, including movie ticket or parking pass, that you may have redeemed through this Program which is subsequently misplaced, lost or stolen after your redemption, or any Benefit that is unclaimed under this Program. 5.13 Splitting of one (1) transaction into several approvals will not be allowed. Splitting is defined as the use of the Card more than once in the same store or establishment within the same day. Any transaction that is determined to be a split transaction will not earn Rebates and electronic stubs under this Program. 5.14 In case of dispute in respect of your eligibility, coverage of dates, fulfillment, etc., Citibank's decision shall prevail. All questions or disputes regarding your eligibility for the Benefits or for any redemption shall be resolved by us, in our discretion. 5.15 Fraud, abuse or any unauthorized action relating to the Card transaction or the redemption of any Benefit may result in forfeiture of the Benefit redeemed or in the charging of the cost of such redeemed Benefit to your Card account. This forfeiture or charging shall be without prejudice to any legal action that may be taken by Citibank. 5.16 We are entitled, in our absolute discretion, at any time and from time to time and without notice and without giving any reason, to take into account or disregard any Card transactions or Purchases in the calculation of Rebates and/or electronic stubs redeemable for Free Movie Tickets or Free Parking Passes to be credited or to otherwise vary the basis of calculation of Rebates and/or electronic stubs redeemable for Free Movie Tickets and/or Free Parking Passes. The rates of the Rebates and the amount required to earn electronic stubs are subject to change and shall be reviewed periodically at our discretion from time to time. 5.17 You agree that we may, at our absolute discretion, without giving notice, change the rates of the Rebates, the required amount to redeem the Rebates, Free Movie Tickets or Free Parking Passes. You shall be responsible for checking the required amount to redeem the Rebates, Free Movie Tickets and/or Free Parking Passes at the time of redemption. 5.18 Any request for adjustment of Rebates or electronic stubs is subject to our approval at our absolute discretion. 5.19 You agree that your redemption using your Rebates and/or Free Movie Tickets and/or Free Parking Passes warrants your acceptance of the Program and any applicable terms and conditions. 6. Other Conditions 6.1 We may at any time vary, modify or amend the terms and conditions of the Program as we may, in our absolute discretion, think fit, and you shall be bound by such variations and amendments. 6.2 We are not liable if we are unable to perform our obligations under these Terms and Conditions, due directly or indirectly to the failure of any machine or communication system, industrial dispute, war, Act of God, or anything outside our control or outside the control of our agents or any third party. We shall not be responsible for any delay in the transmission to us of evidence of Purchases by the participating merchants or any third party. 6.3 We shall be entitled and without liability to you or to any third party to extend any processing time for the awarding or loading of Rebates and/or electronic stubs redeemable for Free Movie Tickets or Free Parking Passes. 6.4 We do not make any representation and/or warranty on the Rebates, Free Movie Tickets and/or Free Parking Passes offered under the Program. Furthermore, we shall not in any way be liable to you or any third party for any goods, services, benefits, arrangements or other privileges or the quality or performance of such goods, benefits, arrangements or other privileges redeemed from or supplied by any merchant, cinema, parking facility, service provider, or any third party under or pursuant to the Program, including for any death, injury, loss of or damage to property, or consequential loss or damage of any nature that you, and if applicable, any person/s, may or has/have suffered arising from or out of the redemption of any Rebate, Free Movie Ticket and/or Free Parking Pass. You should seek redress and direct any complaints or comments in respect of such goods, benefits, arrangements or other privileges to the respective merchant, cinema, parking facility, service provider, or third party. 6.5 Our records of all matters relating to the Program shall be conclusive and binding on you. 6.6 We are entitled, for any reason at any time, without liability or prior notice, to suspend the calculation, accrual or redemption of Rebates, Free Movie Tickets and/or Free Parking Passes, to rectify any errors in the calculation, or otherwise adjust such calculation. 6.7 We may, at any time and without notice, may cancel or terminate the Program. 6.8 Our decision on all matters relating to the Program shall be final and binding on you. 6.9 To the fullest extent permitted by law, in no event will we or any of our officers, employees, representatives and/or agents be liable for any loss or damages (including without limitation, loss of income, profits or goodwill, indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising, whether in contract, tort, negligence or otherwise in connection therewith, even if we have been advised of the possibility of such damages in advance, and all such damages are expressly excluded. 6.10 The Terms and Conditions Governing the Issuance and the Use of Citibank Credit Cards shall likewise apply; you must strictly abide by the same. 7. Taxation The Rebates, Free Movie Tickets, and/or Free Parking Passes obtained as a result of your private transactions should have no taxation consequences. You will be responsible for whatever tax implications may arise out of the ultimate treatment of the Rebates, Free Movie Tickets and/or Free Parking Passes.
