1. General Use of Service
1.1 Your Relationship with My Angel My Hero
Your use of the My Angel My Hero website (the "Website") and any My Angel My
Hero products, channels, software, data feeds and services provided to you on or
from or through the Website by My Angel My Hero (collectively the "Service" or
known as “Company”) is subject to the terms of a legal agreement between you
and My Angel My Hero. "My Angel My Hero" means My Angel My Hero Inc.
These terms form a legally binding agreement between you and My Angel My
Hero in relation to your use of the Service. It is important that you take the time to
read them carefully.
1.2 Accepting these Terms and Condition
PLEASE READ THIS DOCUMENT CAREFULLY. My Angel My Hero, Inc.
("My Angel My Hero," "we," or "us") offers an online video testimonial
platform and community through its website located
at myangelmyhero.com (the "My Angel My Hero’s Site") and related
domains (including myangelmyhero.org), mobile applications, desktop
applications, and PC television applications (collectively, the "My Angel My
Hero Service"). By uploading your video on this website or by using the My
Angel My Hero Service in any way, you accept these Terms of Service
("Agreement"), which forms a binding agreement between you and My
Angel My Hero. If you do not wish to be bound by this Agreement, please
do not upload your videos and do not use the My Angel My Hero Services.
2. License Granted by You
2.1 User Generated Content License
Please note that if you post, upload or otherwise make available any User
Generated Content on our Websites, you will still own the User Generated
Content (assuming you have rights to own it) but you are giving us the right to
use your User Generated Content. That means that if you send in, post, upload,
make available, or disclose to us in any way any User Generated Content, you
grant us, our affiliates and related entities, the right to use it any way we want in
any medium without getting your permission or having to pay you for it.
In legal terms, by providing us with any User Generated Content, you grant us
and our affiliates and related entities, a worldwide, royalty-free, perpetual,
irrevocable, non-exclusive right and fully sub-licensable license to use, copy,
reproduce, distribute, publish, publicly perform, publicly display, modify, adapt,
translate, archive, store, and create derivative works from such User Generated
Content, in any form, format, or medium, of any kind now known or later
developed. You waive any moral rights you might have with respect to any User
Generated Content you provide to us. You also grant us the right to use any
material, information, ideas, concepts, know-how or techniques contained in any
communication you provide or otherwise submit to us for any purpose
whatsoever, including but not limited to, commercial purposes, and developing,
manufacturing and marketing commercial products using such information. All
rights in this paragraph are granted without the need for additional compensation
of any sort to you.
Screening and Removal of User Generated Content. You acknowledge that
we and/or our designees may or may not pre-screen User Generated Content,
and have the right (but not the obligation), in our sole discretion, to move,
remove, block, edit, or refuse any User Generated Content for any reason,
including without limitation that such User Generated Content violates these
Terms of Use or is otherwise objectionable.
Risk from User Generated Content. We try to create an environment in which
users are posting and discussing content that you will find useful, interesting and
appropriate; however we cannot and do not monitor or manage all User
Generated Content. Thus, we do not promise the accuracy, integrity, or quality of
the User Generated Content and do not endorse it in any manner. In other
words, enjoy what other members post or share, but do it at your own risk.
Also, all User Generated Content provided on the Websites is the sole
responsibility of the person who provided it. This means that you are entirely
responsible for all User Generated Content that you provide.
In addition you grant us permission to use your user generated content to be part
of our future films. You grant us, our film maker partners, directors, producers,
actors, to use story to make a film in the future.
2.2 Videos
LICENSE TO MY ANGEL MY HERO: As between you and My Angel My Hero,
you own the video content ("videos") that you submit to the My Angel My Hero
Service. By submitting a video, you grant My Angel My Hero and its affiliates a
limited, worldwide, non-exclusive, royalty-free license and right to copy, transmit,
distribute, publicly perform and display (through all media now known or
hereafter created), and make derivative works from your video for the purpose of
(i) displaying the video within the My Angel My Hero Service; (ii) displaying the
video on third party websites and applications through a video embed subject to
your video privacy choices; (iii) allowing other users to play, download, and
embed on third party websites the video, subject to your video privacy choices;
(iii) promoting the My Angel My Hero Service, provided that you have made the
video publicly available; and (iv) archiving or preserving the video for disputes,
legal proceedings, or investigations.
LICENSE TO OTHER USERS: You further grant all users of the My Angel My
Hero Service permission to view your videos for their personal, non-commercial
purposes. This includes the right to copy and make derivative works from the
videos solely to the extent necessary to view the videos. The foregoing licenses
are in addition to any license you may decide to grant (e.g., a Creative Commons
license).
DURATION OF LICENSES: The above licenses will continue unless and until
you request to remove your “original” videos from the My Angel My Hero Service,
in which case the licenses will terminate within a commercially reasonable period
of time. Notwithstanding the foregoing, the license for legal archival/preservation
purposes will continue indefinitely. In addition any derivative works, edit version
of your video or created films or videos based on your submitted video will still be
part of My Angel My Hero online video platform or archived library and can be
used for further work. Please note that removed your “original” videos may be
cached in search engine indices after removal and that My Angel My Hero has
no control over such caching. In order to contact us regarding removing your
video please email us with your “original” video title or link to
remove@myangelmyhero.org
2.3 Non-Video Content
As between you and My Angel My Hero, you own all non-video content that you
submit to the My Angel My Hero Service. You grant My Angel My Hero and its
affiliates a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license
and right to copy, transmit, distribute, publicly perform and display (through all
media now known or hereafter created), and make derivative works from your
non-video content. In addition, you waive any so-called "moral rights" in your
non-video content. You further grant all users of the My Angel My Hero Service
permission to view your non-video content for their personal, non-commercial
purposes. If you make suggestions to My Angel My Hero on improving or adding
new features to the My Angel My Hero Service, My Angel My Hero shall have the
right to use your suggestions without any compensation to you.
2.4 Comments / Reader Reviews and More
You acknowledge that any submissions you make to the Services (i.e., usergenerated content including but not limited to: comments, forum messages,
reviews, text, video, audio and photographs, as well as computer code and
applications) (each, a "Submission") may be edited, removed, modified,
published, transmitted, and displayed by My Angel My Hero and you waive any
rights you may have in having the material altered or changed in a manner not
agreeable to you. Submissions made to the Services may also be included in our
RSS feeds, APIs and made available for republishing through other formats.
You grant My Angel My Hero a perpetual, nonexclusive, world-wide, royalty free,
sub-licensable license to the Submissions, which includes without limitation the
right for My Angel My Hero or any third party it designates, to use, copy, transmit,
excerpt, publish, distribute, publicly display, publicly perform, create derivative
works of, host, index, cache, tag, encode, modify and adapt (including without
limitation the right to adapt to streaming, downloading, broadcast, mobile, digital,
thumbnail, scanning or other technologies) in any form or media now known or
hereinafter developed, any Submission posted by you on or to the Services or
any other Web site owned by My Angel My Hero, including any Submission
posted on or to the Services through a third party.
You are solely responsible for the content of your Submissions. However, while
My Angel My Hero does not and cannot review every Submission and is not
responsible for the content of these messages, My Angel My Hero reserves the
right to delete, move, or edit Submissions that it, in its sole discretion, deems
abusive, defamatory, obscene, in violation of copyright or trademark laws, or
otherwise unacceptable.
By making a Submission, you are consenting to its display and publication on the
Site and in the Services and for related online and offline promotional uses.
2.5 Content Restrictions
You MAY NOT upload, post, or transmit (collectively, "submit") any video, image,
text, audio recording, or other work (collectively, "content") that:
Infringes any third party's copyrights or other rights (e.g., trademark, privacy
rights, etc.);
Contains sexually explicit content or pornography.
Contains sexually explicit content, nudity, explicit material or pornography.
Contains hateful, defamatory, or discriminatory content or incites hatred against
any individual or group;
Exploits minors;
Depicts unlawful acts or extreme violence;
Depicts animal cruelty or extreme violence towards animals;
Promotes fraudulent schemes, multi level marketing (MLM) schemes, get rich
quick schemes, online gaming and gambling, cash gifting, work from home
businesses, or any other dubious money-making ventures; or
Violates any law.
No rips of movies, music, television, or any other third party copyrighted material.
No promotion towards smoking allowed in your posts
No videos that depict or promote unlawful acts, extreme or real-life violence, selfharm, or cruelty toward animals.
No screen-captures of video games or gameplay videos, even if edited.
You shall not upload to, or distribute or otherwise publish on to the Services any
libelous, defamatory, obscene, pornographic, abusive, or otherwise illegal
material.
Use respectful language. Like any community, the online conversation flourishes
only when our Members feel welcome and safe. You agree not to use language
that abuses or discriminates on the basis of race, religion, nationality, gender,
sexual preference, age, region, disability, etc. Hate speech of any kind is grounds
for immediate and permanent suspension of access to all or part of the Services.
Be courteous. You agree that you will not threaten or verbally abuse other
Members, use defamatory language, or deliberately disrupt discussions with
repetitive messages, meaningless messages or "spam."
2.6 Your Content and Conduct
You agree not to use the Service for any of the following commercial uses unless
you obtain My Angel My Hero’s prior written approval:
the sale of access to the Service;
the sale of advertising, sponsorships, or promotions placed on or within the
Service or Content; or
the sale of advertising, sponsorships, or promotions on any page of an adenabled blog or website containing Content delivered via the Service, unless
other material not obtained from My Angel My Hero appears on the same page
and is of sufficient value to be the basis for such sales.
You agree not to use or launch any automated system, including without
limitation, "robots," "spiders," or "offline readers," that accesses the Service in a
manner that sends more request messages to the My Angel My Hero servers in
a given period of time than a human can reasonably produce in the same period
by using a conventional on-line web browser. Notwithstanding the foregoing, My
Angel My Hero grants the operators of public search engines permission to use
spiders to copy materials from the site for the sole purpose of and solely to the
extent necessary for creating publicly available searchable indices of the
materials, but not caches or archives of such materials. My Angel My Hero
reserves the right to revoke these exceptions either generally or in specific
cases. You agree not to collect or harvest any personally identifiable information,
including account names, from the Service, nor to use the communication
systems provided by the Service (e.g., comments, email) for any commercial
solicitation purposes. You agree not to solicit, for commercial purposes, any
users of the Service with respect to their Content.
You shall be solely responsible for your own Content and the consequences of
submitting and publishing your Content on the Service. You affirm, represent,
and warrant that you own or have the necessary licenses, rights, consents, and
permissions to publish Content you submit; and you license to My Angel My Hero
all patent, trademark, trade secret, copyright or other proprietary rights in and to
such Content for publication on the Service pursuant to these Terms of Service.
You further agree that Content you submit to the Service will not contain third
party copyrighted material, or material that is subject to other third party
proprietary rights, unless you have permission from the rightful owner of the
material or you are otherwise legally entitled to post the material and to grant My
Angel My Hero all of the license rights granted herein.
My Angel My Hero does not endorse any Content submitted to the Service by
any user or other licensor, or any opinion, recommendation, or advice expressed
therein, and My Angel My Hero expressly disclaims any and all liability in
connection with Content. My Angel My Hero does not permit copyright infringing
activities and infringement of intellectual property rights on the Service, and My
Angel My Hero will remove all Content if properly notified that such Content
infringes on another's intellectual property rights. My Angel My Hero reserves the
right to remove Content without prior notice.
YOU AGREE THAT YOUR USE OF THE SERVICES SHALL BE AT YOUR
SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, MY ANGEL
MY HERO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS
DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION
WITH THE SERVICES AND YOUR USE THEREOF. MY ANGEL MY HERO
MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE
ACCURACY OR COMPLETENESS OF THIS SITE'S CONTENT OR THE
CONTENT OF ANY SITES LINKED TO THIS SITE AND ASSUMES NO
LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR
INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY
DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR
ACCESS TO AND USE OF OUR SERVICES, (III) ANY UNAUTHORIZED
ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL
PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED
THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO
OR FROM OUR SERVICES, (IV) ANY BUGS, VIRUSES, TROJAN HORSES,
OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR
SERVICES BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR
OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY
KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED,
EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE
SERVICES. MY ANGEL MY HERO DOES NOT WARRANT, ENDORSE,
GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR
SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE
SERVICES OR ANY HYPERLINKED SERVICES OR FEATURED IN ANY
BANNER OR OTHER ADVERTISING, AND MY ANGEL MY HERO WILL NOT
BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY
TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF
PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR
SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU
SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE
APPROPRIATE.
3. Your Collected Information
3.1 Information we collect About You
In General. We may collect personal information that can identify you, such as
your name and email address, and other information that does not identify you.
When you provide personal information through our website, the information may
be sent to servers located in the United States and other countries around the
world.
Information you provide. We may collect and store any personal information you
enter on our website or provide to us in some other manner, including personal
information that may be contained in any video, comment or other submission
you upload or post to the website. This includes identifying information, such as
your name, address, e-mail address, and telephone number; your likeness; and,
if you transact business with us, financial information such as your payment
method (valid credit card number, type, expiration date or other financial
information). We also may request information about your interests and activities,
your gender and age, and other demographic information.
Information about others. We may also collect and store personal information about
other people that you provide to us. If you use our website to send others
(friends, relatives, colleagues, etc.) a product as a gift, information that may
interest them or messages (such as invitations) through our system, we may
store your personal information, and the personal information of each such
recipient. Similarly, if you use our website to upload, share and/or distribute
content (including videos, comments or other submissions), and such content
contains personal information about others, such information may be stored in
order to allow for such uploading, sharing and/or distribution.

Financial information. We may use financial information or payment method to
process payment for any purchases, subscriptions or sales made on our website,

3.3 How we protect your Personal Information
We take appropriate security measures (including physical, electronic and
procedural measures) to help safeguard your personal information from
unauthorized access and disclosure. For example, only authorized employees
are permitted to access personal information, and they may do so only for
permitted business functions. In addition, we use Pay Pal which does uses
encryption in the transmission of your sensitive personal information between
your system and Pay Pals, and we Pay Pal uses firewalls to help prevent
unauthorized persons from gaining access to your personal information.
4. Video Upload Instructions
You may upload video files of the following types: 3g2 .3gp .asf .asx .avi .flv .m4v
.mov .mp4 .mpg .rm .srt .swf .vob .wmv
The maximum allowed size is 100 MB
5. Children Privacy
AGE REQUIREMENT: You must be at least 13 years old to use the My Angel My
Hero Service. If you are at least 13, but are still a minor (this depends on where
you live), you must have your parent or legal guardian's permission to use the My
Angel My Hero Service. Please have him or her read this Agreement with you.
NOTICE TO PARENTS AND GUARDIANS: By granting your child permission to
use the My Angel My Hero Service, you agree to the terms of this Agreement on
behalf of your child. You are responsible for monitoring and supervising your
child's use of the My Angel My Hero Service. If your child is using the My Angel
My Hero Service and is either under 13 or does not have your permission, please
contact us immediately so that we can disable his or her access. If you have
questions about whether the My Angel My Hero Service is appropriate for your

6. Modification of Privacy Policy or Terms Of Use
We will occasionally update this Privacy Policy to reflect changes in our practices
and services. When we post changes to this Privacy Policy, we will revise the
"Last Updated" date at the top of this Privacy Policy. If we make any material
changes in the way we collect, use, and/or share your personal information, we
will notify you by sending an email to the email address you most recently
provided us in your account, profile or registration (unless we do not have such

7. Limitation of Liability
To the fullest extent permitted by law: (i) MY ANGEL MY HERO shall not be
liable for any direct, indirect, incidental, special, consequential, or
exemplary damages, including but not limited to damages for loss of
profits, goodwill, use, data or other intangible losses.

We understand these are long terms and conditions to use our services. But
these are legal bindings necessary to protect you and your content and our
Company’s reputation as a Non-Profit organization. Our mission is to bring
awareness towards different social causes through film and videos. We feel it is
very important to recognize the power of video but in the meantime we do know
that this power could be used in manipulation and for wrong doing and that is
why we want to protect all the users and our Company from these issues. We
look forward for your feedback and it is not just another film or video production.
We want to help the world and that is why this Company is a Non-Profit
organization so we can make a difference together but we want to make sure all
