CP&P 14-47 (rev. 8/2003) Notification – Child Placed in Protective Custody Pursuant to N.J.S.A. 9:6-8.16 This letter is to serve as an official notice that was placed (name of child) in protective custody on and is in (date) . (name of hospital/medical facility) This action has been taken by (name of physician, hospital director or designee) pursuant to N.J.S.A. 9:6-8.16, which empowers any physician or hospital director (or his designate) to take into custody without a court order any child brought to him for care and treatment who has suffered serious physical injuries resulting from what he interprets as possible abuse. Under the law, the child may be held in protective custody for a period not to exceed three (3) court days. This agency is required by law to conduct an investigation of the circumstances leading to and resulting in the injury or injuries to the child and on the basis of such investigation will determine whether further action will be warranted to insure the child’s safety. In this case the Division may apply for a court order placing the child under its care and supervision pursuant to N.J.S.A. 30:4C-12. Under the law, you have the right to request an opportunity to visit the child. If you wish to make such a request, you should contact the above-named physician or hospital director who will advise you further. We would greatly appreciate your cooperation with this agency during the course of the investigation and assure you that we will take every measure possible to protect you and the child in this matter.
